O97-27ORDINANCE NO. O97-,~' AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING CHAPTER 22, "STREETS AND SIDEWALKS", ARTICLE I. "IN GENERAL", OF THE LAND DEVELOPMENT REGULATIONS BY AMENDING SECTION 4. "OBSTRUCTING STREETS, PROHIBITED," TO PERMIT THE PLACEMENT OF DUMPSTERS, COMPACTORS, AND LOADING ZONES TO BE LOCATED IN THE PUBLIC RIGHT-OF-WAY; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, it has come to the attention of the City Commission of the City of Boynton Beach that amendments are required regarding certain Sections and Articles in the City's Land Development Regulations; and WHEREAS, the City Commission has found that promoting redevelopment and development in the Central Business District requires certain amendments to the existing Land Development Regulations; and WHEREAS, upon recommendation of staff, the City Commission of the City of Boynton Beach has deemed it to be in the best interests of the citizens and residents of the City of Boynton Beach to amend Article I, Section 4 of Chapter 22 of the Land Development Regulations to permit the placement of dumpsters, compactors and loading zones to be located in the public right-of- way. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. Chapter 22, Article I, Section 4. "Obstructing street, prohibited," is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: 4. Obstructing streets, prohibited. It shall be unlawful for any person or the agent or agents of any person to blockade or obstruct any street or public way within the city, so as to impede traffic or pedestrians thereon, or cause any interference or dangerous obstacles to be placed on or across any Wp\ord~mafina~ldr clapt 22 5/20/97 of the streets or public ways within the city, except that in the Central Business District, loading zones, dumpsters and compactors, and their enclosures may be situated in the public right-of-way. Section 2. That each and every other provision of the Land Development Regulations not hereinbefore specifically amended shall remain in full force and effect as previously enacted. Section 3. All laws and ordinances applying to the City of Boynton Beach in conflict with any provisions of this ordinance are hereby repealed. Section 4. Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5. Authority is hereby given to codify this Ordinance. Section 6. This Ordinance shall become effective immediately. FIRST READING this ,~ day of June, 1997.
