Mr. Summers made the motion that l{esolution 69-0 be accepted, Mr. N¥1und seconded and motion unanimously carried. OTHEr: Receipt of K/ght of Way Deed - Easco Develo.~gent Co. (On the Table): /v/r. Nylund made the motion tht this item be removed from the table Mr. lViichael seconded and motion unanimously carried. City Attorney stated that he and Mr, Hopkins, bad checked the location of this Deed for the 50' right of way of S. W. 1st Street between S. W. 2nd and 3r~1 Avenues, and it was their recommendation the City accept the Deed. Mr. Michael made the motion that we accept the recommendation of the City Attorney and Mr. Hopkins and acknowledge receipt of the Eight of Way Deed from Easco Development Co, Mr. Nylund seconded and motion unanimous 1¥ carried. OPENING OF BIDS - 7:45 P,M.: M_r. Michael made the motion that the receiving of bid~ b~ closed and all those bids received be turned over to the City Clerk. Page No. Z MINUTES REGULAR CITY COUNCIL MEETING MAY, 19, 1969 Air Conditioner - Library[ City Clerk opened the following bids: Modern P~oofing Air Conditioning, Inc., Delray Beach Advance Air Conditioning & Heating Inc. Boynton Beach Mr .Nylund made the motion that all bids received be turned over to the Tab,,l~ting Committee for their recommendation. Mr. Summers seconded and motion unanimously carried. AWAt~DING OF BIDS: .One (!) Vibrator .Roller: City Manager stated that in the opinion of the Tabulating Committee, the Essick Model VR-28W Roller Vibrator was the best bid and most adapt- able for the City's needs, it was therefore the recommendation of fl~e Tab. Committee that this piece of equipment be purchased from Griffin Equip- merit Co. for the gross amount of $2,404.00 less $479.00 trade allowance for a net of $1.925.00. IvLr. Michael made the motion that the recommendation of the Tabulating Committee be accepted and the bid be awarded to Gr/~£in Equipment Co. for the net price of $1,925,00. Mr. Nylund seconded ~ motion unani- mously carried. ,.OLd? BUSINESS: ,Street Paving & Drainage Program (On the Table): Mr. Nylund made the motion this item be removed from the table. City Manager stated the Council had an outline of the map before them indicating the area in the no~th end of the City in which this project would be init/areal and advised Council that this could be done at an estimated cost of $116,600. to be paid for over a two year budget period. Much discussion ensued concerning the costs involved for both the street and dra/r~ge programs. Mr. Summers seconded. At this point in the meeting, Mayor Gallo announced that the motion on this item would be held in abeyance inasmuch as it was now time for public hearing. ,PUBLIC HEARING: Request for Change in Zoning: 1. Caldos parcels (south tract -lying between S.W.15th & 2$rd Avenues): Parcel A - R-1AA to C-1 Parcel B - R-1AA to G-1 Parcel C - lt-iAA to Parcel D - R-IAA to R-3A Parcel E - Conditional Use - Church Parcel F - Special Exception Mayor Gallo asked for anyone in-the Audience to come forward who was in favor of this request. Bill Leonard, Attorney represent/ng Caldos Properties, Inc, stated that this request comes before Council with the unanimous recommendation and approval of the City's Pla~r, lng& Zoning Board. Mayor Gallo asked for anyone in the audience to come forward who was opposed to this request. David White, 1077 S.W. Zdth Avenue, President of Golf View Harbor Assoc. Stated that his Association was opposed to this change in zoning, Helen Wilson, 1111 S.W. 24th Avenue, questioned the conflict of interest with certain Council members. Roland P. Amateis, 1042 S. tV. 24th Avenue asked the reason why the City had a Planning & Zoning Board. Charles Eschenburg, 1090 S .W. Co~cihn~n Michael presented coml~rison figures on costs, pol~,lation and acreage with regard to the City o£ Doynton Beach and Leisureville. CounciL~man Nylund made the motion that the recommendation of the Plann- ing and Zoning Board be accepted and the change of zoning be granted. Mr. S~r~mers seconded. Motion carried 4-1, Mr. Michael dissenting. Ordinance 69-15 - llezoning Caldos Parcels A-E: City Attorney read subject Ordinance in its entirety, Mr. Summers made the motion that Ordinance 69-15 be accepted. It is my honest opinion ~hat you gentlemen, I repeat, should search your consciences and if there is the slightest doubt in your n~inds that there is a conflict here tint you should refrain from vot/ng. Mt.Summers made the motion that this item be tabled. Mr. Michael seconded and motion unanimously carried. ,NEW BUSINESS: Solicitation of Road Improvements by the Board cd County Corn,~{ssioners: Mayor Gallo read a letter from the Board of County Commissioners in which they asked the City to compile a list of County maintained streets in the City and inform the County of their recommendations before May' zg, 1969 ~ Mr. Michael made the motion that Mr. Courtne¥ and Mr. Hopkins prepare our recommendations and submit same to the Board of County Coznmissioners over the City Council's signature. AD/ViINIS TRATrVE: Consider lViemorandum from City Nfan;~er Re: Leisurevl]l-~ Mr.Courtney stated that Leisureville had recommended a I0" cast iron v~ter main on SR 804 westward to Congress Avenue, whereas the City recommenda a IZ" line. Mr. Rossi, Consulting Engineer, representing Caldos Properties, Inc. s~ted that Caldos is willing to accept the recommendation of the City and -will install the 12" cast iron water main. Consider Request of Frank Johnson Re: Dat~ of l~etireme~ City Manager stated that subject employee requested a thirty day extension so that he can have time to apply for his social security benefits. 1V/r o Summers made the motion this extension be approved, lV~r. Mr, Summers seconded and motion ~nimOUSly carried. ..Approval of Bills: City Manager stated there were no bills but he would like the City Attorney to review the bills pending fromRussell & Axon, the City's Consulting Eng/neers, for his opinion, OTHER: Request from Gerald Dake, City Planner: B//~yor Gallo read the letter received fromGerald Dake in which he asked for an extension o£ 120 days in order to complete the remaining work according to his contract. Mr. Summers made the motion the extension of lZ0 days be granted, Mr. Nylund seconded and motion unanimously carried. Gerald Hawkins' Propose.d Contract - City Mr. Courtney presented said contract in which Mr. Hawkins asked for a total maximum cost of the audit to be $4,450,00 an increase of $300.00 over the previous year o Mr. Michael made the motion the contract be awarded to Gerald Hawkins, with City A~torney's'approval, for the amount of $4,450.00.
