O97-29ORDINANCE NO. O97-,~' AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENdiNG CHAPTER 2 - ZONING, SECTION 6.F. "PLANNED COMMERCIAL DEVELOPMENT D~ISTRICT" OF THE LAND DEVELOPMENT REGULATIONS,~ BY AMENDING SECTION 6. F.5.a. TO PROVIDE THAT USES WILL NOT BE SUBJECT TO THE MINIMUM ACREAGE REQUIREMENTS OF SECTION 6.C.1. IF THE SITE MEETS MINIMUM ACREAGE REQUIREMENTS FOR REZONING TO PCD AND ALL PORTIONS OF ANY BUILDING DEDICATED TO SUCH A USE ARE SEPARATED FROM RESIDENTIALLY ZONED PROPERTY BY A DISTANCE OF 200 FEET; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, it has come to the attention of the City Commission of the City of Boynton Beach that an amendment to the Land Development Regulations, with respect to Planned Commercial Development Districts, is necessa~; and WHEREAS, the proposed change does not compromise the city's ability to approve quality projects, as the PCD master plan process gives staff the opportunity to regulate buffers, landscaping and building design of all developments to comply with the Community Design Plan; and WHEREAS, the City Commission has determined that it is in the best interests of general welfare to the citizens and residents of the City to provide clarification to permitted and conditional uses; and WHEREAS, upon recommendation of staff, the City Commission of the wp\ord\PCD Use Amendment 5/27/97 City of Boynton Beach has deemed it to be in the best interests of the citizens and residents of the City of Boynton Beach to amend Chapter 2 - Zoning, Section 6. F.5.a. of the Land Development Regulations to provide that uses will not be subject to minimum acreage requirements of Section 6. C.1 if the site meets the minimum acreage requirement for rezoning to PCD and all portions of any building dedicated to such use are separated from residential zoning districts by a distance of at least 200 feet. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section1. Chapter 2 - Zoning, Section 6. F.5.a. of the Land Development Regulations of the City of Boynton Beach is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: a. All uses listed in Section 6.C.1 of these zoning regulations provided however, that uses listed as conditional will not be required to secure conditional use approval if shown on the master plan required as part of this submission, and uses will not be subiect to the minimum acrea,qe requirements of Section 6.C.1. if the site meets the minimum acrea,qe requirement for rezonin,q to PCD and all portions of any buildin,q dedicated to such use are separated from residentially zoned property by a distance of 200 feet; Uses which would require an environmental review permit in the C-3 district shall also require such a permit ... Section 2. That each and every other provision of the Land Development Regulations not hereinbefore specifically amended shall remain in full force and effect as previously enacted. wp\or&PCD Use Amendment 5/27/97 Section 3. All laws and ordinances applying to the City of Boynton Beach in conflict with any provisions of this ordinance are hereby repealed. Section 4. Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5. Authority is hereby given to codify this Ordinance. Section 6. This Ordinance shall become effective immediately. FIRST READING this ,.¢ day of June, 1997.
