3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, REGARDING THE APPLICATION OF RON ROAN OF
5 HIGH RIDGE HOUSING, LLC., AMENDING ORDINANCE 02 -013
6 TO REZONE A PARCEL OF LAND LOCATED ON THE WEST
SIDE OF HIGH RIDGE ROAD, APPROXIMATELY 0.25 MILES
8 NORTH OF MINER ROAD, AS MORE FULLY DESCRIBED
9 HEREIN, FROM SINGLE AND TWO FAMILY DWELLING
1 DISTRICT (R -2) TO PLANNED UNIT DEVELOPMENT (PUD)
11 WITH MASTER PLAN FOR 184 APARTMENTS, IMAGINE
12 CHARTER SCHOOL AND ATHLETIC FIELDS; PROVIDING FOR
13 CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE.

1 5 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
16 adopted Ordinance No. 02 -013, in which a Revised Zoning Map was adopted for said City;
17 and
1$ WHEREAS, WDDW RESOURCES, LLC., owner of the property located on the
19 west side of High Ridge Road, approximately 0.25 miles north of Miner Road in Boynton

2 0 Beach, Florida, as more particularly described herein, has endorsed a Petition filed by
2 1 applicant Ron Roan of High Ridge Housing, LLC., pursuant to Section 9 of Appendix A-
2 2 . Zoning, of the Code of Ordinances, City of Boynton Beach, Florida, for the purpose of
2 rezoning a parcel of land, said land being more particularly described hereinafter, from Single
2 4 and Two - family Dwelling District (R -2) to Planned Unit Development (PUD) as part of the
2 5 master plan for 184 apartments, imagine charter school and athletic fields; and
2 4 WHEREAS, the City Commission conducted a public hearing and heard testimony
2 and received evidence which the Commission finds supports a rezoning for the property
2 hereinafter described; and

3 WHEREAS, the City Commission finds that the proposed rezoning is consistent with

an amendment to the Land Use which was contemporaneously considered and approved at
2 the public hearing heretofore referenced; and
:3 WHEREAS, the City Commission deems it in the best interests of the inhabitants of
4 said City to amend the aforesaid Revised Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
h THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The foregoing Whereas clauses are true and correct and incorporated

herein by this reference.
• Section 2. The following described land located on the west side of High Ridge
111 Road, approximately 0.25 miles north of Miner Road in Boynton Beach, Florida, as set forth
1 as follows:

TRACT "A ", IMAGINE CHARTER SCHOOL AT BOYNTON BEACH, ACCORDING TO
1 THE PLAT THEREOF, RECORDED IN PLAT BOOK 112, PAGES 186 AND 186 OF THE
1 PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA.

1 SAID LANDS SITUATE IN THE CITY OF BOYNTON BEACH, PALM BEACH COUNTY,
1 FLORIDA
1 CONTAINING 183,902 SQUARE FEET /4.2218 ACRES MORE OR LESS.

2. be and the same is hereby rezoned from Single and Two - Family Dwelling District (R -2) to
2 Planned Unit Development (PUD) as part of the master plan for 184 apartments, imagine
2 A charter school and athletic fields. A location map is attached hereto as Exhibit "A" and made
2 a part of this Ordinance by reference.
23 Section 3. That the aforesaid Revised Zoning Map of the City shall be amended
2 accordingly.
2: Section 4. All ordinances or parts of ordinances in conflict herewith are hereby
2 repealed.

1 Section 5. Should any section or provision of this Ordinance or any portion thereof
' be declared by a court of competent jurisdiction to be invalid, such decision shall not affect
the remainder of this Ordinance.
Section 6. This ordinance shall become effective immediately upon passage.
