3 AN ORDINANCE OF THE CITY COMMISSION OF
4 THE CITY OF BOYNTON BEACH, FLORID -
5 RESCINDING ORDINANCE 13 -001 DESIGNAT, G
6 THE PROPERTY KNOWN AS THE BOY TON
7 HIGH SCHOOL LOCATED AT 125 EAST 1 CEAN
8 AVENUE AS A LOCAL HISTO ' SITE;
9 PROVIDING FOR CONFLICTS, SEV ' RABILITY,
10 AND AN EFFECTIVE DATE.

12 WHEREAS, the City Commission of e City of Boynton Beach, Florida adopted
13 Ordinance No. 13 -001 which designated e property known as the Boynton High School
14 located at 125 East Ocean Avenue as istoric site; and
15 WHEREAS, the adoptio of Ordinance No. 13 -001 contemplated a public /private
16 partnership and transfer of rey(property that did not occur; and
17 WHEREAS, st. f supports rescission of Ordinance No. 13 -001 to rescind the
18 designation of a his •ric site which would allow planning for further use of the property as
19 part of a City T. n Square Area project within which the land is located.
20 NO , THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
21 THE C Y OF BOYNTON BEACH, FLORIDA, THAT:
22 Section 1. The foregoing Whereas clauses are true and correct and incorporated
23 erein by this reference.
24 Section 2. Ordinance No. 13 -001 is hereby rescinded. The designation of
25 Boynton High School Historic Site is removed from the property.
26 Section 3. All ordinances or parts of ordinances in conflict herewith are hereby
27 repealed.

1 Section 4. Should any section or provision of this Ordinance or any portion thereof
2 be declared by a court of competent jurisdiction to be invalid, s decision shall not affect
3 the remainder of this Ordinance.
4 Section 5. This ordinance shall become effective mmediately upon passage.
