I. Cali To Order
Carol Ellis, Special Magistrate, called the Hearings to order at 9:02 a.m. and
explained her role and the hearing procedures. Pursuant to Florida Statute, all orders
are appealable to the Circuit Court in Florida and not the City Commission. She
explained a fine will be imposed if the violation(s) are not corrected by the deadline.
11. Swearing in of Witnesses and Introduction
The Minutes Specialist administered an oath to all those intending to testify.
III Approval of May40 June 17, 2015 Minutes
Ms. EIIis approved the minutes with the one change to Case No. 15 -550: the
compliance date should be June 4, 2015 instead of May 30, 2015.
IV Agenda Approval
Courtney Cain, Code Compliance Officer, announced the following changes to the
agenda:

Excessive false alarm service fees.
Courtney Cain, Code Compliance Officer, presented the case which was a City
department referral. An initial inspection on July 2, 2015 revealed there were excessive
false alarms. Written notice was sent on July 2, 2015, giving 15 days to pay the invoice.
Service was obtained by certified mail sent on July 20, 2015. The green card was
signed July 24, 2015.
The accrued false alarm fees totaled $2,500. Officer Cain recommended the
Respondent be given 10 days to pay.
Ms. Ellis inquired if the building was an assisted living facility.
Ken Soloway, employee of the company, advised the facility was an assisted living
facility for dementia residents and those needing memory care. They have pull stations
throughout the property. They cannot block them, and some dementia residents pull
them. This happens occasionally, and they call the Fire Department to advise it was a
false alarm. In the subject cases, the Fire Department showed up anyway. Mr. Soloway
commented they are an affordable assisted living facility and are unable to pass the fee
on to the residents and their families. Ms. Ellis reviewed the false alarms from October
1, 2014 to September 1, 2015, and noted there were six false alarms within the last six
months, with three of them free incidents.
Ms. Ellis advised they have 10 days to remedy the matter. She understood it was
difficult to control dementia patients, but they have to weigh that with the overall public.
Each time the Fire Department arrives for a false alarm, it takes away a valuable
resource the community may need elsewhere. The violation was non - payment of the
fee.
Mr. Soloway clarified they received a bill from the Fire Department for $15,000 when the
owners purchased the building which they paid. A suggestion was made to contact the
Fire Department to appeal the invoice. Ms. Springer explained that was the only way to
appeal the fine.
Decision
Ms. Ellis gave 30 days, until September 18, 2015, to contact the Fire Department to
appeal and explained she does not have the authority to reduce the fine. He would also
have to notify the City if they made any decision to reduce the fine. If no reduction is
given, the fine stands at $2,500 and if not paid by September 18, 2015, a fine of $100 a
day would be imposed thereafter.

Officer Cain presented the case which arose from a citizen complaint. An initial
inspection on June 16, 2015, revealed the above violation. Written notice was sent
giving 15 days to correct the violations. Service was made by posting the property and
in City Hall on July 27, 2015. The property was last inspected on August 18, 2015. Ms.
Ellis reviewed the facts of the case. Officer Cain commented they applied for, but did
not pass inspection. Staff recommended 15 days to correct the violation by September
3, 2015, or a fine of $100 a day thereafter. She noted the 15 days was to pass the
inspection.
Samuel Drummond, representing Elite Recovery, advised they applied for the
Business Tax Receipt. There are three rooms and one was unpermitted. Officer Cain
explained they had converted a garage into a sleeping quarter without a permit. He
confirmed the landlord would have to address the matter because they own the
property. The property was used since December 30 2014, when they applied for the
Business Tax Receipt.
Decision
Ms. Ellis ordered the staff recommendation.

Officer Pierre presented the case for the above violations. He noted only the Business
Tax Receipt was outstanding. The first inspection had failed and a few items needed to
be fixed. Staff recommended a 10 -day compliance date of August 29, 2015, or a fine of
$100 a day thereafter. Ms. Ellis reviewed the facts of the case.

Rodrigo Vera, the property owner, was out of town and did not receive the certified mail
until August 8, 2015. His nephew was helping to remedy the violations. Only the
inspection remained. He invited Code Compliance back to the property to inspect.
Decision
Ms. Ellis ordered the staff recommendation. It was noted the inspection would occur the
next day at 10 a.m.

Officer Shickles presented the case. A routine inspection on May 20, 2015, revealed
the above violation. Written notice was sent giving 30 days to correct the violation.
Service was made by posting the property and City Hall on August 10, 2015. The
property was last inspected on August 18, 2015. Staff recommended a 10 -day
compliance date of August 29, 2015, or a fine of $100 a day thereafter. Ms. Ellis
reviewed the facts of the case. An inspection has not been scheduled.
Gabriella Martins, wife of the managing member of the property, advised the
mailing address of 401 Atlantic Avenue was incorrect and she corrected it when she
applied for the Business Tax Receipt. Ms. Ellis reviewed a printout dated February 17,
2015, from the Property Appraisers website and advised the owner has to maintain the
correct address. It was incorrectly listed on the website.
Ms. Martins advised there was an incident at the property so they had to rent it out, and
did not know about the Business Tax Receipt. The next step was the inspection.
Decision
Ms. Ellis ordered the staff recommendation.

Officer Shickles presented the case which was a City department referral. An initial
inspection on June 12, 2015, revealed the above violations. The Respondent was a
repeat violator. Written notice was sent giving 20 days to correct the violations. Service

was made by Certified Mail green card, signed July 24, 2015. The property was last
inspected on August 18, 2015. Staff recommended a 30 -day compliance deadline of
September 18, 2015, or a fine of $100 a day thereafter. Ms. Ellis reviewed the facts of
the case and the prior violations at the premises. The tarp was removed.
Josephine Daffin, the Respondent, advised her gate was finished and she had to get
the closure. Her yard was clean, the grass grows, but her neighbor cuts her grass. As
for the debris, it was leaves and a mango tree. She rakes, but as much as she rakes,
the leaves fall. She does not have anyone to help her. She submitted an application to
the Solid Waste Authority to have her house painted and was trying to get assistance.
Ms. Ellis reviewed the outstanding issues with her. Ms. Daffin explained her house was
a stucco home and no one has complained about the house being painted. As fast as
she fixes one item, another one arises. She commented grass does not grow in the
backyard.
Ms. Ellis viewed the Solid Waste Authority recycled paint donation application. Ms.
Daffin did not know how long it would take to receive assistance. She advised she has
a disabled 18 -year old, and a 13 and 10 -year old.
Decision
Ms. Ellis gave 45 days to comply by October 3, 2015, or a fine of $100 a day thereafter.
Case No. 15 -1497 DJV Development LLC

Officer Shickles presented the case. A routine inspection on June 19, 2015, revealed
the above violation. The Respondent was a repeat violator. Written notice was sent
giving 10 -days to comply. Service was obtained by a signed, but undated certified mail
green card. The property was last inspected August 18, 2014. Staff recommended a
10 -day compliance date of August 29, 2015, or a fine of $200 a day thereafter.
Ms. Ellis recessed the meeting for a short break at 9:55 a.m. and reconvened the
meeting at 9:59 a.m.
Ms. Ellis noted the property was a multi - family unit and there were several other
properties with violations owned by the same entity. She learned they applied for the
Business Tax Receipt but no inspections had occurred. Officer Shickles explained
there had been miscommunications with the inspection. They have to call and give a
date and time, not just email they are ready for an inspection. In the past he arrives, but
cannot gain access to the unit because of the tenant. The Respondent was a repeat
violator.

David Thause, the property owner, Priscilla Ortiz, a permit processer, and Albert
Williams, the property manager were present. Ms. Ortiz explained to pass the
inspection, they had to sod all the properties and find a contractor to sod all 13
properties.
Officer Shickles explained he provided the Respondent with a list of items they look for
when they inspect. Ms. Ortiz had receipts they contracted with a sod company for the
grass, but they cannot lift the grass with the rain. Mr. Thause explained they purchased
60 properties in November 2014. They are in touch with Officer Shickles all the time.
He advised they were waiting on the sod and were trying to find sod from different
farms, but the rain delayed its delivery.
Ms. Ellis noted this is a repeat violator. Officer Shickles explained they have many
properties and were making a good effort to improve the properties compared to their
previous condition. Mr. Thause requested 30 days at least. Ms. Ellis opined they
should have advised they needed the sod right away before he paid them. Mr. Thause
agreed, but commented the rain affected the delivery.
Decision
Ms. Ellis ordered a 15 -day compliance deadline of September 3, 2015, or a fine of $200
a day thereafter.
Case No. 15 -1498 DJV Development LLC

Officer Shickles presented the case. An initial inspection on June 19, 2015, revealed
the above violations. The Respondent is a repeat violator. Written notice was sent
giving five days to correct the violations. Service was made by a signed, but undated
certified mail green card. The property was last inspected on August 18, 2015. Staff
recommended a 10 -day compliance date of August 29, 2015, or a fine of $200 a day
thereafter. Officer Shickles advised the Business Tax Receipt application was made and
they were waiting for an inspection date and time for all the properties for an interior and
outside inspections. There were similar violations on the property in the past, but
Officer Shickles did not know if it was with the same owner. Ms. Ellis noted this case
was similar to the last case involving a list of repairs.
Albert Williams, property manager, worked with the former owner and there was
nothing done. They are making improvements to all the properties.

Case No. 13 -674 Kerry Hickman

Remove unlawful wooden structure and
provide humane confinement in
accordance with the Ordinance. Every
dog must have a current tag and
registration with Palm Beach County.
Proof required. Proof of rabies
vaccinations must be submitted.
Liz Roehrich, Animal Cruelty Investigator, explained this was a fine certification for a
Cease and Desist Order, for violations at the above address. The Notice of Violation
was sent on April 16, 2013. The case was heard June 19, 2013, and Ms. Hickman
appeared. The compliance date and fine was to cease and desist by June 26, 2013, or
a fine of $500 per occurrence would be imposed. The dates of the occurrences were
July 15, 2015 through August 14, 2015, having 29 occurrences. The total fine was
$15,038.09, plus administrative charges. Officer Roehrich had photographs and
explained she had not been to the property since the Cease and Desist Order was
issued, and she had been in compliance. When she received the complaint and
responded on July 15, 2015, there were multiple violations at the time.
Officer Roehrich also performed a re -check when she received another citizen
complaint and responded on August 14 ". She verified all the dogs and kennels were
still there, and the violations still exist. Ms. Hickman has not advised if she had rabies
shots or licensed tags on the dog. She looked in the County's system and none were
found for her or her significant othe'rs dogs.
Officer Roehrich had photographs taken on July 15, 2015. There are two complainants
who want to remain anonymous that call her and advise nothing has changed. When
she inspected, everything was fairly identical, but the lack of vaccinations and license
tags is still open. The adult dogs that need a rabies shot, license and tags are still in the

same location as they were. Officer Roehrich advised Ms. Hickman's husband told her
Ms. Hickman had all the paperwork.
Ms. Ellis asked about the unlawful wooden structure and learned they were removed
which was how she came into compliance in 2013. There are some excessive kennels
currently on the property and Officer Roehrich explained the Cease and Desist was a
lump order for all of the violations, including the rabies shots and licenses and tags. Io-
date, there has been no proof of the vaccinations and tags. She explained the fine
would only run through August 14 because that was the last time Officer Roehrich
could verify the violations remained and the dogs were still in the same location as they
were a month ago.
Ms. Ellis inquired, provided Ms. Hickman had proof of the rabies vaccination and each
dog had a current tag and registration, if it would be okay for the dogs to be there.
Officer Roehrich responded she would still be in violation of the Manner of Keeping
Ordinance, because there were additional kennels erected. In 2013, she complied by
installing a couple of really nice kennels and removing the unlawful wooden structures.
When Office Roehrich went back last month based on the complaint, there were
additional kennels. Per the Ordinance, only 150 square feet of kennel is permitted per
property and Ms. Hickman has to be in compliance with County Code. The County
Code says a kennel has to be a minimum of 80 square feet. The City in turn says you
may not have more than 150 square feet in total.
Ms. Ellis inquired if the kennel was part of the original Cease and Desist Order and
Officer Roehrich responded no, but there were now more kennels on the premises than
when she was there last month for the complaint.
Ms. Ellis requested confirmation the kennels were not part of the original violation and
Officer Roehrich responded they were. She advised the matter could be concluded if
Ms. Hickman would produce documentation the dogs were currently licensed and
vaccinated.
Kerry Hickman, the Respondent, explained she has puppies. She called Animal
Control on Belvedere and they told her when the puppies are six months old she can
bring them in for licenses and vaccinations. She advised there were no wooden
structures in the kennels. There are five kennels and they are reliable because she
spoke with Palm Beach County Animal Control on Belvedere. Ms. Hickman inquired
how Officer Roehrich got on her property and pointed out she has wooden gates and
there is a no trespassing sign on both sides.
Ms. Ellis inquired if this violation occurred in June 2013, how the dogs could be puppies.
Officer Roehrich explained the case is a revolving door of dogs. Mr. Hickman had
yelled at Officer Roehrich and said he could have 10 dogs. Officer Roehrich agreed
that was true, but the dogs are not legal as there were no vaccinations or tags. She had
photographs of the dogs she observed and the dogs were more than six months old.

Officer Roehrich explained Ms. Hickman was receiving incorrect information. She
questioned why Ms. Hickman would contact the County when the Boynton Beach Police
Department is handling the enforcement. Officer Roehrich explained State law requires
animals to be vaccinated in four months, and the City and County does not conflict with
State law.
Ms. Ellis reviewed the photographs. Ms. Hickman explained the puppies will be five
months old on the 25 and the County advised her to bring in the puppies when they
are six months. She explained the pictures do not show any large dogs and the
pictures were taken through the fence. She commented Officer Roehrich should have
knocked on her door.
Ms. Ellis asked if they were selling the dogs and Ms. Hickman responded they do not
sell dogs. She was also watching a friend's dog who went out of town. There are ten
puppies. Officer Roehrich confirmed some of the dogs were puppies, and she was
advised by Mr. Hickman there were two separate litters of puppies. She saw two
different kennels full of puppies and three adult dogs. Mr. Hickman identified one of the
adult dogs by name, but in a 2013 police report, Mr. Hickman indicated the dog ate a
frog and died. It is a revolving door of dogs that were not legal.
Ms. Ellis noted this was ongoing since 2013. Officer Roehrich also advised Mr.
Hickman was convicted of animal fighting and animal baiting twenty years ago. Ms.
Hickman advised she was not with Mr. Hickman.
Decision
Ms. Ellis certified the lien.
Ms. Hickman objected and explained someone needs to see they are puppies, and Ms.
Ellis explained then she needs to arrange it with the City. Ms. Hickman commented she
would, but she would have to deal with someone other than Officer Roehrich because
she was getting conflicting information.
Ms. Ellis explained this was a fine certification. If she comes into compliance, she can
apply for a lien reduction and have the fine reduced. Ms. Hickman contended she was
watching dogs for friends; however, Ms. Ellis was doubtful they were because there
were kennels on the property. Ms. Hickman explained she had dogs before. Ms. Ellis
explained she would receive an order in about a month. The fine amount was
$15,038.09 including administrative costs. Ms. Hickman inquired if she could retain
counsel and Ms. Ellis advised she could appeal the matter through the Circuit Court of
Palm Beach County.
Officer Roehrich commented she should not raise the issue in court and Ms. Hickman
responded she would.

Officer Roehrich presented the case as contained in the Notice of Violation. The
Respondent was not a repeat violator. The Respondent continuously had dog and
cruelty violations at the property. The family puts various members in the property and
it is difficult to hold someone criminally responsible for some of the abuse. The water
account is in a dead person's name. She requested a Cease and Desist Order with a
$1,000 fine and a compliance date commencing August 20, 2015. She had
photographs which Ms. Ellis viewed. The photographs were not of the violations from
2007, where individuals went to jail.
Ms. Ellis reviewed the photographs of the property and the precarious conditions of the
animals on the property.
Decision
Ms. Ellis ordered the Cease and Desist Order with a $1,000 per occurrence effective
August 20, 2015.

Officer Shickles presented the case. The Notice of Violation was March 31, 2015. The
case was heard June 17, 2015 and no one appeared. The compliance date and fine
was June 27, 2015, or a fine of $500 a day thereafter. The property was last inspected
August 18, 2015, and the violations still exist having 52 days of non - compliance.
David Thause, one of the Respondents, advised everything was done except the
paving. Officer Shickles advised the Business Tax Receipt was still needed, and Mr.
Thause responded they have to wait for the paving to be finished and were waiting on
the permit. They applied on April 28, 2015.
Ms. Ellis reviewed the application and questioned why the paving was taking so long.
Mr. Thause wanted to get the Business Tax Receipt without the paving, but the City
would not allow it, so there was another process. Officer Shickles met with them and
explained there were a few cases coming up for fine certifications and they needed to
address the properties. There was no phone call or scheduling of inspections or
Business Tax Receipt. Mr. Thause agreed and advised he was told he could not obtain
the Business Tax Receipt without the sod or paving. Ms. Ellis reviewed the paving bill.
The property previously had gravel.
Decision
Ms. Ellis noted there was a discrepancy and tabled the case to the next month.

Officer Shickles presented the case. The Notice of Violation was sent April 7, 2015, for
the above listed violations. The case was heard June 17, 2015, and no one appeared.
The compliance date and fine was June 27, 2015, or a fine of $500 would be imposed
thereafter. The property was last inspected August 18, 2015 and the violations still exist
having 52 days of non - compliance. The only violations addressed was the roach
infestation, they repaired the refrigerator and some cabinets, and the outside storage
trash and debris. The application for the Business Tax Receipt has been submitted.
Albert Williams, the Property Manager, commented they installed brand new cabinets,
but the tenant's son has autism and damaged the cabinets. The screens were in the

windows, but the windows that were not screened were the ones with the air
conditioning units in them. Mr. Williams was unaware an inspection was scheduled.
Ms. Ellis acknowledged their efforts and they have many properties with violations, but it

Ms. Ellis certified the fine and advised when everything was done, they could apply for a
lien reduction.

inspected August 18, 2015 and the violations still exist having 52 days of non-
compliance. There was no contact with Officer Shickles regarding the Business Tax
Receipt.
Mr. Thause, owner of DJV, advised he was waiting for the sod. Officer Shickles advised
the compliance date was set and he had not received a call for an inspection.
Additionally, Officer Shickles did not cite the sod, as it was understood it was needed on
all the properties, but originally, when cited, the sod was not an issue. Ms. Ellis
reviewed a proposal from Williams Soils and Sod dated July 28, 2015 to ensure the
property address was correctly listed and saw it was.

Glenn Weixler, Code Compliance Officer, presented the case which arose from a
citizen complaint. The initial inspection on June 12, 2015, revealed the above violations.
The initial inspection date was June 12, 2015, and written notice was sent the same day
giving five days to correct the violations. Notice of hearing was sent certified mail on
July 20, 2015 and the green card was signed on July 27, 2015. The matter was an
electrical hazard. The panel was not up to Code and the ceiling had a leak. When it
rained, when walking between the house and the carport, the person gets shocked.
There was a family with four children under 10 years old and a couple staying there and
each time it rains they get shocked. They have a permit and addressed the electrical
hazard right away, but they did not receive a final inspection. He last inspected the
property on August 18, 2015. Staff recommended a 10 -day compliance deadline of
August 29, 2015, and a fine of $100 a day thereafter.

Jackie Oliver, DYC Rentals, explained they applied for the certificate and were getting
the electrical completed. They were also working with a roofer to make the repairs.
Officer Weixler read the red tag issued on June 2, 2015. He acknowledged they made
an effort to address the electrical hazards, but there were many other items that were of
concern, especially with children at the premises.
Decision
Ms. Ellis ordered a 10 -day compliance deadline of August 29, 2015, or a fine of $100 a
day would be imposed thereafter.
Ms. Oliver requested additional time. Ms. Ellis explained as long as she provided proof
to the City they were working to address the issues; she left it to the staff's discretion
whether to extend the deadline.

was 60 days of non - compliance. Officer Pierre explained the issues were not resolved.
William Layton, Esq. 101 N. J Street, Lake Worth, Harvey, Ladell & Layton,
representing the Tabernacle, explained the property is being occupied by a different
church. Permits were issued in 2012, and expired in 2013. They have not been able to
enter the premises to see what was done. He met with John Kuntzman from the
Building Department and noted there were a lot of renovations being made. The
congregation outgrew the Church. They submitted plans to add bathrooms to facilitate a
larger congregation and when they checked into the parking, they submitted plans for a
larger parking lot. When the City advised they could not have a larger parking lot, they
vacated and another church occupied the building. The permit expired in 2013 and was
referred to Code. Mr. Layton advised they cannot gain entrance to see what has
occurred. The City would need to determine if they need to complete the plans, and
with a smaller congregation whether the revisions were needed. Any repairs or
renovations made would either be permitted or removed.

inspection on April 22, 2015 revealed the above violations. The Respondent was a
repeat violator. Written notice was sent the same day giving five days to correct the
violations. Service was made by certified mail sent on July 22, 2015. The green card
was returned, signed and dated July 27, 2015. As of yesterday, the driveway was
replaced; it was permitted and had a final inspection. The sewer line was repaired, but
they need a permit due to it being a health hazard. The property was last inspected on
August 18, 2015. Staff recommended a 15 -day compliance deadline of September 3,
2015, or a fine of $200 a day thereafter. No interior inspections were made.
The property manager advised the plumber applied for the permit. She tried to enter
the premises and the tenants gave her a hard time. She gave them a 30 -day notice to
vacate because of the issues. They had changed the lock and when the notice was
sent, they destroyed the inside of the house.

showed to the Respondent and Ms. Ellis.
Ricky Scott, son of the owner, reviewed the photographs and advised his father was
in the hospital. He had repaired the fence in the front and would fix the fence in the rear
of the property. He advised he cleans the trash and debris every Monday, Wednesday
and Friday. It is an ongoing battle. The screen was an oversight on his part, and he
could fix the fence right away. He repaired the soffit. Ms. Ellis inquired why he did not
appear at the hearing and learned Mr. Scott was present, as there were two properties.
He thought he may have left after the other property was addressed and was unaware
of this case.
Decision
Ms. Ellis ordered a 15 -day compliance date, or the fine of $250 a day would stand.
When everything was fixed, he should contact the City and the case would be
dismissed.

Kumar Mistrambroker, friend of the owner, advised the owner lives out of the country
and he requested he apply for the Business Tax Receipt for them in June. They are
having difficulty with the tenants allowing access to the unit. The tenant will be vacating
the end of the month. He requested more time to have the inspection occur when the
tenant moves out.

Officer Cain presented the case and advised this was for a Cease and Desist. The
Notice of Violation was sent March 6, 2015, for the above captioned violations. There
were occurrences on May 25, 2015 and June 1, 2015. There was one inspection
costing $96.03 plus the affidavit of filing for $250, totaling $346.04.
At the last hearing, Ms. Ellis requested a detailed letter from the Respondent's attorney
and the City as the nuance of verbal testimony was difficult to follow and there was
much to the Case. Outlining the issues helped to make a decision. Based on the
presentations provided, it appeared that a prior owner had purchased storage
containers that were on site that remained. Attorney Carney pointed out the Notice of
Violation did not mention containers. They complied with the scope of the Order, but
they did not obtain the full scope until June. In May they met with Planning and Zoning

Director, Mike Rumpf, to learn what was and was not permitted. Attorney Carney had
objected to the five days to come into compliance when others were given more.
Attorney Carney was aware of Ms. Ellis's concerns for public health, but those were
removed previously. They tried to comply all along and he did not know what was in
the containers. He pointed out the property is now zoned for a landscaping use and
they will store the rakes and other items the lease uses. Currently, there is just lawn
equipment at the premises.
Ms. Springer pointed out the City Commission approved an Ordinance which requires
the uses to be approved although the use may be allowed in certain zones. Attorney
Carney agreed commercial activities need approval, but the use is no longer prohibited.
It was a City- initiated amendment. The City was conducting a site inspection the next
day. The public health issue was removed, and all items in the narrative were removed
by June 2 "
Ms. Ellis noted there was an ambiguity in the use and she sees efforts to deal with the
matter were made. Robert Richardson, the property owner explained when they were
issued the Cease and Desist, they immediately complied. Mignanos removed the
vegetation, and they wanted a continuance. The property was always used as a
storage lot. Attorney Carney had photographs taken two days before. He thought there
was a void in the Land Development Regulations (LDRs) regarding personal storage of
personal items on personal property and whether a Business Tax Receipt would be
needed. If they are not operating a business and it otherwise meets the Code, the
LDR's were silent on the issue.
Decision
Given the verbal and written testimony, and in light of the fact the City Commission
changed the use, Ms. Ellis dismissed the Cease and Desist Order.
Case No. 11 -848 Central Mortgage Company 1044 Fosters Mill Road
Diane Springer, Code Compliance Coordinator, presented the case. The Notice of
Violation was sent April 11, 2015. The Case was heard June 15, 2011, and no one
appeared. The compliance date was June 25, 2011, or a fine of $400 a day would be
imposed thereafter. The violations were corrected on April 24, 2012, having 303 days
of non - compliance accruing a lien of $121,200 and administrative fees of $826.18.
Ms. Springer was contacted in August 2014, but the Respondent needed to clean the
pool, repair the pool gate, trim overgrowth, replace the screens, pressure clean the
driveway and landscape blocks, uncover windows and pay outstanding 2013 property
taxes. An inspection in November revealed the pool gates still needed to be repaired
and the driveway and landscaped blocks needed to be pressure cleaned. The Code
Officer found additional violations which were to repair the rail on the pool, replant and
mulch the planning area along the front entrance, repair open electrical at the sprinkler

box and cap on the sconce lamp to the left of the garage door. The property was re-
inspected on January 20, 2015, and the pool rail and the pressure cleaning were still
outstanding. Those items were taken care of within three days.
Shie Rios, on behalf of Central Mortgage, explained Central Mortgage obtained the
property during the economic crash. The law firm handling the foreclosure lawsuit, Ben
Ezra and Katz imploded and all of the notices were sent to counsel of record. Central
Mortgage was unaware of the registration requirements and the violations. When they
became aware of them, they addressed the issues. The property sold on July 15
Central Mortgage was requesting a waiver of the fines. The new owner purchased the
property with the existing lien, and it was in escrow.
Ms. Springer explained she received an email from the realtor on January 15, 2015, and
was told all violations were addressed. There were three more items needing to be
addressed and the realtor addressed them in three days.
Decision
Ms. Ellis reduced the lien from $121,200 to $5,000 plus administrative fees of $826.18.
Case No. 12 -359 James Schaffer & Madalyn James 70 Sausalito Drive
Ms. Springer presented the case. The Notice of Violation was sent on March, 7, 2012.
The case was heard on April 18, 2012. The compliance date was to comply by April 28,
2012, or a fine of $100 a day would be imposed thereafter. The violations were
corrected on May 14, 2015, having 110 days of non - compliance and a fine of $111,000
plus administrative fees of $634.12. When the lien inspection took place, all items were
addressed.
Amina McNeil, on behalf of Federal National Mortgage Association, explained
when the lien occurred, the property was in the foreclosure process. When the client
became the owner, they immediately addressed the violations. It appeared the former
property owners were non - responsive to the City and the foreclosure action. They
asked for a waiver of the lien on the property. They had a closing set for July 2015, but
due to the lien, the purchasers received a 30 -day extension. She requested the waiver
so the purchaser and the bank do not have to absorb the cost of a lien accrued from the
prior owner.
Decision
Ms. Ellis reduced the lien to $5,000 plus administrative costs.

Ms. Springer presented the case. The Notice of Violation was sent February 1, 2013.
The case was heard April 17, 2015, and no one appeared. The compliance date and
fine was April 2, 2013, or $250 a day thereafter. The violations were corrected on June
4, 2014, having 405 days of non - compliance, accruing a fine of $101,250, plus
administrative costs of $634.12.
Ms. Springer was contacted in October 2014, and there were several liens on the
property that were lost in foreclosure. When the Bank took title, they were cited for
those violations. The new case had to comply before this case could be presented for
lien reduction. That case pertained to obtaining a permit for siding that was installed
without the proper permit. At the lien reduction inspection, the Code Officer noted a
garage door had to be repaired, remove inoperable vehicles, replace the missing
window screens, paint the stucco, pressure clean moldy surfaces on the walkways and
fence, repair or replace rotted fascia. The bee infestation returned so that needed to be
exterminated, repair or replace a rotted T -111, sod the front yard, trim overgrowth. A re-
inspection in January revealed the house had to be painted, sod the yard, remove the
bee hive, remove trash and debris and repair the gate and fence. On June 18
another inspection revealed the Respondent had to reinstall the four -inch house
numbers, replace missing window screens and sliding door, remove outside storage of
fence panels and there were several outstanding water bills that had to be paid. They
passed the lien reduction inspection on July 22, 2015.
Ben Frank, Property Manager, received the property around June. Prior to that, the
bank was supposed to attend the hearing. They did not have control of the property so
he was unable to start addressing the violations. As soon as they obtained possession,
he contacted Ms. Springer and began fixing the violations.
Decision
Based on the testimony, Ms. Ellis reduced the lien to $5,000 plus administrative costs.
Case No. 07 -3555 Constance S. Lassiter 550 NW 12 Avenue
Ms. Springer presented the case. The Notice of Violation was sent on December 26,
2007. The case was heard April 16, 2008. The compliance date was to comply by May
6, 2008, or $100 a day would be imposed thereafter. The violations complied on
October 16, 2014, having 2,343 days of non - compliance accruing a fine of $234,300.
Ms. Springer was contacted in 2013. The Building Department and staff had indicated to
Ms. Lassiter what needed to be done. The violations were corrected on October 16,
2014, and the Respondent sent the application for the lien reduction in December 2014.
Ms. Lassiter could not attend at that time. When she contacted Ms. Springer again in
June, a re- inspection revealed trash and debris, overgrowth and graffiti needed to be
addressed. Ms. Lassister immediately corrected those violations.

Constance Lassiter, the Respondent, advised she owns property and always did
everything she was supposed to do. She was on vacation and was unaware of the
2007 fine until 2014 when the property was put up for sale and the contractor advised of
the violation.
Ms. Lassiter had spoken with former Building Official Karl Swierzko in the Building
Department and Pete Roy, former Code Compliance Officer, and inquired why she was
not notified. Ms. Lassiter explained she was in the Boynton Beach area nearly all of
2007, and she and her sisters took care of her mother who passed in June. A
registered letter was returned. Notice was posted on the property. Ms. Lassiter advised
there were renters at the property and they did not notify her.
Ms. Springer explained the property was posted on June 3, 2008 and she had a picture
of the posting on the door of Unit B. The original letters were sent to Ms. Lassiter's
address in Washington. Ms. Lassiter explained the letter sent to Tacoma was the only
registered letter, the rest were sent regular mail. Ms. Lassiter was aware of the tenant
in unit B's personal circumstances and an arrangement was made for her to remain in
the premises at a reduced rate with the proviso the tenant would maintain the premises.
She wanted to sell the building and after every other tenant was evicted, the renter from
unit B was evicted. The tenant threatened to get her in trouble with the City and she
incurred monthly water bills. She lost the contract she had to sell the building. There
were four empty units and each month one unit was higher than the other. Someone
stripped the copper from the units and she was dealing with the City. She believes she
has an interested buyer. She received a letter about one of the tenant's broken car, and
she called Code Compliance and had it removed.
Ms. Springer advised there were no outstanding violations.
Decision
Given the testimony by the Respondent and the City, Ms. Ellis reduced the lien to
$2,500 plus administrative expenses.
Case No. 14 -2050 Live Oak Park LLC 410 NE 26 Avenue
Ms. Springer presented the request. The Notice of Violation was sent on August 29,
2014 pertaining to a Business Tax Receipt. The case was heard December 17, 2014,
and no one appeared. The compliance date was January 16, 2015, or a fine of $150 a
day would be imposed thereafter. The violations were corrected on July 16, 2015,
accruing a fine of $27,000 and administrative fees.
Ms. Springer was contacted in June for lien reduction and the Respondent did not have
the Business Tax Receipt. It could not be issued because the permit he pulled was not
finalized. They had to remove trash and debris, unlicensed, inoperable vehicles and

there were outstanding water bills. The property was eligible for lien reduction on
August 6, 2015.
Nabil Kishk, the property owner, explained there is a general contractor working with
him. The house was a foreclosure and people were doing drugs in the house. Officer
Weixler entered the property illegally. He claimed his worker was a burglar, he
requested Police assistance to come in and take a picture. The house had two rooms
that had no closets. He spent $37K on the home. Mr. Priest from the Building
Department explained because he constructed closets, the project was a new
construction. The work was done, but the problem was the blueprint and he could not
finish. He requested more time
Ms. Springer had photographs she showed to Ms. Ellis and the Respondent. She
explained the problem was he did the work before the permits were issued.
Decision
Based on the testimony, Ms. Ellis reduced the lien from $27,000 to $2,500 plus
administrative costs.
Case No. 10 -3493 Prime Property of the Palm Beaches Inc. 550 NW 13 Avenue
Ms. Springer presented the case. The Notice of Violation was sent December 3, 2010,
regarding storing vehicles in a residential zone and obtaining a Business Tax Receipt
for rental property. The case was heard January 19, 2011, and no one appeared. The
compliance date and fine set was January 29, 2011, or a fine of $400 a day would be
imposed thereafter. The violations were corrected on July 29, 2015, accruing a fine of
$656,400 plus administrative fees. The only thing the Respondent had to do to comply
was pay two outstanding water bills.
Kevin Ballore, representing the owner, explained he was originally cited for the
Business Tax Receipt and inoperable vehicles. In 2010, he obtained a printout and it
said he had the license. He thought the issue arose from a tenant. He was upside
down on the property which was a multi - family property he was trying to sell. When he
obtains the 2015 Business Tax Receipt, he will have to pay for the back years. Ms.
Springer thought he paid for the Business Tax Receipt, but did not call for the
inspection.
Decision
Given the testimony and amount of the lien, Ms. Ellis reduced the lien to $10,000 plus

money off of it. Ms. Ellis explained there is another case and it is a repetitive issue. It
was just the Business Tax Receipt, but it was always in compliance.
Case No. 09 -893 Prime Property of the Palm Beaches 409 NE 10 Avenue
Ms. Springer presented the case. The Notice of Violation was sent on March 30, 2009
regarding a Business Tax Receipt for a rental property. The case was heard May 20,
2009, and no one appeared. The compliance date was May 30, 2009, or a fine of $150
a day thereafter. The violations were corrected on October 27, 2009 accruing a fine of
$22,350 plus administrative fees. Ms. Springer was contacted in July for a lien
reduction inspection and the Respondent needed to sod the yard, repair the fence,

outstanding water bills.

2013 or a fine of $200 a day would be imposed thereafter. The violations were
corrected on October 25, 2013, accruing a fine of $23,400 plus administrative costs.
Ms. Springer was contacted in August and all was done.
Brian Shutt, Esq., on behalf of the property owner, explained this was an
administrative oversight on behalf of his client. All violations were in compliance. There
was no impact on the neighbors or neighborhood. They have another item on the
agenda and the townhouse was up the street, in the same townhouse complex with the
same issue. They dealt with a leasing company to rent the property. Emails to the
client and the leasing company showed they were trying to schedule an inspection and
there were issues gaining access due to the tenant. Attorney Shutt's client was
working in New Jersey remediating the effects of Hurricane Sandy. When they
returned, they addressed the issue in October. They became aware of the lien when
they attempted to sell one of the units. With the lien, they would be upside down. The
deal was falling through and Attorney Shutt requested a reduction to zero as it had no
impact on the community.

same and this lien was half the amount of the prior lien. He hoped the reduction would

Ms. Springer presented the case. The Notice of Violation was sent on October 9, 2013,

27, 2014, accruing a fine of $10,650 with administrative costs.
Ms. Springer was contacted in November and they conducted a Business Tax Receipt
and Lien Reduction inspection at the same time. They had to replace screens in the
screen room, repair a wood gate, trim overgrown Palm trees, replace missing window
screens and install smoke detectors in the bedrooms. The case was eligible for lien
reduction on July 28, 2015.
Monica Mancini, the property owner, clarified she was not there in January 2014
because she lives in Europe and she did not know there was a violation. When she
received the Notice of Violation, it was in July 2014 and she contacted Ms. Springer.
She obtained a Business Tax Receipt and had an inspection.
Decision
Ms. Ellis reduced the lien to $1,000 plus administrative fees.

Ms. Springer presented the case. The Notice of Violation was sent on July 2, 2014,
regarding applying for and passing a Business Tax Receipt inspection for rental
property, repair water damaged drywall and wood. The case was heard August 20,
2014, and no one appeared. The compliance date and fine set was September 9, 2014,

Ms. Springer was contacted in January for a lien reduction inspection and they had to
replace the screens on the pool enclosure, the fence and screen door at the front of the
house, plus two outstanding water bills. In April, they needed to remove trash and
debris, obtain a permit for a screen enclosure demolition, and install sod. There were
many other items including an unregistered vehicle and outstanding water bills. Another
lien reduction inspection took place on July 20, 2015, and the property was eligible for
lien reduction.
Liza Amar, property manager for Anacel, explained they worked on the violations,
and when she learned there was a fine, she contacted Ms. Springer who advised a new
inspection was needed. Another inspection revealed they had new violations. They
needed a permit and the owner had needed more time. It was finished a few weeks
ago. She requested a reduction

Ms. Springer presented the case. The Notice of Violation was sent December 11, 2014,
regarding a Business Tax Receipt and inspection for a rental property. The case was
heard February 18, 2015 and Linda Vega appeared. The compliance date and fine set
was February 28, 2015, or a fine of $200 would be imposed thereafter. The violations
were corrected on April 20, 2015, accruing a fine of $10,000 plus administrative fees of
$634.12.
At the lien reduction inspection, the Officer found they needed to sod the front and rear
yard, repair the sprinkler system, obtain a permit for newly installed windows. The
property was re- inspected on July 28, 2015, and trash and debris had to be removed.
The case was eligible for lien reduction.
William Overfeldt, Construction Manager, IH2 Property, acquired the property in
June 2013 in a bulk sale. When it was acquired it was in bad condition. The windows
were previously installed prior to purchase. They obtained violations for the exterior
maintenance, registration and lawn maintenance which was addressed as were the
permits for the windows. A window permit was submitted in early July. It was approved
on July 16 and they passed inspection. He requested a lien reduction to 5% plus the
City's costs.

Bernadine Jones, representing the owner, advised the property was purchased in
August 2014, and they were notified November 4, 2014 for the new violations regarding
permits that needed to be pulled and exterior maintenance. They were preparing for a
major home renovation and she had receipts. They had received extensions and the
renovation took about three months. Ms. Ellis reviewed the various invoices Ms. Jones
presented.
Decision
Ms. Ellis reduced the lien to $2,000 plus administrative fees of $634.12.
Case No. 14 -1224 King Investment Solutions Inc. 121 SE 30 Avenue
Ms. Springer presented the case. The Notice of Violation was sent May 21, 2014
regarding permits for interior renovations, yard maintenance violations, trash and debris
repairs of sprinkler system, gates and a safety barrier for the pool and pool
maintenance. The case was heard July 16, 2014, and no one appeared. The
compliance date and fine set was July 23, 2014, or a fine of $150 a day would be
imposed thereafter. The violations were corrected August 5, 2015, accruing a fine of
$56,550 and administrative fees.
Ms. Springer was contacted in November by Mr. Hernandez who advised he had open
permits, and he could not apply for lien reduction. The next time she heard from
anyone, was the beginning of the month by the new owner, who needed to apply for the
Business Tax Receipt before applying for lien reduction.

Alan Eisenberg and Stanley Kragel, the property owners, were present. Mr.
Eisenberg explained he met Mr. Hernandez in 2014 as he purchased a home from him
in Lake Worth. They had an agreement and two days before the closing, he advised he
could not close because he was short $70,000, so they took a note for the money and
closed. Shortly thereafter, they were contacted by Mr. Hernandez, who had been
making payments and advised he had a property in Boynton Beach, which is the subject
property. Mr. Hernandez asked him for the money to finish the property, which was
denied, but they agreed to take over the loan. Mr. Hernandez borrowed enough money
to purchase and fix the home. They agreed to turn the property over to him in a turn-
key manner. As they progressed, they had to keep paying the contractors to finish the
project. When they applied to a lender for financing they learned of the lien and they
had taken title in lieu of foreclosure. In total they spent $156K to purchase a home in
finished condition, but wound up having to spend another $40,000 to fix it up. He
contacted Ms. Springer who explained the lien reduction process. The property was an
asset. Ms. Springer had before and after photographs Ms. Ellis and the Respondents
viewed.
