LEVYING SPECIAL ASSESSA{E~TS AGAINSTPROPERTY BENE-
FITED BY A CERTAIN STREE~ I~ROVEMENT PROJECT WITHIN
THE SAID CITY, TO-WIT: CONSTRUCTION OF APPROX!~3~THLY
1,306.07 FEET OF ROADWAY ON S. E. 3RD STREET, BETWEEN
S. E. 21ST AVENUE AND S. E. 23RD AVENUE, RECITING BY
WHAT METHOD SAID SPECIAL ASSESSMENT ~I~ ~ADE AND T~

METHOD OF COLLECTION THEREOF, AND FOR OTHER PURPOSES.
WHEREAS, pursuant to the provisions of Section 160 of the
Charter~of the CITY OF BO~TON BEACH, FLORIDA, the City has here-
tofore caused a certain public street to be constructed over the
property more particularly described as: CONSTRUCTION OF APPROX-
I~4ATELY 1,306.07 FEET OF ROADWAY ON S. E. 3_RD STREET, BET~EN, S.
E. 21ST AVENUE AND S. E. 23RD AVENUE, and
WHEREAS, the City Clerk has heretofore compiled ~n assessmen.
roll showing the lots and land assessed to pay the cost %hereof i~
connection with subject improvement, and the amoun~ of assessment
as to each such lot or land, which said ro~l has heretofore been
approved by the City Council; and
~EREAS, proper legal notice of the approval of said roll ha~
been given and a public hearing held relative thereto, at which
time no objections were made, or if objections were made, same
were deemed insufficient by the City Council;
NOW, THEREFORE, BY IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That the special assessment roll covering the
above-described project, a true copy of which ms attached hereto
and hereby made ~ part thereof and marked Exhibit A, is hereby
ratified, approved and confirmed, and the_amounms indicated for
each lot oz parcel described therein are hereby levied against
sa~e as a special improvement and same shall constitute liens
against said land as of the effective date of this Ordinance, each
of said parcels along subject improvemenn having been assessed on
a fron5 footage basis, chargmng each parcel its proportionate
share by dividing its respective f~Ont~ footage into the total
improvement cost.
Section 2: Each property owner shall have the privilege of
paying the entire assessment as to his property within ninety (90)
days from the attachment of said improvemen~ lien without penalty
If any owner fails to pay said lien within said ninety (90) day
period, it shall be paid in three consecutive equal installments,
payable as other ad valorem taxes are paid, commencing with the
year 1977, together with interest at the rate of 8% per annum, fro~
the date of attachment of said lien on the unpaid balance thereof
Section 3: Each of the provisions of this Ordinance are
separabls, including %~rd, clause, phrase, or sentence, and if an
portion hereof shall be declared invalid, the remaining portion
shall net be affected, but shall remain in full force and effect.
Secti'on 4: Repealing Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed~
Sect'ion 5: Effective Date: .This Ordinance shall become
effective in the manner and at the time provided in the Charter
and Ordinances of the City of Boynton Beach, Florida.
