O76-12ORDINANCE NO. 76-12 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FL(~I~IDA, AiV~ENDING ORDINANCE NO. 73-15 FOR THE PURPOSE OF DIRECTING DISPOSITION OF D~EXPENDED PORTION OF REVENUE SHARING FUNDS ALLOCATED FOR EXPENSES OF SOCIAL SERVIC ES ~R POOR AND AGED; PROVm~G FOR'AUTHORITY .TO COD~Y, SAV~GS CLAUSE, REPEAL~G PROViSioNs] AN EFFECTivE DATE, AND FOR OTHER P OSES. ~VHEREFORE, the City Council o£ the City of Boynton Beach, Florida, has hereto£ore adopted Ordinance No. 73-1 5 to provide for the expenditure of ten percent of all FederaI Revenue Sharing Funds received under the State and~ Local Fiscal Assistance Act of 1972, and the City Council deems it advisable to araend said Ordinance so as to provide for the reallocation o£ any unexpended portion of such funds at the end of each fiscal year: NOW, TITEREFORE, be it ordained by the City Council of the City of Boynton Beach, Florida: Section 1. Section 3 of Ordinance 73-15 of the codified Ordinances of the City of Boynton Beach, Florida, be and the same is hereby amended to read as follows: "Section 3. No portion of the said ten percent of the Revenue Sharing Funds shall be disbursed by the City of Eoynton Beach for such ordinary and necessary rnaintenance and operating expenses for sociai services for the poor and aged unless recommended by a majority of the entire membership of The Communily Relations Board and thereafter approved by the City Council of the City of Boynton Beach. If, at the end of any fiscal year, there has accumulated a portion of said ten percent o£ the Federal Revenue Sharing Funds which has never been expended for the aforesaid purposes, then and in that event, any or all excess unexpended funds may be reailocated to such other priority expenditure projects or may revert to the unappropriated fund balance of the Federal Revenue Sharing Account as the City Council may direct by the affirmative majority vote of a quorum. Section 2.~ ..Authority'to Codify: Specific authority is hereby granted to codify and incorporate this Ordinance in~e City's;existing Code. Section 3. Separability: Eachofihe provisions of this Ordinance are separable, incl~ding word~ clause, phrase or sentence, and if any portion thereof shsll be declared invalid, lhe remaining portion shall not be affected but shall remain in full force and effect. Section 4. Repealing Provisions. All ordinances or parts of ordinances in conflict: herewith are hereby repealed. Section 5. Au effective date. This Ordinance shall become effective in the manner and at the time provided in the Charter and Ordinan~ces of the City of B~6ynton ]Reach, Florida. First reading this ~/~ day of March, 1976.
