PLayor Michael acknowledged the presence of Joe Cook: President of the Boynton Beach Jaycees. MINUTES Mr. Gallo moved that the Minutes of June 3, 1968 Meetin~ be accepted as presented. PUBLIC H~AR~G Mayor Michael read the following request for change in zoning: Parcel l: West 1/4 of S.W. 1/4 of N.E. 1/4 less W. 10 ft. and also less E. 180 ~t. o~ N. 135 Ft. and less E. 180 ft. of S. 210 ft.; Ac. Sec. 28-45-43: Palm Beach County Records. Request: R-lA to R-2A Location: Bounded on the South by S.W. 6th Ave., and on the No~th by S.W. 2nd Ave.: and on the West by extension of S.W, 1st St. O~er: DavidJ. Wolfe (Acacia Developers, Inc.) The Mayor then asked for anyone in the audience to come forward who was in favor of the change in zoning. Ward Cummings: 100 S.W. 2nd Avenue: came forward as a representative of David J. Wolfe, o%~er of the parcel, and also as the developer of the proposed apartment building. He fumthe~ assured the Council this would be an attractive, well-kept build- ing which would be an asset to the City. The Mayor then asked for anyone to come forward who was against this change in zoning. Robert Benson: 136 S.W. 6th Avenue~ came forward to state the ~esidents in that area were against this change in a single family area, and they considered it spot zoning. Cornelius Fisher~ 129 S.W. 6th Avenue, stated he was strictly against apartment ~uildings in the area. Oakley Smith~ Sr.~ 201 S.W. 3rd Avenue~ stated he was against apartment buildings in the area. Harry Thomas, 212 S.W. 6~h Avenue stated he was against apartment Build- ings. Otis Cobbler, 128 S.W, 6th Avenue stated he was a signer of a previous petition which stated they were against this change 52G zoning. Much discussion followed. Mayor Michael stated that this was quite a large tract of property and it was p~obably destined to be ~ome type of apartment building eomplex~ but ~elt that the City had a duty to Drotect the rights o~ the residents to live in a decent neighborhood. Mr. Gallo made the motion to approve the change in zoning on this parcel of land ~om R-t?; to R-RA. ~. Collins seconded; motion ce~mied 3-1, ~yor Michael dissenting. Gallo made the mo~ion that Ordinance 68-16 be accepted on firs~ reading. Mm. Collins seconded; m~tion passed 3-1, ~4ayoz~ Michael dissenting. ~WARDING OF BIDS .C.A.T.V. (On the table) Mm- Gallo made the motion this item be removed from the table. Collins seconded. Hnanimously carried. P~. Gallo made the motion that the bid be a%~rded to Teleprompter Cor- poration as recommended by the Tabulating Committee. Mr. Nylund sec- onded. -2- MINUTES REGGLAR CITY COUNCIL ~ETING JUNE 17, 1968 Mayor Michael asked whether or not Teleprompter Corp~ had signed the Statement of Ethics. Mr. Cromwell: Attorney for Teleprompter stated the Corporation had never received one ~ but they were ready and willing ~o sign a Statement of Ethics immediately: which was done. Mayor Michael asked Mr. Gallo To read the entire bid tabulations as sub- mitted by the three (5) companies which he did. The Mayor then asked the City Attorney if this would necessitate a re, er- endure acaording to the City's Charter. Mr. Moore stated this vould not be necessary as CATV is not considered a public utility, and further stated an Ordinance would have to be drai~n up to incorporate the necessary specifications and financial obligations to the city. Motion carried 4-0 ~ Mr. Summers being absent. I.N .SURANCE Mayor Miehae! stated the Tabulating Committee has recommended that Ray Allen Agency be granted the Comprehensive General Liability Insurance and the Harvey Oyer Agency be granted the Volunteer Fire and Au×i%iary Police Accident Insurance. Mr. Gallo moved the Insurance Bids be awarded to Ray Allen, American Fire & Casualty Co., and Harvey Oyer~ Phoenix of HartToz~, as ~ecommended by the Tabulating Committee. Mr. Nylund seconded. Motion carried 4-0. City Attorney explained that according to the City Charter it is not necessary to read Resolutions, and since this Resolution is quite length~z (31 pages), he would suggest Mr. Courtney explain some of the changes involved. Mr. Court-ney commented on some of the significant changes which are involved in Resolution 68-E. Mr. Moore then read Resolution 68-E by caption only. City AttOrney read the letter received from the Attorney for Brown Miller in which he stated the Release oF Easement dated August 22~ 1967 had an error in the legal description which ~s to include ~the East 5 feet of Lot 6~, and asked that the City sign the corrected cOpy of the Release of Easement. City Manager explained t ~h~t the increase in pay scale %,~uld include all employees below the supeD~isory level with the exception o~ the Police and Fi~e Depamtments inasmuch as they did receive a 2-step increase last year. l~, Gallo moved we approve the pay changes as presented by the City Manager. Mr. Nyiund seconded. Mr, Collins stated he was delighted our pay scale %,~as brought up to the level o~ the minimum wage scale compared to the Federal Government. Motion carried 4-0. Consider Progosat of, St. Re~is Paper Co: - Re Paper Re,use Sacks.~ ~. Courtney explained that St. Regis Paper proposed to test an area in the city consisting o~ 500 homes for a 5 month 9eriod with their paper sack system. St. Regis will also 9ut on an educational camgaign for the benefit of the citizens ~ ~elease ne%~ items to the newspapers to keel the citizens informed and remain in the city to answe~ any questions whi] the experiment is being conducted for the three month period. The cost to the city will be approximately $4~000. After the 5 month period~ /~ 511of the trial users vo~e against this sytem~ St, Regis Paper will return one-half of the $4~000. ~o the city. ~. Collins suggested that the City Council~ with Mr. Hopkins~ Public Works D/mector~ t~y to arrange to visit a City nearby %~hois.presently operating under this system before Boynton Beach considers this experi- ment, 14ayor Michael asked ldr. Hopkins if he was familiar with this system~ and PL~. Hopkins stated he was b~t only through %-~ad~ journals. Mayor Michael then questioned Councilman Nylund inasmuch as he has been testing the system /~his home. M~. Snowdenwould like to enter into a Lease Agreement with the City fo~ a period of 5 yeams with the Option ro sign for another 5 years. Mr. Gallo made the motion that we enter into a Lease Ag-~eement with Mr. SPmv~en based on the te~ms of his lease proposal to the City and subject to a completed set of plans and specifications to be approved by the Council. i'~.
