A. BACKGROUND
Nestled between Miami (45 miles to the south) and West Palm Beach (ten miles to the
north), Boynton Beach is the third largest city in Palm Beach County, Florida with a
growing population of approximately 70,000.
Great marinas and canals offering direct access to the Intracoastal Waterway and to the
Atlantic Ocean with a straight shot to the Bahamas Islands which bring boaters, divers
and fishing charters to the area. Commuters and tourists are provided many avenues to
access both Interstate 95 and the Florida Turnpike. Tri-Rail stations are located within
and close to Boynton Beach.
The Boynton Beach City Library is located in the heart of the Boynton Beach business
district. The library, along with several other City buildings, is situated in Town Square, a
two block area that houses approximately 250 employees. These buildings include City
Civic Center and Madsen Center.
The City of Boynton Beach is accepting proposals from businesses interested in
operating a Café at the Boynton Beach City Library. The intent is that this Café operator
will operate the food and beverage services at the Boynton Beach City Library within the
designated City facility.
The City will lease the designated portion of the Library building known as the Sailfish
Cafe to the concessionaire for a period of three (3) years. The Café occupies
approximately 711 square feet, within a concrete structure at 208 S. Seacrest Boulevard,
Boynton Beach, Florida, which is located at the northeast corner of the Library plus a 97
square foot storage room. The Café has direct access to the Library and to the outside.
The space designated as the Café, is owned by the City of Boynton Beach, Florida, and
operated for the selling of food and beverages for Library patrons and the general public.

The awarded operator will conduct an operation that will be customer oriented.

1. The operator will sell food and beverages as allowed by the City Of Boynton Beach at
competitive prices.
2. Operator shall provide all working capital, additional operating equipment, and inventory
necessary to effectively manage the café.
3. Sample /Layout to be submitted with proposal, to include all furnishings.
4. Operator may offer non-consumables for sale. Non-consumables may include, but are
not limited to coffee mugs, hats or tee shirts; however, the City Of Boynton Beach
reserves the right to have the final approval of such items. No alcohol or tobacco
products shall be offered for sale.
5. City shall not be responsible for any goods or equipment stored at the café or storage
room nor will it be responsible for damage resulting from a power failure, flood, fire, theft,
vandalism, explosion and/or other causes.
6. The city reserves the right to inspect premises at any time.
7. The operator shall keep accurate records of all sales and receipts through the use of
electronic cash registers which provide daily tapes and reports. The operator will
prepare a monthly report and mail to: Craig Clark, Library Director, 208 S. Seacrest
Blvd., Boynton Beach, Florida, and attach copies of the daily tapes of each report.

Report will be due the 1 of each month along with the lease payment. The City shall
have the right to inspect the books, records and inventories of the operator at any given
time.
8. At time of award, the operator shall file with the Library Director, a $2,000.00 security
deposit, refundable at the end of the term, without interest, after the determination that
the operator has fulfilled all terms of the lease and left the premises in adequate
condition, (normal wear and tear), as determined by the Library Director.
12. The awarded concessionaire to provide:

Any additional professional equipment desired, including installation.

13. The awarded concessionaire may have the opportunity to provide food service and
catering for meetings and other similar functions.

1. The operator will provide, supervise, and compensate all café employees. The staff will
be employees of the operator, not the City. The operator shall at all times be an
independent contractor and the agreement shall not in any way create or form a
partnership or joint venture with the City. No agent, servant, or employee of the
operator shall under any circumstances be deemed an agent, servant, or employee of
the City. Appropriate staff of operator shall be responsible for possessing food handling
license(s) as required by the Florida State Health Department.
2. Consumption of alcoholic beverages, smoking, and use of tobacco products is
prohibited inside the Library.
3. personnel shall, at all times, present a neat and professional appearance.
4. Personnel who pose a potential security risk must be replaced by the operator.
5. All employees must wear a badge to identify the company they are representing and
their name. If a security badge is not issued by the operator, our Police Department will
issue one for a nominal fee.
6. Operator shall provide a list of employees to the City and provide proof that the
employer has done a background check with the State of Florida Department of Law
Enforcement and the results of the background check for each employee who will be
working at the café. City shall retain the right to prohibit an employee from working at
the café based on the results of the background check.
7. Operator shall employ only competent personnel to perform café services. In the event
that the City, at its sole discretion, at any term of this lease agreement, desires the
removal of any person or persons employed by the operator to perform café services
pursuant to this lease agreement, operator shall remove any such person immediately

I. Responses shall be evaluated by the Selection Committee based on all information
submitted. A short list of the three (3) most qualified, top ranking concessionaires will be
generated according to evaluation criteria listed within this document. The short list will be
submitted to the City Commission for approval. The Selection Committee will recommend
the concessionaire believed most qualified operate the library café to the City Commission
of the three (3) most qualified firms.
J. In the event less than three (3) firms respond to the RFQ, or less than three (3) are deemed
qualified by the Selection Committee, then Procurement Services Division shall make a
determination as to whether to proceed with the lesser number of firms. If the decision is to
re-advertise, and after a subsequent advertisement resulting in three (3) firms that still
cannot be qualified, then the City shall proceed hereunder with the qualified firms.
K. The Selection Committee shall consist of City staff members and may include outside
consultants as deemed necessary.
L. A sample draft agreement that the City intends to execute with the successful firm is
contained within this Request for Qualifications for review. The City reserves the right to
modify the contract language prior to execution. The actual scope of services and
consulting fees will be negotiated following selection of the top firm.
M. Each Respondent, by submission of an RFQ response, acknowledges that in the event of
any legal action challenging the award of a contract in response to this RFQ; damages, if
any, shall be limited to the actual cost of the preparation of the Response.

A. The Response from the proposer is to demonstrate the
qualifications, competence, and capacity of the operators seeking to undertake
the requirements of this Request for Qualifications. As such, the substance of the
Response will carry more weight than its length, form or manner of presentation.
The Response should demonstrate the qualification of the operator and the
particular staff to be assigned to this engagement. It should also specify an
approach that will meet or exceed the Request for Qualifications requirements.
The selected concessionaire shall provide sufficient organization, personnel, and
management to carry out the requirements of this RFQ. Additionally the selected
concessionaire will be required to demonstrate recent experience operating a
food and beverage concession and/or facility.

profit and loss statements for the past five years.

closed due to health reasons. Proposers must have never been found to
have failed to pay all taxes.

all firms will be developed and advanced to the City Commission. The
determination shall be based upon the following criteria and respondents shall
provide, as a minimum, the information listed under each criterion. Failure to
provide adequate information listed on any criterion may result in rejection of the
submittal as non-responsive.

B. Selection Process
1. A Selection and Evaluation Committee consisting of City staff, will review each
submission for compliance with the requirements of the RFQ, including verifying that
each Proposal includes all documents required. In addition, the Committee will
ascertain whether the provider is qualified to render the required services according
to State regulations and the requirements of this RFQ.
2. The Selection and Evaluation Committee will score and rank all responsible
proposals and determine a minimum of three (3) firms deemed to be the most highly
qualified to perform the required service. A sequential ranking of all firms will be
developed and advanced to the City Commission for approval.

3. The City Commission may, at their option, request formal presentations prior to the
final selection.
4. Competitive negotiations will begin once the City Commission has approved the
responsible, responsive firms deemed to be the most highly qualified to perform the
required services.
5. The City will negotiate an agreement based on the attached draft agreement found in
Aand developed from this Request for Qualifications. The City reserves
the right to include additional provisions if the inclusion is in the best interest of the
City, and as determined solely by the City. Assuming the successful negotiation of
an agreement, the final agreement will be submitted to the City Commission for their
consideration and approval.

1. FAMILIARITY WITH LAWS: The Respondent is presumed to have full knowledge of and be
in compliance with all Federal, State, and Local laws, ordinances, rules, and regulations that
in any manner affect the equipment and the services provided to the City. Ignorance on the
part of the Respondent will in no way relieve Respondent of responsibility to adhere to such
regulations.
2. RFQ FORMS: The Respondent IS required to be licensed to do business as an individual,
partnership, or corporation in the State of Florida. All RFQ forms must be executed and
name and address, RFQ title, number, RFQ date and time. Responses not submitted on
RFQ forms herein may be rejected. All Responses are subject to the conditions specified
within this solicitation document. Responses which do not comply with these conditions are
subject to rejection.
3. EXECUTION OF Response: Response must contain a manual signature of an authorized
representative in the space provided on all affidavits and proposal sheets.
4. NO SUBMITTAL: If not submitting a Response, acknowledge so by returning one copy of
Response
reasons listed or give details in the space provided. Repeated failure to quote without

5. RFQ DEADLINE: It is the Respondents responsibility to assure that the Response is

not delivered by the deadline will not be considered. If no award has been made, the City

6. RIGHTS OF THE CITY: The City expressly reserves the right to:
A. Waive any defect, irregularity or informality in any RFQ or RFQ procedure;
B. Reject or
C. Reissue an Invitation to RFQ;

E. Consider and accept an alternate RFQ as provided herein when most advantageous to
the City.
7. STANDARDS: Factors to be considered in determining whether the standard of
responsibility has been met include whether a prospective Respondent has:
A. Available the appropriate financial, material, equipment, facility, and personnel resources
and expertise, or the ability to obtain such, necessary to indicate its capability to meet all
contractual requirements;
B. A satisfactory record of performance;
C. A satisfactory record of integrity;
D. Qualified legally to Contract within the State of Florida and the City of Boynton Beach;
E. Supplied all necessary information in connection with the inquiry concerning
responsibility.
8. INTERPRETATIONS: Any questions concerning conditions and specifications should be
directed to Procurement Services Division personnel identified in the RFQ document in

9. CONFLICT OF INTEREST: The award hereunder is subject to all conflict of interest
provisions of the City of Boynton Beach, Palm Beach County, of the State of Florida.
10. SUBCONTRACTING: If a Respondent subcontracts any portion of a Contract for any
reason, the Respondent must state the name and address of the subcontractor and the
of Boynton Beach reserves the right to accept or reject any or all RFQs wherein a
subcontractor is named and to make the award to the Respondent, who, in the opinion of
the City, will be in the best interest of and/or most advantageous to the City. The City also
reserves the right to reject a RFQ of any Respondent if the RFQ names a subcontractor who
has previously failed in the proper performance of an award or failed to deliver on time
Contracts of a similar nature, or who is not in a position to perform properly under this
award. The City reserves all rights in order to make a determination as to the foregoing.
11. ADDENDA: From time to time, the City may issue an addendum to change the intent or to
clarify the meaning of the Contract documents. Since all addenda are available to
Respondent through -Procurement system demandstar.com, it is each
Respondent responsibility to check with Procurement Services and immediately secure all
addenda before submitting RFQs. Each Respondent shall acknowledge receipt of ALL
addenda by notation on the Addenda Acknowledgement form herein and shall adhere to all
requirements specified in each addendum prior to submission of the RFQ.
12. ANTITRUST CAUSE OF ACTION: In submitting a RFQ to the City of Boynton Beach, the
Respondent offers and agrees that if the RFQ is accepted, the Respondent will convey, sell,
assign or transfer to the City of Boynton Beach all rights, title and interest in and to all
causes of action it may now or hereafter acquire under the antitrust laws of the United
States and State of Florida for price fixing relating to the particular commodities or services
purchased or acquired by the City of Boynton Beach. A
discretion, such assignment shall be made and become effective at the time the Purchasing
Division tenders final payment to the Respondent.

13. LEGAL REQUIREMENTS: Federal, State, County, and City laws, ordinances, rules, and
regulations that in any manner affect the items covered herein apply. Lack of knowledge by
the Respondent will in no way be a cause for relief from responsibility.
14. ON PUBLIC ENTITY CRIMES
Florida Statutes, requests for proposals as defined by Section 287.012(16), Florida Statutes,
and any contract document described by Section 287.058, Florida Statutes, shall contain a
statement informing persons of the provisions of paragraph (2)(a) of Section 287.133,
Florida Statutes, which reads as follows:

which may become due hereunder are not assignable except with the prior written approval

17. INDEMNIFICATION: The selected Respondent shall hold and save harmless the City of
Boynton Beach, Florida its officers, agents, volunteers and employees from liability of any
kind in the performance of this Contract. Further, the selected Respondent(s) shall
indemnify, save harmless and undertake the defense of the City, its City Commissioners,
agents, servants and employees from and against any and all claims, suits, actions,
damages, or causes of action arising during the term of this Contract, for any personal or
bodily injury, loss of life, or damage to property arising directly or indirectly from
Respondents operation pursuant to this Contract and from and against all costs, counsel
fees, expenses and liabilities incurred in and about any such claims, the investigation
thereof, or the defense of any action or proceedings brought thereon, and from and against
any orders or judgments which may be entered therein. The City shall notify the
Respondent
the City arising directly or indirectly from the operations of the Respondents hereunder, for
which the City may be entitled to a claim or indemnity against the Respondent, under the
provisions of this Contract. Respondent shall have the right to control the defense of any
such claim, suit or actions. The Respondent shall also be liable to the City for all costs,
expenses, attorneys fees and damages which may be incurred or sustained by the City by
reason of the Respondents of the contract. Respondent
shall not be responsible for negligent acts of the City or its employees.
18. PUBLIC RECORDS: Sealed documents received by the City in response to an invitation
are exempt from public records disclosure until thirty (30) days after the opening of the Bid
unless the City announces intent to award sooner, in accordance with Florida Statutes
119.07.

The City of Boynton Beach is a public agency subject to Chapter 119, Florida Statutes. The
119.071, Fla. Stat., the contractor shall:
1. Keep and maintain public records that ordinarily and necessarily would be required by
the City in order to perform the service;
2. Provide the public with access to such public records on the same terms and conditions
that the City would provide the records and at a cost that does not exceed that provided in
chapter 119, Fla. Stat., or as otherwise provided by law;
3. Ensure that public records that are exempt or that are confidential and exempt from
public record requirements are not disclosed except as authorized by law; and
4. Meet all requirements for retaining public records and transfer to the City, at no cost, all
public records in possession of the contractor upon termination of the contract and destroy
any duplicate public records that are exempt or confidential and exempt. All records stored
electronically must be provided to the City in a format that is compatible with the information
technology of the agency.
Failure of the contractor to comply with the provisions set forth in this General Condition
shall constitute a Default and Breach of the Agreement with the City.
19. CONTRACT AGREEMENT:
An Agreement outlining the Scope of Services with the intent of accomplishing a timely,
cost-effective completion of a given project will be provided. The Agreement will be based
on successful negotiation.
20. FUNDING OUT:
The resultant Agreement shall remain in full force and effect only as long as the
expenditures provided for in the Agreement have been appropriated by the City Commission
for the City of Boynton Beach in the annual budget for each fiscal year of this Agreement,
and is subject to termination based on lack of funding.
21. PALM BEACH COUNTY INSPECTOR GENERAL:
The successful Respondent is aware that the Inspector General of Palm Beach County has
the authority to investigate and audit matters relating to the negotiation and performance of
any Consultant Agreement/Task Order resulting from this solicitation, and in furtherance
thereof, may demand and obtain records and testimony from the consultant/engineer and its
sub consultants and lower tier sub consultants. The consultant/engineer understands and
agrees that in addition to all other remedies and consequences provided by law, the failure
of the consultant/engineer or its sub consultants or lower tier sub consultants to fully
cooperate with the Inspector General when requested, may be deemed by the municipality
to be a material breach of this Consultant Agreement justifying its termination. The awarded
Consultant/Engineer will be required to sign the Palm Beach County Inspector General
Acknowledgment Form as part of the final Consultant Agreement/Task Order.

1. The City by written notice may terminate in whole or in part any Contract resulting from
this RFQ when such action is in the best interest of the City. If the Contract(s) are so
terminated the City shall be liable for only payment for services rendered prior to the
effective date of termination. Services rendered will be interpreted to include costs of
items already delivered plus reasonable costs of supply actions short of delivery.
2. It shall be the responsibility of the successful Respondent
compensation insurance, general liability insurance and vehicular liability insurance;
during the time any of his personnel are working on City of Boynton Beach property.
Insurance Advisory Form.
The City of Boynton Beach is to be named . The successful
Respondent shall furnish the City with a certificate of insurance after award has been
made and prior to the start of any business on City property. Said insured companies

IDENTICAL TIE SUBMITTALS
Preference shall be given to businesses with drug-free workplace programs. Whenever two or
more submittals which are equal with respect to price, quality, and service are received by the
City of Boynton Beach or by any political subdivision for the procurement of commodities or
contractual services, a submittal received from a business that certifies that it has implemented
a drug-free workplace program shall be given preference in the award process. Established

employee assistance programs, and the penalties that may be imposed upon employees for
drug abuse violations.

3. LEASEHOLD PREMISES. The City agrees to lease to an Operator a portion of the designated City
facility located at the Boynton Beach City Library. Location is at the North East corner, first floor of the
new two story addition. The facility, a concrete structure of approximately 711 square feet, to include
Boynton Beach, Florida and operated for the selling of food and beverages to library patrons and the
general public.
4. TIME FOR PERFORMANCE. Work under this contract shall commence upon the giving of written
notice by the City to the Operator to proceed. Operator shall perform all services and provide all work
required pursuant to this operator for three (3) years from the date written notice is given to proceed,
unless an extension of such time is granted in writing by the City.
5. PAYMENT. The Concessionaire shall pay the City a sum of___________ each month for the first
twelve (12) months of the lease agreement. Subsequent payments each month shall be based on

cash registers, which provide daily tapes and reports. The Operator will prepare a monthly report
to the City and attach copies of daily tapes of each report. The City will have the right to inspect
the books, records and inventories of the Operator at any given time. Monthly reports shall be
due on the first of each month.
c. Final payment of any balance due the City of the total contract price will be made
promptly upon its ascertainment and verification by the City after the completion of concession
services under this agreement and its acceptance by the City.
d. Security deposit of $2,000.00 made by the Operator at time of award will be returned to
Operator at the end of the lease, without interest, after determination that the Operator has

fulfilled all terms of the lease and left the premises in adequate condition, as determined by the
Library Director.

6. OWNERSHIP AND USE OF DOCUMENTS. All documents, drawings, specifications and other
materials produced by the Operator in connection with the services rendered under this agreement
shall be the property of the City.
7. COMPLIANCE WITH LAWS. Operator shall, in performing the services contemplated by this
service agreement, faithfully observe and comply with all federal, state and local laws, ordinances
and regulations that are applicable to the services to be rendered under this agreement.
8. INDEMNIFICATION. Operator shall indemnify, defend and hold harmless the City, its offices,
agents and employees, from and against any and all claims, losses or liability, or any portion thereof,
including legal fees and costs, arising from injury or death to persons, including injuries, sickness,
disease or
act, omission or failure of the Operator.
9. INSURANCE. The Operator shall secure and maintain in force throughout the duration of this
contract comprehensive general liability insurance with a minimum coverage of $1,000,000 per
occurrence and $1,000,000 aggregate for personal injury; and $1,000,000 per occurrence/aggregate
for property damage, and professional liability insurance in the amount of $1,000,000.
Said general liability policy shall name the City of Boynton Beach as an additional named insured
and shall include a provision prohibiting cancellation of said policy except upon thirty (30) days prior
written notice to the City. Certificates of coverage as required by this section shall be delivered to the
City within ten (10) days of notice of award and every year thereafter upon renewal for the duration
of the contract.
10. INDEPENDENT CONTRACTOR. The Operator and the City agree that the Operator is an
independent contractor with respect to the services provided pursuant to this agreement. Nothing in
this agreement shall be considered to create the relationship of employer and employee between the
parties hereto. Neither Operator nor any employee of Operator shall be entitled to any benefits
accorded City employees by virtue of the services provided under this agreement. The City shall not
be responsible for withholding or otherwise deducting federal income tax or social security or for
contributing to the state industrial insurance program, otherwise assuming the duties of an employer
with respect to Operator, or any employee of Operator.
11. COVENANT AGAINST CONTINGENT FEES. The Operator warrants that he has not employed or
retained any company or person, other than a bona fide employee working solely for the Operator, to
solicit or secure this contract, and that he has not paid or agreed to pay any company or person,
other than a bona fide employee working solely for the Operator, any fee, commission, percentage,
brokerage fee, gifts, or any other consideration contingent upon or resulting from the award or
making of this contract.
For breach or violation of this warranty, the City shall have the right to annul this contract without
liability or, in its discretion to deduct from the contract price or consideration, or otherwise recover,
the full amount of such fee, commission, percentage, brokerage fee, gift, or contingent fee.
12Discrimination prohibited. The operator, with regard to the work performed by it under this
agreement, will not discriminate on the grounds of race, color, national origin, religion, creed, age,
sex or the presence of any physical or sensory handicap in the selection and retention of employees
or procurement of materials or supplies.

13. ASSIGNMENT. The Operator shall not sublet or assign any of the services covered by this
agreement without the express written consent of the City.
13. NON-WAIVER. Waiver by the City of any provision of this agreement or any time limitation provided
for in this agreement shall not constitute a waiver of any other provision.
14. TERMINATION.
a. The City reserves the right to terminate this agreement thirty (30) days after delivery of written
notice of such termination and reason (s) for the lease termination.
b. In the event of the death of a member, partner or officer of the Operator, or any of its supervisory
personnel assigned to the project, the surviving members of the Operator hereby agree to
complete the work under the terms of this agreement, if requested to do so by the City. This
section shall not be a bar to renegotiations of this agreement between surviving members of the
Operator and the City, if the City so chooses.
c. This lease agreement may be terminated immediately for default of monthly payment as stated in
item # 5-A of this contract.
d. This lease agreement may, at the option of the City, be terminated immediately if the Operator
shall become insolvent or bankrupt, make an assignment for the benefit of creditors or be
convicted of a crime or any other similar gross misconduct.
15. RENEWAL. The Finance Director may renew the contract, at the same terms, conditions, and
prices, for two (2) additional one (1) year periods subject to vendor acceptance, satisfactory
performance and determination that renewal will be in the best interest of the City.
16. DISPUTES. Any dispute arising out of the terms or conditions of this agreement shall be adjudicated
within the courts of Florida. Further, this agreement shall be construed under Florida Law.

18. INTEGRATED AGREEMENT. This agreement, together with attachments or addenda, represents
the entire and integrated agreement between the City and the Operator and supersedes all prior
negotiations, representations, or agreements written or oral. This agreement may be amended only
by written instrument signed by both City and Operator.
19. PUBLIC RECORDS
The City of Boynton Beach is a public agency subject to Chapter 119, Florida Statutes. The
. Effective July 1, 2013, Section 119.071,
Fla. Stat., the contractor shall:
1. Keep and maintain public records that ordinarily and necessarily would be required by the City in

2. Provide the public with access to such public records on the same terms and conditions that the
City would provide the records and at a cost that does not exceed that provided in chapter 119, Fla.
Stat., or as otherwise provided by law;
3. Ensure that public records that are exempt or that are confidential and exempt from public record
requirements are not disclosed except as authorized by law; and
4. Meet all requirements for retaining public records and transfer to the City, at no cost, all public
records in possession of the contractor upon termination of the contract and destroy any duplicate
public records that are exempt or confidential and exempt. All records stored electronically must be
provided to the City in a format that is compatible with the information technology of the agency.
Failure of the contractor to comply with the provisions set forth in this General Condition shall
constitute a Default and Breach of the Agreement with the City.

SUBJECT: Issues addressed by Cemetery Board
The Cemetery Board meets quarterly. Since 2012, issues addressed by the board members at
Recommended to the City Commission a rewording of Cemetery Rules & Regulations
#1-M to include a fee of $75 for Mausoleum transfers and a language change to clarify
buy-backs by the City at the Mausoleum;
Recommended to the City Commission a change to the Cemetery Rules & Regulations to
allow the overtime fee to begin at 2:00 p.m. rather than 2:30 p.m.;
Recommended to the City Commission fees of $50 and $20 for replacement of large and
small vases at the Mausoleum; and
rights of inurnment at the Mausoleum.
In 2014, the former chair of the board raised the issue of developing ways to generate revenue
for the Cemetery and increasing the landscaping Those
two issues were tabled and remain on the table at this time until after the City Commission
discusses the future of the cemetery at their Strategic Planning sessions.

1.Lot owners shall not allow interments to be made in their lots for remuneration; nor shall any
transfer, assignment, or conveyance of any lot or any interest therein be valid without the consent
in writing of the City of Boynton Beach and same endorsed upon such transfer, assignment or
conveyance. No transfer, assignment, or conveyance of a lot can be made after an actual
interment in it, except with the consent of the City of Boynton Beach after the body is lawfully
removed therefrom. No disinterment shall be allowed except by the consent of the Board of
Governors and upon written request of the owner or owners of the lot and in every case shall only
be made by the proper authorities.
(NOTE: Authorized disinterment and shipment of body may be made only by a licensed funeral
director licensed in Florida to another licensed funeral director at final disposition.) City
disinterment forms shall accompany all disinterments.)
2.The City of Boynton Beach is reluctant to interfere with the tastes of individuals in regard to the
style of their improvements at the cemetery; but in the interest of the whole and all cemetery lot
owners, it reserves to itself the right of preventing or removing any erection, enclosure,
monument, inscription, tree or shrub which is inconsistent with the purpose of these rules and
which the City considers injurious to the grounds. Under no circumstances will lots be allowed to
have on them growing or live plants, trees, or bushes directly planted in the ground and such will
be removed by City employees.
3.In addition to the grave marker, there will be a limit of three items placed on a grave site. In
general, these three items can be those chosen by the owner, but must be able to be moved with
one hand and flowers must be in a container that has a solid base not to exceed 18 inches in
height so that it will easily stand erect or in a container with a point on the bottom that is easily
stuck into the ground.
These items must be tastefully placed at gravesites. No glass vases or figurines will be
permitted. Employees will, for cemetery maintenance purposes, move and replace these items
with care, but the City does not accept responsibility for replacing broken items unless there is a
clear negligence on the part of the City employees.
(NOTE: City employees may remove any item placed on a gravesite that becomes untidy or
unsightly to the appearance of the Cemetery.)
4. Lot enclosures of any kind are prohibited. No mounds are permitted over graves. The grade of
all lots will be determined by the Board of Governors.
5.No person shall be allowed to perform any modification or installation of a monument or marker
on a lot without authorization from the City. No marker shall be accepted by the City without prior
authorization of the City.
6.All excavations shall be made by the City, unless otherwise approved by the City. Installation of
markers must be approved by the City.

grounds.
14. On Memorial Day, Veterans' Day and other national holidays, the Veterans' organizations may

18. No more than three (3) markers will be permitted per adult grave. The markers will run
consecutively beginning at the head of the plot. A second marker would be placed directly below
the first and a third marker would be placed directly below the second. At no time will more than
three (3) markers be permitted. In the Replat section, two (2) cremains will be permitted in a
cremains plot. No more than two markers will be permitted on a cremains plot in the Replat
section.

anticipated, the funeral director and/or family must contact cemetery staff in an effort to work out
the details of the arrival.
25. A fee of $200 will be charged for each half-hour (30 minutes) of delay from the scheduled arrival
time of the funeral. If a later than scheduled arrival is anticipated, the funeral director and/or
family must contact cemetery staff in an effort to work out the details of the arrival.

MAUSOLEUM
1-M. Mausoleum Crypts or Niches - Prior to inurnment/entombment, an owner may transfer or resell
the mausoleum crypt or niche provided the owner first obtains the written consent of the City of
Boynton Beach. Such consent shall be given automatically provided that the new purchaser's
name, address and phone number are on file with the City Clerk and an administrative fee equal
to the cost of relettering the mausoleum, crypt, or niche is paid in full to the City of Boynton
Beach.
After inurnment/entombment, resale or transfer of ownership shall be allowed. The City of
Boynton Beach may purchase the crypt or niche at a cost of 50% of the original purchase price
paid for the crypt or niche and provided that disinurnment/disentombment has occurred and
implemented by the proper authorities.
No disinurnment/disentombment shall be allowed except by the consent of the Cemetery Board
following written request by the owner or owners of the crypt/niche and in every case shall only
be made by the proper authorities.
(NOTE: Authorized disinurnment/disentombment and shipment of body or remains may be made
only by a licensed funeral director licensed in Florida to another licensed funeral director at
terminal point.)
When a crypt or niche was originally sold, the City of Boynton Beach received 15% of the original
sales price. A transfer fee of $75 will be charged when a previously purchased crypt or niche is
resold.
The City will buy-back unused crypts or niches at 80% of the original contract price
2-M. The City reserves to itself the right to approve any erection, enclosure, monument, inscription,
tree or shrub.
3-M. All identification information including letters and emblems on crypts and niches shall be
inscribed by engraving. The cost of new crypt or niche inscription fees shall be paid at time of
interment.
Existing bronze letters shall be replaced with inscription by the City. Replacement inscription
shall be done at no cost to the owner of the crypt or niche, but shall be paid from the Perpetual
Care Fund. If existing bronze emblems are damaged, replacement of an existing bronze emblem

bronze vases previously approved by the City. Fresh flowers can remain for a maximum period of
three (3) days. No artificial flowers, except silk flowers, are permitted in or around Mausoleum
buildings. One (1) vase per crypt/niche will be allowed. Employees will, for maintenance
purposes, move and replace these items with care, but the City does not accept responsibility for
replacing broken items unless there is a clear negligence on the part of the City employees. After
the third day, or in the case of silk flowers, when the Cemetery Sexton determines that the
flowers have become unsightly, said flowers shall be removed and disposed of.

envelopes, memorabilia or photographs shall be allowed for two days.
5-M. No person shall be allowed to perform any modification on anything without written permission
from the City. No money should be paid to any person in the employ of the City for services or
attention, other than their salaries and wages paid by the City.
6-M. All original sales of mausoleum crypts or niches shall be originated by the City of Boynton Beach.
The City of Boynton Beach shall then forward an executed request for the issuance of a
certificate of ownership within 30 days which shall include the purchaser's complete name,
address and phone number. Upon receipt of a request for the issuance of a certificate of
ownership, the City shall issue a certificate of ownership and forward it to the purchaser within
14 days. There shall be no fee for issuance for the certificate of ownership.
7-M. Any veterans' organization may erect a flag and/or memorial at the entrance to the Mausoleum
Chapel on Memorial Day.
8-M. The Cemetery Board from time to time may recommend the altering of the Rules and Regulations
for the government and improvement of the Mausoleum as it may deem requisite and proper,
subject to City Commission approval. All Rules and Regulations shall be applied prospectively
from the date of adoption. No Rule or Regulation shall be construed in a manner which would
negate or alter any contractual right between Boynton Beach. and any party to a purchase
agreement with Boynton Beach.
9-M. As of April 20, 2004, the date of adoption of Resolution No. R04-065, on all new sales, the bodies
placed in the Mausoleum must be embalmed. On previously purchased crypts, if a person does
not wish to be embalmed, the body must be placed in a Ziegler case. Plastic trays must be
placed under the casket on all entombments in the Mausoleum, whether the bodies are
embalmed or not. The funeral home will bear the cost of the Ziegler cases and plastic trays, but
will pass that cost on to the purchaser. Human remains being placed for entombment shall be in
a gasketed metal casket for Mausoleum usage.
10-M. Vases may be purchased only by the property owner or their survivors directly from the City of
Boynton Beach
