1. CALL TO ORDER
Ms. Ellis, Special Magistrate, called the meeting to order at 9:05 a.m. Ms. Ellis
explained her role in the hearings and the hearing procedures. Pursuant to Florida
Statute, all Orders are appealable to the Circuit Court in Florida and not the City
Commission.
1111. APPROVAL OF 4/16/14 MINUTES
There was one change to the minutes: Page 26, Case No 14-78: the Respondent's
name was Roody Silverain and the fine was $100, not $50.
Ms. Ellis approved the minutes with the correction as provided.
111111. APPROVAL OF AGENDA
Vestiguerne Pierre, Senior Code Compliance Officer, announced the following
changes to the agenda:

Pete Roy, Chief Code and Rehabilitation Officer, explained the case was a City
Department referral. The initial inspection date was April 8, 2014, which revealed the
above violations. Notice was issued on April 8, 2014, giving 10 days to comply.
Service was effectuated by posting at City Hall on May 8, 2014. The property was last
inspected on June 17, 2014. Staff recommended 10 days be given to correct the
violations or a fine of $50 a day be imposed thereafter.
Heather Grimes, International Real Estate Co. for Antonio Reale, was notified
yesterdayabout the tenant's bicycles and outside storage yesterday and all else
complied. She was not aware the City required a Business Tax Receipt for a rental
property and they applied for one. Ms. Grimes had photographs of what Officer Roy
considered to be outside storage and explained the owner has a six -foot privacy fence
on the side of the property where the bikes and some empty water bins collecting water
were stored Ms. Grimes had photographs of the property Ms. Ellis, Ms. Springer and
Officer Roy reviewed. They were.
Decision
Based on evidence offered by the Respondent and testimony of the City, Ms. Ellis
adopted the City's recommendation of 10 days to comply, June 28, 2014, and a fine of
$50 per day if not complied.
Ms. Grimes requested clarification of what is allowed in the yard if bicycles were not
permitted and Ms. Ellis referred her to staff.

Officer Roy presented the case for the above captioned violations. Service was
effectuated by posting the notice in City Hall and the property on May 8, 2014. The
hurricane shutters were removed. The property was last inspected on June 17, 2014.
Staff recommended a 10 -day compliance date or a fine of $50 a day thereafter.
Ms. Springer noted the Business Tax Receipt Ordinance Section was not included in
the violation notice. The only violations to be decided at this hearing was the mowing
and trimming of the property. The Business Tax Receipt was excluded from this case.
Decision
Based on the testimony of the City and seeing no one in the audience to speak on the
matter, Ms. Ellis adopted the recommendation of the City for a 10 -day compliance date
of June 28, 2014, or a $50 a day fine with the revisions to the violation just cited by the
City.
Case No. 1 -1103 Alice E. Silva
Property Address: 243 SW 14 Avenue
Violation(s): CO CH4 SEC 4 -14, 4 -36 and 4 -37
Remove dog feces from yard and
neighboring properties. Each dog must

Palm Beach County. Proof of rabies
vaccinations must be submitted.
Liz Roehrich, Animal Cruelty Investigator, presented the case for the above
violations which arose from a citizen complaint. The initial inspection date was April 28,
2014. The Respondent was not a repeat violator as to Code Enforcement, but Officer
Roehrich has encountered the Respondent on other occasions through Animal Control.
Written notice was sent on May 2, 2014, giving 10 days to correct the violations. Service
was effected by certified mail on May 12, 2014, but was returned unsigned. The
property was posted on June 6, 2014. Throughout the years there were multiple
animal - related complaints regarding dogs Ms. Silva owns. Her mother owns the home
and she lives there with her daughters. There have been multiple violations with
multiple dogs over the years. This case pertained to an animal feces buildup in the front
yard. The children walk the dog at the property line with an adjoining neighbor. Officer
Roehrich responded on February 7, 2013, and the front yard property line was laden
with feces. Ms. Martinez, the owner's daughter, corrected the matter. The same thing
occurred on April 28, 2014. The same neighbor complained and there was the same
amount of feces all through the yard. The Respondent complied, but the next day, the
neighbor found dog feces thrown in her yard. Officer Roehrich requested a Cease and

Desist Order for all the cited Ordinance sections. The dogs are never vaccinated or
licensed until Officer Roehrich gives her a warning and then she complies.
Ms. Ellis inquired if the matter was still occurring Officer Roehrich explained she waits
for a neighbor to complain and does not routinely police the issue. She was not looking
every day. The registration, rabies vaccination and license was updated in April relative
to the case.
Sandra Martinez, 243 SW 14 Avenue, the owner's daughter was a tenant in the
mother's home. She had two daughters that moved back in with her They have their
dogs and was unaware they were not picking up after their pets.
Decision
Ms. Ellis approved the recommendation of the City for the Cease and Desist Order.
Going forward, each time the Respondent was non-compliant a $250 fine would be
imposed effective June 25, 2014.
Case No. 14-1106 FPM Properties LLC
Property Address: 161 NE 17 Court

Every dog must have current tag and
registration with Palm Beach County.
Proof of rabies vaccinations needed.
Provide proper outdoor housing for dogs
at all times. Obtain permit for kennel.
Officer Roehrich presented the case for the above captioned violations. The
Respondent was not a repeat violator regarding the Code Enforcement process, but
was a continuous violator. Notice was sent certified mail on May 12, 2014, and was not
returned. The property was posted on June 6, 2014. There is a tenant at the property
with several pit bulls. Since May 10, 2013, Officer Roehrich responded five times to
various citizen complaints. The tenant was issued multiple warnings and 12 citations.
Two dogs were vaccinated, but the tenant never obtained the license and tags and has
been cited for that. The tenant has a new dog with no license, tag or rabies
vaccinations and the dog was hostile.
Officer Roehrich had photographs which Ms. Ellis viewed. Officer Roehrich requested a
Cease and Desist Order. Palm Beach County can license, sterilize and vaccinate the pit
bulls for free, but the owner refused the service. Officer Roehrich wanted a $1,000 per
occurrence fine. The owner has contested earlier citations and has not paid the fines.
She tried to contact the company that owns the home to no avail.

Decision
Based on the testimony by the City and no one present to speak on the matter from the
public, Ms. Ellis approved the Cease and Desist Order with the $1,000 per occurrence
fine effective June 19, 2014.
Case No. 1 -406 Raul Vargas, Jr.
Property Address: 405 SE 1 St Street
Violation(s): CO CH 15 SEC 15- 120(D) and (E) INC.
Remove trash and debris from rear and
side yard. Remove tires, appliances,
wood and junk. Repair or remove
dilapidated shed in rear yard, repair roof
and windows on rear porch and all
fascia boards.
Courtney Cain, Code Compliance Officer, presented the case for the above
violations. The case arose from a citizen complaint. The initial inspection date was
February 28, 2014. The Respondent was a repeat violator. Written notice was sent
giving 14 days. Notice was posted at City Hall and the premises on May 27, 2014. The
property was last inspected on June 17, 2014. The violations were a hurricane hazard.
Staff recommended a 15 day compliance date of July 3, 2014, to correct the violations
or a fine of $100 a day thereafter. Officer Cain had photographs Ms. Ellis and Mr.
Vargas viewed.
Raul Vargas, the occupant, inquired if there were photographs from the initial
inspection which Officer Cain produced. When he was able to contact Officer Cain he
explained the air conditioners were stored there were for scrap. He has not worked
since 2010. He is disabled and explained his disability restricted his physical
movements. On March 31 he called Officer Cain and advised him of his conditions. He
requested he be sent copies of the original photos so he could see the problem and a
transcript, but received no response. With help from his family, they removed items and
most of the air conditioners, but there were some new ones for income. There was a
load leaving today. He advised the property was sold in April and had been in
foreclosure for four years. There is a writ of possession and an agreement he will be
vacating the premises at the end of month or first week in July. He did what he could
which he explained in previous violations. Mr. Vargas produced sale documents Ms.
Ellis viewed.
Decision
Since the Respondent was no longer the owner of record, staff will recite the case under
the new owner. Ms. Ellis closed the case. Mr. Vargas advised the new owners of the
issue.

undated. The property was last inspected on June 17, 2014. Staff recommended a 15
day compliance date of July 3, 2014, to correct the violations or a fine of $50 a day
thereafter. The Business Tax Receipt was still outstanding.

matter, Ms. Ellis ordered the recommendation of the City of a 15 -day compliance date,

Officer Guillaume presented the case for the above captioned violation which arose
from a routine inspection. The initial inspection date was April 25, 2014. Written notice
was sent giving 10 days to correct the violation. Certified mail was sent and the green
card was signed on May 21, 2014 Staff recommended 15 days be given to correct the
violations or a fine of $100 a day thereafter.
Mike Garret, Invitation Homes, I1-12 and I1-13, would have to verify the home was
vacant. There was an application for a Business Tax Receipt filed, but the property had
not passed the inspection. Mr. Garrett had spoken with Officer Hart and will check what
was submitted and then organize an inspection for both their occupied and vacant
properties.
Decision
Ms. Ellis ordered a 15 -day compliance date of July 3, 2014 and a $100 a day fine
thereafter.

Officer Guillaume presented the case for the above captioned violations which arose
from a citizen complaint. The initial inspection date was April 25, 2014. Written notice
was sent giving 15 days to comply. The green card was signed May 19, 2014, and the
property was last inspected on June 17, 2014. Staff recommended 15 days be given to
correct the violations and a $100 a day fine.
Carmen Bengochea, Property Manager with Colony America, spoke with Officer
Guillaume and asked for an extension. There was an inspection on May 14, 2014, and
there was a new installation for an air conditioner and water heater with no permit. Last
week, the permit was applied for, but not approved. She asked her construction team
how long it would take for approval through to final inspection and they requested
between 30 and 45 days.
Ms. Ellis questioned the case pertained to a Business Tax Receipt. Officer Guillaume
explained they did not pass the inspection because items were installed without the
proper permits.
Decision
Given the testimony by the City and the testimony of the Respondent, Ms. Ellis
approved a 45-day compliance date of August 2, 2014 with a $100 fine if not complied
by then.
Case No. 14-1035 Regency Centers Inc.

Officer Guillaume presented the case for the above captioned violation. Staff
recommended 15 days be given to correct the violation and a fine of $100 a day

Officer Hart presented the case for the above captioned violations which arose from a
citizen compliant. The initial inspection date was March 19, 2014. Written notice was
sent via regular mail on March 19, 2014, giving 10 days to correct the violations. Notice
was posted at the premises and at City Hall on June 9, 2014. Officer Hart met with the
Respondent on March 31 and agreed on a 30 -day extension which lapsed. The
property was last inspected on June 17, 2014. Ms. Ellis reviewed photographs taken
on June 17, 2014. The trash was cleared, but the broken fence remained outstanding.
Roy Smith, 1107 SW Boynton Avenue, submitted documents. He has been having
trouble with his eye and his doctor advised he could not lift anything over 10 pounds.
He had to sit for over a month, take pills and drops and has to hold his head up. Prior to
this, he was working seven days a week. He did not contest the issues, but could not
take care of them. He was told in a week and a half or so, someone would come in to
help him. He lives alone.
Decision
Ms. Ellis approved a 30 -day compliance date of July 18, 2014, or a fine of $50 a day
thereafter.

spoken with the Respondent who indicated the matter would be corrected within 90

Business Tax Receipt was needed and they applied. He commented they never
received notice for the 10 days. After the renters leave, they will make the repairs.
Officer Pierre explained after an inspection is made, they recommend 10 days, but he
was unsure if the owner knew when the tenant was moving out. They will need time to
fix the problem. The Respondent did not have an exact date when the tenants would be
moving out. Ms. Ellis recommended working with the City to learn what needed to be
done to pass the inspection.

Officer Pierre presented the case. The Notice of Violation was January 2, 2014, for a
Business Tax Receipt . The case was heard on April 16, 2014. The compliance date
and fine set by the Board was April 26, 2014. There were 52 days of non - compliance
and an administrative fee of $634.12
Stephan Caro, owner of the property, was unaware he was in the fine process. The
address for the Business Tax Receipt was different than the address the notice was
sent, so he did not get the notices. He only found out about this hearing because the
tenant was served.
He met with the Code Inspector who gave a list of items to repair. He had photos of
items. He had a hard time finding someone to fix the window. He was pulling a permit
for a flat roof and addressing the violations as soon as possible. He would have
complied sooner if the received the notices.
He purchased the property in November and made application for the Business Tax
Receipt on March 26, 2014. Family and friends were living at the premises, while they

Case No. 1 -182 IH2 PROPERTY FLORIDA LP 2709 SW Stn Street
Officer Pierre presented the case. The case was heard April 16, 2014, and no one
appeared. The compliance date and fine was April 26, 2014 and a fine of $50 a day.
The violation still exists having 52 days of non - compliance a fine of $386.12. The
Respondent was to apply for and pass inspection for a Business Tax Receipt for a
rental property.
Mr. Garret advised he will follow up and confirm an application was submitted and
schedule an inspection.
Decision
Ms. Ellis certified the fine.
Case No. 1 -184 IH2 PROPERTY FLORIDA LP 2640 SW 8th Street
Officer Pierre presented the case which pertained to applying and passing inspection for
a Business Tax Receipt for rental property. The case was heard on April 16, 2014, and
the date and fine set was April 26, 2014, or a fine of $50 a day thereafter. The violation
still exists having 16 days of non - compliance. The inspection and affidavit filing fees
were $634.12
Mr. Garrett agreed to follow up on the status of the Business Tax Receipt and the
inspection.
Decision
Ms. Ellis certified the fine.
E. LIEN REDUCTIONS
Case No. 12 -1683 Wells Fargo Bank 261 N. Atlantic Drive
Ms. Springer presented the case. The Notice of Violation was August 28, 2012,
regarding registration of a foreclosed property. The Respondent was to repair the roof
and ceiling, windows and doors, front and rear screen windows and doors, obtain a
permit for the pool fence, and the Respondent was to fix the light fixtures and obtain a

permit for the new windows. The case was heard on October 17, 2012 and no one
appeared. The compliance date and fine was October 27, 2014, or a fine of $1,000 a
day would be imposed thereafter. The violations were corrected on March 13, 2014,
having 501 days of non - compliance. There were four inspections and an administrative
fee of $634.12. The total fine was $501 thousand. There was an outstanding water bill
of $133.66 paid and on May 22, 2012, the building was placarded as unsafe. The owner
was originally cited and when it fell into foreclosure, staff closed the case and cited
Wells Fargo.
In June 2013, Ms. Springer received a letter from a title company requesting a lien
reduction inspection. Ms. Springer gave them a list of items to repaiar. She was
contacted in September by a realtor and she gave him the same information. She was
again contacted In December 2010 by Sue King, who advised her the building was in
such disrepair, the bank demolished it and the permit was finalled on March 13, 2014.
The property was now in compliance
Sue King, Data Quick Title, 5629 Strand Boulevard, Naples, explained Wells Fargo
took certificate of title on March 25, 2013. At first, it looked like mold issues to be
addressed with others. Finally through several contacts with Code, Compliance, the
asset manager thought the best solution was demolition. She spent about $8K before
demolition and about $13,495 for the demolition. The foreclosed amount was $59,881.
Decision
Given the testimony by the Respondent and the City, and given the City has confirmed
the Respondent is eligible for lien reduction, Ms. Ellis reduced the lien to $3,500, plus
administrative costs of $634.12.
Case No. 13 -147 Dalland Properties 137 NE 11 Avenue
Ms. Springer presented the case. The Notice of Violation was issued on January 30,
2013 for a deteriorated fence and trash. The case was heard on May 15, 2013, and no
one appeared. The compliance date and fine was May 25, 2013 or a $500 a day fine.
The violations were corrected on December 20, 2013, having 198 days, a fine of $99K
and administrative fees of $634.12. There were outstanding property taxes and water
bills of about $600 that had to be paid to be eligible for lien reduction. She was
contacted in January and advised they had to secure the building, replace the windows
and screens, repair or replace rotted fascia, replace the missing air conditioning
compressor, repair the sprinkler system, trim hedges, mow overgrowth and remove
debris from the front yard. In February, most violations still existed. The property was
inspected April, 30 and there were still violations remaining. The property was
inspected on May 22, 2014, and the violations were corrected.
Bernadine Jones, Dalland Properties, explained Dalland Properties previously had
very poor property management. Dalland has hundreds of properties in Palm Beach

County and they thought property management was handling the matter, but was not.
Ms. Jones was hired and they were ensuring the properties were in compliance in
Boynton Beach.
Decision
Given the testimony of the Respondent and the City, and that the City confirmed the
Respondent has met the criteria for a Lien Reduction, Ms. Ellis reduced the lien to
$2,500 plus administrative costs of $634.12.
