The meeting was called to order by Mayor Madsen at 7:35 P.M. Invocation
was given by Father Varm, St. Mark's Catholic Church, and the Flag
Salute was led by Mr. Banks.
Mr. Madsen recognized former mayor James Mahoney in the audience.
MINUTES
Mr. Banks moved that the minutes of the regular meeting of April ~,
1966 be approved. M~. McCoy seconded and it was unanimously carried.
In theminutes of the special meetimg of April ll, 1966, Mr. Banks
made a correction on page 2, paragraph l, 6th lime, as follows:
changing "..that we also enter into.." to read "..that we cooperate
with..". Mr. Banks moved for approval of the minutes of the special
meeting of April 11, 1966 with the correction. ~r. Boos seconded.
Mr. Boos suggested that the following statement of Mr. David be added
to the special minutes of April 11, 1966:
'~r. David stated that thsre is no probability of the more than 500
connections im their property because it is completely developed, but
that there are other areas that might be developed."
The motion was unanimously carried.
~. M~sen stated that this is the first meeting this year that council
has not had a conference at 6:30 P.M. due to the brevity of the agenda.
OLD BUS IR~SS
Consolidation of assessim~ and collectir~ taxes with those of the County
Mr. Kaita stated that Council has indicated a desire for the consolidation
of assessing and collecting taxes with those of the County. ~ir. BLain
recommended that Council set forth by motion or resolution the policy
that will be followed when we have the opportunity to do so.

Mr. Boos moved that the recommendation of the city manager be followed
and that a prope~ resolution be prepared to be presented for formal
adoption. ¥~. McCoy seconded and it was u~n~nimously carried.
Report of ~rip to st. Au~ustiue to meet ~th F. E. C. officials
Mr. Kain made a report on the trip to St. Augustine to meet with FiE°C°
officials. Mr. Kain, ~. Boos, ¥~. Moore and Mr. ~dsen attended this
meeting to discuss the opening of S. E. 2nd Avenue crossing. ~. Kain
reported that the purpose of the meeting was~ manifold. The city wanted
to explore the possibility of obtaining at least two more crossings
over the railroad tracks, one at S. E. 2nd Avenue from ~th Street to
3rd Street S.E., and opening of c~ossiug on N. 17th Avenue to Federal
High~y. The railroad indicated some disapproval at 17th because of
having a crossing at 15th. There have been several suggestions as to
how to work this out. One is to ?~ork with the developers who are work-
lng land up there now and there is a chance that 17th could be worked
into ~th Street w~l~h runs into 15th. ~. Kain stated that he is
reluctant to close 15th Ave.
There-is a possibility of openin~ S. E. 2nd Avenue and the cost of pre-
paring the crossing must be born~ by the city. The railroad officials
reported that it would cost approxLmately $25,000 and the city would be
responsible for this ex?sndit~re over a period of three years. 2~Lr.
Kain reco~ended that cotuucdl put this in the new Dadget and provide
for these funds at least on the first installment.
Mr. Kain reported that they discussed the removal or relocation of the
team tracks and that he would like to explore with Delray Beach about
the establishment of a station somew~re between the two localities.
Mr. Madsen stated that the crossing at N. E. 17th Avenue was frowned on
by the officials because of it being so close to 15th Avenue. Mr.
M~dsen said he asked if the $25,000 payment could be extended to a
five year plan instead of three. This was not known at this time. Mr.
Carr~han stated that it would cost appro~tely $3,000 or $4,000 for
the approaches, but that this is an assessable item. Mr. Madsen stated
that ¥~. Corbett will be doe here shortly and tell us where we can move
the team tracks.
Mr. Boos noted that there was a discussion about the 30 acres which h~s
been presented to the railroad on the east side of their right-of-way
south of 23rd Street. He stated that when ~Lr. Corbett comeg ~e' that
he will address the Industrial Committee and possibly the Planning and
Zoning Board and see if the location will be acceptable to both Boynton
Beach and Delray Beach for a station.

Mr. Moore recommended that the agreement concerniug S. E. 2nd Ave. be
reviewed. He stated that there are some items that sho~!d be negotiated.
Mr. Madsen requested Mr. Kain to notify all the people along S. E. 2nd
Ave. to come to the counCil meeting and voice their opinion.
Mr. Kain will review the agreement with Mr. Moore and notices will be
mailed to the people along S. El 2nd Avenue that this item is coming up
for discussion before council.
Letter concerni~ Pence P~rk_
Mr. KaLu read a letter from Mr. H~npel~ann dated April 16, 1966 con-
cerning a restroomat Pence Park on S. E. J+th St. & 5th Ave. Mr. Kain
stated that it appea~s that the pl~abLug must be redone and also
connected to sewers. He stated tB~t the city is workJ~ug on gett~ag
approximate costs to do this work. Mr. Madsen asked Mr. Kain to answer
this letter and take care of this matter.
Mr. Madsen recognized past mayor~ A1 Summers.
?UBLIC AUDIENC~
Mrs. Emily Jackson came forward and stated that she thought there were
more important things to be done, such as roads to be fixed, instead
of obtaining additional railroad crossings at this time% She also
announced that I~. Bert Johnson v~ll speak here Thursday, April 21, 1966.
Mr. Layton Ti~m came forward and stated that he felt he had been
harassed by ~. Collius while ~rking in Bo~uaton Beach putting up a
sign at Publix P~rket. Mr. Ti~n stated that he felt he ~s entitled
to a public apology from Mr. Collf_us and other persons involved in this.
Mr. Kain stated that he did not lauow just how far administrative people
should go in attempting to determine whether or not a private business
is licensed and whether or not the people working for them are actually
working for them. He stated the inspection department inspected as
much as they could and that ~s, Padgett and ~. Fretz did as much as
they could as to proper license and statements of ~. TLmmbeing correct,
and that when persons come to the City Hall we take it that their
statements are true until disproven. M~. Kain stated that there is no
reason to disbelieve anything ~ir. Timm has told us. ~. TL~m stated he
had no complaints about anyone in City Hall, only Mr. Collins.
Mr. Madsen stated that he thought Mr. Collins was trying to do a good
job but may have gone a little overboard. Mr. Banks stated that this
should have been handled through Mr. Kain, who ~rlll be responsible for
any complaints on licenses. ~r. Ranks told ~. Timm he was sorry for

the embarrassment that had been caused him and that he felt the most
of the trouble has been corrected.
Mr. Kain asked Mr. Timm to meet v~lth him and Nm. Collins.
~[r. ¥~adsen asked Kr. Summers to come forward and give his interpretation
of the trouble with the lights on the tennis courts. Mr o Nadsen stated
that he felt $900 was too much to spend on this item. Mr. S~w~ers
stated that he did not feel more lights v,~rs needed, that they just
needed to be readjusted at night for the best usage.

~&r. Banks gave the following report on the trip to ~ashfington, March
29, 30 and 31, 1966 and details of the Open-Space Land Program. Th~se

"The Open-Space Land Program as established by Congress requires that
any jurisdictions contemplating applications under this act must qualify
as having established a comprehensive planninE p. roEra~_m. The planning
program should be of a type to qualify as an urban area plan. In dis-
cussing this with H.U.D. officials in Washington, I believe that our
Planning and Zoning Board could be desigm~ted as the official body to
study, recommend and initiate application under the Open-Space Program.
I recommend to the Conncilthat the Planning and Zoning Board be desig-
nated as the official body to initiate an application under the Open-
Space Program in accordance with Federal requirements. The Planning
and Zoning Board should be asked to examine three sites for possible
acquisition and to recommend one of these sites to the Council for
acquisition."
Mr. Banks moved for the adoption of this report and that the Pl~nninc
and Zoning Board be designated as the official body to initiate an
application under the Open-Space Program in accordance with Federal

Mr. Boos seconded. The vote was 3 in favor and Mr. ~{cCoy voted against.
Mr. McCoy stated that his reason for voting against this motion was that
he didnot llke this free money from the Federal government. ~. Banks
stated that he has disuussed this at length with Mr. McCoy and that he
is entitled to his convictions ~ud that they understand each other on
this.

Mr. McCoy noted a letter concerning the 20th Ann~s1 Short Course for
City F~nagers to be held Lu Gainesville April 2~th to April 27th. Mr,
McCoy moved to authorize ¥&r. Kain to attend this meeting in Gaines-
v~l]e. ~ir. Banks seconded and it was unanimously carried.
Mr. Banks noted a letter from Ray Jara in connection with a report
from ~{r. Kain on the Parks and Recreation Board Meeting. Fir. Kain
stated that he would rather bring this up at a later meetiug. He
stated he would provide council with a complete f~_le on this and have
it ready for the May 2nd meeting.
LEGAL
Mrs. Padgett read a Proclamation na,~ng April 20, 1966 ~'Dr. Akes Day".
Mr. McCoy moved for the adoption of this Proclank~tion. Mr. Banks
seconded. Mr. Madsen stated that he was glad to see this event occur
to honor Dr. Akes for his service to the City of Boynton ~ach. Motion
was unanimously carried.
Mr. Moore rezd a Proclamation r..~ug May i as 'Taw Day, U.S.A." Mr.
Boos moved for adoption of this Proclamation. ¥~. Banks seconded ar~
it was unanimously carried.
.AD~{INtSTRAT IVE
A meeting was set for Saturday morning April 30, 1966 at 9:00 A.M. to
discuss the Capital Improvement Program.
Mr. Kain noted that the city is coming to a close of the sanitary sewer
work contract and he recommends that council have a meeting the first
part of next month with the consulting engineers to discuss the program
to follow. Mr. Kain will arrange this meeting.
Mr. Boos noted that the School Board has some possible thoughts of using
20 acres of land on Congress Avenue for a vocational school, high school
and TV program. He stated that it ~*as the feeling of council that it
might be proper for us to sewer that area and that the city engineer
could give us some idea of what it would cost to extend sewers to them.
For emergency Ee should consider holding hack some amount since it
could materialize that all three may be put out there.
Departmental Reports
Mr. Banks moved that the departmental reports be accepted. Mr. McCoy
seconded. ~Lr. Boos noted again how much oil vehicle #8 is using. He
asked if it would be proper for council to instruct the sd~nistrator
to work out a program of replacement and a program of service.
Kain stated that council has discussed this generally and that it

be brought out in the budget.
¥~. Boos stated that he w~uted to complement those persons who gave a
written report to council last week on thair completeness and frankness.
Motion ~s %manimously carried.
~. tfaiu reported that Mr. Churey has completed the 600 lineal feet of
sidewalk. It is installed and completely satisfactory and funds are
available ~u Activity 5800. Mr. Kain recommended payment of this bill
in the amount of $800.00.
Mr. Banks moved that this b~ll be paid. M~. McCoy seconded and it %fas
unanimously carried.
Mr. Boos noted that no meeting had been set withMr. Frost and members
of his staff on the spending of $25,000 for resurfacing segments of
Seacrest Blvd. Mr. Boos stated he felt that we should act and advise
them where to use these funds, t~Lr. Kain said he would contact
Frost by phone and try to set up s~me kind of meetS~g with council.
