Minutes 07-14-16MINUTES OF THE RED LIGHT CAMERA HEARINGS HELD IN COMMISSION CHAMBERS CITY HALL, 100 E. BOYNTON BEACH BLVD, BOYNTON BEACH, FLORIDA, ON THURSDAY, JULY 14, 2016, AT 9:00 A.M. James Stokes, Special Magistrate Shana Bridgeman, Assistant City Attorney Anthony Petriello, Traffic Infraction Enforcement Officer Officer Anthony Verrigni, Traffic Infraction Enforcement Officer 1. Call to Order: Mr. Stokes explained he is the Special Magistrate and is a neutral third party. The statute requires it. Any document handed to him will become part of the record. Everything is being recorded. The City will hand him a packet for each case, which was already received by the violator. He is not a judge, he is a special magistrate appointed under the Statute. He cannot rule on the legality or constitutionality of the program that has bene argued in front of a judge, and violators can appeal Mr. Stokes decision. If that is the case, he will let the violator make the case and put it on record, because courts will look at this record first. The original notice indicates if the owner was not driving, they should send in an affidavit indicating who was driving so the notice could be resent to that individual. Often there are company cars or children drivers. This is a non -criminal civil violation, and the owner, the first name on the registration, is sent the notice. If identifying the driver, it goes to them. If not identified, the vehicle ran the light and the owner has to pay the bill. He will still have to rule if the car went through the red light. This will save time. The original notice is fined at $158, if requesting a hearing its $208. Once they start the hearing and found guilty, there is a hearing fee up to $250, and the City Commission set at a fee of $35, so the fine increases from $208 to $243. There is an opportunity to change the plea before the hearing starts. He asked if anyone wanted to the change their plea, they should come to the front row and an order will be printed giving 30 days to pay. This is not a traffic citation, no points are assessed against ones driving record and it will not impact insurance rates. If not paid, there is a hold on the registration renewal. It will show as an unpaid violation. The cases are heard in the order of the sign in sheet. A man advised he needed a payment plan. There is no mechanism in place for Mr. Stokes to offer a payment plan. Payments must be made within the 30 days, or at least be paid before renewing the registration The City will not take partial payments. The man indicated he only has Social Security. Mr. Stokes recommended he address it with the cashier. Anthony Verrigini, Traffic Infraction Enforcement Officer, Boynton Beach, Police Department, commented he was employed by the City of Boynton Beach for nine years. As part of his duties, he issues notices of violation for the City's Red Light Camera program. As part of the Red Light Camera program, he uses the American Traffic Solutions (ATS) Axsis software system and is well acquainted on how the software system works. On April 28, 2016, he logged into the Axsis software system to review events. In the queue, he observed that on April 28, 2016, at approximately 9:27 a.m., a vehicle registered to the violator was travelling westbound on W. Woolbright Road at SW 8th Street in the number one left -turn lane. After a review of the electronic evidence and photographs, a notice of violation was issued on April 28, 2016. Officer Verrigni submitted a video and still images of this case and all cases dated for today on a CD into evidence and a standard evidence pack. Mr. Stokes explained he officers control the videos from their laptop. What they see is linked to all the other screens so all will see the same images. Attorney Chaskelson had no objection to Mr. Stokes admitting the evidence into the record. The subject vehicle made a U-turn. Mr. Stokes and Mr. Chaskelson viewed the video. Mr. Chaskelson asked if Officer Verrigni was present at the scene at the time of the incident. Officer Verrigni responded they were not. Officer Verrigni advised the software system he viewed the incident on was the ATS software system. American Traffic Solutions is located in Arizona and they are a third party to his office. Mr. Chaskelson had no further questions and noted for the record, this was an unconstitutional violation of Mr. Hawkins' due process rights, also pursuant to the City of Hollywood versus Eric Arem, as a third party vendor was responsible for the images being viewed in court today. The argument speaks to a reasonable doubt if Mr. Hawkins or the registered owner of the vehicle, if the license plate number could be clearly made out by the video, he would argue there is insufficient evidence beyond a reasonable doubt, that this car 2 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida July 14, 2016 belongs to Mr. Hawkins or any registered owner whatsoever, and they cannot properly identify the car beyond a reasonable doubt, and based on that, he asked Mr. Hawkins be found not guilty of this offense. Mr. Stokes asked if there was a clear picture of the license plate and after a second review, Mr. Stokes advised the plate was clear. Decision Mr. Stokes upheld the violation and assessed a fine of $243 payable in 30 days. Kanwal Bawa Chickering Notice No. 1851600025667 Officer Verrigini mentioned on January 15, 2016, at 7:54 a.m., a vehicle registered to the violator was travelling eastbound on W. Boynton Beach Boulevard at Congress Avenue in the number five lane. After a review of the electronic evidence and photographs, a notice of violation was issued February 3, 2016. Officer Verrigni submitted the ATS evidence pack to the court and had still images and video to pay. Mr. Stokes and Ms. Chickering viewed the video and still images. Ms. Chickering explained she is an ER doctor. At that time it was not safe to stop abruptly. It was not something a flagrant violation of the law. She was driving and in that one case, it was not safe to stop in that manner. Mr. Stokes noted there was nobody close behind her. There was a five second amber light; however, he dismissed the citation due to another issue. Decision Mr. Stokes dismissed the citation. Sonia Kristin Williams M-39 Notice No. 1851600065085 Officer Verrigini explained he has been employed by the City of Boynton Beach for nine years. As part of his duties, he issues notices of violation. for the City's Red Light Camera Program. As part of the Red Light Camera Program he uses the American Traffic Solutions (ATS) program and is well acquainted with the software system. On February 24, 2016, at 1:59 p.m. Officer Verrigni logged into the Axsis software system to review events. In the queue he reviewed that on February 24, 2016, a vehicle registered to the violator was travelling eastbound on Boynton Beach Boulevard at N. Congress Avenue in the number two lane. He recognized the intersection as he had been there hundreds of times. The intersection looks the same in the photographs and videos as it does in real life. All these events occurred in Palm Beach County, Florida. He had documents in the City's possession that are used in the normal course of City business and are subject to Florida's Public Records Law. Mr. Stokes admitted all the documents into evidence. Mr. Stokes and Ms. Williams viewed the video and still photographs and Mr. Stokes noted she ran a red light before going in front of an ambulance. Ms. Williams noted her middle name was Kristina. She is a physician for all the years she was a driver, she was a safe driver and never ran a red light and has abided by the law. She was not thinking and had many things on her mind. She came to apologize. Decision Based on the testimony and admission, Mr. Stokes upheld the violation and assessed a fine of $243 payable in 30 days. She asked if there could be a reduction, or appeal. Mr. Stokes explained she could appeal and the violation will not impact her driving record. Mark J. Krueger Notice No. 1851600069228 Officer Verrigini explained he has been a City employee for nine years and as part of his duties, he issues notices of violation for the City's Red Light Camera program. He uses the ATS Axsis software system and was well acquainted with the software. On February 27, 2016, he logged into Axsis software to review events and saw in the queue, at that date and time, a vehicle registered to the violator was travelling northbound on S. Federal Highway at SE 23rd Avenue in the number three straight lane. After a review of the electronic evidence and photographs, a notice of violation was issued on March 17, 2016. He had an evidence pack he submitted to the court. He noted the vehicles' brake lights did not go on and there was no attempt to stop for the light. Messrs Stokes and Krueger viewed the video and still images. Mr. Krueger commented at this number three lane and light, the light was malfunctioning as there is no yellow in that lane light. He was aware of the dangers of running the light. He asked if that light has currently or in the past malfunctioned. Officer Verrigini responded there was a bulb burned out that was replaced. Sergeant Hawkins, Boynton Beach Police Department explained the defendant is correct, the amber light was burned out. At about the same time, he notified County traffic and they fixed it two days later. Mr. Krueger asked if it was consistently or currently malfunctioning, but Sergeant Hawkins could not testify as it was a County issue. He asked if that occurred before. Sergeant Hawkins explained lights burn out all the time and he did not have further information about light outages on S. Federal Highway other than this instance. 4 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida July 1, 2016 Mr. Stokes explained if you approach lights and they are all off, the law requires motorists to stop as if it is a four-way stop. If there were no lights showing, the obligation was to stop. Mr. Krueger requested further information about the violation being an infraction against the vehicle. Mr. Stokes explained it is a moving violation against the vehicle, not the driver. This was a civil violation against the vehicle and the citation attaches to the vehicle's registration. Mr. Krueger thought it was unconstitutional and asked, based on the Officer's testimony, if there a reasonable expectation with the light out, he could reasonably stop. The distance between the green and red lights was four seconds and he was focusing on his lane, not the others. Mr. Krueger queried based on the video, if there was a reasonable expectation he could have stopped at the light and not entered into the intersection in regard to his brakes. He thought the amber light would have been three seconds and learned the amber was timed for four seconds. He commented he was focusing on his lane. He did not intend to run the light, but he only had four seconds to realize there was no light. Mr. Stokes explained when the green light changed, the light would have turned red in four seconds as it would have been yellow for four seconds if the amber light would have appeared. In this instance with the amber light burned out, he should have stopped. Decision Mr. Stokes explained whether there was a yellow light or not, four seconds is longer than most other cities to stop and he upheld the violation and assessed a fine of $243 payable in 30 days. Diane Marie Mulvey Notice No. 1851600079136 Officer Verrigini conveyed he has been employed for nine years by the City of Boynton Beach Police Department. As part of his duties, he issues notices of violation for the Red Light Camera program and he uses the ATS Axsis software. He is well acquainted with how it works. On March 7, 2016, he logged into the Axsis system software to review events and in the queue he observed on that date, a vehicle registered to the violator was travelling northbound on Federal Highway and SE 23rd Avenue in the number three lane. He recognized the intersection as he has traveled it hundreds of times and the intersection looks the same in the photographs and videos as it does in real life. After reviewing the photographs and video, he determined the vehicle that ran the red light was in violation of Florida Law. He had documents, still images and a video he submitted to Mr. Stokes. Mr. Stokes and Ms. Mulvey viewed the video and still images. Ms. Mulvey commented she was in the same lane with the yellow light malfunctioning as the prior case. She thought a reasonable expectation was the equipment would display a yellow light to give a fair warning and she understood the car was behind the Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida July 14, 2016 line when the light was red, but they needed a warning as they are creatures of habit. The speed is alittle high to just stop when one is cruising on a long stretch of road. The other lane had a larger vehicle obstructing her view. It was diffult to register. Mr. Stokes agreed as far as expectation, but drivers should always be alert and if something was out of the ordinary, they should be extra alert. If no lights, motorists must stop. He commented it was not a defense. Decision Based on the testimony and evidence, Mr. Stokes upheld the violation and assessed a fine of $243, payable in 30 days. Glenn Cohen Notice No. 1851600029933 Officer Petriello, Traffic Infraction Enforcement Officer, conveyed he has been employed for four years by the City of Boynton Beach Police Department. As part of his duties, he issues notices of violation and Uniform Traffic Citations for the City's Red Light Camera program and as part of his duties, he uses the ATS Axsis software and is well acquainted with the software. On February 8, 2016, he logged into the Axsis system software to review events and in the queue he observed on January 20, 2016, at 2:38 p.m., a vehicle registered to the violator was travelling southbound on N. Congress Avenue at W. Gateway Boulevard in the number one lane. He recognized the intersection as he has traveled it hundreds of thousands of times in the course of his duties and the intersection looks the same in the photographs as it does in real life. After reviewing the photographs and video, he determined the vehicle that ran the red light in violation of Florida Law. All of the events occurred in the City of Boynton Beach, Palm Beach County, Florida. He had documents and still images used during the course of City business and he displayed a video and still images. Messrs. Stokes and Cohen viewed the video and still images. Mr. Cohen explained when he got to the intersection, the light seemed to change from green to red in a few seconds and he hesitated and then proceeded through. The car on the opposite side of the street did not release their brakes. Cars were making a left turn on the oppose side of the street and he got confused. Mr. Stokes noted there was a five -second yellow light. Mr. Cohen thought there was a glitch. Decision Based on the testimony and evidence, Mr. Stokes upheld the violation and assessed a fine of $243 payable in 30 days. Steven G. Kashian Notice No. 1851600061142 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida July 14, 2016 Officer Verrigini conveyed he has been employed for nine years by the City of Boynton Beach Police Department. As part of his duties, he issues notices of violation for the Red Light Camera program and uses the ATS Axsis software and is well acquainted with how it works. On March 9, 2016, he logged into the Axsis system software to review events and in the queue he observed on February 20, 2016, a vehicle registered to the violator was travelling northbound on Federal Highway at SE 23rd Avenue in the number two lane. After a review of the electronic evidence, he determined the vehicle ran the red light and issued a notice of violation on March 9, 2016.. He had documents and still images and video he submitted to Mr. Stokes. Messrs. Stokes and Kashian viewed the video and still images. The red light time was 1.1 seconds and the vehicle speed was 54 mph. Mr. Kashian asked Officer Verrigini about the time he reviewed the video and about the process to send out the citation. Officer Verrigni explained he issues the Uniform Traffic Citation from him through ATS Axsis software system. Mr. Kashian explained he feels he has a right to a speedy hearing and from the time the images showed he ran a red light, were reviewed and he received the citation in the mail, two and a half months had elapsed. He did not remember going through Boynton although he did not doubt going through the intersection as no one drives his truck. When he was going through he was already committed at the speed coming up to the red light, and he had no other option as he could not stop in time. Officer Verrigini commented the speed limit is 35 mph. Mr. Kashian did not know as he rarely goes through Boynton. He was aware the Magistrate had some discretion, and he hoped common sense and practicality would come into play. He has never been cited for a red light ticket. He is a full time resident and residents put up with tourist traffic. He commented everyone makes mistakes and common courtesy is nice for residents in Palm Beach County. Mr. Stokes noted it was a four second yellow light which is plenty of time to warn someone to stop and Mr. Kashian went through 1.1 seconds later. Cross traffic would have been moving and decisions are not made on speed, although it was clear he was travelling at a higher speed. Mr. Stokes appreciated the testimony, but it was not a viable defense and he advised he has much less discretion than a judge. Decision Mr. Stokes upheld the violation and assessed a fine of $243 payable in 30 days. Mr. Kashian asked how long the Officers have to notify him of the violation and asked if there was a time limit as the envelope was not time stamped. Mr. Stokes did not know the time limit, but commented the notice was dated May 8, 2016. Mr. Kashian asked if he could get a ticket a year later. Mr. Stokes suggested speaking with Sgt Hawkins about the parimeters. The traffic infraction occurred on February 10, 2016, the notice of violation was issued March 9, 2016 and the person is given 60 days to pay. The notice was issued hearing request form on March 30, 2016. Fritz Edward Diehl Mr. Stokes corrected himself the due date March 9, 2016. Mr. Kashian signed the Notice No. 1851600040526 Officer Verrigini conveyed he has been employed for nine years by the City of Boynton Beach Police Department. As part of his duties, he issues notices of violation for the Red Light Camera program. As part of his duties, he uses the ATS Axsis software and he is well acquainted with the software. On February 19, 2016, he logged into the Axsis system software to review events and in the queue he observed on February 1, 2016, a vehicle registered to the violator was travelling eastbound on W. Boynton Beach Boulevard at SW 8th Street in the number one turn lane. After a review of the electronic evidence, he determined the vehicle ran the red light and issued a notice of violation on February 19, 2016. This occurred in Boynton Beach, Palm Beach County, Florida. He had documents, still images and a video he submitted to Mr. Stokes. Messrs. Stokes and Diehl viewed the video and still images. Mr. Diehl explained he was in a line of traffic of vehicles turning left. The minivan slowed down to make a U-turn and he had to slow as well. If the minivan travelled in his same path, there was a pick-up truck behind him was afraid to stop as the truck was previously following closely behind. It was a quick decision. After the minivan slowed, he had to slow and he did not want to get rear ended. After he went through he realized vehicles started to approach from the other direction. Mr. Stokes did not think the vehicle was that close behind to be a hazard. It was a 4.5 second yellow light. Decision Based on the testimony and evidence, Mr. Stokes upheld the violation, assessed a fine and gave 30 days to pay. Mr. Diehl commented very few people use turn signals in Boynton Beach and thought it should be addressed in the City. Joan Carroll Harrison -Boughton Notice No. 1851600036698 Officer Verrigini explained he has been employed by the City of Boynton Beach for nine years and as part of his duties, he issues notices of violation for the Red Light Camera program. He has used the American Traffic Solution software and advised he is well acquainted with the software. Officer Verrigni explained on February 17, 2016, he logoed into Axsis software system to review events and in the queue he observed on January 28, 2016, a vehicle 3 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida July 14, 2016 registered to the violator was travelling southbound on Congress Avenue at W. Woolbright Road in the number two lane. After a review of the electronic evidence, Officer Verrigini issued a notice of violation on February 17, 2016. All these events occurred in Palm Beach County Florida. He had documents and the evidence to submit including a video and still images. Mr. Stokes and Ms. Harrison -Boughton viewed the video and still photos. She asked Officer Verrigini when he indicated the location, he said Congress and W. Woolbright Road and it was the wrong location. Officer Verrigini agreed and commented the location was mistyped. The violation occurred on S. Federal Highway and SE 23rd Avenue. She thought there was a man versus machine argument and the violation is not against her, it is against the vehicle. Ms. Harrison -Boughton explained she lives close to the location. She stops at the light and proceeds through it about three times a day. The only way she does not go through the light is if she is turning left outside of the complex. She has received a red light ticket at this location in the past, knew she was guilty and paid it. The reason she appeared was there were extenuating circumstances with her vehicle the day it happened. The day before the violation, there was a storm and trees were knocked over. The next morning, she thought the light was out. When she looked at the light, she thought nothing was there and the light was out because of the storm. The event is against the car and the car is in the junk yard, because it was a five speed and there was so much trouble with the transmission if she stopped she would have stalled in the middle of the light. It was a matter of two choices and she commented the City can continue to prosecute the car, but she does not have it any more. She was experiencing financial and medical issues. She was so convinced there was a power outage, she came home and called FPL. She had paperwork showing she thought it was out. Mr. Stokes noted if the power was out at the intersection, her obligation was to stop. Mr. Stokes reviewed the evidence again. Decision Mr. Stokes dismissed the citation and suggested she speak with Sgt. Hawkins Betty Olive Henricy Notice No. 1851600054766 Ms. Henricy was present as her case was reset to this hearing and she was supposed to bring the police report. The matter pertained to a rental vehicle and her driver's license was stolen in 2016. She was unable to rent a car from the rental company. Ms. Henricy advised the Department of Motor Vehicles advised this will be the last year before expiration of the license. Her testimony under oath was she was not driving and unable to rent from Enterprises. X, Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida July 1, 2016 Mr. Stokes advised this case was not on the printed agenda, but was continued from the last hearing. It was noted the Police Department had no objection to dismissing the citation. Decision Mr. Stokes dismissed the citation noting the report number from the Delray Beach Police Department was 08-006129 by Officer D. Hunter, ID No. 965. Mr. Stokes took judicial notice of the Officers operating the ATS Software and were familiar with the intersections involved for violations involving the following individuals who were not present: Margaret Albergo Notice No. 1851600020148 Officer Verrigini advised on January 8, 2016, at 7:53 p.m., a vehicle registered to the violator was travelling southbound on NW 8th Street at W. Boynton Beach Boulevard in the number two lane. After a review of the electronic evidence and photographs, a notice of violation was issued on January 27, 2016. The red light time was .6 seconds. Officer Verrigni submitted an evidence pack to the court. Mr. Stokes viewed the video and still images. Decision Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $258 payable in 30 days. Florence M. Balint Notice No. 1851600035088 Officer Verrigini mentioned on January 26, 2016, at 12:39 p.m., a vehicle registered to the violator was travelling eastbound on Boynton Beach Boulevard at Seacrest Boulevard in the number three straight lane. After a review of the electronic evidence and photographs, Officer Verrigni issued a notice of violation on February 12, 2016. The red light time was 1.7 seconds. Officer Verrigini submitted the evidence pack with video and still images to Mr. Stokes which he viewed. Decision Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $258 payable in 30 days. Richard George Blake Notice No. 1851600060904 Officer Verrigini commented on February 20, 2016, at 1:02 p.m., a vehicle registered to the violator was travelling southbound on S. Broderick Notice No. 1851600077577 Officer Verrigini conveyed on March 6, 2016, at 8:28 a.m., a vehicle registered to the violator was travelling southbound on South Federal Highway and SE 3rd Avenue in the number one left turn lane. After a review of the electronic evidence, Officer Verrigni issued a notice of violation on March 25, 2016. The red light interval was .5 seconds. He submitted the ATS evidence pack including videos and still images to Mr. Stokes which he viewed. Decision Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $258. Mark Stanley Brooker Notice No. 1851600045848 Officer Petriello mentioned on February 6, 2018, at 1:42 p.m. a vehicle registered to the violator was travelling southbound on NW 8t" Street at W Boynton Beach Boulevard in the number two lane. After a review of the electronic evidence, Officer Petriello issued a notice of violation on February 26, 2016. The red light time was 9.6. Officer Petriello submitted the ATS evidence pack to Mr. Stokes viewed the video and still photographs. 11 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida Decision July 14, 2016 Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $258. Stanley H. Cale Notice No. 1851600044510 Officer Petriello commented on February 5, 2016 at 9;52 a.m., a vehicle registered to the violator was travelling eastbound on W. Boynton Beach Boulevard at N. Congress Avenue in the number two lane. After a review of the electronic evidence and photographs a notice of violation was issued on February 26, 2016. The red light time was .3 seconds. He submitted the ATS evidence pack to Mr. Stokes who viewed the video and still images. Herschel Charles Ford Notice No. 1851600045434 Officer Petriello explained on February 6, 2016, 8:59 p.m. a vehicle registered to the violator was travelling westbound on W. Woolbright Road at S. Congress Avenue in the number two lane. After a review of the electronic evidence and photographs, a notice of violation was issued on February 26, 2016. The red light time was .3 seconds.
