17 WHEREAS, Arthur B. D'Almeida, Managing Member, as Applicant is requesting
13 the City abandon a portion of rights of way consisting of mostly unimproved streets and
19 alleys between NE/SE 3`d Street and the FEC Railroad from Boynton Beach Boulevard
20 south to SE 1st Avenue, subject to staff comments; and

22 WHEREAS, comments have been solicited from the appropriate City
23 Departments, and public hearings have been previously held before the City's Planning &
24 Development Board, and the City Commission on the proposed abandonments; and
25
26 WHEREAS, staff has determined that the subject portions of the rights-of-way
27 requested to be abandoned do not adversely impact traffic, or affect other adjacent
28 property owners and therefore no longer serve a public purpose, and the City Commission
2Q adopts that finding.

3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, SUPPORTING THE COMBINED EFFORTS OF THE
5 UNITED STATES CENTER FOR DISEASE CONTROL AND
6 PREVENTION ("CDC") AND THE DEPARTMENT OF JUSTICE
7 ("DOJ") TO CURTAIL THE OVERPRESCRIBING OF OPIOIDS
8 BY PHYSICIANS; AND PROVIDING FOR AN EFFECTIVE
9 DATE.

11 WHEREAS, the City Commission of the City of Boynton Beach, Florida, recognizes
12 that the heroin and prescription opioid epidemic is one of the most urgent law enforcement and
13 public health challenges facing our country; and
14 WHEREAS, opioids are a class of drugs that includes the illegal drug heroin as well as
15 power pain relievers available by prescription, such as oxycodone (oxycontin), hydrocodone
16 (vicodin), codeine, morphine, fentanyl,methadone, and many others; and
17 WHEREAS, the Department of Health and Human Services recently announced that
18 3.8 million people ages 12 and older are currently misusing prescription pain relievers in our
19 country; and
20 WHEREAS, in 2014, more than 60% of the 47,000 drug overdose deaths in America
21 involved opioids, reflecting a dramatic increase over the past two decades; and
22 WHEREAS, according to the Centers for Disease Control and Prevention ("CDC"),
23 opioids are commonly prescribed for pain. In fact, an estimated 20% of patients presenting to
24 physician offices with non-cancer pain symptoms or pain-related diagnoses receive an opioid
25 prescription. In 2012 alone, health care providers wrote 259 million prescriptions for opioid
26 pain medication, enough for every adult in the United States to have a bottle of pills; and
27 WHEREAS, opioid pain medication use presents serious risks, including overdose and
28 opioid use disorder. From 1999 to 2014, more than 165,000 persons died from overdose related
29 to opioid pain medication in the United States, and
30 WHEREAS, in the past decade while death rates for the top leading causes of death
31 such as heart disease and cancer have decreased substantially, the death rate associated with
32 opioid pain medication has increased markedly; and
33 WHEREAS, the sales of opioid pain medication have increased in parallel with opioid-
34 related overdose deaths; and
35 WHEREAS, the Drug Abuse Warning Network estimated that greater than 420,000
36 emergency department visits were related to the misuse or abuse of narcotic pain relievers in
37 2011, the most recent year for which data is available; and
38 WHEREAS, scientific research has identified high-risk prescribing practices that have
39 contributed to the overdose epidemic; and

40 WHEREAS, observational research showed significant increases in opioid prescriptions
41 for pediatric populations from 2001 to 2010 and a large proportion of adolescents are
42 commonly prescribed opioid pain medications for conditions such as headache and sports
43 injuries; and
44 WHEREAS, use of prescribed opioid pain medication before high school graduation is
45 associated with a 33% increase in the risk of later opioid misuse and misuse of opioid pain
46 medications in adolescence strongly predicts later onset of heroin use. Thus, risk of opioid
47 medication use in pediatric populations is of great concern; and
48 WHEREAS, on the average day: at least 78 people will die from an opioid-related
49 overdose, 3,900 people will use a prescription opioid outside of legitimate medical purposes and
50 supervision, and 580 people will try heroin for the first time.
51 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
52 THE CITY OF BOYNTON BEACH, FLORIDA,AS FOLLOWS:
53 Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being
54 true and correct and are made a specific part of this Resolution.

56 Section 2. That the Centers for Disease Control and Prevention created the CDC
57 Guideline for Prescribing Opioids for Chronic Pain- United States, 2016 on March 18, 2016 in
58 order to help curtail the overprescribing of opioids by physicians through more physician
59 education as well as better risk and assessment of patients.
60 Section 3. That the Department of Justice ("DOJ") through Former United States
61 Attorney General, Loretta E. Lynch, sent a letter to the governor of every state on September
62 20, 2016 requesting their help in addressing the prescription opioid and heroin epidemic by
63 requesting their assistance in strengthening prescription drug monitoring programs and ensuring
64 safe drug disposal.
65 Section 4. That the City of Boynton has seen a dramatic increase in overdose due to
66 heroin and opioids in the past year (more than 100% increase.in 2016 over 2015 according to
67 Police Department statistics).
68 Section 5. That the City Commission of the City of Boynton Beach supports the
69 combined efforts of the CDC and DOJ in reducing the number of opioid prescriptions and
70 ensuring safe disposal.

72 Section 6. That the City of Boynton Beach hereby directs City officials and City staff
73 to take any and all actions necessary to effectuate the intent of this resolution and hereby directs
74 the City Clerk to send a copy of this Resolution to: the Palm Beach County League of Cities,
75 the Florida League of Cities, Governor Rick Scott, Senator Jeff Clemens, Representative Lori
76 Berman, Senator Bill Nelson, Senator Marco Rubio, and Congresswoman Lois Frankel.

78 Section 7. If any clause, section, other part or application of this Resolution is held by
79 any court of competent jurisdiction to be unconstitutional or invalid, in part or application,it
80 shall not affect the validity of the remaining portions or applications of this Resolution.

83 adoption.
