In accordance with Ordinance number 001-07, the enclosed "Final Lien Modification
Order" is hereby forwarded to you for review. As required by Ordinance number 001-07,
the following procedures are to be followed:

MS CAUSE came before the City of Boynton Beach Code Compliance Magistrate on the Respondent's
application for lien reduction on &n11gEX 20, 2016, pursuant to Chapter Two, Article Five of the City Code of Ordinances.
The Magistrate having considered the application, all the facts regarding the specific code or codes the appealing party was in
violation of, the date of the original Magistrate hearing, the date the affidavit of compliance was issued, the current lien
amount and all pertinent information relating to the specific ease and being otherwise duly advised in the premises, it is

I . This Magistrate has subject matterjurisdiction of this cause and jurisdiction over the Respondent.
2, The Respondent has met all the lien reduction procedures established by the City Coda of Ordinances.

6. This Order is not final until the time period for appeal under the Code has elapsed and if appealed is properly
disposed by the City Commission.
7. In the event that the property owner does not comply with the Magistrate's order, as approved or modified by
the City Commission, within ninety (90) days of Commission's action, the Lien Reduction Order shall be of no further force
or effect, and the original hen shall romm on the property. No extensions of the ninety (90) day period shall be pem:dtted,

Mildred Jeanne Cook, said she had no idea of the problem when she purchased the
property in 2012. The work had been done in 2009, and it was reported to her in 2015.
She requested that the lien be removed.
Based on the testimony, Ms. Ellis ordered that the $6200 lien plus the administrative
costs of $730.15 be reduced to Just the administrative costs of $730.15.

Ms. Springer presented the case. Notice of violation was sent on April 25, 2014. The
Code hearing was on June 13, 2014, and Michael Garrett appeared. Compliance date
and fine set was July 3, 2014 or $100 a day. Case came into compliance on November
10, 2015; there were 494 days of non-compliance at $100 a day for a total fine of
$49,400 with four inspections plus administrative costs of $634.12. An additional three
lien reduction inspections were done on the property. There was an outstanding water
bill that had to be paid and in order to comply the case, the Business Tax inspection had
to be done and they had to pay for the 2016 Business Tax Receipt. They were then
ready for lien reduction.
Williaoii ®verfelt, Irritation Homes aka IH3 Properties, was sworn In by Ms. Ellis. He
said the property manager and Michael Garrett are no longer with the company, and the
paperwork got lost. He said they paid the Business Tax Receipt in June, having
received the violation in May. The lien was recorded in September 2014, and they
finally passed the Business Tax Receipt inspection in November, 2014. Mr. Overfelt
said he has a $765 invoice for landscaping that was approved (sprinkler system), and
he showed the invoice.

Based on the testimony given by both the City and the respondent, Ms. Ellis ordered
that the current lien of $49,400 plus the administrative costs of $634.12 be reduced to
$4,500 plus the administrative costs of $634.12.
