3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
4 OF BOYNTON BEACH, FLORIDA, AMENDING THE CITY'S
5 CODE OF ORDINANCES TO AMEND THE TITLE TO
6 CHAPTER 23 TO READ "TAXATION, ASSESSMENTS AND
7 FEES;" TO CREATE A NEW ARTICLE V IN CHAPTER 23 TO
8 BE ENTITLED "EMERGENCY MEDICAL SERVICES FEES
9 AND CHARGES," TO ADD A NEW SECTION 23 -55 TO BE
10 ENTITLED "DEFINITIONS" TO PROVIDE FOR DEFINITIONS,
11 A NEW SECTION 23 -56 TO BE ENTITLED "EMERGENCY
12 MEDICAL SERVICES TRANSPORTATION FEES AND
13 CHARGES" TO PROVIDE FOR THE FEES AND CHARGES,
14 AND A NEW SECTION 23 -57 TO BE ENTITLED "COLLECTION
15 OF EMERGENCY MEDICAL SERVICES TRANSPORTATION
16 FEES AND CHARGES" TO PROVIDE FOR COLLECTION;
17 PROVIDING FOR CODIFICATION; PROVIDING FOR
18 CONFLICTS; PROVIDING FOR SEVERABILITY; A N D
19 PROVIDING FOR AN EFFECTIVE DATE.

21 WHEREAS, the City Commission finds it in the best interest of the City to create a
22 new Article V in Chapter 23 to provide for and confirm fees and charges for Emergency
23 Medical Services Transportation, and the collection thereof; and,
24 WHEREAS, the City Commission finds it in the best interest of the City that the
25 title to Chapter 23 of the City's Code of Ordinances be corrected to reflect its contents, and
26 provide for the inclusion in the future of assessments and fees as may be authorized by the
27 City Commission
28 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
29 OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:

31 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
32 being true and correct and are hereby made a part of this Ordinance.
33 Section 2. The Code of Ordinances of the City of Boynton Beach is hereby
34 amended to amend the title of Chapter 23 as follows:

3 Section 3. The Code of Ordinances of the City of Boynton Beach is hereby
4 amended by amending Chapter 23 to add a new Article V, to be entitled "Emergency
5 Medical Services Transportation Fees and Charges" by adding a new a new Section 23 -55
6 to be entitled "Definitions, ", a new Section 23 -56 to be entitled "Emergency Medical
7 i Services Transportation Fees And Charges," and a new Section 23 -57 to be entitled

13 Sec. 23 -55. Definitions.
14 For the purposes of this chapter, the following definitions shall apply:
15 (a) Basic life support (BLS) services include the treatment of medical emergencies by a
16 qualified person through the use of techniques such as patient assessment,
17 cardiopulmonary resuscitation (CPR), splinting, obstetrical assistance, bandaging,
18 administration of oxygen, application of medical anti -shock trousers, administration of a
19 subcutaneous injection using a premeasured auto - injector of epinephrine to a person
20 suffering an anaphylactic reaction, and other techniques described in the Emergency
21 Medical Technician Basic Training Course Curriculum of the United States Department
22 of Transportation.
23 (b) Advanced life support services means the treatment of life - threatening emergencies
24 through the use of techniques such as endotracheal intubation, the administration of
25 intravenous fluids, medications, telemetry, cardiac monitoring, cardiac defibrillation, and
26 the use of external pacemakers by a qualified paramedic. Advanced life support services
27 are classified in two categories as follows:
28 (1) Advanced life support, level 1 (ALS1). Where medically necessary, the provision of
29 an assessment by an advanced life support (ALS) provider and/or the provision of
30 one or more ALS interventions. An ALS intervention is defined as a procedure
31 beyond the scope of an EMT -Basic as defined in the National EMS Education and
32 Practice Blueprint.

1 (2) Advanced life support, level 2 (ALS2). Where medically necessary, the
2 administration of at least three (3) different medications and/or the provision of one
3 (1) or more of the following ALS procedures:
4 • Manual defibrillation/cardioversion.
5 • Endotracheal intubation.
6 • Central venous line.
7 • Cardiac pacing.
8 • Chest decompression.
9 • Surgical airway.
10 , • Intraosseous line.
11 Sec. 23 -56. Emergency Medical Services Transportation Fees and Charges.
12 (A) The fees and charges for emergency medical transportation services are as follows:
13 Effective October 1, 2014:
14 (1) BLS Transport Fee $610.00
15 (2) ALS1 Transport Fee 610.00
16 (3) ALS2 Transport Fee 770.00
17 (4) Mileage 12.00
18 Effective October 1, 2015:
19 (1) BLS Transport Fee $630.00
20 (2) ALS1 Transport Fee 630.00
21 (3) ALS2 Transport Fee 790.00
22 (4) Mileage 12.50
23 Effective October 1, 2016:
24 (1) BLS Transport Fee $650.00
25 (2) ALS1 Transport Fee 650.00
26 (3) ALS2 Transport Fee 810.00
27 (4) Mileage 13.00

8 Sec.23 -57 Collection of Emergency Medical Services Transportation Fees and Charges.
9 (A) The Fire - Rescue Department will submit bills to patients or to the patient's insurance
10 carrier for the provision of Basic Life Support or Advanced Life Support transportation.
11 (B) The Boynton Beach Fire - Rescue Department has established the Standard Operating
12 Guidelines for EMS Transportation Billing Policies, Procedures and Collections. The
13 Administration and Finance Officer is hereby authorized to adjust the accounts as stated
14 in the policy.
15 (C) The City may collect delinquent charges through any and all available legal remedies.
16 (D) The City Finance Department is hereby authorized to accept assignment at the maximum
17 allowable rate of Medicaid, Medicare, and Palm Beach County Health Care District
18 benefits.
19 (E) The City Finance Department is hereby authorized to negotiate payment settlements of
20 outstanding debts owed to the City for emergency services rendered when the debtor is
21 unable to satisfy the outstanding balance due.

23 Section 4. City Staff is authorized to take all steps necessary to effectuate the
24 intent of this ordinance.
25 Section 5. It is the intention of the City Commission of the City of Boynton Beach
26 that the provisions of this Ordinance shall become and be made a part of the Code of
27 Ordinances of the City of Boynton Beach, Florida. The Sections of this Ordinance may be
28 renumbered, re lettered and the word "Ordinance" may be changed to "Section ", "Article" or
29 such other word or phrase in order to accomplish such intention.

1 Section 6. All Ordinances or parts of Ordinances, Resolutions or parts of
2 Resolutions in conflict herewith be and the same are hereby repealed to the extent of such
3 , conflict.
4 Section 7. If any clause, section, or other part or application of this Ordinance
I ;
5 j shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such
6 unconstitutional or invalid part or application shall be considered as eliminated and so not
7 affecting the validity of the remaining portions or applications remaining in full force and
8 effect.
9 Section 8. This Ordinance shall become effective upon adoption.
