1. Call to order by local Hearing Officer, James D. Stokes
Mr. Stokes called the hearings to order at 9:08 a.m.
Mr. Stokes explained he is a Special Magistrate and a neutral third party brought in to
hear these cases. He knows nothing about the cases and he has not viewed any of the
evidence. He advised the program is authorized by Florida Statute, has been
challenged and as of today, is legal. A few years ago, the City of Boynton Beach put
the program on hold to ensure it complied with all aspects of the law. When the
program resumed, personnel from the vendor, American Traffic Solutions (ATS),
testified, under cross examination to explain how the program operates and meets all
the legal requirements. Pursuant to the Statute, if the vehicle is found in violation, the
initial fine is $158. When the owner sent in the request for hearing, a $50 additional
administrative cost was added bringing the cost to $208. If the violation is upheld, the
Statute also permits a hearing charge which could be up to $250, but the City of
Boynton Beach set the fine at $35.
Mr. Stokes advised people often come up with defenses that do not work. One
common misconception is making a U-turn on a red light is permissible, but it is not.
Another issue is individuals say I was not driving and do not know who was. The owner
is the first name on the registration. The citation is a civil violation on the vehicle. The
notice says if you were not the driver, you can identify who was and staff would redirect
the citation to them. If the driver is not identified, the default position is the vehicle’s
owner is responsible. Sometimes there are company cars, or teenagers involved and
the Statute is written to avoid that. Individuals can still have their hearing, but Mr.
Stokes provided the information to enable individuals who may want to change their
plea to save the hearing cost.
Mr. Stokes explained the officer controls the videos on the monitor from their laptop and
all parties view the same information at the same time.

Mr. Stokes explained if individuals want to make a legal challenge, they should
understand he is not a judge. He cannot rule if the program is illegal or not. He is only
a hearing officer. If taking the case to court, the court will ask if they exhausted their
administrative hearing rights. Mr. Stokes cannot rule, but he will let them make their
record, as the court will look at it.

The Clerk administered an oath to all those intending to testify.
Mr. Stokes requested anyone wanting to change their plea come to the front of the
Chamber. He explained the Order gives 30 days to pay. He also clarified no points are
assessed on one’s driving record and it is strictly a monetary fine. If not paid within the
30 days, the citation will put a hold on the vehicle’s registration. He commented the City
has the burden of proof and the Officers will make their presentation first.

Officer Verrigini reviewed on April 10, 2016, at 1:46 p.m., a vehicle registered to the
violator was travelling westbound on Woolbright Road at S. Congress Avenue, in the
number two lane. After a review of the electronic evidence, Officer Verrigini issued a
notice of violation on May 3, 2016. He submitted a standard evidence pack to the Court
and a CD with still images and videos for all the cases being heard by Mr. Stokes.
Attorney Mellinger had no objection to the evidence submitted. Attorney Mellinger and
Mr. Stokes viewed the electronic evidence.
Attorney Mellinger had no objection to hearing the second case as the defense would
be the same.

Officer Petriello commented on April 17, 2016, at 7: 02 p.m., a vehicle registered to the
violator was travelling southbound on S. Congress Avenue at W. Woolbright Road in the
number one lane. After a review of the electronic evidence and photographs, Officer

Petriello issued a notice of violation on May 6, 2016. He submitted the evidence pack to
Mr. Stokes. Mr. Stokes and Attorney Mellinger viewed the video and still images.

Attorney Mellinger put on record the opinion of the 4 District Court of Appeals from the
City of Hollywood verses Arem. He commented the West Law citation is not published
yet, but the case number was 4012-1312, City of Hollywood versus Arem which states
in pertinent parts referencing FS 3.16, the statute does not authorize a private vendor to
issue citations either expressly or impliedly. The Legislature, in section 3.16.1.a. did
permit cities to delegate the review of information obtained from a traffic infraction
detector. It did not permit the cities to delegate their authority to issue any resulting
traffic citations anywhere in these statutes. Had the legislature intended to allow for
delegation of this authority or responsibility, just as it expressly allowed for delegating
the review of traffic citation detector information by employees or agents under 3.16.1.a.
it could have easily done so. Under the clear wording of the Statute, as enacted, it did
not; that is from the holding and conclusion. The holding reads Florida law does not
grant the City, referencing Hollywood that is, any authority to delegate a private third-
party vendor with the ability to issue uniformed traffic citations. Only cities law
enforcement officers and Traffic Infraction Enforcement Officers have the authority to
issue such citations. This was issued by the Fourth District Court of Appeals and is
binding on Palm Beach County and it was not overturned by the Appellate Court which
would be the Florida Supreme Court. He commented the determination was issued on
October 15, 2004, which remains good law today. Last year, the Palm Beach County
Court invalidated over 250 of these citations”.
Mr. Stokes explained he was aware of the case. Officer Petriello explained he is a
Traffic Infraction Enforcement Officer, and for this case, he reviewed the videos and he
issued the violation, not a computer. Officer Verrigini explained he also is a Traffic
Infraction Enforcement Officer with the Boynton Beach Police Department and he also
reviewed the notice of violation and issued it.
Mr. Stokes mentioned the City put their program on hold for eight or nine months, and
when it started back up, ATS testified to the whole program and it satisfied Mr. Stokes
the way they work. ATS sends the videos raw footage to the Police Department and
they review it and decide which are violations. Attorney Mellinger explained the
distinction is the Officer did not record that information or make the stop. It was
provided by a third party vendor to them. If they personally filmed the incident, it would
have been different. The third party was the provider of the information and they
reviewed, which is addressed in Arem. Reviewing does not pass the muster under
Arem. Mr. Stokes explained the Officers review the information and make the
determination as to who should receive the citation.
Decision

Based on his understanding of Arem and what he heard on October 8, and he
suggested Attorney Mellinger obtain the transcript, Mr. Stokes upheld both violations

and assessed a fine of $243. Attorney Mellinger asked if the violation will automatically
turn into a Uniform Traffic Citation (UTC). Mr. Stokes explained it turns into a UTC if
there is no response. At this point it is this order which assesses a fine of $243 and if
not paid, it attaches to the registration. Mr. Stokes clarified if the violator does not
respond at all to the initial notice of violation it will turn into a UTC, but if someone
responds and asks for a hearing, the hearing is held, the $243 attaches to the
registration. If you want to appeal, one must take it down to the courthouse within 30
days and file an appeal.
Lexine Antonet Smith Notice No. 1851600116490
Officer Petriello commented on April 14, 2016, at 6:49 p.m., a vehicle registered to the
violator was travelling on W. Boynton Beach Boulevard at N. Congress Avenue in the
number four lane. After a review of the electronic evidence and photographs, Officer
Petriello issued notice of violation on May 5, 2016. He submitted the evidence pack to
Mr. Stokes. Mr. Stokes and Ms. Smith viewed the video and still images.
Ms. Smith advised her daughter was driving and told her to attend the hearing, but she
was not present. She has her name and number, but does not know where she is at this
moment as she left on bad terms. Mr. Stokes explained he did not know what her
defense would be. Mr. Stokes explained he could rule on what he saw, which was a
violation, or he could continue the hearing, if she would appear next time. Ms. Smith did
not want to have another hearing.
Decision
Based on the video, Mr. Stokes found a violation occurred and gave 30 days. He
suggested Ms. Smith give her daughter the order and tell her to pay it in 30 days.
Christine Bandieramonte Notice No. 1851600084813
Officer Verrigini reviewed on March 12, 2016, at 2:21 p.m., a vehicle registered to the
violator was travelling eastbound on Gateway Boulevard at N. Congress Avenue in the
number two left-turn lane. After a review of the electronic evidence and photographs,
Officer Verrigini issued a notice of violation on March 21, 2016. He had the standard
ATS evidence pack he submitted to Mr. Stokes. Mr. Stokes and Ms. Bandieramonte
viewed the video and still images.
Ms. Bandieramonte thought the light was very short. The light went from green to
yellow to red, and this had happened to her three years ago. She mentioned the light at

SE 23 went for two seconds and after hundreds of people in the neighborhood
contested it, they changed the light to six seconds. She saw the light was yellow and
she started to pass. She was looking at the car in front of her and there was a beige car
trying to make a right turn and traffic coming from the other side. The guy that was in
front of her went through. She was looking at him, the traffic, the light, and she was

making a left turn and could not speed up. If she had, she would have been fine. The
traffic started coming from the other side when she cleared the road. She did not know
why she was penalized. She asked if the light was checked to see how many seconds
it stayed on. Mr. Stokes explained the light was yellow for five seconds, which is one of
the longer lights in the City and it can go down to three seconds. The City Commission
had the lights on the cameras increased by a half a second or more, so most
intersections with cameras have longer yellow lights. In this instance, it was five
seconds. Ms. Bandieramonte noted Congress is a wide street to turn left. In 2013, it
was a very short street and it went to six seconds and she asked why the light on
Congress was not more than five seconds. Mr. Stokes explained the Palm Beach
County Traffic Engineer sets the timing of the lights and the City increased the time at
the intersections with cameras. Mr. Stokes noted five seconds is a long time. Three or
four cars can go through. Ms. Bandieramonte commented there was only one car in
front of her. Mr. Stokes commented the driver in front of her made it over the line and
she did not.
Decision
Mr. Stokes upheld the violation and assessed a fine of $243, payable in 30 days. He
requested she wait for the order to be printed before leaving.
Jerald Alan Goldstein Notice No. 1851600114008
Mr. Goldstein explained he was not present to defend, only to request four months to
pay. He understood he had up until the time to register the vehicle. Mr. Stokes
explained that Statute only allows for 30 days to pay. Mr. Goldstein pled guilty and did
not want to proceed with the hearing.
Larry Joseph Galovics Notice No. 1851600056597
Officer Petriello conveyed on February 16, 2016, at 1:43 p.m., a vehicle registered to
the violator was travelling eastbound on Boynton Beach Boulevard at N. Seacrest
Boulevard in the number three lane. After a review of the electronic evidence, Officer
Petriello issued a notice of violation on March 7, 2016. He submitted an evidence pack
to Mr. Stokes. Mr. Stokes and Mr. Galovics viewed the video and still images.
Mr. Galovics watched the video and saw three other cars in the intersection. He would

be the 4 car in the intersection. Officer Petriello showed where Mr. Galovics ran the
light.
Decision
Based on the evidence, Mr. Stokes upheld the violation and assessed a fine payable in
30 days.

Fredda Enid Cohen Notice No. 18516000096
Officer Petriello mentioned on March 24, 2016, at 12:02 p.m., a vehicle registered to the
violator was travelling eastbound on Boynton Beach Boulevard at N. Congress Avenue
in the number two lane. After a review of the electronic evidence, Officer Petriello
issued a notice of violation on April 18, 2016. He submitted an evidence pack to Mr.
Stokes. Mr. Stokes and Ms. Cohen viewed the video and still images.
Ms. Cohen explained that day she was at the Boynton Beach Nursing Home on
Lawrence and Boynton Beach Boulevard. His brother fell out of the bed, fractured his
head, had a brain bleed and was transported to JFK Memorial Hospital. She was
following behind, upset and panicking as she had never been to JFK. She was not in
any condition to be driving and later that day he passed. Mr. Stokes noted she was
almost a full two seconds into the light and she would not have helped anyone if she
was t-boned in the intersection. He sympathized, but it was not a defense.
Decision
Mr. Stokes upheld the violation and assessed a fine payable in 30 days. Ms. Cohen
explained she gave her name to the Officer to not go through with the hearing 10
minutes ago. Mr. Stokes removed the hearing fee.
Edward Charles Huber Notice No. 1851600113711
Officer Verrigini recalled on April 11, 2016, at 4:54 p.m., a vehicle registered to the
violator was travelling westbound on Woolbright Road at S. Congress Avenue in the
number two lane. After a review of the electronic evidence, Officer Verrigini issued a
notice of violation on May 4, 2016. He submitted the evidence pack to Mr. Stokes.
Messrs. Stokes and Huber viewed the video and still photographs.

Mr. Huber explained the violation occurred on April 11. His truck is driven mostly by
him and he did not get any kind of notice until May 8, 2016, so he had no way to figure
out who was driving. He has sons. He objected because who would know a month later
who was driving. It took the City two days to let him know to come to the hearing, but
only a month to notify him of the violation. He noted the lights in the picture are yellow.
He did not know if there was anything wrong with the camera and would not have made
any kind of a plea if he did not see the light was yellow. Otherwise he would have just
sent in a check. He commented he is one of the few people who does not have a
computer, so he had no way to do anything else. In the picture, the light was clearly
yellow.
Decision
Based on the evidence presented, Mr. Stokes dismissed the case.

Officer Verrigini conveyed on March 11, 2016, at 7:49 a.m., a vehicle registered to the
violator was travelling on S. Congress Avenue at W. Woolbright Road in the number
four straight lane. After a review of the electronic evidence, Officer Verrigini issued a
notice of violation on March 28, 2016. He had an evidence pack to submit to the court.
Messrs. Stokes and Louica viewed the video and still images.
Mr. Stokes viewed the video and still, but could not see clearly as a bus was blocking
the view.
Decision
Mr. Stokes dismissed the citation.

Officer Verrigini indicated on February 23, 2016, at 7:51 p.m., a vehicle registered to the

number two left-turn lane. After a review of the electronic evidence, Officer Verrigini
issued a notice of violation on March 11, 2016. He submitted the evidence pack to Mr.
Stokes. Mr. Stokes and Ms. Defour viewed the video and still images.
Decision
Mr. Stokes dismissed the case.
Michele Schein Notice No. 1851600103993
Officer Verrigini commented on April 1, 2016, at 12:30 p.m., a vehicle registered to the
violator was travelling westbound on Woolbright Road at S. Congress Avenue in the
number two left-turn lane. After a review of the electronic evidence, Officer Petriello
issued a Notice of Violation on April 22, 2016. He submitted the evidence pack to Mr.
Stokes. Mr. Stokes and Ms. Schein viewed the video and still images.
Ms. Schein advised the school bus blocked the light, and she realized she ran the light
and applied her brakes. If she jammed on her brakes she could have gotten rear ended.
Mr. Stokes explained there are multiple lights she could have looked at to avoid being
blocked and if one is so close they cannot see the light, they are following too closely.
Decision
Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $243
payable in 30 days.

Officer Petriello commented on March 31, 2016, at 8:12 a.m., a vehicle registered to the
violator was travelling eastbound on Boynton Beach Boulevard at N. Congress Avenue
in the number three lane. After a review of the electronic evidence, Officer Petriello
issued a notice of violation on April 21, 2016. He submitted the evidence pack to Mr.
Stokes. Messrs. Stokes and Goldfeder viewed the video and still images.
Mr. Goldfeder explained anything that leads up to the photograph is not visible. There
was someone driving closely behind him and he locked up the brakes. He had two
choices which were to potentially be rear-ended or go through the light that turned red.
If an Officer was present, the other car would have been cited. He thought he would get
hit.
Decision
Based on the video and evidence, Mr. Stokes upheld the violation and assessed a fine
of $243.
Mr. Goldfeder understood if the fine is not paid in 30 days, it follows the registration. He
commented if he does not have the car anymore and is not using the plate, if he would
have to pay the fine. Officer Petriello explained it follows the license plate. If Mr.
Goldfeder wanted to register the license plate or apply for a new license plate, the hold
would be transferred to the new plate.
Julius Edward Guerra Notice No. 1851600102656
Officer Petriello explained on March 31, 2016, at 6:21 a.m., a vehicle registered to the
violator was travelling westbound on W. Woolbright Road at S. Congress Avenue in the
number one lane. After a review of the electronic evidence, Officer Petriello issued a
notice of violation April 21, 2016. He submitted the evidence pack to Mr. Stokes.
Messrs. Stokes and Guerra viewed the video and still images.
Mr. Guerra explained he was in the lane behind the bus and someone needed to get
over, so he moved over to the other lane where the bus was not and at that time, his
view was obstructed. When he was in the intersection he realized the light was red. Mr.
Stokes noted there were three lights. Mr. Guerra explained it was the angle and it
happened just prior to entering the intersection.
Decision
Based on the evidence presented, Mr. Stokes upheld the violation and assessed a fine
of $243 payable in 30 days.

Officer Verrigini mentioned on March 8, 2016, at 1:23 a.m., a vehicle registered to the
violator was travelling northbound on Congress Avenue at W. Woolbright Road in the
number three straight lane. After a review of the electronic evidence, Officer Verrigini
issued a notice of violation on March 25, 2016. He submitted the evidence pack to Mr.
Stokes. Mr. Stokes and Ms. Fernandez viewed the video and still images.
Mr. Fernandez commented the Red Light Cameras were unconstitutional. They are tax
payers and they pay police officers to issue tickets to those who cross red lights, not a
third party. He wanted to proceed with his constitutional rights and appeal in court.
Decision
Based on the testimony and video, Mr. Stokes upheld the violation. He explained he
has 30 days to pay and file the appeal at court.
Adrienne Frances Butner Notice No. 1851600066539
Officer Verrigini conveyed on February 25, 2016, at 3:45 p.m., a vehicle registered to
the violator was travelling on W. Woolbright Road at Congress Avenue in the number
one left-turn lane. After a review of the electronic evidence, Officer Verrigini issued a
notice of violation on March 14, 2016. He submitted the evidence pack to Mr. Stokes.
Mr. Stokes and Ms. Butner viewed the video and still images.
Ms. Butner disputed the violation because she could not see in the picture and she also
did not have a computer. She does not know anyone with a computer and she did try to
check out the video. Mr. Stokes explained the video showed she ran the light.
Decision
Based on the video, Mr. Stokes upheld the violation and gave 30 days to pay.
John Patrick Donohue Notice No. 1851600101583
Officer Petriello mentioned on March 29, 2016, at 1:31 p.m., a vehicle registered to the
violator was travelling eastbound on Woolbright Road at S. Congress Ave in the number
one lane. After a review of the electronic evidence, Officer Petriello issued a notice of
violation on April 21, 2016. He submitted the evidence pack to Mr. Stokes. Messrs.
Stokes and Donohue viewed the video and still images.
Mr. Donohue commented it looked like he was making a U-turn, and the cars were on
the other side of the intersection when he crossed. His picture showed two of them.
Mr. Stokes explained often at intersections the lights on the other side may be timed

differently. Mr. Donohue did not think that was the case as he lives there. Mr. Stokes
commented anyone who runs the light is cited. Mr. Donohue did not believe it.
Decision
Based on the testimony, video and photographs, Mr. Stokes upheld the violation, and
assessed a fine of $243 payable in 30 days.

Officer Verrigini indicated on February 11, 2016, at 12:10 p.m., a vehicle registered to

number three straight lane. After a review of the electronic evidence, a notice of
violation was issued on March 1, 2016. He submitted the evidence pack to Mr. Stokes.
Mr. Stokes and Ms. Anyanwu, the violator’s wife and the driver of the vehicle, viewed
the video and still images. Ms. Anyanwu explained she misplaced the citation. She is a
social worker who conducts many home visits. Mr. Stokes reviewed the evidence again

Officer Verrigini related on February 10, 2016, at 3:16 p.m., a vehicle registered to the

number two straight lane. After a review of the electronic evidence and photographs,
Officer Verrigini issued a notice of violation on March 9, 2016. He submitted the
evidence pack to Mr. Stokes. Mr. Stokes and the Lana Pugaliese viewed the video and
still images.
Ms. Pugaliese explained she got the notice and was shocked because this location had
the camera the longest.
Decision
Mr. Stokes assessed a fine of $208 and waived the hearing fee.
Joan Dobkin Tomasino Notice No. 1851600084888
Officer Verrigini mentioned on March 12, at 3:09 p.m., a vehicle registered to the

two straight lane. After a review of the electronic evidence, Officer Verrigini issued a
notice of violation on March 31, 2016. He submitted the evidence pack to Mr. Stokes.

Ms. Tomasino did not deny the violation. Her issue was that, other than herself and
three other people, have all received four red light camera tickets at the intersection.
She thought it was bizarre and coincidental that most red lights are between four
seconds and 4.5 seconds. She thought there was no way the light was four seconds.
She wanted to understand the time of the red light and felt it was entrapment. She
acknowledged the violation, saw it, but wanted to be heard. Mr. Stokes explained the
timing is set by the County Traffic Engineer and they calibrate the lights frequently.
Officer Verrigni explained the Statute governing that intersection calls for a 3.6 second
light based on the speed. The County set it at 4.0 seconds.
Decision
Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $243
payable in 30 days.

Officer Verrigini conveyed on February 13, 2016, at 9:53 a.m., a vehicle registered to

number two lane. After a review of the electronic evidence, a notice of violation was
issued on March 2, 2016. He submitted the evidence pack to Mr. Stokes. Mr. Stokes
and Ms. Bonami viewed the video and still photographs.
Ms.Bonami explained she did not remember any of this as she was sick and on the way
to the hospital.
Decision
Based on the testimony and evidence, Mr. Stokes upheld the citation and assessed a
fine, but waived the hearing fee. He explained the fine was payable within 30 days.

violator was travelling eastbound on Boynton Beach Boulevard at N. Seacrest
Boulevard in the number two lane. After a review of the electronic evidence, Officer
Petriello issued a notice of violation on April 29, 2016. He submitted the evidence pack
to Mr. Stokes, who viewed the video and still images.
Decision
Based on the evidence presented, Mr. Stokes upheld the violation and assessed a fine
of $258.
