3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
4 AMENDING CHAPTER 2 OF THE CITY'S CODE OF
6 ORDINANCES, ENTITLED "ADMINISTRATION ", ARTICLE I, "IN
6 GENERAL ", BY CREATING SECTION 2 -24, TO BE ENTITLED
7 "NON- DISCRIMINATION POLICY "; PROVIDING FOR NON-
DISCRIMINATION IN THE CITY'S HIRING POLICIES AND ALL
OTHER ACTIVITIES PROMOTED OR SPONSORED BY THE CITY
1a OF BOYNTON BEACH; PROVIDING FOR CODIFICATION,
11 ' CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE.

131 WHEREAS, the City of Boynton Beach (the "City ") is an equal opportunity
141 employer; and
15H WHEREAS, the City Commission seeks to codify the City's policy of non -
16 1 discrimination in hiring; and
1 WHEREAS, the City Commission seeks to further ensure a policy of non-
1: discrimination in all activities promoted or sponsored by the City; and
1 • ; WHEREAS, the City Commission finds that codifying a non - discrimination policy is
2' in the best interests of the citizens and residents of the City.
2 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
2• OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:

2 Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed
2 as being true and correct and are hereby made a specific part of this Ordinance upon adoption
2E hereof.

2 Section 2. Chapter 2, entitled "Administration ", Article I, entitled "In General ",
2 ' of the City of Boynton Beach Code of Ordinances is hereby amended by specifically creating
2 Section 2 -24, to be entitled, "Non- Discrimination Policy" to read as follows:

31 fhe City of Boynton Beach shall not discriminate against and person in its
41 hiring, promotion, operation or sponsorship of any activities or programs, or
51 engage in any other discriminatory practice against any person based on race,
6 age. religion, color. gender, gender identity or expression. sexual orientation,
7 national origin. marital status, physical or mental disability. political
8 affiliation or any other unlawful factor.

10 Section 3. It is the intention of the City Commission of the City of Boynton Beach
11 that the provisions of this Ordinance shall become and be made a part of the Code of
12 Ordinances of the City of Boynton Beach, Florida, and that the Sections of this Ordinance
13 may be renumbered, re- lettered and the word "Ordinance" may be changed to "Section,"
14 "Article ", or such other word or phrase in order to accomplish such intention. !
15 I Section 4. If any clause, section, or other part or application of this Ordinance
16 shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such
17 unconstitutional or invalid part or application shall be considered as eliminated and so not
18 affecting the remaining portions or applications remaining in full force and effect.
19 Section 5. All Ordinances or parts of Ordinances, Resolutions or parts of
20 Resolutions in conflict herewith be and the same are hereby repealed to the extent of such
21 conflict.
22 ! Section 6. This Ordinance shall become effective immediately upon its passage and
