I. CALL TO ORDER
Ms. Ellis, Special Magistrate, called the meeting to order at 9:02 a.m. Ms. Ellis
explained her role in the hearings and the hearing procedures. Pursuant to Florida
Statute, all Orders are appealable to the Circuit Court in Florida and not the City
Commission.
The Minutes Specialist administered an oath to all those intending to testify.
II. APPROVAL OF 5/21/14 MINUTES
There were two changes to the minutes:
Page 3, Case No. 14 -720, the second sentence should read, "The Respondent was
given five days for a compliance date of May 26, 2014, or a fine of $500 per day
occurrence
Page No. 31 — Case No. 14 -779 — the fine amount should be $200.
Ms. Ellis approved the minutes with the corrections provided.
III. APPROVAL OF AGENDA
Skip Lewis, Senior Code Compliance Officer, announced the following changes to
the agenda:
Case Nos.: 14 -801, 14 -1263, 14-1324,14-1253, 14 -1057, and 14 -1215 complied and
Case Nos. 14-1032, 14 -735 and 14 -1218 were removed.
Diane Springer, Code Compliance Coordinator, announced which Respondents
were present and all the lien reductions Respondents.
Ms. Ellis approved the agenda with changes. Ms. Ellis requested cell phones be
silenced or turned off.

Case No. 14 -1130 FPM Properties LLC

Courtney Cain, Code Compliance Officer, presented the case for the above
captioned violation. The case arose from a routine inspection on May 7, 2014. The
initial notice was a written notice giving 30 days to correct the violations and the trash
and debris was corrected. Service was obtained by certified mail, but the green card
was not dated. The property was last inspected on July 15, 2014. The Respondent
was a repeat violator.
George Podray, the owner was present and had photographs where the sod was
installed and the yard was cleared. Mr. Podray contended the Officer wanted sod
planted under the mango trees and it would not grow. Subsequently, he was told to cut
down all the mango trees.
Ms. Ellis viewed the photographs Mr. Podray had. Officer Cain also had photographs
he showed to Mr. Podray and Ms. Ellis. Mr. Podray asked if the photographs were of
his property. Officer Cain clarified the photographs he presented were of other
properties in the area that had mango trees with sod underneath.
Decision
Based on the evidence of Mr. Podray's property, there must be sod planted. She gave
10 days to install the sod and then the property would be re- inspected to ensure it
meets the City's requirements.
Mr. Podray thought it was subjective and asked who determines how much sod. Ms.
Ellis reiterated the sod must be installed by July 26 or a fine of $100 a day would be
imposed.
Case No. 14 -1050 Tina Y. Johnson
Property Address: 3210 E. Palm Drive

Glenn Weixler, Code Compliance Officer, presented the case for the above captioned
violations. The case arose from a routine inspection. The initial inspection date was
April 29, 2014. Notice was sent on April 29, 2014 giving 10 days to correct the
violations. Service was obtained by certified mail sent on June 24, 2014, and the green
card was signed on June 28, 2014. Regular mail was sent on April 29, 2014. Officer

Weixler had allowed an extension. The property was last inspected on July 15, 2014,
and he recommended allowing an additional 15 days to correct the violations by July 31,
2014, and a fine of $50 a day. Proof had been provided that the Respondent was
genuinely trying to register the vehicle.
Tina Johnson, the owner of the property, explained her husband was restoring a 1970
Chevy. They will register the vehicle and all else to comply. He had the bumper and
different parts of the vehicle in storage. She agreed 15 days was sufficient to correct
the matter.
Decision
Based on the testimony of the City and the Respondent, Ms. Ellis ordered the City's
recommendation of a 15 -day compliance date of July 31, 2014, and a $50 a day fine
thereafter.
Case No. 1 -1256 Lucille Galiana & Patricia L. Kuhn

Officer Weixler presented the case for the above captioned violations. The case arose
from a routine inspection. The initial inspection date was May 30, 2014, and notice was
sent on May 30, 2014, giving 10 days to correct the violations. Service was obtained by
certified mail sent on June 24, 2014, and signed on June 27, 204. Regular mail was
sent on May 30, 2014. All the violations were corrected except for the Business Tax
Receipt and application needed to be made. The property was last inspected on June
15, 2014. Staff recommended 10 days be given to correct the violations or a fine of $50
a day. The Respondent had the application in hand. After the meeting, she would
apply.
Lucille Galiana, the property owner, commented she has the last house on the street
and the sidewalk ends at her driveway. When children play up and down the street, they
leave everything in front of her home and the wind blows debris into her yard. It collects
on her corner fence. The landscaper clears it, but it is a recurring issue. She confirmed
she had the application for the Business Tax Receipt.
Decision
Based on the testimony by the City and the Respondent, Ms. Ellis ordered the City's
recommendation of a 10 -day compliance date of July 26, 2014, and a fine of $50 a day
thereafter.

Officer Cain commented the case complied with no fine. He had spoken with the
Respondent outside of Chambers.
Case No. 14-94 Haim Realty Group LLC

Apply for and pass inspection for Business Tax
Receipt for rental property. Remove all
inoperable vehicles and outdoor storage.
Officer Lewis presented the case for the above captioned violations. The initial violation
date was January 23, 2014. The hearing date was April 16, 2014 and no one appeared.
The compliance date was May 16, 2014, with a fine of $50 a day. The property was last
inspected on July 7, 2014, and the violations still exist having 60 days of non-
compliance and administrative fees of $730.15. Staff recommended certifying the fine.
Ms. Ellis requested confirmation the Respondent was not present at the last hearing.
Officer Lewis verified no one was present at the last hearing and the hearing was
properly noticed. He explained the situation arose from a rental property in poor
condition. He notified the owner who contacted him and the Officer gave them time to
correct the violations. They removed the tenant, but never called for an inspection. Two
and a half months ago, Officer Lewis inspected the premises and gave a list of repairs
in order for someone to rent the property. These included air conditioning and air
handier permits and exterior work.
Since that time, the property was again rented without a final inspection and permits
were not pulled for the air conditioning. Some work was done, but with the other
tenants renting the premises, other violations were occurring. They could not obtain the
Business Tax Receipt without the permits. He thought there was a possible health and
safety issue due to the lack of permits and Officer Lewis was unaware if there were
smoke detectors. The Respondents were present.
Ilan Abenhaim, the property owner, agreed with Officer Lewis. He had hired a property
manager who was dealing with Officer Lewis and had receipts to show he paid for the
repairs. Mr. Abenhaim was told by the property manager he had attended the hearing
and met Officer Lewis at the premises and he had not. The property manager was
stealing rent monies. Mr. Abenhaim has 50 properties that he was told were vacant that
were not and from which the property manager was collecting rent. When this case was

opened, Mr. Abenhaim contacted Code Enforcement to comply. He had police reports
from Boca and Hollywood and the matter was being forwarded to the State Attorney.
He was present to comply and spent over $2,500 on issues that needed to be fixed. He
applied for the air conditioner permit, but a tenant rented one of the homes, so he had to
install a window unit.
Ms. Ellis explained no one appeared at the last meeting and that was when she could
determine the length of time to comply. Even though he was defrauded, she has to
certify the fine based on the violation. He could return for a lien reduction.
Mr. Abenhaim explained he never got the original notice. Jamie Pellini, his assistant,
and Mr. Abenhaim attended the Code hearings in June, but the hearing was cancelled.
He produced the letter dated June 18 They still had not applied for the air
conditioning permit or Business Tax Receipt and Officer Lewis advised Ms. Pellini they
had 30 days to obtain the permit and Business Tax Receipt inspection.
Ms. Springer explained when the letter was sent, the clerk forgot to include the
inspection date, so it did not generate a case history to appear on the letter. In June,
the case was removed from the agenda, the Respondent advised not to come, and the
case was rescheduled to July. The Respondent received an extra 30 days.
Decision
Due to the amount of time given, Ms. Ellis certified the fine and explained they could
return and apply for lien reduction.
Case No. 09 -3383 Boynton Ventures I LLC 101 South Federal Hwy.
Ms. Springer presented the case. The Notice of Violation as October 22, 2009 to mow,
weed and trim, repair the broken sidewalk and remove grass and weeds from it. The
case was heard November 18, 2009 and no one appeared. The compliance date and
fine set was November 28, 2009 or a fine of $250 a day would be imposed thereafter.
The violations were corrected on January 31, 2013, accruing a total fine of $289,750.
The property was a vacant lot on the corner of Federal Highway and Ocean Avenue.
Ms. Springer was contacted in May. There was debris that had to be removed, but it
met the requirements for a lien reduction at that time.
John Hart, Law Firm of Carlton Field Joren Burt, was present on behalf of the
owner, Capstone Resdev LLC, a subsidiary of PNC Bank. The property was a
foreclosure. The case arose from a prior owner, Boynton Ventures, which was
foreclosed. Subsequent to the foreclosure, Capstone took title and there was an initial
issue in gaining compliance due to them paying a contractor to address the matter,
which was not addressed. They hired someone else that resulted in a delay. The
property was a real estate owned property that was under contract to close in October.

He requested a lien waiver or a substantial reduction. There were initially routing
issues, but Capstone was now aware of the matter and would ensure the property was
in compliance.
Decision
Based on the presentation by the City and the testimony by the Respondent's
representative, Ms. Ellis reduced the lien from $289,750 to $5,000 excluding the
administrative costs of $634.12.
Case No. 11 -2731 Capstone Resdev LLC 101 South Federal Hwy.
Ms. Springer presented the case. The Notice of Violation was sent October 5, 2011, to
mow, weed and trim the property, remove trash, debris and horticultural debris, repair
the paver on the sidewalk on the north side, and replace screening on the fence. The
case was heard December 21, 2011, and no one appeared. The compliance date and
fine set was December 31, 2011, or a fine of $250 a day would be imposed thereafter.
The violations were corrected on January 31, 2013, accruing a fine of $99,000 plus
$634.12 in administrative fees.
Mr. Hart explained this case was basically the same as the prior case. They were
working to get the properties cleared and the lien reduced so they could move on.
Decision
Based on the presentation by the City and the testimony by the Respondent's
representative, Ms. Ellis reduced the lien from $99,000 to $5,000 excluding the
administrative costs of $634.12.
Case No. 13 -2103 Capstone Resdev LLC 101 South Federal Hwy.
Ms. Springer presented the case. The Notice of Violation was sent September 24,
2013, to mow and remove trash and debris. The case was heard November 20, 2013,
and no one appeared. The compliance date and fine was November 30, 2013 or a fine
of $250 a day would be imposed thereafter. The violations were corrected on March 10,
2014, accruing a fine of $24,750 plus administrative fees of $730.15.
Mr. Hart explained this case was the same as the prior cases and requested as much of
a reduction as possible.
Decision
Given the presentation by the City and the comments by the Respondent's
representative, Ms. Ellis reduced the line from $24,750 to $2,500 plus administrative
fees of $730.15.

Ms. Springer explained none of the fines could be paid until they receive the final notice.
She provided letters explaining the matter has to be approved by the City Commission
first and she could not accept payment until that time.
Case No. 09 -3493 Citimortgage 706 Ocean Inlet Drive
Ms. Springer presented the case. The Notice of Violation was sent on November 4,
2009, to register and maintain foreclosed property, mow overgrown yard areas, and trim
overgrown vegetation. The case was heard on December 16, 2009, and no one
appeared. The compliance date and fine was December 31, 2009, or a fine of $250 a
day would be imposed thereafter. The violations were corrected on November 5, 2010,
accruing a fine of $77,000 plus administrative fees of $634.12.
To qualify for a lien reduction, the applicant paid an outstanding water bill of almost
$1,100, nearly $10,000 in property taxes and pay off three municipal liens of almost
$1,800. Ms. Springer received an email on May 13, 2014, requesting the lien reduction
inspection. The Officer could not determine if it complied. There were roof tiles on the
roof that had to be removed and there were issues with the self - latching gate. A re-
inspection occurred on July 14, 2014, and the property was eligible for lien reduction at
that time.
Richard Carey, Coquina Cove XXLLC, was present and explained the property was
sold in foreclosure on May 2, 2013, and they became the owners. The notices were
sent to Citimortgage, but Coquina Cove was the owner. They addressed the Code
violations and requested a reduction.
Decision
Based on the presentation by the City and the comments by the Respondent's
representative, the lien of $77,000 was reduced to $5,000 plus administrative costs of
$634.12.
Case No. 13 -1423 Dalland Properties LP 2206 NE 4th Court
Ms. Springer presented the case. The Notice of Violation was sent on July 1, 2013 to
obtain a Business Tax Receipt for rental property. The case was heard on September
18, 2013, and no one appeared. The compliance date and fine was September 28,
2013, or a fine of $150 would be imposed thereafter. The violations were corrected on
May 16, 2014 accruing a fine of $57,250 plus administrative fees of $634.12. In order to
qualify for the lien reduction, the 2013 property taxes had to be paid. The lien reduction
inspection revealed the Respondent had to remove inoperable vehicles, weed and
fertilize the yard which was addressed on June 17, 2014.
Bernadine Jones, representing Dalland Properties, explained Dalland hired her and
her team to manage their properties. She spent $2,000 to $3,000 to bring the property

into compliance and obtain the Business Tax Receipts. Dalland owned the property for
a few years, but terminated the prior property management company.
Decision
Based on the testimony of the City and the testimony of the Respondent's
representative, Ms. Ellis reduced the lien from $57,250 to $3,500 plus administrative
costs of $634.12.
Case No. 10 -544 Clyde E. & Alberta S. Jones 1625 NE 2 nd Street
Ms. Springer presented the case. The Notice of Violation was sent on February 25,
2010, to mow the yard and trim overgrown vegetation. The case was heard on April 21,
2010, and no one appeared. The compliance date was May 1, 2010, or a fine of $75 a
day would be imposed thereafter. The violations were corrected on February 13, 2012,
accruing a fine of $48,900 plus administrative costs. To qualify for the lien reduction,
outstanding water bills of about $1,600, five municipal liens and over $1,000 in property
taxes had to be paid.
When Ms. Springer was contacted for lien reduction, the inspection revealed the
Respondent had to install sod in the yard and swale, replace windows and screens,
remove tires and the broken fence. The property was re- inspected and items had to be
removed from the carport. The property had to be sodded on the side of the house and
some vegetation along the fence had to be trimmed. On June 12, 2014, the property
was eligible for lien reduction.
Bernadine Jones explained this case was the same as the prior cases. The
Respondents were long -term tenants, and when they cleaned up, they put the items in
the carport and porch. It was in compliance and Mr. Jones hired Ms. Jones to keep the
property in compliance.
Decision
Based on the testimony of the City and the comments by the Respondent's
representative, Ms. Ellis reduced the lien from $48,900 to $3,500 plus $634.12
administrative costs.
Case No. 10 -3074 Clyde E. & Alberta S. Jones 1625 NE 2 nd Street
Ms. Springer presented the case. The Notice of Violation was sent on October 13, 2010,
to mow the overgrown yard, and maintain the property. The case was heard on
November 14, 2010, and no one appeared. The compliance date and fine was
December 20, 2010, or a fine of a $1,000 a day would be imposed thereafter. The
violations were corrected on February 13, 2012, accruing a fine of $437,000 plus
administrative fees.

Ms. Jones explained the same situation occurred. They had $5,000 in municipal liens,
the property taxes and all were current. They also obtained the Business Tax Receipt
and the property looks great. The home was not for sale.
Decision
Based on the testimony of the City and the comments made by the Respondent's
representative, the lien of $437,000 was reduced to $15,000 plus administrative costs of
$634.12.
Case No. 11 -3264 Clyde E. and Alberta S. Jones 1625 NE 2 nd Street
Ms. Springer presented the case for the above captioned violations. The Notice of
Violation was sent December 2, 2011, to secure the building. The case was heard on
January 18, 2012, and no one appeared. The compliance date and fine was January
28, 2012, or a fine of $250 a day. The violations were corrected on March 5, 2012,
accruing a fine of $9,000 with administrative fees.
Bernadine Jones explained this was an owner who owns many properties. This property
fell by the wayside. Ms. Ellis commented owning this property is a privilege and it
needs to be maintained. Ms. Jones explained she is managing at least 40 properties in
Boynton Beach alone.
Decision
Given the presentation by the City and the comments by the Respondent, the $9,000
was reduced to $1,000 plus administrative costs of $634.12.
Case No. 08 -977 Thomas A. Aius 3350 Ocean Parkway
Ms. Springer presented the case. The Notice of Violation was sent on March 24, 2008,
to remove trash and debris from the front and rear yard, repair the screen and obtain a
Business Tax Receipt for the rental property. The case was heard May 21, 2008, and
no one appeared. The compliance date was June 5, 2008, or a fine of $250 a day
would be imposed thereafter. The violations were corrected on September 25, 2008,
accruing a fine of $27,750.
An outstanding water bill of nearly $3,300 and five municipal liens had to be paid. Ms.
Springer was contacted in November and the roof had to be replaced and permits
obtained. There was rotted wood on the fascia porch support, porch ceiling, carport
ceiling and soffit. The soffit screens, screens on the porch, windows and doors all had
to be replaced. There was open wiring on the porch in the rear, the wall in utility room
had to be replaced, and the Respondent was to mow, weed and trim the overgrowth on
the rear and side yards. All the repairs were completed on April 21, 2014. There was
slight overgrowth, but in May the property was eligible for lien reduction.

Bernadine Jones, of Prodigy Capital, explained the prior owners created the
violations and the property was purchased at auction. The home was gutted and the
property management team did an amazing job improving the property. The property is
for sale, but was not under contract. Ms. Springer had photographs Ms. Jones and Ms.
Ellis viewed.
Decision
Based on the presentation by the City and comments by the Respondent's
representative, Ms. Ellis reduced the $27,750 lien to $2,000 plus $634.12 in
administrative costs.
Ms. Ellis inquired about the price of the home, but Ms. Jones advised they had not yet
determined the price.
Case No. 0 -1984 Thomas A. Agius 3350 Ocean Parkway
Ms. Springer advised the next three cases were for the same property. The Notice of
Violation for this case was sent on July 10, 2008, to secure the property, mow and
remove trash and debris. The case was heard on August 28, 2008, and no one
appeared. The compliance date was August 30, 2008, or a fine of $100 a day would be
imposed thereafter. The violations were corrected on May 21, 2012, accruing a fine of
$135,900 plus administrative costs.
Bernadine Jones, of Prodigy Capital, explained the prior owner caused the violations.
Prodigy Capital purchases the homes at auction. They correct the violations
expeditiously and begin rehabbing the homes.
Ms. Ellis inquired if most of the properties were purchased at auction. Ms. Jones
responded they were or were real estate owned properties. They were speculative
investors. They lose money on some homes and make money on others.
Decision
Based on the presentation by the City and comments by the Respondent's
representative, Ms. Ellis reduced the $135,900 lien to $5,000 plus administrative costs
of $634.12.
Case No. 09 -2040 Thomas A. Agius 3350 Ocean Parkway
Ms. Springer advised a Notice of Violation was sent on June 26, 2009, to mow the
overgrown lawn. The case was heard on August 19, 2009, and no one appeared. The
compliance date to correct the violations was August 29, 2009, or a fine of $500 a day
would be imposed thereafter. The violations were corrected on September 30, 2009,

accruing a fine of $15,500. The Board chose not to certify the entire amount in 2009
and certified the fine for $2,184.12 including the administrative fees.
Bernadine Jones, of Prodigy Capital, explained the violations were caused by the
former owner.
Decision
Given the presentation by the City and the comments by the Respondent's
representative, Ms. Ellis reduced the fine certified in the amount of $2,184.12 to $800
plus $634.12 in administrative costs.
Case No. 12 -126 Thomas A. Agius 3350 Ocean Parkway
Ms. Springer explained the Notice of Violation for this case was sent on January 25,
2012, to secure the building. The case was heard on March 21, 2012, and no one
appeared. The compliance date and fine was March 31, 2012, or a fine of $150 would
be incurred thereafter. The violations were corrected on May 20, 2012, accruing a fine
of $7,500 plus administrative fees.
Bernadine Jones, of Prodigy Capital, reiterated the case was the same as the
previous cases. The prior owner caused the violations, which she had corrected.
Decision
Given the presentation by the City and the comments by the Respondent's
representative, Ms. Ellis reduced the fine of $7,500 to $1,500 plus administrative costs
of $634.12.
Case No. 12 -2080 Dalland Properties, LP 520 NW 13 Avenue
Ms. Springer presented the case. The Notice of Violation was sent on October 19, 2012,
to obtain a Business Tax Receipt for the rental property. Ms. Springer explained in
addition to the Business Tax Receipt, Chapter 15 relating to the Community
Appearance Code, was cited on the notice of hearing, but nothing was placed in the
narrative. Only the Business Tax Receipt portion would be heard. The case was heard
on December 19, 2012 and no one appeared. The compliance date and fine was
January 29, 2012, or a fine of $100 a day would be imposed thereafter. The violations
were corrected on July 14, 2014, accruing a fine of $56,100 plus the administrative fees.
The Business Tax Receipt was applied for in 2012 and no inspection was done on the
property because it was vacant at the time and the Business Tax Receipt was no longer
needed. On April 16, 2014, Ms. Springer was contacted for a lien reduction inspection,
and the Respondent had to sod the area in front and to the west of the house and the
property would be eligible for lien reduction. On May 22, 2014, Ms. Springer found the

water bill was under someone else's name other than Dalland Properties and Ms. Jones
confirmed there was a tenant. Ms. Jones obtained the Business Tax Receipt and the
property was in full compliance on July 14, 2014.
Ms. Jones, of Dalland Properties LP, commented she was not aware of the tenant at
the time so they did not have the Business Tax Receipt, but once she was advised of it,
they applied that day and had an inspection the following day. Ms. Jones agreed to
ensure the Business Tax Receipt is renewed each year.
Decision
Based on the testimony of the City and the comments by the Respondent's
representative, Ms. Ellis reduced the fine from $56,000 to $3,000 plus administrative
fees of $634.12.
Case No. 14 -1413 Yolanda Jones

The alarm has a special sensor on one side of the home which acts as a shock

to vibrate.

"The City was requesting that the fines be certified in the following cases.
All the violators have been provided Notice of tonight's hearing, with Proof
of Notice filed in the record with the Board Clerk. At this time, no one is
present this evening for any of the cases I am requesting for certification
at this time. All of the cases have been re- inspected and each case
remains in non - compliance.
The following cases are requested for certification at this time in the
amount established by the Board in the Orders of Violation for each case,
as set forth on the docket ":
