1. Call to Order
James Stokes, Special Magistrate, called the hearings to order at 9:10 a.m. He
introduced himself and explained he is a neutral third party that hears these cases
throughout the State. He has no prior information about the cases and the City would
present its case first. The monitors are connected and all will see visuals at the same
time. Officers will give him the information that was already sent to the violator, which
he will review. The $158 is the initial fine with the first notice; it is set by State Statute.
When requesting a hearing, there is up to a $250 administrative fee to cover the cost of
the hearing. The City Commission made a recommendation of $35 which Mr. Stokes
follows.
If there is a finding a violation occurred, no points are assessed on the driving record. It
is an administrative charge against the vehicle. The first name on the vehicle
registration receives the notice. If the owner was not driving, an affidavit naming the
driver can be submitted and a new notice of violation would be sent to that person.
Often teenagers may be driving, or a company vehicle is involved. If the owner does not
identify the driver, Mr. Stokes determines if the car created the violation and the owner
is responsible. Licenses will never be suspended if the fine is not paid, but the
registration will be put on hold and the Department of Motor Vehicles (DMV) will advise
the owner to clear up the issue.
Mr. Stokes explained if anyone wanted to change their plea, they could do so and
violators will have 30 days to pay. He is not a judge and he cannot rule on the
constitutionality of the Red Light Camera program as it has already been addressed by
several courts of appeal; however, people have the right to challenge it. If so, Mr.
Stokes advised he would allow the violator to make their case and go to court. The
court will ask if they attended the local hearing first. There is also a filing fee to appeal.

Anthony Verrigini, Traffic Infraction Enforcement Officer, commented on April 22,
2016, at 3:36 p.m., a vehicle registered to the violator was travelling northbound on
South Federal Highway at SE 23rd Avenue. After a review of the electronic evidence
and photographs, Officer Verrigini issued a notice of violation on May 12, 2016. He had
an evidence pack with a CD and still images for this case and all the cases being heard
today which Mr. Stokes admitted the evidence. Messrs. Stokes and Sanfilippo viewed
the video and still images.
Mr. Sanfilppo explained it was not him driving. He uses car services and it is impossible
for him to identify who was driving based on hair as he does not have hair. He has
never been issued a parking ticket and he finds the violation egregious. If it were him,
he would pay the fine. Mr. Stokes explained the Statute says if the owner cannot identify
the driver, the violation goes to the owner of the vehicle.
Decision
Based on the video, Mr. Stokes upheld the violation.
Mr. Sanfilippo commented he will appeal and he is under no obligation to find out who
the driver was. He then advised he would pay the fine in pennies.
Anthony Vacca Notice No. 1851600149764

9:50 a.m., a vehicle registered to the violator was travelling westbound on W. Gateway

June 6, 2016. He submitted the evidence pack to Mr. Stokes and Messrs. Stokes and
Vacca viewed the video and still images.
Mr. Vacca explained one vehicle is a SUV and other vehicle is tan or gray. He had a
picture of the back of his vehicle being red and explained this is what his vehicle looked
like and it does not resemble the picture. Mr. Stokes reviewed the picture Mr. Vacca
submitted.
Decision
Mr. Stokes dismissed the citation.

Officer Verrigini explained on June 4, 2016, at 5:13 p.m., he observed a vehicle
registered to the violator travelling eastbound on W. Boynton Beach Boulevard at NW
2" Avenue. After a review of the electronic evidence and photographs, Officer Verrigini
issued a notice of violation on June 14, 2016. He submitted the evidence pack to Mr.
Stokes and had a video and still images to show. Messrs. Stokes and Morales viewed
the evidence. Mr. Morales had no comment.
Decision
Mr. Stokes upheld the violation and assessed a fine payable within 30 days.
Tammie Jo Harris

Officer Verrigini conveyed on April 26, 2016, at 6:15 p.m., a vehicle registered to the
violator was travelling southbound on NW 8th Street at W. Boynton Beach Boulevard.
After a review of the electronic evidence and photographs, Officer Verrigini issued a
notice of violation on May 24, 2016. He submitted the evidence pack to Mr. Stokes and
had a video and still images to play. Mr. Stokes and Ms. Harris viewed the evidence.
Ms. Harris advised her daughter was driving.
Decision
Mr. Stokes upheld the violation and assessed a fine and gave 30 days to pay.
Brian R. Cook

Officer Shepaum, Boynton Beach Police Officer, mentioned on June 3, 2016, at 6:29
p.m., a vehicle registered to the violator was travelling southbound on NW 8th Street at
W. Boynton Beach Boulevard in the number two lane. After a review of the electronic
evidence and photographs, a notice of violation was issued on June 10, 2016. She

submitted an evidence pack to Mr. Stokes and Messrs. Cook and Stokes viewed the
video and still images.
Mr. Cook explained he had a problem with how the image was attained with the light
timing being altered from a four second yellow to a three second yellow. He lives there.
He was forced to go through the red light because the timing was altered and the video
evidence seems to have been slowed down to make the illusion the yellow light was
longer than it is. He understood a hold would be put on his registration. He had to learn
the difference between a citation and violation. He looked up Florida Statute 3.16. It was
written specifically for the program which shifts the burden from the State to prove he
was in the vehicle. He was given three choices on the notice of violation, which was to
either pay it, contest it or submit someone else was driving. He asked if, by signing and
sending in his request to appear, he waived his right to go before an actual court and
learned he did not. He advised he will still go before a county court judge.
Decision
Based on the video, Mr. Stokes upheld the violation and assessed a fine payable in 30
days. He noted, if appealing, he must appeal in 30 days.
Ashok Kumar Notice No. 1851600204650
Officer Petriello recalled on August 8, 2016, at 11:50 a.m., a vehicle registered to the
violator was travelling southbound on N. Congress Avenue at W. Gateway Boulevard in
the number three lane. After a review of the electronic evidence and photographs,
Officer Petriello issued a notice of violation on August 25, 2016. He submitted the ATS
evidence pack to Mr. Stokes and Messrs. Stokes and Kumar viewed the video and still
images.
Mr. Kumar advised he was not driving the car. He submitted the information because
individuals from out of the country were driving. He checked with them and was advised
they heard sirens. He provided an affidavit and explained the driver was back in Hong
Kong. Mr. Stokes explained based on the affidavit he could not fine him. The issue is
this will still go to default against Mr. Kumar's car registration or Mr. Stokes could make
a finding today, Mr. Kumar pay it and they can reimburse him.
Decision
Mr. Stokes found the vehicle went through the light and gave 30 days to pay.
There was discussion about sending the affidavit to the drivers in Hong Kong, which the
driver may not pay. Mr. Stokes explained the fine has to be paid at some time. They
could not send the notice to Hong Kong until they have an opportunity for a hearing.
Mr. Stokes explained the order gives 30 days to pay. This is an absentee driver and Mr.
Stokes explained he will deal with this the same way as people who schedule hearings

and do not show up. He ruled in their absence, they are guilty, but the fine will attach to
Mr. Kumar's vehicle. He asked if he could pay the original $158 and was advised he
could not. Mr. Stokes suggested Mr. Kumar should have paid the $158 and sent them
the bill. At this point, the vehicle owes the City $243.
Howard S. Cooper Notice No.1851600160663
Officer Petriello explained on November 18, 2015, at 1:57 p.m., a vehicle registered to
the violator was travelling eastbound on W. Boynton Beach Boulevard at N. Congress
Avenue in the number two lane. After a review of the electronic evidence and
photographs, Officer Petriello issued a notice of violation on November 7, 2015. He had
a video and still images to play. Messrs. Stokes and Cooper viewed the evidence.
Mr. Cooper commented the video showed the main light as green. He was going to the
intersection and his peripheral vision saw a green light. He commented it was a
mitigating factor. He put in a Florida Public Record request a month ago asking for
documentation as to the integrity of the program, internal controls and calibration which
is the responsibility of the City who has a fiduciary responsibility to its citizens. He had
documentation of the request and felt the documents do not exist and they are germane
to his case. If considering an adverse opinion, he requested Mr. Stokes stay his case
until he receives his documents. It is necessary for his defense in the matter.
Sergeant Hawkins, Boynton Beach Police Department, explained the Public Record
request was being processed.
Decision
Mr. Stokes tabled the case until the January 12th meeting. A new hearing notice will be
sent.
Gloria Rosengarten
Marvin Rosengarten appearing

11:56 a.m., a vehicle registered to the violator was travelling westbound on W.
Woolbright Road at S. Congress Avenue. After he reviewed the electronic evidence,
Officer Verrigini issued a notice of violation on June 9, 2016. He submitted the
evidence pack to Mr. Stokes and Messrs Stokes and Rosengarten viewed the video and
still images.
Mr. Rosengarten had just left the doctor's office regarding a health issue and advised he
was not concentrating.

Michael Allan Bluestein
Notice No. 1851600048750
Officer Petriello indicated on February 9, 2016, at 4:30 p.m., a vehicle registered to the
violator was travelling southbound on South Federal Highway at SE 23rd Avenue in the
number two lane. After a review of the electronic evidence and photographs, Officer
Petriello issued a notice of violation February 29, 2016. He submitted the evidence
pack to Mr. Stokes and Messrs. Stokes and Bluestein viewed the video and still images.
Mr. Bluestein asked if there was someone from the County available to testify there was
a three or four second yellow light. Mr. Bluestein explained no one was available to
testify the lights are working correctly and Mr. Stokes must dismiss the case. He asked
if someone from the camera company was available to testify the lights were working.
He has a perfect driving record and has travelled through that intersection many times
and felt the light was shorter than in the video which could make a difference between
running a yellow or red light.
Mr. Stokes explained there is a camera log and ATS testified on October 8, 2015, about
the camera which he could get a transcript of and which Mr. Stokes takes notice of.
The camera log shows there was a calibration test done on the 9th at 2 a.m. about 14
hours before the violation. It does not mean they were fully calibrated at the time, but
14 hours prior they were. Mr. Stokes commented he looks at the video and can see the
yellow light went on and off, the red light came on and the vehicle went through. He did
not need a traffic engineer to tell him the difference between yellow and red. He was
not sure how long the yellow lights were, but the data indicates four seconds and a
yellow light is the time to slow down, not keep going.
Decision
Based on all this and the video evidence that is clear the light was red, Mr. Stokes
upheld the violation, assessed a fine and gave 30 days to pay or appeal.
Kyle Hilliary Sandberg Notice No.1851600129535
Officer Verrigini related on April 30, 2016, at 2:34 p.m., a vehicle registered to the
violator was travelling northbound on S. Congress Avenue at W. Woolbright Road.
After a review of the electronic evidence and photographs, Officer Verrigini issued a
notice of violation on May 25, 2016. He submitted the ATS evidence pack to the court.
Messrs. Stokes and Sandberg viewed the video and still images.
Mr. Sandberg asked when issuing the citations if Officer Verrigni looks at the videos or
pictures and learned the Officers look at everything. Mr. Sandberg explained he can
barely see this screen. Mr. Stokes understood and there are a few intersections that

have glare. What helps is all traffic signals have red on top and green on the bottom.
When he reviews he ensures there is consistency with the video and the stills.
Decision
Based on the evidence, Mr. Stokes upheld the violation, assessed a fine and gave 30

Harlan Jay Friedman
Notice No. 1851600094804
Officer Petriello commented on March 22, 2016, at 10:52 a.m., a vehicle registered to
the violator was travelling southbound on NW 8th Street at W. Boynton Beach Boulevard
in the number two lane. After a review of the electronic evidence and photographs,
Officer Petriello issued a notice of violation on April 15, 2016. He submitted the
evidence pack to Mr. Stokes and Messrs. Stokes and Friedman viewed the video and
still images.
Mr. Friedman commented there was a Florida Uniform Traffic Citation (UTC) issued for
this already. Officer Petriello explained the citation was dismissed because there was a
local hearing request made at the same time they issued the UTC.
Mr. Friedman commented the vehicle was being repaired; he could find out who was
test driving it. He saw, according to the picture, the light was red for 3/10ths of a
second. He commented there is human reaction time and the program is to enhance
safety at intersections, the last thing one wants to do is jam on the brakes. If looking at
the video, the vehicle is well out of the intersection or traffic the other way. He did not
know if the equipment was accurate up to 1, 2 or 3/10ths of a second, assuming they
are calibrated. He thought it was pushing the boundaries of how humans are supposed
to respond.
Mr. Stokes uses his vision where the car was. He agreed when trimming things down to
10ths of a second, it should be reviewed by a human being. Mr. Stokes explained part
of his analysis is the length of the yellow light. He had four seconds of a yellow light and
3/10ths of a second which is when motorists are supposed to stop. Mr. Friedman
explained the road is curved before the lights and the trees obscure the lights until you
get close. He could not see the sign indicating it was photo enforced and drivers could
not see the light four seconds before the intersection.
Decision
Mr. Stokes explained the vehicle did go into the intersection after the light was red. Mr.
Stokes explained even at 1/10th of a second, he would not dismiss after a full four
second yellow light as the yellow light is a warning drivers should prepare to stop.
Mr. Friedman contended drivers cannot see the light that quickly and often there is
traffic stacking. Mr. Stokes explained those are traffic engineering issues, but in a

hearing, he takes the prima fascia (checking legal spelling) evidence the traffic
engineering is appropriate unless he hears otherwise. His job is to determine if the
vehicle entered the intersection after the light turned red and he determined it did.
Steven Franklin Ritter
Notice No. 1851600132737
Officer Verrigini commented on May 5, 2016, 3:39 p.m., a vehicle registered to the
violator was travelling southbound on South Federal Highway at SE 23rd Avenue in the
number two straight lane. After he reviewed the electronic evidence, Officer Verrigini
issued a notice of violation on May 26, 2016. He submitted the evidence pack to Mr.
Stokes and Messrs. Stokes and Ritter viewed the video and still images.
Mr. Ritter advised he had an affidavit of a lost stolen tag. He noticed the tag was lost or
stolen on May 1. He made four to five attempts to come to the Police Department. He
was told they have to go to the vehicle which was inoperable in his driveway. It was
some length of time before someone came. Mr. Ritter advised the plate was stolen by
someone who was driving an identical car. Mr. Stokes asked if there was another page
to the report. Mr. Ritter did not think so and if so, advised it would not have been
pertinent.
Mr. Stokes asked what the City's position was. Officer Petriello reviewed the matter and
advised the date was different and the tag was reported stolen a month later. He
thought it was suspicious as the tag belonged to a two -door silver Cadillac Eldorado and
the images were of a two -door Cadillac Eldorado. Also on November 6, 2016, the
Cadillac Eldorado was found abandoned with the plate attached to it, which was
contained in paperwork in the back of the packet.
Mr. Stokes asked if he sold the vehicle and whoever stole the plate put it on the right
vehicle. Mr. Ritter did not know. He sold the vehicle in June or July, but did not have a
record of the sale. Mr. Stokes commented his initial inclination was to accept it as filing
a false police report to avoid a Red Light Camera ticket which was much more serious.
He took issue with the thought someone stole the plate and put it on an identical car
that ran a red light and then he sold the car and the plate ended back on the car before
it was discovered abandoned. Mr. Stokes asked if he got a new plate on his new
vehicle. Mr. Ritter explained the car was already sold.
Decision
Mr. Stokes upheld the violation and assessed a fine of $243 payable in 30 days.
James Arnette Bouie

Amanda Shepaum, Boynton Beach Police Officer, explained on May 12, 2016, at 3:51
p.m., a vehicle registered to the violator was travelling eastbound on E. Boynton Beach

She submitted the evidence pack to Mr. Stokes and Messrs. Stokes and Bouie viewed
the video and still images.
Mr. Bouie was confused about the picture and was looking at the car on the other side
of the roadway. When he got the letter it did not show him the picture.
Decision
Mr. Stokes upheld the violation and gave 30 days to pay.
Samuel Astuto

Officer Verrigini explained on April 27, 2016, at 12:20 p.m., a vehicle registered to the
violator was travelling southbound on NW 8t" Street at W. Boynton Beach Boulevard.
After a review of the electronic evidence and photographs, a notice of violation was
issued on May 24, 2016. He had the evidence pack he submitted to Mr. Stokes and
Messrs. Stokes and Astuto viewed the video and still images.
Mr. Astuto explained there was an EMT behind him and another vehicle. He saw an
EMT approaching him from behind and it is still Florida law to yield to emergency
vehicles. Officer Verrigni explained the videos only run 12 to 13 seconds and there is
no audio. Mr. Astuto reiterated there was an EMT and he was under oath the siren was
sounding. He understood if guilty he would have to pay, but he was abiding by the law.
Mr. Stokes explained if so he should yield and move to the right; however, Mr. Astuto
contended there was no way to get out of the way except to keep going straight. Mr.
Astuto commented there is a long curve on Boynton Beach Boulevard and there were
vehicles that could not be seen. The video evidence does not show all that needs to be
seen.
Mr. Stokes asked if Mr. Astuto got a copy of the call log and learned he did not. Mr.
Stokes commented the red light violation was clearly evident. Mr. Astuto asked if the
system was monitored and if someone was watching frame -by -frame if a violation
occurred and learned there was.
Decision
Based on the testimony and evidence, Mr. Stokes upheld the violation and assessed a
fine payable in 30 days.
