Minutes 12-17-14 MINUTES OF THE CODE COMPLIANCE/LIEN REDUCTION HEARINGS HELD IN COMMISSION CHAMBERS, CITY HALL, 100 E. BOYNTON BEACH BLVD. BOYNTON BEACH, FLORIDA, ON WEDNESDAY, DECEMBER 17, 2014, AT 9 A.M. PRESENT: Carol Dutra Ellis, Special Magistrate Diane Springer, Code Compliance Coordinator ® Call To Order Ms. Ellis, Special Magistrate, called the meeting to order at 9:02 a.m. She explained her role in the hearings and the hearing procedures. Pursuant to Florida Statute, all Orders are appealable to the Circuit Court in Florida and not the City Commission. She explained a fine would be imposed if the violation was not corrected by the deadline. 111. Approval of Minutes of October 15, 2014 The following corrections were noted: • Page 16, the Respondent is AU M Properties LLC • Page 22, Case 14-1675, the fine should be $200 a day • Page 23, Case 14-1771, the spelling of Respondent's name is Elizabeth Gable Est. • Page 26, Case No. 14-1993, the compliance date is October 30, 2014 • Page 28, Case 14-1553, the fine should be $300 a day Decision Ms. Ellis approved the minutes with the changes submitted by staff. ® Approval of Agenda Vestiguerne Pierre, Senior Code Compliance Officer, announced the following changes to the agenda: Case Nos: 14-2325 and 14-2425 complied. Case No. 14-2335 was removed. Case Nos. 14-792, 14-2345, and 14-1267 were tabled to the January 21, 2015, meeting. Meeting Minutes Code Compliance Board Boynton Beach, Florida December 17, 2014 Decision Ms. Ellis approved the agenda with the changes as cited by staff. I. Swearing in of Witnesses and Introduction The Minutes Specialist administered an oath to all those intending to testify. V. New business A. Cases to be Heard (Respondents Present) Case No. 14-2433 Jaquarius, Jar r, Jarnmel & Nathaniel A. Shelton Property Address: 1614 N. Seacrest Blvd. Violation(s): CO CH4 SEC 4-4, 4-32, 4-36, & 4, 37 No tethering. Dogs must be humanely secured to owner's property at all times or on a leash when off the property. Each dog must have a current tag and registration. Proof of rabies vaccination must be submitted. Liz Roehrich, Animal Control Inspector, reviewed the case for the above violations. Service was sent by certified mail on November 10, 2014, and the green card was signed and returned on November 18 but was undated. The City was requesting a Cease and Desist Order. This had been an ongoing issue including a dog bite in July. The owner refused to quarantine the dog and was issued multiple citations, which he ripped up when cited. The City was able to quarantine the dog, but the owner did not redeem the dog and has other dogs. A dog was observed tethered in the front yard. Officer Roehrich had photos she presented to Ms. Ellis. There are multiple siblings that live at the premises and it is difficult to determine who owns which dog. There was no one present at the hearing to respond. Officer Roehrich recommended a $1,000 fine for the Cease and Desist Order and a one-day compliance date. Decision Given the testimony by the City and seeing no one in the audience to respond, Ms. Ellis ordered the Cease and Desist Order with a $1,000 fine per occurrence, and a one-day compliance date. Case No. 14-2376 Yachtsman Properties LL C — Fast Lane Food 2 Meeting Minutes Code Compliance Board Boynton Beach, Florida December 17, 2014 Property Address: 1600 N. Federal Highway Violation(s): CO CH2 SEC 2.5 — 12 + 13 Excessive false alarms and service fees. Pete Roy, Chief Code and Rehabilitation Officer, reviewed the case for the above captioned violation, which was a referral from the Police Department. The initial inspection date was October 17, 2014. Written notice was sent October 17, 2014, giving 15 days to correct the violation. Certified mail was sent on November 17, 2014, and the green card was signed on November 27, 2014. An invoice for $6,450.00 has not been paid. Staff recommended a 10 -day compliance date of December 27, 2014, or a fine of $50 a day be imposed thereafter. Fred Bertrand, owner of Fast Lane Food and Beverages, explained a representative from the alarm company was supposed to be present, but could not make the meeting. He requested rescheduling the case. When they were contacted about the alarms, they contacted the alarm company and they determined the batteries were bad. They changed the batteries in September. They received an invoice which they gave to the City. When the City contacted them, the alarm company stated the battery was disconnected instead of bad batteries. When he questioned the alarm company about it, the representative indicated he confused the issue. Bad batteries caused the false alarm. Mr. Bertrand explained he is the only employee at the store. All of the 11 false alarms occurred in September, but the Fire and Police Departments responded each time. Mr. Bertrand had an invoice from the company showing they came out and fixed the matter. Decision Since Mr. Bertrand indicated he had a witness from the alarm company, Ms. Ellis thought it was important they speak. She tabled the case to the next month's meeting to give his witness the opportunity to speak and explained if he does not attend, she will impose a fine. Case No. 14-2400 Charles R. Herring Sr. Property Address: CO CH15 SEC 15-120(D) INC. Violation(s): Remove all outside storage from property, including unregistered and inoperable vehicles, appliances, tubs and junk. Courtney Cain, Code Compliance Officer, reviewed the case. An initial inspection on October 23, 2014, revealed the above captioned violations. The Respondent was a repeat violator. Written notice was sent giving 14 days to correct the violation. Notice 3 Meeting Minutes Code Compliance or Boynton Beach, Florida December 17, 2014 was effectuated by certified mail, green card signed on December 1, 2014. The property was last inspected on December, 16, 2014. Charles Herrin the owner, explained he thought the letter was for his son who was using his address. The second letter he received was a registered letter which specified it was for Charles Herring Sr. He advised he had been sick and he had never got a chance to speak to the Code Officer. He thought he complied and removed the tubs and junk. He then realized he had not complied and requested an extension to avoid the fine. If possible, he requested 15 or 30 days to comply. Officer Cain had photographs he showed to the Respondent and Ms. Ellis. It was noted Mr. Herring, Sr. resides at the address. Officer Cain recommended, due to the upcoming holidays, a compliance deadline of 60 days or a fine of $100 a day. Decision Ms. Ellis ordered a 45-day compliance date due to the Respondent being a repeat violator. She explained after 45 days, a fine of $100 a day would begin to accrue. Mr. Herring explained he refurbishes old cars. He was in the process of selling them. One vehicle was not registered. Ms. Ellis recommended working with City staff. Case No. 14-1617 Bentley Partners LLC Property Address: 2105 NE 3 rd Street Violation(s): CO CH13 SEC13-16 CO CH15 SEC 15-120(D) INC CO CH 15 SEC 15-120(D) I B Apply for and pass inspection for Business Tax Receipt for your rental property. Mow, weed and trim overgrowth and tree along NE 20 Avenue to a minimum height of 14 feet over the road and 10 feet over the right of-way/swale. Remove outside stored materials, trash and debris. Glenn Weixler, Code Compliance Officer, advised the case complied. Case No. 05-1145 BG Meadows Square 4707 N. Congress Avenue Diane Springer, Code Compliance Coordinator, reported the Notice of Violation was sent on June 9, 2005, to replace missing trees and shrubs per the site plan, repair potholes in the parking lot and repair the fence. The case was heard on October 19, 2005, and no one appeared. The compliance date and fine set by the Board was 4 Meeting Minutes Code Compliance or Boynton Beach, Florida December 17, 2014 November 18, 2005, or a fine of $50 would be imposed thereafter. The violations were corrected on November 17, 2014, accruing a fine of $164,250, plus administrative fees. Ms. Springer was first contacted in October, and pointed out there were past water bills in the amount of $12,588.78 from a prior tenant that had to be paid. The property was in a plaza. Ms. Springer found six businesses operating without Business Tax Receipts. One unit made interior renovations without a permit and there were two permits that had never been finalized. There were repairs needed. Ms. Springer noted there were two parcel control numbers needed: one for the gas station and convenience store, and the other for the entire plaza. Ms. Springer noted what she presented applied to both locations. All the repairs were made in a month. She commented most of the damage was due to hurricanes. The plaza was previously maintained. Trees and bushes were missing Trevor Joseph, Property Manager, explained he started managing the property in March. He learned of the violations and liens at the end of September from the corporate office. They worked hard and had been in contact with Ms. Springer. Over $100,000 was spent to restore the landscaping to Code and $10,000 to $15,000 for the additional repairs. Ms. Ellis inquired why it took so long to address the issues. Mr. Joseph explained there were multiple property managers and some were not located in the area. He had not received any notification about the issue after the lien was filed, and he learned of it in September. Decision Given the testimony by the City and the Respondent's presentation, Ms. Ellis reduced the lien to $2,000, plus $922.21 in administrative costs. Case No. 06-2033 BG Meadows Square 4719 N. Congress Avenue Ms. Springer explained the Notice of Violation was sent on August 3, 2006, to repair the ceiling over the gas pump, weed and install grass around the service station area, clean the entire area and maintain the property. The case was heard on May 16, 2007, and no one appeared. The compliance date and fine set was May 26, 2007, or a fine of $250 a day would be incurred thereafter. The violations were corrected on October 16, 2007, accruing a fine of $35,500, plus administrative costs. Mr. Joseph commented the violations were corrected before he started to manage the property. 5 Meeting Minutes Code Compliance or Boynton Beach, Florida December 17, 2014 Decision Ms. Ellis ordered the lien be reduced to $1,000, plus the $922.21 in administrative costs. Case No. 14-1916 Claudio Cid Property Address: 3501 N. Old Dixie Highway Violation(s): CO CH13 SEC 13-16 CO CH15 SEC 15-120(D) INC BBA FBC 2010 ED 105.1 Apply for and pass Business Tax Receipt inspection for your rental property. Remove unregistered and inoperable recreational vehicles. Mow and trim overgrowth. Fence permit required. The Minutes Specialist administered an oath to the Respondent. Officer Pierre advised the case arose from a routine inspection which revealed the above violations. He advised the Respondent was present. Leo Cid, on behalf of his brother, Claudio Cid, announced he got the application for the Business Tax Receipt and had to schedule the inspection. Officer Pierre recommended 15 days and $100 a day fine thereafter if not corrected. He commented some vehicles were removed. He had photographs he showed to the Respondent and Ms. Ellis. Decision Ms. Ellis ordered a 15-day compliance date, and if not corrected by then, a $100 a day fine would accrue thereafter. Case No. 14-1934 Claudio Cid Property Address: Sunset Road Violation(s): CO CH15 SEC 15-120(D) INC CO CH 10 SEC 10-52 BBA FBC 2010 ED 105.1 Remove unregistered inoperable recreational vehicles from your lot. Mow and trim overgrown yard areas. Remove Debris. Obtain permit for fence. Permit required. 6 Meeting Minutes Code Compliance Board Boynton Beach, Florida December 17, 2014 Officer Pierre presented the case as contained in the Notice of Violation. He advised the subject property is a vacant lot behind the house. Leo Cid, on behalf of his brother, Claudio Cid advised he got the permit for the fence, and they removed other items and would finish up. Officer Pierre recommended 10 days to remove the rest of the violation. Decision Ms. Ellis ordered a 10-day compliance date and a fine of $100 a day thereafter. Case No. 14-2218 Stellar Homes Group LLC Property Address: 2560 SW 14 Street Violation(s): BBA FBC 2010 ED 105.1 Permit required by Building Department for new pool fence and gate. Final inspections for open permits for air conditioning and interior remodeling needed. Luny Guillaume, Code Compliance Officer, reviewed the case arose from a routine inspection on September 25, 2014. The above captioned violations were found. Lei a Boggs, authorized agent from the company which manages the property, inquired if this was the first violation for this address. They had just hired a new general contractor for the Palm Beach area who was working on obtaining the permits. She requested more time. Decision Ms. Ellis gave a five-day compliance deadline of December 22, 2014, to come into compliance, and if not complied by then, a $500 a day fine would begin to accrue. Case No. 14-2449 Beauly LLC Property Address: 3070 SE 1 st Place Violation(s): CO CH13 SEC 13-16 CO CH20 SEC 20-6 Boat must be parked on a hard surface. Apply for and pass Business Tax Receipt inspection for rental property. Officer Pierre explained the case arose from a citizen complaint. 7 Meeting Minutes Code Compliance or Boynton Beach, Florida December 17, 2014 Lei oggs explained the boat was removed and she offered photographs as proof. As for the Business Tax Receipt, she had to communicate with the current tenants regarding the inspection. Decision Ms. Ellis ordered a five-day compliance deadline to apply for the Business Tax Receipt, or a $500 a day fine would be imposed thereafter. Case No. 14-1427 Fetlar LLC Address: 8052 Stirrup Cay Ct. Violation(s): CO CH13 SEC 13-16 Apply for and pass Business Tax Receipt inspection for your rental property. Officer Guillaume reviewed the case. A Notice of Violation was sent June 12, 2014, for the above captioned violation. The case was heard on August 20, 2014. The violations were corrected on October 31, 2014, but there was 66 days of non-compliance and the fine needed to be certified The administrative fees were $730.15 He explained to Ms. Boggs there was a fine accruing, and the fine was ready to become a lien on the property. Officer Guillaume explained the Respondents can apply for a reduction to get the lien reduced. Decision Ms. Ellis certified the existing fine. Case No. 14-1917 Fetlar LLC Property Address: 146 SE 27 Way Violation(s): CO CH13 SEC 13-16 Apply for and pass Business Tax Receipt inspection for your rental property. Mow and trim overgrown yard. Officer Pierre reviewed the case. The Notice of Violation was sent on August 14, 2014, for the above violations. The case was heard on September 15, 2014. The compliance date and fine set was to correct the violations by October 25, 2014, or a fine of $500 a day would be imposed thereafter. There were 52 days of non-compliance and the violations were not corrected. Ms. Ellis explained the case was now in the lien penalty certification process. This and the prior cases already had a hearing and a fine and deadline had already been imposed. 8 Meeting Minutes Code Compliance or Boynton Beach, Florida December 17, 2014 Lela Boggs explained she had advised the company in previous cases, it was easier to obtain a Business Tax Receipt when the property was vacant. The company would schedule the inspection as soon as possible. Decision Ms. Ellis certified the lien and explained when the violations were corrected, Ms. Boggs could apply for a lien reduction. Case No. 14-1674 Stellar Homes Property Address: 7205 Chesapeake Circle Violation(s): BBA FBC 2010 ED 105.1 Permits required for remodeling. Four times fee will be applied. Plumbing, electrical, mechanical and building permits required. Officer Shickles announced the case complied, and he recommended no fine. The subject property was a vacant house and the Respondent had all the permits. The original fine set was $100 a day and there was 27 days of non-compliance. Decision Ms. Ellis ordered the recommendation of the City. Case o.1 -2391 Otto Alexander Bendien Property Address: 1851 Via Granada Violation(s): CO CH2.5 SEC 2.5+12+13 Excess false alarms and service fee. Officer Roy presented the case as contained in the Notice of Violation. Service was obtained by certified mail on November 18, 2014, and the green card was signed on November 24, 2014. Staff recommended a 10-day compliance deadline of December 27, 2014, or a $50 a day fine would be imposed thereafter.
