Robert Beyrer, was recognized as representing Sterling Village Senior Citizens. M~N-dTES - Regular Meeting October 20~ 1969 & Continued Meeting October 21, 1969. Minutes of the October 20th meeting and October 21st continuation of this meeting approved 5-0. Councilman Nylund made the motion which was seconded by Councilman Michael. PUBLIC AUDIENCE Col. albert Weh~ell, Boynton Isles - complained about conflict of inter- est and the garbage contract being pivento private concern. He stated he had defended our country in three wars and he didn't feel the end ever justifies the means. Me recalled Hitler used this technique. He felt this so-called gold mine will be salted. He felt the moral decay in the country goes down to council level and he regretted seeing this country go down by the apathy of most people. Harry LeForte - Coquina Cove, said he believed in living up to City OrdiD~nces and under Section 8-20 he indicated he would file charges against the Mayor in the coming campaign~ and tell people why he should not be re-elected. Robert ~Beyrer, Sterling Village, referred to his appearance before Coun- oil at last regular meeting were his o%wa views and not those of his organization that he~ometimes ~epresents before council. He said he could not condone conflict of interest. However, inasmuch as council was acting on the recommendation of the zoning beard with reference to Leisureville - he ~elt if councilmen were paid a living we. ge it would be different but under the circumstances he re-stated his position that he did not expect a member of council paid $1200. to be denied the right to do businsss. Bill Edeli, Ocean Ridge resident, requested Council to consider the pro- gram neighboring cities have in regard to examination of eyes, which would indicate if leukemia is present. He felt council was~oing a good job with L~isu~eville. Emily Jackson, 728 N.E. 9th ?venue. She indicated she thought city should charge $2.00 and see if it can't get out of the red and keep the best city service we now have. Eddie Mitchell~ 329 N.E. i2th Ave. - In a paragraph of MayorTs letter to Mitchell h~, made inquiry why the hiring of blacks in City Hall had to be turne~ver tO C~ty t~t.t?rney~ since there is a civil ~ervice beard. He asked i~ the~e was a dlfferent set of ~ules fo~ blacks. BIDS A. OPENING - One Psssen~er ElevatOr Mayor called for receiving of bids for passenger elevator for City Hall. ~o Michael moved that receiving of bids be closed. Motion seconded by Mr. Summers and motion c~rried 5-0. No one was in audience in regard to Opening of Bids. There was only one bid. P~BLIC .AHDIENCE - Continued Mayor ~allo replied to Eddie Mitchell's inquiry that he had asked the City ~ttorney if the Civil Se~viee test had to be a written test~ or if they could inTe~iew individuals making application for the job through Personnel Director. Rev. Lee, 407 N.W. 9th Bvenue - Ma~e inquiry if the resolutio~ discussed last Thursday %~utd be on The agenda and he was advised it would come under ~Oth'er~ on the agenda, Rev. WhiTe~ 152 N.E. 12th Avenue~ asked about resurfacing and repaving of streets. Mayor said they were in controversy with the contractor. City Attorney advised that there is a limitation under the terms of the contTact. The o~.~er of Boynton Taxi~ said they would take To The poils: free charge~ anyone that did not have transportation, William H. Miller~ 1212 N.W. 1st Street~ complained about the streets in his section of the city were ~rse, and in deplorable condition: Than any place in Palm Beach County. He felt the filling of gravel in holes was throwing away money. City Manaqer~ Grady Court'ney - With reference To the meeting held with a representative from FHA in Miami said it was his intent to help the Council by pinpointing this particular meeting to hear the man and leamn more about what could be done in reference to Rev. Lee~s request. He megTetTed it caused council to be c~itiaized because it was his intent to help and he felt it was misconstrued in the press. Further reference -2- MINUTES REGULAR CITY CO~CIL MEETING NOVEMBER 3, 1969 to streets - he said something is being done to correct drainage and the city needs $360,000 to $400~000 to complete the project. He replied to Emily Jackson that the city was trying to take what we had from last year and put together with new budgeted money thereby cutting the cost. Rev. White - Asked how council can sit and allow so much for one section and none for black section. He felt the whole black section had been neglected. Ezell Hester, 1106 N.W. 1st Street. Since Mr. Moreno is going to pick up garbage he felt he should put a secretary dov~ stairs and let him pay her and not let the city bill everything for Mr. Moreno. BID OPENIN~ - One bid by Montgomery Elevator Co., Motine, Illinois. ~. Michael mo~d that bid be rejected because he felt there was no need for elevator in City Hall. Motion died for lack of second. Bids sent to 18 people and only 1 bid was received. Mr. Nylund moved that bid be turned over to tabulating committee for their recommendation. Motion seconded by Mr. Collins and motion carried 3-2. Hr. Summers and Mr. Michael voted Mrs. Padgett was instructed to open the bid, %.~ich she read in the amount of $10~595~ to be completed i~ 180 days and does not include construction work. SEWAGE PROJECT - ~orce Main 12~ - AWARDING The Mayor announced that bids had been received at 4:30 P.M. on Sewage project. Mr. Allen, Mrs. Padgett and City ~anaqer were present. It was necessary to open at this time so City Engineer had time to check and see if bids met the specifications. Engineer's recommendation was to award to low bidder E.N. ~Jurray of Buena Vista, Ga. for $79,439. ~r. Michael moved that the city accept engineers recommendation for Force Main t2L, seconded by Mr. Sun~ners and carried 5-0. P~BLIC HEDgiNG - Request for change in zoning Parcel 1 & 2 - Caldos requests - Stanley Weaver, Chairman of Planning and Zoning Board appeared to report the Board had just met to consider Parcel 1 ~ Parcel 2 requests of Caldos now before council, and it was their recommendation that beth requests be granted, however, with strings attached as to landscaping~ etc. ~r. Forrest Wallace appeared and asked if they had any idea what the strings attached pertained to. He referred to moratorium on future building in Boca Raton, if the present building trend continues, an in- crease in sewer system or sewer system converted over to ocean out-fall. ORDINANCES - 2nd READING No. 69-35 - igcrease in taxi rates. M~, [,rioore read Ordinance No. 69-33 on second reading to increase the taxi rates. Mr. Nytund moved to accept Ordinance NO. 69-53~ seconded by Mr. Michael and motion carried 5-0. No. 69-56 - increase in, impounding and redemption fees. i,~r. I4oore read Ordinance No. 69-36 on second reading, to increase im- pounding and redemption fees. ~ir. },~ichae! moved to accept Ordinance No. 69-36, seconded by Mr. Nylund and motion carried 5-0. ~o. ~9-37 r ~eclarati°n of intent to annex - Oliver Lend Corp. ~. Moore read Ordinance No. 69-37 declaring intent to annex re Oliver Land Corp. on second reading. He recommended that Planning Board's recommendation be included in the advertising notice. Motion by F~. Nylund that Ordinance 69-37 be approved on second reading: seconded by Mr. Summers and motion carried 5-0. OR, DINANCES - 1st ~BDI/~G No. 69-34 - Anti-noise - Mr. Moore read Ordinance 69-34 an Anti-noise ordinance. Mr. Summers moved that Ordinance 69-34 be accepted on first reading. Motion seconded by Mr. Collins and motion carried 3-2. M~. Nylund and Mr. Michael voted ~no.': No. 69-35 - Uae of firearms with council approval - Reference to annual turkey shoot~ Mr. bloore recommended that the request for use of firearms under consideration as Ordinance 69-55 could be covered under existing Ordinance as it appears in Section 17-49. I,~. Michael moved that this be removed from table Co= discussion. Motion seconded by M~. Summers and motion carried 5-0. ~ z~r. Michael moved that Ordinance 69-35 be st~icken from the agenda. ~kption seconded by Mr. Summers and ca. rried 5-0.~ No. 69-38 - Bus Franchise - l~r. Moore read on first reading Ordinance 69-38 re bus franchise by Joseph Tomherg. He explained that this is a license for public conveni~no~and not really a franchise - operators would have to be approved and under each eirsumstance the perticular individuals %,~uld have to be approved. Mr. Summers moved that Ordinance 69-38 be passed on first reading; seconded by l~Ir. Michael moved that Resolution 69-FF be passed. Seconded by Mr. N~lund and motion carried-5-0. Resolution No. 69-GG - 14r. l~ore read Resolution 6S-GG pertaining to approval by Housing g Urban Development. This was passed at request of Rev. Lee so his church group could qualify for federal aid to build an apartment complex for approximately 100 families. (lO0%mortgage guar- antee by Miami mortgage company and occupants to receive up to 70% rent supplement paid by federal government.) Verge~ 203 S.W. 9th - urged passing of ordinance to control cats from running loose. Mr. Albert Wehrell - agreed with Mr. Bennett. He said they did cause a lot of disturbance in that section of to~ and they do kill birds. J. T. Kelley: Sterling Village voiced his opinion that their freedom from annoyance in Sterling Village from dogs was because of the dog ordinance. He insisted they be protected from cats. Since there are 1500 people in the village he felt this should be given serious con- sideration and ~as not a laughing matter. l~Ir. Summers moved that the City Attorney be instructed to draw up an ordinance controlling cats. Motion seconded by M~. Collins and motion carried 3-2. Discuss bills to be presented to Legislative Clinic - November 25, t96S. ~4r. }~Oore advised that under the new constitution the legislative clinic is swamped with the enactment of special legislation. The~e is a pro- vision wherein you can handle much of the requests on a loea! level and that is %~;hat the legislators want and unless the matter is a routine one they will discourage it~ will recommend that it be handled on a refer- endum basis locally. Mr. Michael moved that the City of Boynton Beach su~it to the Legisla- tive Clinic the request to increase interest rate item and also the method of investing pension fund. Motion seconded by}-~. Nylund and motion carried 5-0. Eze!l Hester said he felt the Mayor should be elected directly instead of indirectly, He and Eddie Mitchell felt if a negro ran many do not vote for him because if he got the highest number of votes he might be mayor and odds are against him. Michael moved that since the responsiblity of the City Menager and Public Works Direeto~ has been reduced by garbage going Out to private company that their salaries be reduced proportionately to their re- duction in ~esponsiblity 10% and 22% ~espectively.
