Minutes 03-15-66C MINUTES OF SPECIAL MEETL~G OF CITY COUNCIL, BOYNTON BEACH, FLORIDA, HELD IN CITY HALL, MARCH 15, 1966 AT 9:00 A.M. PRESENT: Walter A. ~L~dsen, Mayor J- Allison Banks, Councilman Charles N. Boos, Councilman Gilbert Collins, Cotmcilman Fo T. Kain, City M~nager ~ene Moore, City Attorney Tereesa Padgett, City Clerk ABSENT: Frank J. McCoy (unable ta attend) Mayor Madsen called the meeting to order and Mr. Boos suggested the name of R. L. Brandewie to fill the vacancy on the Board of Adjust- ment, du~ to the resignation of Merlin Doughty, alternate. Mr. Madsen recommended Ray Allen. There followed discussion of the advisability of appointing anyone closely associated with other Board ~mbers and members of the Council. Also the point was made that the Council should try to name someone not already on another city board. Mr. Boos withdrew Mr. Brandewie's name from consider- ation but noted that Mayor Madsen had been opposed to Mr. Hank Thompson's appointment and pointed out how successfully Mr. Thompson was fulfilling h&s tenure. The N~yor stated for the record that although he had opposed the appointment of Hank Thompson, a personal friend of his, because of what he considered a conflict of interest, he felt that F~. Thompson was doing & fine jo~. Mr. Banks submitted the name of George Cummius to be considered for the appointment and noted Mr. Cunmfins' interest in the growth and development cf business in the city and his knowledge of the building trade. Mr. Banks moved to appoint George Cummins to the Board of Adjustment subject to his acceptance. Motion seconded by Mr. Boos and unanimously carried ~-0. There were two vacancies on the Plumbin~ Board caused by the resig- nation of ~Ir. Ray Lawser because of his heavy work load and the resignation of C. Ostrom at the request of Mr. ~illiam McK~chnie. Fir. Collins said Mr. Ostrom had advised him that he did not have the opportunity to defend h~m~elf. The Council decided at present only to fill the vacancy created by M~r. Lawser's resignation. Banks suggested Jerry Scott be considered, hut it was mentioned that he was not properly qualified to fill the position. ~. Boos moved ~o appoint Bobby James to the Plumbing Board. Motion seconded by Mr. Banks and unanimouslycarried ~-0. MINUTES Special Meeting of City Council March 15, 1966 _REQUEST FOR REZONIN~ Mr. Leon Weekes has applied for rezoning of property located at 1R6½ N. E. lOth Avenue. Mr. Moore advised that it would be possible to grant conditional usage under Section 31. Mr. Boos moved to author- ize conditional~use of the property. Motion seconded by Mr. Banks and unanimously carried &-O. _LOCATION OF VOCATIONAL Tw~ ¥~G CENTER Mr. M~%dsen stated that he was 100 per cent in favor of doing whatever could be done hy legal action, u~ .... · -~. ~u~s said he felt the situation should be analyzed to see if there had been any violation by the School Board of the terms of the bond. Mr. Madsen felt the sooner some action Was taken~ t ' he better it would be and asked Mr. Moore what could be a ne ~mmedlately. Mr. Moore noted that there was one other administrative action open and that was to go to the State and present facts that the City feels justified in its position of the need being in the south county. Mr. Banks mentioned that Dr. Campbell had said that the State could not ac~, but only approve. Mr. Moore stated that Mr. Christian has agreed to accept a presentation from the Council and he has agreed to re- view our case. Mr. Moore suggested that if this action fails Council could take this into C' ' · · rcumt Court althouEh his feeling was that it was almost an impossible chance that a court would go against the decision of an elective body. inasmuch as the conrts Were very reticent to substitute their judgment in cases of this nature. The City Attorney said that the School Board should be requested to put the funds back into Carver and Seacrest High Schools in the event that Council was not successful in getting the vocational school located in the south county, and we should pursue this point and check the legality of diverting ~oney from the school bond issue. He stated further, however, t~at it was his feeling that Council should exhaust all administrative procedures before initiating legal act ion. Mr. Banks moved to authorize the City Attorney to have reviewed all prior action relating to the action of the School Boa~d and to have the information reviewed by State authorities and himself to see if there are any legal steps Council can take to protect itself. Mr. Boos seconded the motion and asked that it include instructing the attorney to examine the bond indenture to determine whether or not the School Board could prove th~%t there is a lesser need at Carver and Seacrest. Also, if the City Attorney thinks it necessary, he be authorized to go to Tallahassee. Motion carried unanimously ~-O~ -2- MINUTES Special Meeting of City Council March 15, 1966 BREAK IN S~/~R LI~ At this point, in answer to an urgent telephone request from the City Engineer, F~. Robert Carnahan, Council gave authorization to obtain a pump for the emergency just created in the vicinity of N.E. 26th Avenue where a sewer main had broken. This break would put two or three hundred houses out of service. VOCATIONAL SCHOOL_ Mr. John L. ~rchie, President of the Chamber of Commerce, addressed the Council and stated that he was in full agreement with the action taken by the Council relative to the vocational school. Some discussion followed on the possible use of the twenty acre tract hy the School Board for an educational television center. MLr. Banks said that he felt that Council should have some commitment on the land. Mr. Boos moved to have the deed returned to the city to be held in escrow with the understanding that the land is being held for use as a vocation school site. Mr. Moore s~id he felt this should be done with continuing tender that ~f the School Board followed what the Council had originally intended, the land was still available to the Board as a Vocational school site. Mr. Moore read the following letter written by him to Mr. j. Stock, on Byran~ attorney for the School Board. March 4, 1966 Mr. Jo Stockton Bryan, School Board Attorney Bryan and Jackson 270 South County Road Palm Beach, Florida Jr, Re: City of Boynton Beach-Palm Beach County School Board Dear Jack: Confirming our previous telephone conversation regarding the special warranty deed which ~I have previously delivered to you in connection with the above-captioned matter, running from the City of Boynton Beach to the Board of Public Instruction, Palm Beach County, I would appreciate it if you would continue to hold this deed in escrow pending final determination of the City Council as to whether or not it shall authorize the release of this instrument to the school board. It was an outright grant to the School Board. The only authority Council has is the letter to the School Board attorney and Mr. Moore felt Jack Bryan shoold be specifically advised not to record bhe deed but to re~urn it to the city. Mr. Boos motion was seconded hyMr~ Collins and carried unanimously ~-0. It was again noted that Mr. Moore was to make up a package for presen- tation to Mr. Christian.
