SUBJECT: 2015 Report of Minority and Physically Disabled Appointments
Section 760.80, Florida Statutes, requires statutorily created decision making and regulatory
boards, commissions, councils, and committees of the state to submit a report to the Secretary of
State annually by December 1. This report discloses the number of appointments made during
the preceding year from each minority group and the number of non - minority appointments made,
expressed both in numerical terms and as a percentage of the total membership of the board,
commission, council, or committee. In addition, information must be included in the report
detailing the number of physically disabled persons appointed to the boards, commissions,
councils, and committees in the previous calendar year. This form can be downloaded from the
Division's website at:

We are providing this notice to you in order that you can advise those respective authorities created
by general or special act of the legislature that fall within the oversight of your agency. A copy of

A. PROPOSED RESOLUTION NO. R15 -018 - Approve and authorize the
City Manager to execute an Agreement with Government Services Group,
Inc. to assist the City of Boynton Beach to continue the Fire Assessment
Program for the FY 2015 -2016 budget with the scope of professional
services and specialized assistance in the amount of $17,500.
B. PROPOSED RESOLUTION NO. R15 -019 - Approve acceptance of Lake
Ida Deed from Palm Beach County.

Commissioner Merker moved to accept the conveyance that he would not support.
Commissioner Fitzpatrick seconded the motion.
Commissioner Merker consistently held there are approximately 30 parks in existence
that are not being maintained properly. The budget created by Commissioner
Fitzpatrick had many revenue assumptions that were not reliable. Commissioner
Merker was not against parks; however, the financial issues were paramount and other
projects needed funding also. He would not support the purchase of another park. He
recalled the County had voted against the conveyance at one point.
Vice Mayor Casello inquired of Wally Majors, Recreation and Parks Director, where the
$100,000 would be deducted in the budget and Mr. Majors responded the park impact

James DeVoursney, 2625 Lake Drive North, introduced himself as a candidate for the
Community Redevelopment Agency (CRA) Board. He had a background as a
physician, business owner and lived in the CRA corridor. He was very interested in
participating and volunteering to serve.
Ray Whitely, 5503 Wishing Star Lane, Greenacres, works with the Boynton Beach
Coalition of Clergy. He thanked the Commission, especially Commissioner McCray for
all he does for District II. Commissioner McCray indicated he was humbled by the
praise.
No one else coming forward, Mayor Taylor closed Public Audience.
5. ADMINISTRATIVE

Vice Mayor Casello moved to reject funding for establishing community investment
funds. Commissioner Merker seconded the motion.
Commissioner Fitzpatrick recalled 18 years ago he had lobbied the County
Commissioners for their funds that were $150,000 per County Commissioner. It was
then instituted in Boynton. It was the source of funding for the clock in front of the
Children's Museum. There are very few things a Commissioner can personally take
credit for doing. A fund of $2,000 per Commissioner is not a major issue. It is a hassle
to get any funding through the Commission.
Mayor Taylor agreed donations and expenses come up long after the budget has been
passed. Vice Mayor Casello agreed the intentions were commendable, but it was a
slippery slope. Mayor Taylor explained any donation had to come before the entire
Commission for approval. Commissioner Merker reiterated the act of doing it
individually was wrong. It should be done as a group with the required three votes.

The motion failed 2 -3 (Mayor Taylor, Commissioners McCray and Fitzpatrick
dissenting).

Commissioner Fitzpatrick moved to make a policy and send it to the Inspector General.
Commissioner McCray seconded the motion.
Vice Mayor Casello inquired if the $10,000 would remain in the budget and not spent
until an official opinion is issued.

The motion passed 4 -1 (Commissioner Merker dissenting).
C. Review applications and appoint citizen member to the CRA Board for a
four -year term expiring in March, 2019.
Mayor Taylor explained there were two methods to proceed. One method would allow
each Commissioner to rank each applicant and then tally the votes. The other method
would be to open the floor for nominations that would be voted on individually.

the gavel and seconded the motion.
Commissioner Merker asserted the candidates were not being given the opportunity to
present their credentials. The advantage was to the incumbent. The procedure should
have each candidate address the Commission. He suggested the matter be postponed
so each candidate could appear and speak.

The motion passed 3 -2 (Vice Mayor Case /lo and Commissioner Merker dissenting).
Nomination
Commissioner McCray nominated Woodrow Hay to remain on the CRA Board.
Commissioner Merker nominated Linda Cross.
Vice Mayor Casello nominated James DeVoursney.
No further nomination being made, Mayor Taylor closed the nominations.
Commissioner Fitzpatrick remarked he had interviewed two of the candidates and knew
the others fairly extensively. There was an opportunity to prepare for the selection. He
was pleasantly surprised there were good, qualified people that want the position and
he hoped all the applicants would stay involved in public service in Boynton Beach.
Mayor Taylor agreed and felt all the resumes and candidates are more than qualified to
serve. There are nine boards with openings and no one has applied. He urged the
candidates to get involved in the community. Vice Mayor Casello concurred. He had
read the resumes and was particularly interested in the perceived three problems within
the CRA. It was proposed that there be future discussion on making the CRA Board
entirely civilian candidates. It would take the politics out of the CRA. Vice Mayor
Casello commended all the applicants who had applied.
Commissioner Merker argued there needs to be change. Although the current Board
has done a good job, there is a point where the members become saturated and new
ideas were not forthcoming.
Commissioner Fitzpatrick thought term limits for the CRA Board members of either eight
years or six years with two three -year terms or two four -year terms be considered so
there is some cycling.

December Haynes, a member of the Landscape Association, congratulated the City of
Boynton Beach and staff for selection of parks and plants. The City was doing a
fantastic job and obviously the City cares about water and best management principals.
Robert Pollock, 210 NE 27 Avenue, had gone through the Heart of Boynton and it
was coming along fine. He would continue to watch the area and attend any meetings
to ensure the area is not forgotten.

B. Accept the written report to the Commission for purchases over $10,000
for the month of March 2015.
C. Approve purchase of replacement pumps from Florida Bearings a division
of Kaman Industrial Technologies of Riviera Beach, FL to replace the pumps for Lift
Stations # 413, 403, 606 and 812 in the amount of $35,052.03 as a sole source
purchase.
D. Approve the acceptance of the reimbursement agreement between the
City and the Bureau of Medical Oversight (BEMO) and Florida Department of
Transportation (FDOT) in the amount of $33,800 for EMS Data Collection funding
assistance.
E. Approve a purchase order for the removal of approximately 7000 cubic
yards of lime sludge from the East Water Treatment Plant by WestWind Contracting for
the estimated cost of $68,500. This removal is immediate due to the start of
construction for the upgrading of the East Water Treatment Plant.
F. Approve the one -year extension for RFPs /Bids and/ or piggy -backs for
the procurement of services and /or commodities as described in the written report for
April 21, 2015 - "Request for Extensions and /or Piggybacks ".
G. Authorize rejecting the one bid submitted in response to the solicitation
for a "Two Year Bid for Diesel /Propane Generator and By -Pass Pump Maintenance and

execute a 3 -year lease with GPS Technologies, Inc. to provide GPS
devices on the Golf Carts at the Boynton Beach Links Municipal Golf
Course for a one -time set -up fee of $1,615 and a monthly cost of $680
($8,160 annually).
C. Accept the Fiscal Year 2014 -2015 Budget Status Report of the General
Fund and the Utilities Fund for the six (6) month period ending March 31,
2015.
D. Approve award of the bid for the "Replacement of the HVAC System for

Mary Lou Guzman, 19 Miller Drive, was concerned about the Publix renovations on
Congress Avenue. The handicapped parking was centered in front of the entrance of
Publix and they deleted handicap access spots at other store entrances on the strip
center. She inquired who could address this issue. Mayor Taylor requested she provide
her contact information and Development staff would contact her.
Ray Whitely, 5503 Wishing Star Lane, Greenacres, thanked the City Commission for
attending the Children's Oasis Banquet on May 30 He also thanked them for
connecting with their vision to enable today's youth to become tomorrow's leaders. He
advised three scholarships were awarded for $1,500, $1,000 and $500. Mr. Whitely
explained they have identified the East Boynton Wildcat organization to serve in the
next two years. There are nearly close to 400 people in the organization and their goal
was to provide about $25,000 in support over the next few years. He thanked all and the
Mayor for their support. Mayor Taylor thought the event was great and commended him
and the organization for their work with the youth.

Commissioner Fitzpatrick was the City representative for the Organization. They are
increasing the size from 19 members to 21 members and the State Statute allows 25
members. Both Boca Raton and the City of West Palm Beach have two voting
members. The two towns designated to fill the two seats are Greenacres and the
Village of Royal Palm. Boynton Beach is under - represented on the MPO based on
population. A no vote may send a message for the next time there are additional
members added, that Boynton Beach should get a second member.
Vice Mayor Casello inquired if there was a criteria based on population and the number
of members and Commissioner Fitzpatrick was not aware of any criteria. The MPO

Commissioner Fitzpatrick had pulled the item for discussion. He expressed concern the
City was offering a lower rate to the Village of Golf than the citizens of Boynton Beach
pay for fire service as measured by the property taxes and millage rates. He would not
support providing the services that were being paid for by the middle class and those on
fixed income within the City of Boynton Beach. He also questioned if a change to

Dr. Piotr Blass, 113 W. Tara Lakes Drive, felt Mayor Taylor was serving the City with
dignity and composure. He asserted there is consensus to establish the University of
Boynton. His vision was for a 24 -story building designed by top architects to give new
direction to the City. Boynton Beach needs direction. Dr. Blass was very much against
taxes. The City could decide that 65 year old residents, with 25 years in a house, would
pay no taxes.
James DeVoursney, 2625 Lake Drive North, felt having the Chair of the Planning and
Development Board publicly make horrible remarks embarrasses the City and the
citizens. It is a black eye on the City for developers to see.

interjected the City is unaware of the applicants. The Board acts as a body. It is
actually a ratification by the Commission for approval.

Financial Advisory Committee and believed a youthful viewpoint of the City was needed
going forward. He noted West Palm Beach and the County had decriminalized
possession of 20 grams or less of marijuana and asked if Boynton Beach could do the
same.
Mayor Taylor advised he had discussions with the Criminal Commission and the
Boynton Chief of Police relating to marijuana.

Reverend Bernard Wright, 713 NW 2 nd Street, commended the City and Jeff
Livergood, Director of Public Works and Engineering, on their responsiveness to
complaints about issues in the Heart of Boynton Beach. He did complain about no
sidewalks on 4 th Street going toward Galaxy Elementary and children have to walk on
the street.
Mayor Taylor advised in his neighborhood the streets are full of children walking to the
school bus because there are no sidewalks. The drivers have to be aware and be
careful. The entire City does not have sidewalks.
Commissioner McCray mentioned there was a plan for sidewalks on 4 th Street and Mr.
Livergood could provide an update. It has been reviewed.
Lawrence Gordon, Vice Mayor of the Town of Haverhill, introduced himself as a
candidate for County Commission District 7. He hoped to work with all the residents in
his area. People need to be involved in government.
Tom Duran, Troop 395, thanked the Commission for allowing his troop to attend the
meeting. The Scouts had to leave the meeting to get ready for school the next day.

Hurtuk invited everyone to visit and sample the homemade ice cream, funnel cakes,
waffles, ices, candy apples and cotton candy that are made on the premises.
Commissioner McCray did not attend the Grand Opening, but he did stop in and
sampled the ice cream. Mayor Taylor remarked new businesses are welcome in our
City and he wished Mr. Hurtuk much success. They even make ice cream pies in any
flavor. Vice Mayor Casello thanked Mr. Hurtuk for choosing Boynton Beach. His
business is a real asset to the City.
Robert Pollock, NW 27 Avenue, thanked the Boynton Beach Police Department for
responding to a report by a neighbor of a man on his front porch. The man was caught
and the matter resolved. It was a job well done.
Dr. Piotr Blass, 113 W. Tara Lakes Drive, wished everyone Happy Holidays. He was
thankful the Old High School remained. He was sad Ms. Prainito was retiring and felt
she was the best City Clerk in the United States. Dr. Blass reported he had been
teaching at the University of Warsaw and discussing the City of Boynton Beach as a
Sister City. He remained convinced the University of Boynton Beach was needed.
Herb Suss, 1711 Woodfern Drive, wished Ms. Prainito the best following a job well
done. He would miss Ms. LeJeune and her work with sustainability and climate change.
He talked about the unsung heroes including the sanitation workers, library workers,
police and fire, and parks workers. All employees of the City are truly unsung heroes in
his opinion. He wished everyone a Happy New Year and good tidings.

Vice Mayor Casello moved to appoint John Gurley as an alternate member.
Commissioner McCray seconded the motion.

The motion passed unanimously.
Commissioner McCray urged the citizens to apply to fill the many vacancies that are
remaining. Citizen input is needed and new members are welcome to give back to the
City and their community.
Mayor Taylor stressed there are appointments that will need to be made by
Commissioner Fitzpatrick at the next meeting.
Vice Mayor Casello thanked all those who did apply. The City needs citizen
participation. The Community Redevelopment Agency Advisory Board can be anything
it wants to be and at some point it could become a permanent, independent CRA board.
Commissioner Merker concurred with Vice Mayor Casello and moved to have an
independent board so the citizens are respected. Mayor Taylor advised the issue was
not on the agenda to come before the Commission at this meeting. Commissioner
Merker repeated his contention that the previous action of the Commission was
disrespectful to the citizens. Vice Mayor Casello countered that Commissioner Merker
had publicly called himself and Woodrow Hay a very unflattering name and was
requested to leave the premises. The current argument was disconcerting and Vice
Mayor Casello requested Commissioner Merker's remarks be toned down in the future.
B. Request to Sunset the Code Compliance Board
Motion
Commissioner McCray moved to sunset the Code Compliance Board. Vice Mayor
Casello seconded the motion.
Vote
The motion passed unanimously.
