HELD IN COMMISION CHAMBERS, 100 E. BOYNTON BEACH BOULEVARD
BOYNTON BEACH, FLORIDA
ON TUESDAY, JULY 14, 2015, AT 6:00 P.M.

A. Lloyd E. Minnis, Plaintiff vs. City of Boynton Beach, Defendant - In the Circuit
Court of the Fifteenth Judicial Circuit, In and For Palm Beach County,
Florida - Case No. 2015 CA 000172 Division AE
Attorney Cherof announced they would discuss the pending lawsuit regarding Lloyd E. Minnnis
versus the City of Boynton Beach pending in the 15 Judicial Circuit Court of Palm Beach
County. In attendance in the closed -door session would be the Mayor and members of the City
Commission, the City Attorney, City Manager and Assistant City Attorney Tracy DeCarlo. The
session will last approximately 25 minutes and they will return to Chambers to adjourn the
Special Meeting.
Commissioner Fitzpatrick announced this is in regard to a Metropolitan Planning Organization
vote that he led the City Commission to vote to deny. They may have to return to the matter
because after the meeting, the Fire Chief approached him indicating he was unsure they read it
correctly, and they may have actually voted themselves out of the MPO. The next day he sent
an email to the MPO Director and asked his opinion and was advised the attorney had not
gotten back to him, so this may have to be addressed at the next meeting. He may have made a
mistake and wanted the members to be aware they may have to revisit the issue.
Attorney Cherof advised if the City Commission, even though it was a Special Meeting, wanted
to reconsider the matter, they could move to pass the motion that was before the City
Commission and condition that approval by sending the Resolution back with a notation that the
City was approving it, but point out the City may not be properly represented on the MPO and
ask for future consideration of it. They would get the point they wanted to make across and
move forward with participation in the program.
Commissioner Merker so moved. Commissioner McCray seconded the motion that passed
unanimously.

Attorney Cherof advised the above motion was to reconsider the matter. The next motion would
be to do what he had previously advised.

unanimously.
Attorney Cherof announced they would make sure the issue would be sent with the appropriate
cover letter and he would ask Commissioner Fitzpatrick to review the draft. Mayor Taylor
agreed.
Mayor Taylor recessed the Special City Commission meeting at 6:05 p.m. for the closed -door
session.
Mayor Taylor reconvened the meeting to adjourn at 6:31 p.m. as the closed -door session had
concluded.
