3 A RESOLUTION OF THE CITYOF BOYNTON BEACH,
4 FLORIDA, CALLING ON FLORIDA GOVERNOR RICK SCOTT,
5 STATE SENATE PRESIDENT ANDY GARDINER, AND STATE
6 SPEAKER OF THE HOUSE STEVE CRISAFULLI TO ENACT A
7 BILL TO INSTALL EMBEDDED, IN -ROAD, SOLAR - POWERED,
8 MARKER LIGHTS IN OR WITHIN A 1 -MILE RADIUS OF AN
9 URBAN AREA IN CONJUNCTION WITH THE CONSTRUCTION,
10 RECONSTRUCTION, OR OTHER CHANGE OF ANY STATE
11 TRANSPORTATION FACILITY; AND PROVIDING AN
12 EFFECTIVE DATE

14 WHEREAS, in 2013, most bicyclist fatalities occurred between 4 PM and Midnight
15 (48 percent) and 68 percent in urban areas; and
16 WHEREAS, many costal roads in the State of Florida are required to turn off street
17 lights during turtle nesting season (March thru October). Embedded, In -Road Solar Marker
18 Lights will provide a bike lane lighting source during the turtle season and throughout the
19 year; and
20 WHEREAS, bicyclists accounted for 2.35 percent of all traffic fatalities and
21 approximately 48,000 bicyclists were injured in 2013; and
22 WHEREAS, in 2013, 743 people lost their lives in bicycle /motor vehicle crashes, or
23 two people every day of the year in the USA; and
24 WHEREAS, 83 percent of bicyclists surveyed said they felt threatened for their
25 personal safety during their rides by motorists; and
26 WHEREAS, 68 percent of bicyclists fatalities occurred in urban areas; and
27 WHEREAS, 57 percent of bicyclists fatalities occurred at non - intersections; and
28 WHEREAS, in 2013, the State of Florida ranked first in the nation with the highest
29 rate of bicyclist fatalities with 6.8 bicyclist fatalities per million residents, compared to the

30 national average of 2.35 percent; and
31 WHEREAS, in 2013, the State of Florida ranked first in the nation with the highest
32 rate of bicyclist fatalities with 5.5 percent of all total traffic fatalities, compared to the
33 national percentage of 2.3 percent; and
34 WHEREAS, public agencies are required to maintain minimum reflectivity of
35 longitudinal pavement markings unless continuous lighting assures that the markings are
36 clearly visible at night; and
37 WHEREAS, when Embedded, In -Road Solar Markers (RRPMs) supplement or
38 substitute for longitudinal lines, minimum pavement retro reflectivity levels are not
39 applicable; and
40 WHEREAS, Embedded, In -Road Solar Marker Lights improve the nighttime
41 visibility of bike lanes and bicyclists and reduce the risk of roadway departure crashes by
42 making the bike lanes visible for drivers at a greater distance; and
43 WHEREAS, Embedded, In -Road Solar Markers Lights are approved by the Florida
44 Department of Transportation (FDOT) as an Internally Illuminated Raised Pavement Markers
45 (IIRPM); and
46 WHEREAS, Embedded, In -Road Solar Marker Lights are economical and easy to
47 install with zero maintenance; and
48 WHEREAS, in 2012, The National Safety Council (NSC) estimated that the bicycle
49 fatality crash cost to society is $3.3B and the bicycle injury cost to society is $2.9B
50 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
51 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
52 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as

53 being true and correct and are hereby made a specific part of this Resolution upon adoption.
54 Section 2. The City of Boynton Beach City Commission calls on Florida
55 Governor Rick Scott, State Senate President Andy Gardiner and State House Speaker Steve
56 Crisafulli to require the installation of embedded, in -road, solar - powered marker lights in
57 certain bicycle ways that are established in, or within a specified radius of, an urban area.
58 Section 3. This Resolution will become effective immediately upon passage.
59 PASSED AND ADOPTED this 5day of WA-114-E. 2016.
