Officer Guillaume: Good evening, Luney Guillaume, Code Compliance Officer, City of Boynton Beach, I've been previously sworn in. Case No. 12 -806. Location of Violation: 915 Greenbriar Drive. Single - Family homestead. Property Owner: Amy and Michael Senkowicz. It was a citizen complaint. Initial inspection date was May 4, 2012. The violation is complied, but I recommended a Cease and Desist on the boat. Chair Costantino: Your name and address for the record. Mikylo Senkowicz: Um, Mikylo Senkowicz, 915 Greenbriar Drive, Boynton Beach, Florida. Chair Costantino: Alright. Um, we need a plea of guilty, not guilty, no contest. Mikylo Senkowicz: No contest. Chair Costantino: You understand that the Officer is asking for a Cease and Desist Order? Do you know what that means? Mikylo Senkowicz: Kind of, not exactly. Chair Costantino: Okay, apparently you have been doing boat repair? Mikylo Senkowicz: Not repair. I do, I just recently got out of the United States Marine Corp and I do commercial fishing and I've been parking my boat in the front yard and taking it out every night to fish, coming back and leaving it in the front yard and I guess I've been, I've been cited. I have been cited before saying to move it and now I've moved it into my driveway and I haven't been cited there so. Um yes, it's been out front. Office Guillaume: Yes Ma'am. Mikylo Senkowicz: That's fine with me too. I can leave it there. Chair Costantino: Okay. So he's asking for us to give a Cease and Desist Order that any time that they go past the property and that is not parked properly, where you have it parked currently, that you will be fined. Do you understand that? Mikylo Senkowicz: Yes ma'am. Mr. Foot: Where he is repairing the boat? Chair Costantino: Well I think he's more - Luney, you are more concerned about the parking than the repair, correct? Officer Guillaume: The parking and the repairs. Chair Costantino: And repairs? Officer Guillaume: Yeah, but -- Chair Costantino: Well cuz, the Cease and Desist is for the actual parking. Officer Guillaume: And repairs. Mr. Foot: Of the boat. Chair Costantino: And repairs. Ms. Yerzy: If it's his own boat, why is he not allowed to make some kind of corrections to it, some kind of repairs to it? Chair Costantino: I imagine it's kind of like cars, it's gonna be a limited type of repair. If he, if he's pulling out a motor, that can't be done. If he's replacing a, doing a patch of fiberglass maybe that's allowed. I'm not familiar with that section of the Code as far as what can and what can't be done as far as boat repair. It's all - - (Inaudible) Chair Costantino: Come and speak so it's recorded so we all know. Officer Roy: No. The parking he was talking about, he's in the street when he's doing that. Chair Costantino: We understand that. Officer Roy: Okay so. It's not - - he's saying his yard, but it's in the front, it's in the street and as far as repairs on the boat, no, you can't grind, you can't sand, you can't spray paint any of that. Chair Costantino: But as far as the outboard motor he could do - - Officer Roy: He can, yeah, he can take the cowling off the motor and tune it up, that's not a problem. Chair Costantino: Change spark plugs, etcetera. Officer Roy: Yup. Chair Costantino: Okay. Ms. Yerzy: Thank you. Chair Costantino: Alright, we're all clear now. Kathleen? Ms. Carroll: Based on testimony and evidence presented in the aforementioned case, I move that a Cease and Desist Order be issued giving Amy and Michael Senkowicz until September 29, 2012, to bring the violations of the City of Boynton Beach Code Sections as cited into compliance. Chair Costantino: Yes. Ms. Carroll: Oh, okay. Vice Chair Cole: Yes it is. Ms. Carroll: That's okay, by the Respondents and hereby Orders that a fine in the amount of $250 per occurrence of the violation thereafter shall be imposed'upon the Respondent. Ms. Yerzy: Second. Chair Costantino: Motion by Ms. Carroll, seconded by Ms. Yerzy, $250 per occurrence. All in favor? (Unanimous ayes). All opposed? Motion carries. Chair Costantino: Alright, if they catch that boat parked anywhere but where you have it currently, they will write a violation and it will be $250 for every time the violation occurs.
