I. Call To Order
Carol Ellis, Special Magistrate, called the hearings to order at 9:10 a.m. She
explained her role in the hearings and the hearing procedure. Pursuant to Florida
Statute, all orders are appealable to the Circuit Court in Florida and not the City
Commission. She explained a fine will be imposed if the violation(s) are not corrected
by the deadline.
II. Swearing in of Witnesses and Introduction
The Minutes Specialist administered an oath to all those intending to testify.
III. Approval of Agenda
Vestiguerne Pierre, Senior Code Compliance Officer, announced the following
changes to the agenda:
Cases Nos. 15 -140 and 15 -372 were closed.
Case Nos.: 15 -760, 15 -876, 15 -856, 15 -1026, 15 -584, 15 -586, 15 -587, 15 -594, and 15-
852 had complied.
Case Nos.15 -840, 15 -371 and 15 -1084 were removed.

Officer Pierre presented the case as contained in the Notice of Violation. Staff
recommended 30 days be given to correct the violations by July 17, 2015, or a fine of
$100 a day thereafter. He advised the violations remain outstanding.
Monika Lembit, Grand Strawberry, LLC owner, advised she paid for the Business
Tax Receipt and Certificate of Use and weeded the yard. When she called for the
inspection, they indicated she needed a water heater permit and there was an open roof
permit. She obtained the permits, but they are not yet closed. She called for an
inspection on Monday for the water heater, and the inspection showed an electrical
switch needs to be changed, which also requires a permit. Ms. Lembit had receipt
numbers for the Business Tax Receipt and Certificate of Use as receipt numbers 15-
35029 and 15 -14814 respectively, but she did not have the actual paperwork.
Ms. Ellis reviewed the paperwork. Officer Pierre explained when they inspect the
property, if any work is done without a permit, they cannot pass the inspection. The
Respondent has not provided any evidence as of today, showing the issues were
addressed.
Ms. Lembit conveyed she tried to call and her husband left a message. She reiterated
she was working to correct the issues.
Decision
Ms. Ellis ordered 30 days to correct the violations by July 17, 2015, or a fine of $100 a
day thereafter. She encouraged Ms. Lembit to communicate with Code Compliance
about her progress.

Officer Pierre presented the case as contained in the Notice of Violation. Staff
recommended 30 days be given to correct the violations by July 17, 2015, or a fine of
$100 a day thereafter. Officer Pierre explained the Respondent was still in violation.
Diana O'Loughlin, owner, explained they addressed the front flower bed. The yard
had not been addressed because her husband was out of work for a year and a half
and they did not have the funds to install the sod. He is now employed and they
contacted Sod Father to install sod. She explained there was an issue with one of the
water pipes connecting to the street. The City made the repair, and threw the dirt back
on the property, but did not sod or level the yard. They waited to see if the City would
come back, but as the hearing drew closer, they opted to install bushes by Friday and
sod by the weekend. She had photographs.
Decision
Ms. Ellis ordered 30 days to correct the violations by July 17, 2015, or a fine of $100 a
day thereafter.

inspection.
Kevin Cohen, the property owner, advised he would complete the work in a week or
two. Ms. Ellis explained the house numbers were a safety issue. She bifurcated her
order as follows:

Officer Pierre presented the case as contained in the Notice of Violation. Staff

thereafter. He reported the violations remained outstanding.
The Respondent was administered an oath.
Susan Froehlich, the property owner, advised she weeded the gravel and had
treated it every other day. There are bare spots in the yard because she was weeding
the yard by hand and laid grass seed. She requested more time to finish the work and
she informed Ms. Ellis she has to get a well pump and irrigation. She was there less
than a year and cleared a third of the property. Officer Pierre commented she has a
large yard and was working to correct the matter.

Ms. Ellis ordered a 30 -day compliance date of July 17, 2015, or a fine of $100 a day
thereafter.

Grisel Pineda, Anworth Properties, Inc., explained she applied for the rental license.
After speaking with Officer Cain, they called for sod and continued due diligence. She
explained the yard was large and they have to install irrigation. The plans were
approved and the yard would be completely finished by Wednesday of next week.

Laurent Legagneur, the owner, advised he was almost finished. The sod was coming
later in the day, but he trimmed the trees and understood the violations.

Case No. 15 -878 David P. Penegor

Officer Pierre presented the case as contained in the Notice of Violation. Staff
recommended a 30 -day compliance date of July 17, 2015, or $100 a day fine thereafter.
The violations still remained. The Respondent was working on the sod, but the swale
still needed to be addressed.
Kevin Penegor, the owner's son, lives at the premises and indicated they laid sod in
the bare spots on the swale, but due to a bus stop, the swale gets trampled and driven
on by the buses. The grass was dead now. There was work planned for the bus stop
and they will install a bench. He thought adding sod was defeating the purpose
because it would be ripped up. Ms. Ellis inquired if this was communicated to the City
and Mr. Penegor had only learned of it yesterday when they were marking the street.
Mr. Penegor thought the City should have given him advance notice of the work. He
had photographs of him laying sod in the bare areas of the swale. He did not know
when the work would be completed by the City. Ms. Ellis encouraged communication
between all parties involved.

Officer Pierre presented the case as contained in the Notice of Violation. Staff
recommended a 30 -day compliance date of July 17, 2015, or a fine of $100 a day
thereafter. The Respondent was a repeat violator. Ms. Ellis requested clarification.
Code Compliance received a complaint there were people sleeping in a tent in the
garage due to the construction being done. Officer Pierre spoke with them and they
were sleeping in a tent outside the garage. Officer Pierre could not tell if they were
sleeping in the garage any more. Ms. Ellis inquired if the work requiring a permit
pertained to the interior work. Officer Pierre found out major renovations were ongoing
and no permits were pulled.
Ms. Ellis noted in 2012, there was a violation regarding a Business Tax Receipt and a
red tag for construction work. The Respondent complied on April 22, 2014. Ms. Ellis
researched whether the violations ran with the land or the owner.
Lou Meyers, property owner, explained he kicked people out the same day he got the
permit. He had a permit number for the construction work and advised homeless people
were helping him with the construction and painting. He had a copy of the permit
number which Ms. Ellis reviewed. Mr. Meyers explained he could pick up the permit.
Decision
Ms. Ellis ordered a 30 -day compliance date of July 17, 2015, or a fine of $100 a day
thereafter. She recommended providing proof to Code Compliance when he received
the permit so they could close the case.

Officer Hart presented the case which arose from a citizen complaint. The initial
inspection date was April 13, 2015. Written notice was sent regular mail the same day
giving 10 days to correct the violations. Certified mail was sent April 29, 2015, and the
green card was returned signed, but undated. Staff confirmed someone was living at
the premises. There is an unpermitted structure so the owner could not obtain the
Business Tax Receipt. The Respondent was also a repeat violator. The property was
last inspected on June 16, 2015.
Ms. Ellis received clarification the Respondent was operating a business which was a
rental property. The home had work done without permits and the complaint was the
toilet was overflowing. When Officer Hart entered the property, the ceilings were very
low, which led him to check with the Building Department. He learned they did not have
permits. Currently, there were no tenants at the home, but it was an ongoing issue and
the Respondent was a repeat violator. Officer Hart requested a Cease and Desist Order
effective immediately. Ms. Ellis inquired about the 10 -day compliance deadline. Officer
Hart explained he could not tell if the property was occupied because the front door was
behind a gate. The prior violation pertained to the same issue on the same property
approximately one year ago. The tenant moved out which alleviated the violation.
Yvick Narcisse, the owner, explained he purchased the home in "as is" condition.
When he went to the Building Department to check on permits, he was told no permits
were issued. Staff at the Building Department indicated they would contact Officer Hart
to advise him no violation was found. Mr. Narcisse was given photographs that would
be sent to Officer Hart that the construction was done in the 1950s or 1960s. Mr.
Narcisse commented if there was a violation, they were pre- existing because he did not
make any alterations. He was not renting the property, but he lived on one side. The
City could assert he altered the home to rent it and he did not. He purchased the home
three years ago. Ms. Ellis explained when he purchased the home, he inherited the
issue.
Decision
Ms. Ellis ordered a Cease and Desist Order, effective immediately and she clarified he
could not rent the property unless these issues are resolved. She recommended
working with the Building Department.
Mr. Narcisse reiterated he had spoken with the Building Department and he was told
they could not find anything. It was one unit and a single - family home. He advised
Florida Law specifies if it was not separated or there were not more than five units, a
Business Tax Receipt is not needed. Ms. Ellis explained if income is received, a
Business Tax Receipt is needed. Officer Hart approached the Building Department and
received a printout which Ms. Ellis reviewed. She noted the April 2014 printout for the
subject location indicated there was an enclosure completed without a permit.. Officer
Hart confirmed that was the unpermitted structure in the violation. The second page
showed there has not been a Business Tax Receipt applied for since 2006. Officer Hart

did not have photographs. He agreed the structure was one building, but an addition
was added to the side of the house without a permit.
Mr. Narcisse had photographs Ms. Ellis viewed. She inquired if he intended to rent the
property when he purchased it and Mr. Narcisse responded he did not Officer Hart
explained he spoke to two tenants that lived there, and they indicated they had paid
rent. One tenant was fearful his cat would get sick and has since been evicted. The
eviction notice was served on the tenant in Officer Hart's presence. Ms. Ellis took note
there was a prior violation and anticipated one would reoccur again.
Decision
Ms. Ellis ordered a Cease and Desist Order effective immediately with a $500 per
occurrence fine, and gave 30 days, until July 17, 2015, to resolve the Business Tax
Receipt matter or a fine of $100 a day would be imposed thereafter.
Case No. 15 -960 Murat & Cinaise Donastor & Ducles

Officer Hart presented the case as contained in the Notice of Violation. The case arose
from a citizen complaint. The initial inspection date was April 22, 2015. Written notice
was sent the same day giving 10 days to correct the violations. Certified mail was sent
on May 13, 2015, and the green card was returned undated. The Respondents were
repeat violators. The property was last inspected June 16, 2015. Staff recommended a
10 -day compliance date of June 27, 2015, and a fine of $200 a day thereafter. Officer
Hart had photographs he showed to the Respondents and Ms. Ellis. The Respondent
confirmed the photographs were of his property.
Maurice Cereledi, representing the owners, explained Mr. Donastor does not speak
English well and did not understand the violations. They spoke to him about the
violations about a week ago. He spoke to the Code Officer and the owner who
indicated they cleaned the yard, but the Officer was not satisfied. He requested a
transcript of the hearing to advise them what they needed to do. Officer Hart explained
there was a lot of trash, and much has been cleared, but there is still quite a bit left. A
roll -off dumpster is on the premises filled with roofing debris.
Decision
Ms. Ellis ordered a 10 -day compliance date of June 27, 2015, and a fine of $100 a day
thereafter.

$100 a day would be imposed thereafter.
Ellen Vonderlanken, the property owner, was living in the house which was going
into foreclosure. She held the yard sales because she was not receiving child support.
She advised two years ago, she was told the City was not charging for permits for yard
sales. She commented even Code Compliance officers saw the yard sales and said
nothing. The house numbers were always above the garage, and a Boynton Beach
sanitation truck knocked over her mailbox. She had not noticed the house numbers
were not on the mailbox until she noticed her recycling was not being picked up. She
installed the numbers on the mailbox. She explained she did not have money for sod

as her husband took the money she gave him to pay the mortgage, but did not pay it.
She is on disability and is terminally ill. She agreed to put grass seed down. She
purchased a ping pong table which she moved to the driveway for her children. Officer
Pierre explained the ping pong table was not part of the violation. Most of the debris
was removed, but there was still some left.
Decision
Ms. Ellis ordered a 30 -day compliance deadline of July 17, 2015, to comply with all
issues. If not, a fine of $100 a day thereafter would be imposed. She encouraged Ms.
Vonderlanken to communicate with Code Compliance.
Case No. 15 -726 Geneva C. Fann

Officer Shickles presented the case which arose from a routine inspection. The initial
inspection date was March 31, 2015, for the above violations. Written notice was sent
giving 10 days to correct the violations. Individual service was made on Thomas Fann.
The only remaining violation was to obtain the permits for the five sheds. The property
was last inspected on June 16, 2015. Staff recommended a 10 -day compliance date of
June 27, 2015, and a fine of $100 a day thereafter.
Thomas Fann, co -owner of the property, advised he moved the sheds five times and
he has to obtain an engineer regarding anchoring the sheds, which he cannot afford to
do. Ms. Ellis explained if he cannot obtain the permit, the sheds would have to be
removed. Mr. Fann requested 30 days to remove the sheds because there were items
stored there.
Decision
Ms. Ellis ordered a 15 -day compliance deadline of July 2, 2015, or a fine of $100 a day
thereafter.

Officer Shickles presented the case which arose from a routine inspection. The initial
inspection date was April 8, 2015. The Respondent is a repeat violator and the same
code violation was cited in May of 2014, and April 2014. Written notice was sent giving
10 days to correct the violations. Service was individual service on Josephine Daffin.
The property was last inspected on June 16, 2015. Staff recommended a 10 -day
compliance deadline of June 27, 2015, or a fine of $250 a day thereafter. The only
remaining violation was the vehicles.
Josephine Daffin, the owner, explained she could not move the cars so she put a
fence around the yard and enclosed them. She is unable to obtain a driver's license
due to a medical condition. The second car belonged to her deceased son and it was
all she had to remember him by. She wanted to try to keep the car. Ms. Daffin
explained her family situation. She is by herself and on disability. It would take her
more than 10 days to correct the violation. There are three vehicles, and she could
address two of them.
Ms. Ellis noted the violations in April 2014 pertained to her deceased son's Pontiac and
this was the third time she was cited for the same violation, which costs the City money.
If this was the first violation, she could have been more flexible. She explained she
would give 10 days to correct the violation. Ms. Daffin requested 30 days. Officer
Shickles was amenable to the 30 days.
Decision
Ms. Ellis ordered a 30 -day compliance date of July 17, 2015, or a fine of $500 a day
would be imposed thereafter.
Case No. 15 -946 Federal National Mortgage Assoc.

Officer Shickles presented the case as contained in the Notice of Violation. The case
arose from a citizen complaint. The initial inspection date was April 22, 2015. Written
notice was sent giving 15 days to correct the violation. Service was made by certified
mail. The green card was signed on May, 20, 2015. The property was last inspected
on June 16, 2016. Staff recommended a 10 -day compliance deadline of June 27, 2015
or a fine of $100 a day thereafter. The home was in foreclosure and there are tenants
that are being evicted.

Todd Hamilton, United Realty, the listing broker for Fannie Mae, explained they
took title via foreclosure. The bank was in the process of evicting the tenant. There are
disputes between the prior owner and the occupants. An email from the eviction
attorney revealed an appeal was filed by the defendant, which needs to be resolved
before an eviction can proceed. No rent is being collected and the property will be sold.
Mr. Hamilton attempted to obtain a certificate of use from the Building Department and
was referred to Code Compliance.
Officer Shickles recommended the case be closed. Mr. Hamilton produced
documentation regarding the eviction proceedings. Ms. Ellis noted the appeal to vacate
the sale stays the eviction until the appeal is resolved. There were printouts from a
portal for properties under foreclosures. The last update was May 29, 2015.
The eviction attorney indicated the appeal filed by the Defendant was pending and will
need to be resolved before the eviction can proceed. The defendant filed the initial brief
on February 16, 2015. On May 29, 2015, the appellate court entered an order giving
co- counsel until June 28, 2015, to file an answer brief. The estimated completion was
November 1, 2015.
Decision
Ms. Ellis believed the documents constituted evidence of an eviction and closed the
case.
Case No. 15 -763 Robin Pierre

Officer Weixler presented the case which arose from a routine inspection. The initial
inspection date was April 1, 2015. Written notice was sent regular mail the same day
giving 10 days to correct the violations. Notice was by certified mail sent on April 29,
2015. The green card was signed on May 2, 2015. The property was last inspected on
June 16, 2015, and the violation still exists. Staff recommended a 30 -day compliance
deadline of June 17, 2015, or a fine of $50 a day thereafter.
Robin Pierre, the owner, explained the tenant will not open the door to let the
contractor do any work. He applied for the Business Tax Receipt and produced the
paperwork which Ms. Ellis and Officer Weixler reviewed. Officer Weixler had inspected
the premises and explained the tenant was uncooperative and refused to let the
contractor in to do the work needed to pass the Business Tax Receipt inspection. Mr.
Pierre explained he started the eviction process on Monday and had purchased the
property about three years ago. The tenant has not paid rent for two months. Ms. Ellis
noted the lease was for one year and if written correctly, if the tenant is not paying rent

or allowing an inspection, it could be considered a violation of the lease regardless of
the rent. She noted the owner was making efforts to comply.
Decision

Officer Pierre presented the case as contained in the Notice of Violation. The case was
heard on February 18, 2015. The compliance date was March 20, 2015. The violations
still exist.
Ms. Ellis indicated the overgrown yard was no longer an issue. The only issue
remaining was the sod.
Simone Snyder, property owner, explained at the last hearing, Officer Cain had
indicated the sod was no longer a violation, but the roof was. Ms. Snyder asserted
Officer Cain stated the property looked very nice when he visited the property. Officer
Pierre responded, according to his re- inspection on June 16, 2015, there is a sod issue.
Ms. Snyder requested evidence and contended she had planted sod. He produced
photographs he showed to Ms. Snyder and Ms. Ellis. He explained to Ms. Snyder she
had to maintain the swale. Ms. Snyder explained the photographs were of areas where
she did not have sod and not of areas where she did sod.
Ms. Snyder reiterated Officer Cain indicated the yard was fine. She explained the
irrigation system was broken. She had installed a new walkway in the front yard and
installed sod around it. She also explained she has someone coming twice a month to
cut the grass. She emphasized when she showed Officer Cain photographs of the front
yard, he complimented her on the new design of the front yard. Ms. Snyder advised
there was still work to be done and she had removed all the old concrete
Officer Pierre had a prior photograph in the file to show Ms. Snyder and he explained
the photographs Ms. Ellis has all looked the same. Ms. Snyder advised she also had
photographs on her phone, but she did not have that phone with her. She wanted to
show all that was done.

After reviewing the photographs, Ms. Ellis noted the yard was mowed, the rock areas
were weeded and she applied for a Business Tax Receipt, but she no longer needed it
and had an exemption. Officer Pierre explained the Code requires grass, and there
were weeds. Ms. Snyder had receipts for the sod. Officer Pierre explained the Code
requires the homeowner to maintain the swale. Ms. Snyder explained there were
markings for excavation on Seacrest, and she wanted to wait until after that was done.
Ms. Ellis expressed she tabled the case last month and inquired what occurred since
then. Ms. Snyder had received 30 days to work with the City. Ms. Snyder thought the
only remaining violation was the roof. She had thought the sod was not an issue. She
had some sod plugs and removed the concrete and installed a brand new walkway.
Ms. Snyder contended Officer Cain congratulated her on the work she had been doing.
There was an issue with the timeframe because she was contemplating installing a new
driveway in the front yard, which was when the work began. She aborted that project,
installed a walkway and planted sod around it.
Decision
Ms. Ellis agreed to table the case to review the testimony from last month and decided
to recall the case at the end of the meeting to allow Ms. Snyder to take photographs of
her yard and return to the meeting.
Case No. 15 -457 Boynton Business Park LLC

Officer Pierre presented the case as contained in the Notice of Violation. The case was
heard on April 15, 2015. The compliance date set was to correct the violations by April
22, 2015. The violations still exists.
Ms. Ellis reviewed the history of the case. The case was red tagged in February 2015
for interior work done without permits. No one appeared at the April 15, 2015 hearing
and Ms. Ellis ordered a compliance date of April 22, 2015, and a fine of $500 a day
thereafter. The property was last inspected on April 23, 2015 and the violation still
remained. On May 20, 2015, no one appeared at the fine certification and Ms. Ellis
tabled the case to the June meeting.
Corey Tickner, Current Capital, explained he appeared last month. He had spoken
with Officer Cain outside of the meeting, who indicated Mr. Tickner could leave because
permits had been pulled, so he left. Previously, the authorized representative for the
property was the landlord's attorney, who failed to notice any party of the hearing in
April, otherwise he would have attended. Mr. Tickner confirmed the permits were
applied for and he had the permit numbers 15 -2329 and 15 -2330. The plans were

turned in mid -May by the contractor and the initial plan review was finished May 29,
2015. Comments were not received until June 8, 2015, and they were updating the
plans per the City comments.
Officer Pierre had no information in the file why the case was tabled, but indicated the
case was heard and work was done without a permit.
Ms. Ellis reviewed the documents Mr. Tickner submitted which were a printout of the
application and the status of the plan review showing some items were approved and
there were some outstanding items. She noted this occurred in February 2014, and the
application was made in May. Mr. Tickner explained there were issues with the
contractor and architect. They had to change architects as the first one had caused
delay.
Decision
Ms. Ellis ordered an additional 30 days to comply as there has been substantial
compliance. She tabled the case to the next month.
Case No. 15 -310 Federal National Mortgage Assoc.

Officer Shickles presented the case. The Notice of Violation was February 12, 2015,
and the case was heard on March 18, 2015. Joe Sauter appeared. The compliance
date and fine was March 28, 2015, or a fine of $150 a day thereafter. The violations still
exist having 80 days of non - compliance.
Ms. Ellis reviewed the history of the case. In May 2015, a fine certification hearing
occurred and Mr. Sauter appeared. The case was tabled to the June meeting.
Mr. Sauter, Joe Sauter Realty, commented there was a plan revision and he had a full
set of plans from the contractor which he provided to Ms. Ellis. Officer Shickles
commented there were no permits yet. Mr. Sauter agreed the permits were late. He
received a verbal approval from the asset manager for the prior contractor, but upper
management rejected the company, causing them to use a different contractor.
Application has not been made and they were nowhere near resolving the matter. The
property is a problem property. They have a buyer, but the buyers were waiting on the
outcome of the property. Officer Shickles recommended certifying the fine and returning
for lien reduction.

Officer Pierre presented the case. The Notice of Violation was May 19, 2014. The case
was heard July 16, 2014, and the compliance date and fine set was July 16, 2014 or a
fine of $100 thereafter. There was a Cease and Desist ordered and there were two
occurrences.
Ms. Ellis reviewed the history. She ordered the Cease and Desist Order in July 2014
with a $100 fine per occurrence plus administrative charges. No one appeared at the
hearing. One violation occurred May 19, 2015, and the second violation occurred on
June 12, 2015.
David Saget, the owner, was present. Ms. Ellis had outlined the events and Mr. Saget
asked what a Cease and Desist meant. Ms. Ellis explained the Cease and Desist Order
and the matter has been ongoing since 2014. Officer Pierre explained Code
Compliance takes a photograph, even after the truck is moved, because the truck
returns.
Mr. Saget explained the truck was gone two weeks. One violation was last year. He
explained he travelled to Haiti after the earthquake to assist his handicapped children.
He purchased a truck in May to send to Haiti and shortly thereafter, Code Compliance
took pictures of the truck. Mr. Saget called Officer Cain and explained he moved the
truck and would be sending it to Haiti.
Ms. Ellis asked why he did not attend the hearing in July 2014 and Mr. Saget responded
his mother had passed away. Ms. Ellis reviewed two photographs dated May 19, 2015,
and June 1, 2015, showing the presence of a white oversized truck on the property.
Ms. Ellis explained he was found in violation.
Decision
Ms. Ellis certified the fine.

Ms. Springer presented the case. The Notice of Violation was sent on October 5, 2012,
to obtain a permit for the walk in cooler and freezers, added display cases and the wall
between the kitchen and sales area. A Business Tax Receipt was required. The case
was heard on January 16, 2013, and no one appeared. The compliance date and fine
set was March 17, 2013, or a fine of $150 a day would be imposed thereafter. The
violations were corrected on May 14, 2013, having 57 days of non - compliance and a
fine of $8,550, plus administrative costs of $634.12. Ms. Springer commented the
Business Tax Receipt could not be issued while the permits were open.
The case originated from a red tag from the Building Department. The contractor had
revised the floor plan and the work listed on the permits was different from the work that
was done. All the permits were issued, but two portions of the permit were pending.
The Respondent had paperwork showing they did issue sections of the permits, which
looked like the permits were open and pending when they were not.
The Respondent, Ms. Orlando, had attended the fine certification hearing and
misunderstood. The Forum Shoppes had contacted Ms. Springer and she explained
the lien was under Palermo Bakery and then the owner contacted her. The owner was
unaware the fine had been certified.
Anna Orlando, owner of Palermo Bakery, conveyed Ms. Springer's comments were
correct.
Decision
Based on the testimony, Ms. Ellis reduced the lien from $8,550 to $500 plus
administrative expenses of $634.12 for a total amount of $1,134.12.
Case No. 11 -3421 David & Nataliya Giordano 2315 N. Congress Ave. #31
Ms. Springer presented the case. The Notice of Violation was sent on December 19,
2011, for violations pertaining to a Business Tax Receipt for a rental property. The case
was heard on March 21, 2012, and no one appeared. The compliance date and fine
was April 4, 2012, or a fine of $100 a day would be imposed thereafter. The violations
were corrected on December 22, 2014, having 990 days of non - compliance and a fine
of $99,000 plus administrative fees of $634.12.
Ms. Springer was first contacted by Mr. Giordano in April 2014 when he learned of the
lien on the property. He thought once application was made and the Business Tax
Receipt paid for in March 2012 that he was issued the permit. He never called for an
inspection. Ms. Springer advised he should reapply for the Business Tax Receipt since
it lapsed for two years. Mr. Giordano did so, called for an inspection and had to pay for
the 2012, 2013, 2014, and 2015 Business Tax Receipts. He failed the first inspection
on November 3, 2014, and then passed on December 22, 2014.

David Giordano, property owner, explained he lives in New Jersey, and learned of the
case through a friend that came down to check on the home and the notice was taped
to the door. He mailed a check and the application for the Business Tax Receipt in
2012, and never heard anything. He called Officer Cain and left information to forward
all correspondence to the New Jersey address, and he heard nothing for a year until he
attempted to sell the property. A lien search found the lien on the property. The property
has been for sale and has been vacant for a year. He did not have a contract on the
property.
Ms. Springer explained the application signed in 2012 and 2014 highlighted one must
call to schedule an inspection for rental property after the application is submitted.
Decision
Based on the testimony, Ms. Ellis reduced the lien to $2,500, plus administrative fees of
$634.12. The current lien was $99,000.
Mr. Giordano objected and commented the lien could have been zero had Officer Cain
responded to him and sent the mail to his address. He advised he addressed the issue
immediately. Ms. Ellis responded he had not and the instructions to call for an
inspection were very clear.
Case No. 14 -2414 Lansdowne Mortgage LLC 103 SE 21" Avenue
Ms. Springer presented the case. The Notice of Violation was sent on October 24, 2014
to register and maintain a foreclosed property per City Code. Repairs were needed to
the fence at the front of the property and screen. The case was heard December 17,
2014, and no one appeared. The compliance date and fine was to correct the violations
by December 27, 2014, or a fine of $100 a day would be imposed thereafter. The
violations remained outstanding for 61 days accruing a fine of $6,100 plus
administrative fees of $634.12.
Ms. Springer was contacted in February for a lien reduction inspection and she advised
the case was not in compliance. They brought it into compliance on February 27, but
they also conducted the lien reduction inspection which revealed the Respondent had to
replace missing window screens, secure the property, obtain a permit for a water
heater, replace both missing air conditioners, obtain a permit for a screen enclosure,
utility room, sod bare areas in the front yard, repair soffit screens, a wood fence, broken
planks on the front of the fence and repaint the fence. There were also outstanding
property taxes and a water bill of over $2,000 that had to be paid. The property was re-
inspected on April 6, 2015, and some violations remained. Another inspection a month
later revealed all was corrected.
Dale Disham, Landsdowne Mortgage, explained they took possession of the home
through a foreclosure. They got a contractor and improved the property and put the

property up for sale. They removed the fence. They invested $6,000 and when the air
conditioner was installed, someone stole it and they had to replace it.
Ms. Springer had photographs she showed to Ms. Ellis. Mr. Disham explained they
worked with Ms. Springer to address each violation until the property was in
compliance.
Decision
Based on the testimony, Ms. Ellis reduced the lien to $500, plus administrative costs of
$634.12.
Case No. 14 -773 SFRH SF Rental LP 2621 NE 3` Street
Ms. Springer presented the case. The Notice of Violation was sent April 1, 2014,
regarding a Business Tax Receipt inspection. The case was heard on May 21, 2014.
Aaron Gill appeared. The compliance date and fine was June 20, 2014, or a fine of
$100 a day thereafter. The violations were corrected on January 29, 2015, having 222
days of non - compliance and administrative fees of $634.12.
Ms. Springer was contacted in February for a lien reduction inspection and violations
pertaining to securing the building, repairing a broken window in the rear, replacing
missing window screens, repairing fence in the rear, obtaining a permit for newly
installed air conditioning and sodding the yard were found. The property was re-
inspected on March 30, 2015, and the sod and fence violations remained. An
inspection on May 8, 2015, showed all were addressed.
Alex Saadi, SFRH SF Rental LP, explained when the violations were occurring, they
had a different property management company. They have many properties and they
were not being maintained. They addressed the matter a few months ago and they
were bringing all their properties into compliance. They spent $13,000 on this property..
It is in compliance and they want to maintain it.
Decision
Based on the testimony, Ms. Ellis reduced the lien to $3,000 plus administrative costs of
$634.12.
Case No. 13 -2354 SFRH SF Rental LP 302 SW 5 Avenue
Ms. Springer presented the case. The Notice of Violation was sent on October 25, 2013,
pertaining to a Business Tax Receipt inspection and repair of the wood fence on the
east side of the property. The case was heard on January 15, 2014, and no one
appeared. The compliance date and fine was January 30, 2014, or a fine of $50 a day
would be imposed thereafter. The violations were corrected on May 22, 2014, having

476 days of non - compliance, accruing a fine of $23,800, plus administrative costs of
$922.21.
Ms. Springer was contacted in May for a lien reduction inspection and a section of the
fence needed to be repaired. Three days later, the violation was corrected.
Alex Saadi, SFRH SF Rental LP, explained there were violations added after they
addressed the original ones that were cited. They addressed all immediately. The
tenants were uncooperative and there were unregistered vehicles. Mr. Saadi advised
they invested several thousand dollars in the property.
Decision
Based on the testimony, Ms. Ellis reduced the lien to $3,000, plus administrative costs
of $922.21.
Case No. 14 -1905 Joseph K. Maiuro 27 Crossings Cir. B.
Ms. Springer presented the case. The Notice of Violation was sent August 12, 2014, to
abate mold in the residence. The case was heard on October 15, 2014, and no one
appeared. The compliance date and fine was October 25, 2014, or a fine of $100 a day
would be imposed thereafter. The violations were corrected on April 10, 2015, having
166 days of non - compliance and a fine of $16,600, plus administrative costs of $730.15.
Ms. Springer was contacted in April for a lien reduction and the inspection showed the
Respondent had to replace screens, missing landscaping in the courtyard, address
mold and pressure clean the exterior of the building. The property was re- inspected on
April 24, 2015, and only pressure cleaning the outside of the building remained. She
was contacted again on May 26th and the property passed inspection.
David Roy, P.A., on behalf of Mr. Maiuro, commented this was a significant mistake
for his client, who owns 14 units in the Crossings. The tax records show his old address,
which he moved from in 2000. The tenant was vengeful and did not notify Mr. Maiuro of
any violation notices mailed to the property. The tenant was evicted in March and the
violations were corrected within 30 days. He advised although the community has a
HOA and exterior walls needed HOA approval, they were able to address the exterior
wall.
Decision
Based on the testimony, Ms. Ellis reduced the lien to $500, plus administrative costs of
$730.15.

Ms. Springer presented the case. The Notice of Violation was sent March 21, 2014
regarding violations pertaining to mow, weed and trim all overgrowth and install four -
inch house numbers on the building. The case was heard on May 21, 2014, and no one
appeared. The compliance date and fine was May 28, 2014, or a fine of $100 a day
would be imposed thereafter. The violations were corrected on January 23, 2015,
having 239 days of non - compliance, accruing a fine of $23,900 plus administrative fees
of $634.12.
Ms. Springer was contacted in January 2015, and the Respondent needed to obtain a
permit for the new exterior entry door and garage, remove trash, debris and outside
storage, tire and lawnmowers, repair or replace windows, pay past due property taxes
and water bills and have a final inspection on an open plumbing permit. Ms. Springer
was contacted again in May 2015 and the water bill and property taxes had to be paid,
and the yard and swale needed to be sodded. In June 2014, the water bill remained.
The bill was paid and the property was eligible for lien reduction.
Robert Aspenwall, the Respondent's son, was unaware of the issues when his
mother passed. He addressed the issue and was trying to sell the property. He advised
there is a contract on the property and he did not have the funds to correct the matters
earlier.
Decision
Ms. Ellis reduced the lien to $500, plus administrative fees of $634.12.

Officer Pierre presented the case for the above violations. Staff recommended a 10 -day
compliance date of June 25, 2015, or a fine of $200 a day thereafter.
Nicole Lucero, the homeowner, explained the original work was done in 2006. They
had not done any work on the home that requires a permit. The permits were open for
years and they purchased the home three years ago. The person they bought the home
from indicated all was addressed and $1,000 was paid to the City. She learned later
there were open permits and then received a hearing notice. Her husband attended the
June hearing and they reopened all the permits. There was much to do and they

wanted to comply. The permits will expire on September 1 St and she requested that
amount of time to fix the violations.
Decision
Ms. Ellis tabled the case to the next month's meeting.
Ms. Lucero had documentation she provided to Ms. Ellis. After a review, Ms. Springer
pointed out Ms. Lucero obtained all the permits. Officer Pierre recommended the case
be closed. The case was closed.

Officer Hart presented the case as in the Notice of Violation. The case arose from a
City Department referral. The initial inspection date was March 17, 2015, and written
notice was sent the same day giving 10 days to correct the violation. Service was
obtained by posting the property and City Hail on June 3, 2015. The property was
inspected on April 10, 2015, and failed due to missing smoke detectors, ripped or
missing soffit screens, outside storage, trash and debris, torn or missing window
screens, a hot water heater permit was needed and sod. The property was last
inspected on June 16, 2015, and Officer Hart spoke with the owner who requested a 30-
day extension to July 17, 2015. Staff recommended a 30 -day compliance date of July
17, 2015, and a fine of $150 a day thereafter. Officer Hart and the Respondent will
meet at the property on Friday morning to review all that needed to be done.
Maximiot Valceus, the owner, was present. Ms. Ellis explained the City was allowing
the 30 -days and there was an understanding between the parties.
Decision
Ms. Ellis ordered the 30 -day compliance date of July 17, 2015, and a $150 a day fine
thereafter.

Officer Shickles presented the case. The Notice of Violation was November 12, 2014,
pertaining to trash and debris, outside storage, inoperable and unregistered vehicles,
repair of fence and gates, and remove awnings and shutters or put in up position for fire
safety. The case was heard January 21, 2015, and no one appeared. Gasper Thomas,
the property owner's son appeared at the fine certification hearing and the case was

tabled. A compliance date of May 7, 2015, and fine of $300 a day thereafter was
imposed. The property was last inspected on June 16, 2015, and the violations still
exist having 101 days of non - compliance. Except for the hurricane shutters remaining
in a down position, which was a fire safety hazard, all the other violations were
corrected. Officer Shickles was told by the Respondent the shutters could be raised to
the up position within the hour.
Marie Thomas, the property owner and her son Gasper, were present, and Gaspar
explained when he last appeared it was emphasized there be better communication. He
contended if he calls for an inspection and he missed an item, Code should advise what
needed to be done. He explained he was unaware they had to remove the shutters.
The awnings in the photographs were part of the home and it was a matter of telling his
mother all was clear except for the awnings. He did not see any reason to spend half a
day at the hearing, when the Officer could have indicated they had to raise the shutter.
Ms. Ellis explained the Notice contained information about the hurricane shutters.
Decision
Ms. Ellis ordered the shutters /awning be raised by 5 p.m. If not, the fine is certified.
Case No. 14 -1382 Federal National Mortgage Assoc. 232 SW 4 th Avenue
Ms. Springer presented the case which pertained to installing sod in the yard and swale
area and applying for a Business Tax Receipt for a rental property. The case was
heard on November 19, 2014, and no one appeared. The compliance date and fine
was to correct the violations by December 4, 2014, or a fine of $50 a day would be
imposed thereafter. The violations were corrected on May 12, 2015, having 158 days of
non - compliance and a total fine of $7,900 plus $730.15 in administrative fees.
Ms. Springer was contacted in June for a lien reduction inspection. Nautica Realty was
handling the property and had addressed the violations prior to the inspection. The
property passed the lien reduction inspection immediately.
Angie Niebel, Nautica Realty, authorized representative for Fannie Mae, agreed
with the presentation made by Ms. Springer.
Decision
Based on the testimony, Ms. Ellis reduced the lien to $500 plus administrative costs of

been discussion about the sod issue and the Respondent was given until Friday of that
week to produce evidence to Code Compliance regarding the sod and to show
compliance was achieved.
Ms. Ellis clarified there were two cases. The case being heard pertained to sod and Ms.
Snyder was given time to produce evidence of compliance. Ms. Snyder commented
she thought she had until Friday to reopen the fence and roof permits. Officer Cain and
she went to the Building Department to apply for a permit after the hearing and they
reviewed photographs of the yard Ms. Snyder had on her phone. She also had receipts
for sod installed before the hearing. Ms. Snyder asserted Officer Cain saw the work she
did and that he said it looked nice. She contended there was nothing in writing that she
was responsible for addressing anything outside of the sidewalk and this was a new
issue.
Ms. Ellis explained it was clear the sod was an open issue from last month. Ms. Snyder
explained the photographs were of the work she started on her yard last month. The
property had been watered regularly and some grass needed to be reinvigorated due to
the removal of concrete for a redesign of the yard. Ms. Ellis reviewed the photographs
Ms. Snyder had on her phone.
Decision

Ms. Snyder explained when she went to the Building Department to address the matter,
they asked why she wanted to reopen the permit, and she responded because she was
cited. The Building Department explained there was no reason to open the permit. She
presented a letter indicating she did not need to reopen the permit after the hearing last
month. She and Officer Cain went to the Building Department and Officer Cain
explained to Building staff why it needed to be reopened. The Building Department
investigated the matter further and determined when the roof permit was applied for by
the prior owner as an owner /builder and no inspections took place. Ms. Snyder now
understood why she was asked to reopen the permit and she obtained a letter from an
engineer regarding it, which Ms. Ellis reviewed. Ms. Snyder produced documentation
the date the permit was reopened.
Ms. Ellis inquired if the vehicle was in the carport. Ms. Snyder advised she had the
registration for the vehicle and commented the registration was dismissed last month.
There was a Chevy Avalanche there because she needed a vehicle to drive. This
month, she drove from Virginia in a van and the violation was for a Dodge Ram truck.
Officer Pierre explained the vehicle currently on the property was fine, but there was a
different vehicle, which was gone.
