1. Call to Order:
Mr. Stokes called the hearings to order at 9:04 a.m. and explained he is the Special
Magistrate and a neutral third party appointed by the City to hear these cases. He has
no relationship with the City and he would be viewing the evidence for the first time at
the hearing. The City presents their case first using the same video, photos and
documents as the violator received and all parties will review the evidence at the same
time.
Mr. Stokes explained he is not a judge and his authority is limited to deciding if the
vehicle went over the limit line before or after the light turned red. On October 8, 2015,
American Traffic Solutions (ATS) was present as there was concern how the program
was run. The ATS representative was cross examined by opposing counsel regarding
the program and Mr. Stokes was satisfied the program is run in accordance with law. A
case had arisen that law enforcement cannot delegate their authority to issue citations
to a private company. Mr. Stokes explained the transcript is available and the City did
not delegate its powers to ATS. All the images go to the Police Department and the
appropriate offices make the decision to issue the ticket. Mr. Stokes has no authority to
challenge the legality. If violators want to do so, they must make their record and go to
the Palm Beach County courthouse and file an appeal and make their case there. A
judge can rule on the legality and constitutionality of the program. He noted there is a
filing fee at the courthouse.
Other issues that have surfaced were violators often think u -turns on red lights are legal
and they are not. Mr. Stokes explained the fine is an administrative charge against the
vehicle and not a moving violation. If the violation is upheld, no points are assessed on
the license. The license is not suspended and insurance rates are not impacted. The
vehicle is being charged with running the red light. If the owner was not driving, the
owner could send in an affidavit indicating who was and the Officer would send a new
notice to the named driver. People often have proof they were not in the area or a
company car was identified with multiple drivers or even various children driving the
vehicle and the owner is unsure who was driving at the time. Mr. Stokes explained that
is not a defense. If the owner cannot identify the driver by name, the owner is
responsible for the vehicle. Mr. Stokes explained the notice is sent to the first name on

the registration and he will decide if the car went through the red light. If so, the car is
guilty and the owner is responsible.
Under the Statute, the original notice of violation had a fine of $158. When requesting a
hearing, the administrative fee raises the total fine to $208. If the owner has a hearing,
a hearing fee is added. The fee can be up to $250, but the City of Boynton Beach opted
to charge $35 per citation. Mr. Stokes cannot do anything about the $158 or the $208,
but the information could save the violators money if they were going to assert the
named defenses Mr. Stokes had previously mentioned.

Anthony Verrigini, Traffic Infraction Enforcement Officer, commented on May 31,
2016, at 4:50 a.m., a vehicle registered to the violator was travelling eastbound on
Woolbright Road at Congress Avenue in the number four straight lane. After a review of
the electronic evidence, Officer Verrigini issued a notice of violation on June 9, 2016. A
CD containing all videos and still images for this case and all the cases was submitted
to Mr. Stokes as evidence. Mr. Stokes accepted the evidence for all the cases being
heard today and for this case into the record. Mr. Stokes and Ms. Renick viewed the
video and still photographs.
Denise Renick explained she goes to work every morning at the same time and this
morning was behind a truck and her view was obstructed. The ground was wet from
rain. She saw the green light reflected on the ground and there was a car on the left
that passed. The street turns into three lanes, just past the light and the truck was
moving to the right. She saw the light was red when she passed.
Decision
Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $243
payable within 30 days.
Tcheltchy Deriphonse Notice No. 1851600145424
Officer Verrigini commented on May 21, 2016, at 8:39 a.m., a vehicle registered to the
violator was travelling eastbound on Woolbright Road at S. Congress Avenue in the
number one left -turn lane. After a review of the electronic evidence, Officer Verrigini
issued a notice of violation on June 8, 2016. Officer Verrigni submitted an evidence
pack to the court. Messrs. Stokes and Deriphonse viewed the video and still images.
The vehicle made a U-turn.
Mr Deriphonse explained he was not the driver and he sent the ticket to someone else.
He did not send in the transfer of Liability Affidavit and was unfamiliar with the process.
Decision
Mr. Stokes upheld the violation and suggested he get the money from his friend. He
explained he had 30 days to pay or a hold would be put on the vehicle registration.
Kirk Deago Murray Notice No. 1851600049873
Officer Verrigini commented on February 10, 2016, at 3:32 p.m., a vehicle registered to
the violator was travelling northbound on S. Federal Highway at SE 23d Avenue in the
number two lane. After a review of the electronic evidence and photographs, Officer
Verrigini issued a notice of violation on March 1, 2016. He submitted an evidence pack
to Mr. Stokes. Messrs Stokes and Murray viewed the video and still images.

Mr. Murray did not dispute his vehicle went through the light. His wife was driving the
vehicle and she told him both cars braked because there was an ambulance
approaching and she did not want the emergency vehicle to wait.
Mr. Stokes noted the video showed she was 300 to 400 feet past the intersection and
she still made no attempt to move to the right. If an ambulance was approaching she
would have moved.
Ms. Murray was present and she remembered as she had family in town and they were
trying to shop for a wedding ring at a WalMart. She was unfamiliar with the area. Mr.
Stokes commented when she cleared the intersection on the other side of the light, she
did not move over to the right and no ambulance appeared in the video. None of the
other vehicles moved over either.
Decision
Mr. Stokes upheld the violation and assessed a fine of $243.
John Jennings
Notice No. 1851600033000
Officer Verrigini reviewed on January 23, 2016, at 6:04 p.m., a vehicle registered to
Gerard James Polite was travelling northbound on N. Congress Avenue at W. Gateway
Boulevard in the number three straight lane. After a review of the electronic evidence,
Officer Verrigini issued a notice of violation on February 11, 2016. On May 6, 2016,
Gerard J. Polite sent in an affidavit naming John Jennings as the driver. Officer
Verrigini processed the affidavit and reissued the notice of violation. Officer Verrigini
submitted the ATS evidence pack to Mr. Stokes. The affidavit was for John Jennings as
the driver.
Messrs. Stokes and Jennings viewed the video and still images. Mr. Jennings
commented it was not clear to him. At the time he approached the intersection, the light
was amber and if he had to apply the brakes, he would have gone through the
intersection, so he had to speed up to catch the amber light. The light was not red
when he proceeded through the intersection. He commented there was no way for him
to stop. Mr. Stokes explained he had five seconds to stop. Mr. Jennings explained he
was three to four feet away from the intersection when the light was amber. He made
sure there was no one else coming from either direction. Mr. Stokes reiterated the
yellow light was for a full five seconds and he had an opportunity to stop. Mr. Jennings
disagreed.
Mr. Jennings commented he will appeal because he is a State official for North Carolina
and New York and a State officer in Florida.

Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $243 to
either pay or appeal within 30 days.
Patricia A. Perron Notice No. 1851600029982
Anthony Petriello, Traffic infraction Enforcement Officer, commented on January 20,
2016, at 3:32 p.m., a vehicle registered to the violator was travelling eastbound on W.
Woolbright Road at S. Congress Avenue in the number three lane. After a review of the
electronic evidence and photographs, Officer Petriello issued a notice of violation on
February 8, 2016. He submitted the evidence pack to Mr. Stokes and had a video and
still images to play.
Mr. Stokes and Ms. Perron viewed the evidence. Ms. Perron did not deny the violation
and advised she was not driving. She was appealing based on a medical/financial
hardship. It is difficult for her to get back on her feet and the citation set her back quite a
bit. She was back to work but requested some type of a break. Mr. Stokes appreciated
her situation, but his hands were tied. He had indicated earlier he has no latitude in the
matter.
Decision
Mr. Stokes upheld the violation and assessed a fine, but waived the hearing fee. The
amount of the fine was $208. She asked if she should appeal. Mr. Stokes advised
when appealing the case, the court will look to see if there is evidence to support his
decision and there is a court filing fee. Ms. Perron explained she was not indicating Mr.
Stokes was wrong. She asked for more than 30 days. Mr. Stokes explained he can
only give 30 days, per Statute. He explained if not paid within the 30 days, the violation
will attach to the vehicle registration, but there is no late fee or interest involved.

Spencer Dylan Ledgard Notice No. 1851600106020
Officer Petriello mentioned on April 3, 2016, at 3:20 p.m., a vehicle registered to the
violator was travelling southbound on S. Federal Highway at SE 23rd Avenue in the
number two lane. After a review of the electronic evidence, Officer Petriello issued a
notice of violation on April 25, 2016. He submitted the ATS evidence pack to Mr.
Stokes.
Messrs. Stokes and Ledgard viewed the video and still images. Officer Petriello
explained speed is not a factor in issuing a citation; however, Mr. Ledgard was going 71

mph in a 35 mph zone. Mr. Ledgard commented Mr. Stokes could not see what was
occurring during, before or after the occurrence. He thought there was probably a
reason why he ran the light. He asked if there is an allotted time for intersections and
thought he was cutting it so close and the equipment has the infractions down to a tenth
of a second. He thought it was safer to go through the intersection than trying to stop.
He did not know if he was driving at the time. Mr. Stokes commented the yellow light
was four seconds and he was two tenths of a second over the red. Mr. Stokes advised
he has to consider how long the light was yellow. Mr. Ledgard commented if there was
an officer present, he doubted he would have received a ticket and he thought it was
ridiculous the way the City was abusing taxpayers. He thought it ridiculous to allow
private companies to come in and do their jobs for them. He is disenfranchised and he
asserted Mr. Stokes was part of the problem because he did not care about the people.
He commented the problem is not being addressed.
Decision
Mr. Stokes upheld the violation and assessed a fine of $243.
Spencer Dylan Ledgard
Notice No. 851600114735
Officer Petriello conveyed on April 12, 2016, at 8:15 p.m., a vehicle registered to the
violator was travelling southbound on S. Federal Highway at SE 23 d Avenue in the
number two lane. After a review of the electronic evidence, Officer Petriello issued a
notice of violation on May 4, 2016. He submitted the ATS evidence pack to Mr. Stokes
and had a video and still images to play.
Messrs. Stokes and Ledgard viewed the evidence.
Mr. Ledgard advised he was using the same defense. He was trying to drive safely and
did not want to stop suddenly. He did not think he did anything wrong.
Decision
Mr. Stokes upheld the violation and assessed a fine of $243 payable in 30 days.
Carmela Nanton

Officer Petriello advised on December 18, 2015, at 3:32 p.m., a vehicle registered to the
violator was travelling northbound on N. Congress Avenue at W. Gateway Boulevard in
the number two lane. After a review of the electronic evidence and photographs, Officer
Petriello issued a notice of violation on January 4, 2016, to Alton Nanton.
Officer Petriello explained on March 7, 2016, Alton Nanton submitted an affidavit
naming Carmela Nanton as the driver. Officer Petriello processed the affidavit and
reissued the notice of violation to Carmela Nanton on March 10, 2016. He submitted

the ATS evidence pack with the affidavit attached and had a video and still images to
play. Mr. Stokes and Ms. Nanton viewed the video and still images
Ms. Nanton asked if the program would cease in January. Mr. Stokes advised the City
Commission made a decision to take the program offline at midnight on December 31,
2016. She asked why. Mr. Stokes explained it was a legislative decision and he did not
know what the Commissioners were thinking. Ms. Nanton thought from her perspective
it could not have been a long time when the light had changed and it is very difficult to
stop especially when it comes to the turning lane. If the driver is stuck in the
intersection, cars are turning and it can be dangerous. She did not recall the situation
and was surprised to receive the notice. She could contest it, but she thought it was
unfair as she sat at the intersection and watched what happens. She has seen the light
flash and the picture taken before individuals made the infractions. She wanted to know
how many seconds it was. Mr. Stokes explained the light was yellow for five seconds
and the red light time was two-tenths of a second. She asked if there was any mercy.
Mr. Stokes explained he considers the yellow light being yellow for a full five seconds
before. It is the signal to start slowing down and plan to stop. Ms. Nanton explained if
she is driving the speed to make the light and she is not over the speed limit and the
light changes, she can stop in the intersection, she would obstruct the intersection. She
would not be able to reverse in the intersection. Because of the closeness of it, she
asked for mercy as it was two-tenths of a second.
Mr. Stokes reviewed the video a second time and commented there was plenty of
opportunity to stop.
Decision
Based on the evidence, Mr. Stokes upheld the violation.
Ms. Nanton commented for the record it was an unfair calculation and she asked for the
for names of the individuals who are cited and penalized having their registration held
up in a program that is being discontinued because it is unfair to the public and a use of
private enterprise to make money and tax communities. She asked if they would be
able to receive their money back since they are getting rid of the program. She asked
why they do not suspend the violation. Mr. Stokes explained the City Commission had
the authority to terminate the program immediately. They opted not to renew the
contract with the vendor. Mr. Stokes was aware the red light cameras are not well liked
all over the State. Ms. Nanton contended they are not well used. Mr. Stokes advised It
is a lawful program and until then, citations will be issued. Ms. Nanton thought there
would be a class action lawsuit and thought it was unfair that for .2 seconds, Mr. Stokes
was fining her over $200. She asked for mercy.
Mr. Stokes reiterated the violation is upheld and the fine is $243 payable in 30 days.

Officer Verrigini conveyed on May 7, 2016, at 8:22 p.m., a vehicle registered to the
violator was travelling westbound on Gateway Boulevard at N. Congress Avenue in the
number two left -turn lane. After a review of the electronic evidence, Officer Verrigini
issued a notice of violation on June 11, 2016. He submitted the ATS evidence pack to
Mr. Stokes. Mr. Stokes and Ms. Destin viewed the evidence.
Ms. Destin did not understand the video. She had no comment and did not remember
the incident.
Decision
Mr. Stokes upheld the violation and waived the hearing fee.
Elaine Portnoy
Notice No. 1851600150606
Officer Petriello summarized on May 28, 2016, at 11:47 a.m., a vehicle registered to the
violator was travelling eastbound on Boynton Beach Boulevard at N. Congress Avenue
in the number two lane. After a review of the electronic evidence, Officer Petriello
issued a notice of violation on June 9, 2016. He submitted the ATS evidence pack to
Mr. Stokes. Mr. Stokes and Ms. Portnoy viewed the evidence.
Ms. Portnoy did not know which vehicle was hers. After Officer Petriello pointed it out,
she commented the light was green and it turned to red as she was making the turn.
Ms. Portnoy did not know she ran a red light and could not believe she did. She does
not know her way around and was coming back from the doctor. She thought the notice
said failed to comply with a steady red signal and thought she was fined because she
went over the line. Ms. Portnoy thought the lights were a disservice and asserted they
were wrong and inaccurate. She thought one could not tell what occurred from the
pictures. She did not know she ran the light and commented the picture was different
than the video.
Decision
Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $243
payable in 30 days. She asked to pay $158. Mr. Stokes explained that she had an
administrative fee and a hearing fee.
Candace Dorothy Culzac
Notice No. 1851600070366
Ms. Culzac explained she had not been able to view her video. It indicated her Notice
Number or pin number was invalid. Mr. Stokes recommended she view it with Sergeant
Hawkins. After the review, Officer Petriello conveyed on February 28, 2016, at 10:35
p.m., a vehicle registered to Sandra Maureen Tropman was travelling northbound on S.

Federal Highway at SE 23rd Avenue in the number two lane. After a review of the
electronic evidence, Officer Petriello issued a notice of violation on March 18, 2016. On
April 19, Sandra Tropman sent in an affidavit naming Candace Dorothy Culzac as the
driver; he reissued the notice to Ms. Culzac on April 22, 2016. He submitted the
evidence pack and presented a video and still images.
Ms. Culzac explained she is a co-owner of the vehicle and she sent in the affidavit. Ms.
Tropman is her aunt and Ms. Tropman was the only one that received notice of the
violation. Ms. Culzac had both sets of keys so she assumed the responsibility.
Mr. Stokes explained the notice went to Ms. Tropman. Ms. Culzac had the vehicle
registration with both of their names on it. Mr. Stokes explained the notice goes to the
first name listed on the registration. Ms. Culzac explained she went on the website and
it was invalid. The officer had to access the video for her through the police portal. She
saw the violation, but explained her grandmother had multiple myeloma and at the time
it was her duty to sleep at North Broward Hospital at night. It was a Sunday night at
10:25 p.m. in Boynton Beach and she has no ties to Palm Beach County. She lives at
home with her mother who has a medical condition. She could not tell who was driving
without a front image to see who would be in the vehicle to accuse anyone of this
violation. She is 98% sure it was not her. Sergeant Hawkins confirmed the video was
not on the normal website. She viewed the video through the Axsis system. She saw
the tire on the line at the red light and the plate, but no image of the driver. She noted
she was advised per Statute, there is no image of the person. She explained if taken
away, a property interest for the registered owner, she thought there would have to
have to be due process notice for this person and there was no person attached to the
violation.
Mr. Stokes agreed and explained pursuant to Statute if the driver cannot be identified,
the violation reverts to the vehicle. No points are assessed on her driving record. It is
similar to a Code violation for a house and they gave the house a citation. The
homeowner owns the home and the owner has to fix it. If there is a fine, the owner has
to pay it. If the vehicle creates a violation, the registered owner is responsible.
Mr. Stokes explained Ms. Culzac can go forward with the hearing or because she could
not see the video, she could change her plea to guilty and he could waive the hearing
and administrative fee. She did not like pleading guilty to an infraction against a vehicle
when she knows it was not her. Mr. Stokes understood, but explained the Statute
defines the process. Ms. Culzac asked if she pled guilty if she would lose her right to
appeal and learned that was correct. Ms. Culzac decided to move forward with the
hearing.
Officer Petriello played the video and still photographs which Mr. Stokes and Ms. Culzac
viewed. The still images Ms. Culzac saw showed the tire is on the line not behind. Mr.
Stokes agreed the still image showed the tire on the limit line but the bumper was over
the limit line. Based on the video, the vehicle was behind the limit line.

Ms. Culzac added using the still images, not the video that was inaccessible at the time,
the images show the vehicle is on the line. Mr. Stokes understood about the still
images on the line and she testified earlier she was unable to watch the video, so he
afforded her the opportunity to watch the video and also afforded her the opportunity to
pay the $158, which she could have paid had she had access to the video originally.
Decision
Based on the video, Mr. Stokes upheld the violation and assessed a fine of $243
payable in 30 days.
Ms. Culzac asked if the fine was based on the video and not the still images that were
sent and learned it was based on the video.

violator was travelling southbound on NW 8th Street at W. Boynton Beach Boulevard in
the number two lane. After a review of the electronic evidence, Officer Petriello issued
a notice of violation on July 20, 2016. He submitted the ATS evidence pack to Mr.
Stokes who viewed the video and still images.
Decision
Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $258.

issued a notice of violation on April 25, 2016. He submitted the ATS evidence pack to
Mr. Stokes who viewed the video and still images. The video showed the red light time
was 1.1 seconds.
Decision

Officer Petriello advised on April 14, 2016, at 7:40 p.m., a vehicle registered to the
violator was travelling southbound on S. Federal Highway at SE 23 d Avenue in the
number two lane. After a review of the electronic evidence, Officer Petriello issued a
notice of violation on May 5, 2016. He submitted the ATS evidence pack to Mr. Stokes
who viewed the video and still images.
Decision

Officer Verrigini commented on May 4, 2016, at 7:49 p.m., a vehicle registered to the
violator was travelling southbound on NE 8t" Street at Boynton Beach Boulevard in the
number one left -turn lane. After Officer Verrigni reviewed the electronic evidence, a
notice of violation was issued on May 26, 2016. There is a 1.4 second red light time.
