MINUTES OF THE REGULAR CITY COMMISSION MEETING HELD IN COMMISSION CHAMBERS, CITY HALL, 100 EAST BOYNTON BEACH BOULEVARD, BOYNTON BEACH, FLORIDA ON TUESDAY, NOVEMBER 5, 2014 AT 6:30 P.M. PRESENT Jerry Taylor, Mayor Lori LaVerriere, City Manager Joseph Casello, Vice Mayor James Cherof, City Attorney David T. Merker, Commissioner Janet Prainito, City Clerk Mack McCray, Commissioner Michael M Fitzpatrick, Commissioner 1. OPENINGS A. Call to Order - Mayor Jerry Taylor B. Invocation by Apostle Tommy Brown with New Disciple Worship Center C. Pledge of Allegiance to the Flag led by Commissioner Mike Fitzpatrick Mayor Taylor called the meeting to order at 6.31 p.m. Apostle Tommy Brown gave the invocation followed by the Pledge of Allegiance to the Flag led by Commissioner Fitzpatrick. D. Agenda Approval: 1. Additions, Deletions, Corrections Mayor Taylor requested to add an item under Announcements to announce a Thanksgiving food drive. Commissioner Merker wanted to add a Future Agenda Item to discuss a process for selecting a candidate for a future Community Redevelopment Agency (CRA) Board vacancy. Vice Mayor Casello requested to pull Item 6.D under Consent Agenda. For informational purposes, Commissioner Fitzpatrick pulled Item 6.B. 2 Adoption Motion Commissioner McCray moved to approve the agenda as amended. Commissioner Merker seconded the motion. Vote The motion passed unanimously. 1 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 2. OTHER A Informational items by Members of the City Commission Commissioner McCray thanked staff for their work on an excellent Pirate Fest event. He had gone to two ribbon cutting ceremonies at the Hyatt Regency Colin Groff, Director of Utilities, was recognized for his quick response to the complaints made by Bernard Wright relating to the standing water around the Rahming Head Start Daycare Center Mr. Groff gave credit to his staff. Commissioner Merker complimented Amy Zimmermann, a CRA staff member, who worked tirelessly to make the Pirate Fest a huge success. Vice Mayor Casello observed many families had taken children to the election polls to teach them civic responsibility It was noted the Community Caring Center's Great Gatsby Gala would be held at Benvenutos and he hope all could attend. Commissioner Fitzpatrick had gone to the League of Cities meeting in Lake Worth, a ceremony at Veterans Park remembering Beirut, a meeting of the Boynton Beach Woman's Club, the Pirate Fest, American Legion meeting and the Mayor's welcoming of the Les Cayes Haiti Sister Cities delegation and the reception. Commissioner Fitzpatrick was concerned with a recent a newspaper article that quoted statements from his fellow Commissioners that were counter - productive to the City. It resulted in eroding his trust and confidence in his fellow Commissioners. The connection of the parcel with Lake Ida Park is supported by residents in Chapel Hill and Golfview Harbour. The change in support of the project, casts doubt on the Commission's ability to make an agreement and keep it and to grasp a great deal. Commissioner Fitzpatrick contended the County Commission had extended a hand of friendship to the City of Boynton Beach The City will continue to be in an austerity mode for years to come and all the existing parks will not be brought up to the highest standard However, it should not be an excuse to spurn the acquisition of additional park lands. The citizens would eventually have access to Lake Ida Park at no expense to the citizens of Boynton Beach. Commissioner Fitzpatrick recalled his idea to create the Kid's Kingdom playground now valued at over $450,000 that was acquired for under $50,000. Half of the value was volunteer labor and private donations together with discretionary funding from two County Commissioners. Mayor Taylor was involved in the project also. Commissioner Fitzpatrick was confident a similar situation would arise with the Lake Ida property. If access cannot be obtained, a flotilla could be launched from Lake Ida Park. While the City of Boynton Beach may have to provide some funding, there are multiple sources for potential funding. NOVEMBER 5, 2014 would lobby their Commission to assist The Metropolitan Planning Organization has re- written their process of allocating funds and local projects will be eligible. There may be federal dollars available also. Private businessmen have offered to raise private donations. Commissioner Fitzpatrick encouraged the Commission to support his idea to acquire the property Commissioner McCray thanked Reverend Wright for his concern about the stormwater around the Head Start Center and for bringing it to the attention of the Commission. 3. ANNOUNCEMENTS, COMMUNITY & SPECIAL EVENTS & PRESENTATIONS A Beginning Thursday, November 6, and lasting from 4 to 6 weeks, the City will be reconstructing the sidewalk entries into City Hall, as well as nearby handicap parking spaces. This project will bring the City into compliance with Americans with Disabilities Act (ADA) current standards for entrances and allow the City to continue to receive grant funds from the Federal Department of Housing and Urban Development (HUD). During construction, there will be no pedestrian access to the two front doors of City Hall. Pedestrians will be guided to the West Wing and Police Department entrances. Temporary handicap parking spaces and ramps will be provided in the City Hall parking lot. The south half of the City Hall parking lot will be available for customers, as well as the east half of the parking lot across the street from City Hall. The utility payment drop box will temporarily be moved across the street Employee parking will be available in the parking garage, the west half of the parking lot across the street from City Hall and at the new parking lot east of the parking garage. Additional phases of the work, such as striping and signage, will require these parking lots to be closed, for a day at a time, during November 27 through November 29 In order to accommodate these ADA requirements, some vegetation will be removed from the front of City Hall. Mayor Taylor explained the project that would be undertaken to bring City Hall in compliance with ADA provisions and the planned changes at City Hall to accommodate the work being done. The second announcement that was added to the agenda, involved the Boynton Beach Caring Center partnering with the City to collect food for Boynton Beach residents. The public was encouraged to drop off any donations to City Hall by November 17 Mayor Taylor thanked those who contribute to the cause. 3 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 4. PUBLIC AUDIENCE INDIVIDUAL SPEAKERS WILL BE LIMITED TO 3 MINUTE PRESENTATIONS (at the discretion of the Chair, this 3 minute allowance may need to be adjusted depending on the level of business coming before the City Commission) Vivian Brooks, Executive Director of the Boynton Beach CRA, commended the City Manager, Police Chief Katz, Risk Administrator, and the Public Works Department for their assistance with the Pirate Fest It was a phenomenal team effort. Mayor Taylor pointed out the next CRA meeting would be held on Wednesday, November 12 Mark Karageorge, 240A Main Boulevard, commemorated the many contributions to the City that had been made by Elliot Williams, a very involved community leader, who had recently passed away. Joyce Harris and two team members, spoke on behalf of the Boynton Heat travel basketball team, about a safety issue in and around Ezell Hester Center There had been two shootings in the parking lot over the past week. Ms. Harris requested additional security for herself and the ten boys on the team One participant advised the Commission the area was not the best environment for children because of smoking, cursing and yelling. Another team member had witnessed many different situations in the parking lot. Mayor Taylor advised the concerns would be brought to the attention of the Police Department. Commissioner McCray pointed out the Boynton Beach Wildcats had escorted the Miami Dolphins onto the field at their last game and the City should be proud of the young men. Herb Suss, 1711 Woodfern, awarded Vice Mayor Casello the designation of Most Valuable Commissioner. Mr. Suss would bring back information from a meeting he would attend relating to the Ebola virus. He was invited to join a climate change organization and would share the data. A short discussion on climate change was offered. No one else coming forward, Mayor Taylor closed public audience 5. ADMINISTRATIVE A Appoint eligible members of the community to serve in vacant positions on City advisory boards. NOVEMBER 5, 2014 Arts Commission: 1 regular and 1 alternate Building Board of Adjustment and Appeals: 1 regular and 1 alternate Cemetery Board: 1 alternate Education & Youth Advisory Board: 1 alternate and 1 student NN Financial Advisory Committee: 4 regulars and 2 alternates Golf Course Advisory Committee 1 alternate Historic Resource Preservation Board: 2 alternates Library Board: 1 alternate There were no applicants for appointment. 6. CONSENT AGENDA Matters in this section of the Agenda are proposed and recommended by the City Manager for "Consent Agenda" approval of the action indicated in each item, with all of the accompanying material to become a part of the Public Record and subject to staff comments. A. PROPOSED RESOLUTION NO. R14 -109 - Assess the cost of nuisance abatement on properties within the City of Boynton Beach B. PROPOSED RESOLUTION NO. R14 -110 - Approve and adopt the 2015 Revised Palm Beach County Local Mitigation Strategy Plan (LMS) for reducing the City's vulnerability to identified natural, technological and societal hazards. Commissioner Fitzpatrick requested further explanation on the Plan. Carisse LeJeune, Assistant City Manager, outlined the request The Plan is updated every five years and the State approved the Plan. Each City had to adopt the Strategy and it would have many benefits. The City would be included in the Risk Hazard Analysis that is done County -wide. Strategies are exposed to deal with a variety of vulnerabilities on an array of topics. The CRS, Community Rating System, could be utilized that is the basis for the need for Flood Insurance. The current rate is seven which allows residents to have a 15% reduction on flood insurance for those required to carry the coverage. Commissioner Fitzpatrick indicated the Ebola virus would be included in the strategies and the City was doing what it could to address the issue and concerns. Motion Commissioner Merker moved to approve Item 6.B. Commissioner McCray seconded the motion. 5 1 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 Vote The motion passed unanimously. C. Approve and authorize the purchase of Dell servers for the I.T.S. Department by piggybacking off of State Contract number 250 - WSCA -10 -ACS in the amount of $29,197.56. D. Approve and authorize the purchase of Dell desktop computers and monitors for various City departments by piggybacking off of State Contract number 250 - WSCA -10 -ACS in the amount of $29,999.75. Vice Mayor Casello inquired about the turnover on computers of the City. John McNally, Director of ITS (Information Technology Systems) indicated his Department was responsible for 300 to 400 computers. The request would replace approximately 55 computers. The amount had been trimmed down due to the economy, but more money was being allocated to assist with improved graphics and more intense applications. The older computers are refreshed and re- distributed throughout the work force. Vice Mayor Casello suggested leasing may be more efficient. Mr. McNally indicated the leasing versus purchase question had been investigated revealing the difference would be minimal. The dollar investment would be very similar. Vice Mayor Casello suggested the leasing would give the City more up -to -date software. The oldest computers are sent to Palm Beach County Surplus who auction off the equipment, returning a minimal portion of the sale price to the City of Boynton Beach. Mr. McNally offered to review the two options and report to the Commission. Ms. LaVerriere noted the software is purchased separately and the operating systems have just recently been updated. Commissioner McCray recalled the lease versus buy strategy had previously been reviewed. Motion Commissioner Merker moved to approve Item 6.D. Commissioner McCray seconded the motion Vote The motion passed unanimously. E Approve the purchase of replacement pumps for the Utility Department from Xylem Water Solutions USA, Inc. for Lift stations 304, 317, 510 and 905 for a total price of $50,125 38 as Xylem is a sole source vendor for these pumps. 6 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 F Approve increase to Purchase Order #140211 issued to Fisher Scientific Company L.L.C.to $26,321.02 utilizing State of Florida Contract #490- 000 -12- ACS which expires December 31, 2014 G. Approve the continuing utilization of the State of Florida Contract for Multifunction Copiers, Service and Supplies with Konica Minolta under contract number 600- 000 -11 -1 for continuing lease agreements and eight new lease agreements for the Police Department. H. Approve the minutes from the Regular City Commission meeting held on October 21, 2014. 7. BIDS AND PURCHASES OVER $100,000 A. PROPOSED RESOLUTION NO. R14 -111 - Approve an annual service agreement with Motorola, Inc. in the amount of $112,571.40 for the continued maintenance and repair of the City's radio telecommunications systems as a sole source vendor and authorize the City Manager to sign the Agreement. Motion Commissioner McCray moved to approve Item 7.A Commissioner Merker seconded the motion. Vote The motion passed unanimously. B. Approve a one -year extension to the "Cooperative Bid to Furnish, Deliver and Discharge Quicklime ", with a 2.31% increase, to Lhoist North America. This product will be ordered on an "As Needed" basis for the period December 16, 2014 through December 15, 2015. The anticipated expenditure for this product for the renewal term is $315,000. Motion Commissioner Fitzpatrick moved to approve Item 7.B. Commissioner McCray seconded the motion. Commissioner McCray inquired, if the cost exceeded $315,000, would the matter be brought back before the Commission for review. Ms LaVerriere confirmed it would be brought back to the Commission Vote 7 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 The motion passed unanimously 8. CODE COMPLIANCE & LEGAL SETTLEMENTS A. Approve negotiated settlements in the amount of $20,000 each (total amount of settlements is $40,000) in the case of Sylvia and Robert Silberberg v. City of Boynton Beach. Motion Commissioner Merker moved to approve Item 8.A. Commissioner McCray seconded the motion. Commissioner McCray related the plaintiffs were originally asking for $100,000 each. Vice Mayor Casello pointed out the default that caused the accident had been fixed. Commissioner Fitzpatrick commended Kevin Ramsey for the fine job. Mayor Taylor added there had been a fall off the stage at the Civic Center that resulted in the lawsuit. Vote The motion passed unanimously. B. Approve negotiated settlement of $40,000 in the case of Ymanne Laurent v. City of Boynton Beach. Motion Commissioner McCray moved to approve Item 8.B. Commissioner Merker seconded the motion. Commissioner McCray emphasized the plaintiff was originally requesting more than three times the settlement figure. The settlements are usually the best way to minimize the expense. Vice Mayor Casello remained concerned with the water leaking in the lobby on rainy days and the use of buckets to collect the water. The problem was being addressed. Mayor Taylor advised a citizen had fallen in the lobby and remarked there were many leaks in the roof. Vote The motion passed unanimously 9. PUBLIC HEARING 7 P.M. OR AS SOON THEREAFTER AS THE AGENDA PERMITS 8 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 The City Commission will conduct these public hearings in its dual capacity as Local Planning Agency and City Commission. A. Notice of Intent 2014 -01 Following Public Hearing the City Commission, by majority vote, shall either approve or disapprove the further processing of the proposed regulation which is the subject of the Notice of Intent NOI 2014 -01, adopted by Resolution R14 -102 established a 365 study period regarding the zoning regulations, Business Tax Receipts and Certificates of Use as they relate to the location, use and operation of the production and distribution of medical marijuana Since the referendum vote on the recent election failed, Mayor Taylor felt the issue was moot Commissioner Merker understood the required percentage of votes was not garnered. He did not feel the issue was moot and it would return on the next ballot in 2016. As long as there is no cost involved the City should move forward with its efforts to be prepared Mayor Taylor replied the moratorium was simply to put any applications or requests on hold to see what the State regulations would mandate. It would be impossible to move forward when there are no regulations to assess He reiterated his view that the current request be removed from the agenda Motion Vice Mayor Casello moved to remove Item 9.A from consideration Commissioner McCray seconded the motion Commissioner McCray noted if employee time was utilized there would be a cost Vote The motion passed 4 -1 (Commissioner Merker dissenting). 10. CITY MANAGER'S REPORT A Discussion of Red Light Camera Program. Mayor Taylor disclosed he had met with Greg Parks from American Traffic Solutions (ATS) to discuss the issue Assistant City Attorney Shana Bridgeman advised there was a recent Court ruling that is not final. The City can proceed with the program because there is no order in place 9 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 The Police Department is continuing to issue notice of violations and citations for red light camera violations. Attorney Cherof added the City's procedure to issue a citation is distinguishable from other cities and any opinion offered would not be binding on the City of Boynton Beach. The recommendation was to stay the course while the appeal progressed through the legal system. Updates would be distributed. There have been class action, federal cases and the City of Boynton Beach is named in one and possibly two of those cases. The papers have not been served on the City and, if served, a close -door session would be held to discuss the matter Mayor Taylor disclosed he had met with the City Attorney and discussed the matter and the recent case. Newspapers assert that many cities have curtailed their red Tight program, but only Palm Beach County has done so because their contract had expired. Data gathered revealed crashes have decreased 55% at monitored intersections and there have been zero fatalities. The violations have decreased 60% per install light camera installation. Statistics indicate 90% of those ticketed do not get a second ticket. Non- residents received 63% of the tickets Out of five cities, Boynton Beach has the highest percentage of violations at 37% with Delray second at 15% Mayor Taylor favored continuing the program There is a contract in effect until 2016 that would require monthly payments through the end date. Commissioner Merker contended the key element was safety and should come first. Vice Mayor Casello asked for the sequence of events and process after a picture is taken of a violation Attorney Bridgeman explained ATS has a two -step verification process beginning with the data being captured, transmitted electronically to Arizona where an ATS employee reviews the information and pulls the vehicle information from the State database. The employee then reviews the business rules questionnaire to confirm there is a violation as instructed by the City of Boynton Beach to evaluate. A second ATS employee again reviews the violations and determines if a violation occurred based on the Boynton Beach business rules questionnaire. If a violation has occurred, the information is sent back to the City and the police officers determine whether a violation occurred and either accepts or rejects the violation. Many violations are rejected and some lead to the notice of violation and later on a Uniform Traffic Citation. Vice Mayor Casello wanted a breakdown of the pay structure. Ms LaVerriere responded the red light ticket cost $158, the State gets $83 and City retains the $75 balance. Attorney Bridgeman added the vendor rate is $4,850 or $72,900 a month in lease payments for 15 cameras Ms. LaVerriere advised the traffic safety fund pays for three staff members, lease payments to ATS and the Special Magistrate expense. The 10 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 revenues were anticipated at $1,058,500 and the expenses almost equal the revenues. The City is not gaining additional revenue and there is no cost at this time. The accidents in the City have reduced. If the cost exceeds the revenue, the program would have to be re- assessed. The program has changed driver behavior. The number of cases requesting hearings had tapered down and not as many tickets were being issued. The contract would be reviewed in May of 2016. Attorney Cherof recommended six months in advance of the contract ending, the program should be revisited. He emphasized the program was designed as a safety program. There was consensus to maintain the status quo. B. In observance of the Jewish holiday of Hanukkah, which begins at sundown on Tuesday, Decemberl6, 2014, consider moving the second City Commission meeting in December to Monday, December 15, 2014 at 6:30 p m. in Commission Chambers. Motion Commissioner Merker moved to change the City Commission meeting date to Monday, December 15. Commissioner McCray seconded the motion. Vote The motion passed unanimously. 11. UNFINISHED BUSINESS - None 12. NEW BUSINESS - None 13. LEGAL A. PROPOSED ORDINANCE NO. 14 -013 - SECOND READING - PUBLIC HEARING - Approve High Ridge Landing PUD rezoning (REZN 14 -002) from a PUD (Planned Unit Development) with the Master Plan for 110 single - family homes, to a PUD to be combined with adjacent property to the north, establishing a Master Plan consisting of 184 apartments, the Imagine Charter School and athletic fields, located at the NW corner of High Ridge Road and Miner Road. Applicant: Ron Roan, High Ridge Housing, LLC. (TABLED TO 11/5/14) 11 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 B. PROPOSED ORDINANCE NO. 14 -014 - SECOND READING - PUBLIC HEARING - Approve High Ridge Landing PUD rezoning (REZN 14 -002) from R -2 (Single and Two - Family Residential District) to a PUD to be combined with adjacent property to the south establishing a new Master Plan consisting of 184 apartments, the Imagine Charter School and athletic fields, located at the NW corner of High Ridge Road and Minor Road. Applicant: Ron Roan, High Ridge Housing, LLC. (TABLED TO 11/5/14) C. Approve a Major Site Plan Modification (MSPM 14 -002) to allow construction of 184 mufti-family rental units (High Ridge Landing) consisting of eight (8) two- and three -story apartment buildings, amenity area, and related site improvements at the northwest corner of High Ridge Road and Miner Road, on 8 44 acres within a PUD (Planned Unit Development) zoning district. Applicant: Ron Roan of High Ridge Housing, LLC. (TABLED TO 11/5/14) Motion Commissioner McCray moved to remove Items 13 A, B and C from the table. Commissioner Merker seconded the motion. Vote The motion passed 3 -2 (Vice Mayor Casello and Commissioner Fitzpatrick dissenting). Attorney Cherof explained the two Ordinances were related. The applicant agreed to consolidate Items 13 A, B and C for hearing. Attorney Cherof administered an oath to all those intending to testify. Proposed Ordinances No. 14 -013 and 14 -014 was read by title only, on second reading by Attorney Cherof. The applicant was available to answer any questions. Mayor Taylor opened the issue for public comment and no one came forward. Motion Commissioner McCray moved to approve Item 13.A. Commissioner Merker seconded the motion. Vice Mayor Casello hoped the Commission would reconsider their first vote on the matter The development would bring many problems into the community including safety and overcrowding. He urged the Commission to respect his views as it was in his District and he knew the problems that would create. The 184 rental units would not fit in the parcel of land that now includes a parcel with a charter school and over 1,000 students. This is the wrong location for the type of development He reiterated his requested that the Commission vote no. Vote City Clerk Prainito called the roll. The vote was 3 -2 (Vice Mayor Casello and Commissioner Fitzpatrick dissenting). Motion Commissioner McCray moved to approve Ordinance 14 -014. Commissioner Fitzpatrick seconded the motion. Mayor Taylor opened the issue for public hearing. Motion Commissioner McCray moved to approve the Major Site Plan Modification and improvements. Commissioner Merker seconded the motion. (1) PROPOSED ORDINANCE NO. 14 -029 - FIRST READING - Approve addition of Non - Discrimination Policy Attorney Cherof read Proposed Ordinance No. 14 -029 by title only on first reading. Motion Vice Mayor Casello moved to approve Ordinance No. 14 -029. Commissioner Merker seconded the motion 13 MEETING MINUTES REGULAR CITY COMMISSION BOYNTON BEACH, FL. NOVEMBER 5, 2014 Mayor Taylor asked how the Ordinance differed from the current policy on non- discrimination Attorney Cherof replied it is not included in the Code of Ordinances and the request would do so. It was previously an administrative policy only Mayor Taylor opened the issue for public hearing and no one came forward. Vote City Clerk Prainito called the roll. The vote was 5 -0. (2) PROPOSED ORDINANCE NO. 14 -030 - FIRST READING - Approve addition of The Boynton Beach Domestic Partnership Act. Attorney Cherof read Proposed Ordinance No. 14 -030 by title only, on first reading. Motion Commissioner Merker moved to approve Ordinance No. 14 -030. Commissioner McCray seconded the motion. Mayor Taylor asked how the Ordinance differed from the current policy Attorney Cherof replied it is not stated in the Code of Ordinances or an administrative policy. It expands the class of domestic partners to the same type of benefits City employees have for spouses and other dependents. Commissioner Merker asserted it was needed and all people should be treated equally. Mayor Taylor felt it was directed at those who live together and are not married, including same sex couples He opposed the concept. Mayor Taylor opened the issue for public hearing and no one came forward. Vote City Clerk Prainito called the roll The vote was 4 -1 (Mayor Taylor dissenting). 14. FUTURE AGENDA ITEMS A. DEPARTMENTS INCLUDE REJECT ENGINEERING / PUBLIC WORKS / FORESTRY / UTILITIES Comments: 1. At time of permitting, submit an irrigation plan for review and approval. Landscaping must meet the Engineering Design Manual Standards P -13 and K -8 for sight triangle and there shall be unobstructed cross visibility at a level between 2.5 feet and 8 feet \ above the pavement. (2010 LDR, Chapter 4, Article II, Section 4.A.12.f.) FIRE Comments: None (All previous comments have been addressed). POLICE Comments: None (All previous comments have been addressed). BUILDING DIVISION Comments: 2. Note that changes or revisions to these plans may generate additional comments. Acceptance of these plans during the DART (Development Application Review Team) process does not ensure that additional comments may not be generated by the commission and at permit review. 3. At time of permit review, submit signed and sealed working drawings of the proposed construction. i 4. Buildings, structures and parts thereof shall be designed to withstand the minimum wind loads of 170 mph. At the time of permit review, submit details of reinforcement of walls for the future installation of grab bars as required by the FFHA, Title 24 CFR, Part 100.205, Section 3, Requirement #6. All bathrooms within the covered dwelling unit shall comply. 6. Identify within the site data the finish floor elevation (lowest floor elevation) that is proposed for the building. Verify that the proposed elevation is in compliance with regulations of the code by adding specifications to the site data that address the following issues: a. The design professional -of- record for the project shall add the following text to the site data. "The proposed finish floor elevation _ NGVD is above the highest 100 -year base flood elevation applicable to the building site, as determined by the SFWMD's surface water management construction development regulations." b. From the FIRM map, identify in the site data the title of the flood zone that the building is located within. Where applicable, specify the base flood elevation. If there is no base flood elevation, indicate that on the plans. c. Identify the floor elevation that the design professional has established for the building within the footprint of the building that is shown on the drawings titled site plan, floor plan and paving /drainage (civil plans). 7. A water -use permit from SFWMD is required for an irrigation system that utilizes water from a well or body of water as its source. A copy of the permit shall be submitted at the time of permit application, F.S. 373.216. 8. Pursuant to approval by the City Commission and all other outside agencies, the plans for this project must be submitted to the Building Division for review at the time of permit application submittal. The plans must incorporate all the conditions of approval as listed in the development order and approved by the City Commission. 9. All areas of the recreation /leasing center shall comply with the Federal Fair Housing Act. 10. The east wall of building #2 and the west wall of building #1 shall be of fire rated construction. The full address of the project shall be submitted with the construction documents at the time of permit application submittal. The impact fee per dwelling for a multi - family (dwellings in buildings containing 5 or more units) project is $595 per unit. Therefore, the impact fee for this project is $109,480 (184 x $595). PLANNING & ZONING Comments: 13. Approval of this project is contingent upon the approval of the accompanying request for rezoning (REZN 14 -002). 14. A re -plat of the subject property shall be required prior to permitting. �1 15. The parking deficiency on plans shall require the addition of spaces to address deficiency, a code revision, or a variance to the current regulations concurrent with or prior to site plan approval. 16. At time of permitting, revise rear garage elevation (sheet A2.01 G) to include architectural enhancements that do not replicate garage doors in compliance with the design standards of the Land �l Development Regulations and for contribution to project appearance visible from streets and access road. 20. At time of permitting, revise landscape plans to replace sod with groundcovers or other plants except where used for play areas or otherwise where residents have access for recreational purposes. If the areas labeled Active Rec /Sod Areas to the rear of Buildings 1, 2, 4, and 6 remain sodded, the plans shall be revised to indicate relocation of landscaping to provide pedestrian accessibility to these areas for all residents of the development for recreational purposes, and include continuous walking paths and signage as dog walk areas. 21. Indicate all existing and proposed utility lines and easements, their purposes and widths, on all plans. 22. The applicant shall coordinate with the property owner of the adjacent sports field to ensure that their respective site plans indicate the correct location of the pedestrian gate proposed near Building #8, �I leading to the sports field. 23. At time of permitting, revise plans Ito include a detail of perimeter fence with brick columns and gates (man gates, sliding gates, etc). Indicate height, type, materials, and colors on each detail. 24. At time of permitting, revise all plans to match the revised parking layout showing spaces for motorcycles, compact cars, and spaces for charging of electric vehicles, dispersed throughout the development. • • High Ridge Landing (MSPM 14 -002) Conditions of Approval Page 5 of 7 DEPARTMENTS INCLUDE REJECT 25. At time of permitting, revise site plan to provide the minimum number I of required pedestrian amenities. All bike racks shall be covered, and to the maximum extent feasible, trash receptacles shall include �l ashtrays and be located near other pedestrian amenities. 26. At time of permitting, revise photometrics plan to include an elevation drawing of a typical freestanding outdoor lighting pole (indicating height from grade to top). The typical drawing of the freestanding outdoor lighting poles must include the color and materials. 27. At time of permitting, revise photometrics plan to include the following notes: The design, style, and illumination level shall be compatible with the building design (height) and shall consider safety, function, and aesthetic value. A minimum average Tight level of one (1) foot candle shall be provided, with no more than 10% of the spot readings below one (1) foot candle and none below '/ foot candle. Lighting shall not be of an intensity that produces glare on adjacent property. Feature lighting emphasizing plants, trees, barriers, entrances, and exits is encouraged. 28. At time of permitting, revise plans to ensure that the locations of all freestanding light poles are consistent on each sheet and that they are not too close to landscaping when it becomes mature. 29. At time of permitting, revise site plan and landscape plan to dimension width of perimeter buffers. 30. At time of permitting, revise Landscape Details sheet so that plant list and landscape notes are on right side of page (not legible due to stapled set). 31. At time of permitting, revise landscape plan to include the amount of pervious and impervious area (in square feet and percent of site). 32. At time of permitting, revise landscape plan plant list to include sod if sod is proposed. Staff recommends further elimination of any small sod areas to reduce irrigation demand, substituting hardy groundcovers and shrubs in place of sod. 33. At time of permitting, revise landscape plan to note proposed method of irrigation. At time of permitting, revise landscape plan (sheet 1) to correct corner conflict between sidewalk and landscaping at Miner Road pedestrian entrance. 38. At time of permitting, revise plans to indicate all parking spaces designed for motorcycles, scooters, mopeds, etc. as covered parking spaces. 39. At time of permitting, revise plans to indicate a decorative paver pedestrian crosswalk in front of the trash compactor to provide continuous pedestrian connectivity to sidewalks. 40.
