BACKGROUND
Darryl L. Johnson is seeking conditional use approval for the conversion of a 3,312 square foot building
to a funeral home establishment. The subject property is located at 2015 South Federal Highway and is
currently vacant. The proposed Funeral Home is generally permitted within C-3 zoning districts,
however since this property is within 200 feet of a residential zoning district, City Commission Approval is
required.
STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
Section 11.2.D of the Land Development Regulations contains the following standards to which
conditional uses are required to conform. Following each of these standards is the Planning and Zoning
Division’s evaluation of the application as it pertains to standards.
The Planning and Development Board and City Commission shall consider only such conditional uses as
are authorized under the terms of these zoning regulations and, in connection therewith, may grant
conditional uses absolutely or subject to conditions including, but not limited to, the dedication of
property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the
protection of the surrounding area and the citizens’ general welfare, or deny conditional uses when not
in harmony with the intent and purpose of this section. In evaluating an application for conditional use
approval, the Board and Commission shall consider the effect of the proposed use on the general health,
safety and welfare of the community and make written findings certifying that satisfactory provisions
have been made concerning the following standards, where applicable:

The subject property currently has two driveways on Federal Highway and one driveway on SE 21
Avenue. The southernmost driveway on Federal Highway is a one-way exit only. The remaining two
driveways are utilized for two-way traffic. The applicant intends to keep the property access and
internal circulation as existing.
2.
The subject property currently has 36 available parking spaces which exceeds the minimum number
of parking spaces required by code, 17, based upon one (1) per 200 square feet of floor area. The
loading area is located in the rear of the building as to minimize visibility from Federal Highway. The
proposed use will not increase the intensity of parking or promote additional glare, noise or odors.
The parking lot striping has faded over the years and staff is recommending the re-striping to bring
the parking lot into compliance.

The applicant must meet with the City’s waste removal division of Public Works. Based on their
operations and type and amount of waste generated the applicant may request to be issued rollout
containers in lieu of a dumpster.

The City of Boynton Beach Utility Department currently serves the site, and utilities would continue
to be available and provided consistent with Comprehensive Plan policies and city regulations. No
additional impacts are anticipated with this application.

The existing screening, buffering, and landscaping is currently in compliance with the previously
approved plans. Any revision to the approved site plan will require the appropriate planning &
zoning approvals. Any existing dead planting material must be replaced and maintained.

The site currently has one monument sign. Any additional signage will require permits and
appropriate approvals. The parking area contains 20 ft. light poles with cut-off light fixtures to
minimize light spillage onto adjacent properties. Additionally, there are mounted wall pack lights at
the building’s entries.

No new structures are being proposed through this application. The existing setbacks are
conforming to current standards. The dimensions are approximately: front (east) 16 feet; rear (west)
78 feet; side (north) 70 feet; and side (south) 53 feet.

The proposed funeral home establishment reuses an existing, vacant, structure fronting Federal
Highway. The proposed use of the building would be of similar intensity and capacity of the existing
and intended uses of the buildings immediately to the north and south. To the north is a place of
worship and to the south is an eating establishment. The existing structure is located towards the
front of the property on Federal Highway and has open spaces, including parking areas and
landscaping, against the residential uses to the west. The property is surrounded by rights-of-way
on all four (4) sides, providing further separation from adjacent uses.

The existing height of the one-story building will not change with this application, and is compatible
with the structures on the adjacent commercial properties, as well as being well below the 45 foot
maximum height allow in the C-3 zoning district.

The overall economic effects of the proposed use on adjacent and nearby properties, and the city as
a whole, will likely be negligible.

With incorporation of staff comments, the proposed project would comply with all requirements of
applicable sections of city code.
12.
With incorporation of all conditions and staff recommendations contained herein, the proposed use
would operate in a manner that is in compliance with the above-referenced codes and ordinances of
the city.
RECOMMENDATION
Based on the discussions contained herein, compliance with development regulations, and the
consistency with the Comprehensive Plan, staff recommends that this request for Conditional Use be
approved subject to satisfying all comments contained in Exhibit “C” - Conditions of Approval.
