Earl Dog,ney, First Presbyterian Church, gave the invocation and Mr. ~ led the Flag Salute. M!k~J. TES: ~Lr. Archie mo~ed that an error in the minutes of December 6, 1965 be corrected as follows: on page 3, 2nd paragraph, strike "suggest- mug the change..." and add words "opposing charge frown R-1 to C-l, but in favor of alternate recommendation of Board ~ich change was...". M~. Madsen made a motion that the miuutes be accepted ~ corrected. Motion was seconded by Mr. Banks and urmmJ~nously carried 5~0~ Motion was made by Nr. Archte that the miuutes of Decemo~r 8, 1965 be accepted. Motion was seconded by ~. Madsen and u~uanimously carried 5-0. OLD BUSINESS Request of Ivy Merkel to rezone property known as S 136.?' of W 60' of Lot 6~ Block !A~ .Sawyer~s Addn. 101 East Ocean Avenue. Mr. Archie made a motion that this~'re~ue§t'be .removed from the Mr. Madsen seconded the motion and it was unanimously carried. There has been a public hearing on this request. Mr. Banks stated that the request-is for the property to be rezoned so that it would be resaleable. He stated that a change of zoning should be done for a specific purpose not Just for a sale. Mr. Banks then made a motion, that the request of Ivy Merkel be denied. Mr. Madsen seconded and it was unanimously carried 5-0. Request of Vernise Butler to rezone parcel located at ll5 N._ E. 13th Ave. Mr. Madmen moved that this request be removed from the table. Mr. Archie seconded and it was unanimously carried. Mr. Bar,ks moved to take the recommendation of the PlannLug and Zoning Board of -1- _MIk~TES City Council, Boynton Beach, Florida December 20, 1965 December 9, 1965 that the re,est be denied. Mr. Madsen seconded and it was unanimously carried 5-0. R_~_eoort by City AttorneE re asse_~sments levied by P~2um Beach County Mr. Moore gave a review of a letter from Me. Ma~ll, County Tax Assessor, mud stated he felt the solution would be to press for corrective state legislation. Current la;~ appear to grant wide discretionary po~ers to tax assessors in settiug valuation rates. Mr. Madsen stated that if the public would appeal to Mr. ~uxwell on an individual basis it would be corrected. Mr. Boos stated that he ~s well-pleased with by Mr. Max~ll in individual and felt that duplicity.~ He stated that there are ~ counties ~ere one tax is levied on an equitable b~sis. ~ Boas sa,id ~th the proper leadership of this council and coop~rattuE with the co-~uty commissioners properly c~eled through the city ~ttorney, that the city could spearhead a great Sa-~ings to s!l the people of P~_Im Beach County. He suggested that the counoil and city attorney follow through on that type of program and t~ keep th~ thing going ~th that in ndnd. Aporoval of the White, re Mock Contract for Sewer L~es to Subcontractor Whitm~re Mock was awarded the contract from the City of Boynton Beach, but are now engaged in extensive v~rk at Cape Kennedy and substitute a subcontractor. The company has been checked out and bhere has been a meeting with representatives of both companies, Russell & Axon, F~ugins~rs~ and Mr. Kain. It is agreeable on both sides that the subcontract be placed and since work is behind time for begin, it is recon~ended that this subcontract be placed. Mr. Kain explained that there is no assignment of contract and that we still deal with Whitmire Mock. Mr. Mahoney inquired National Construction Company, the subcontractor. Mr. Neff of Russell & .Axon was in the audience and stated that they were known as A. Gaudio and Sons. Mr. Mahoney asked about othsr jobs that they have done. Mr. Neff said they have done an outfa/1 job for North M~t Beach and have had two small Jobs, one iu Pompano and one in Deerfield Beach. Mr. Neff said he does consider then re- liable and feels that they w~t~ do the Job. The city is protected by %~hitmire Mock contract and does have them legally tied up. He does not anticipate difficulty. Mr. Neff stated t~t White, re Mock will do the ~ii~ station and tha~ this new contract 5ms nothing to do with the Iift station contract with the City of Boynton Beach. Mr. Banks wanted to know if under this set-up now ~ith this change order can we, as a city, hold %~hitmire Mock to the contract which -2- MINUTES City Council, Boynton Beach, Florida December 20, 1955 has been subcontracted? Mr. Moore said that the city will pay ~T~itmire Mock and they will pay National Construction Company and that the city will have no contractural relationship with National Construction Co. Mr. Boos made a motion that a letter from Mr. Kain of December 9, 1965 recommending the arrangement be accepted. Motion was seconded by Mr. Madsen. Vote ~s ~ YES, and Mr. Mahoney voting NO. PUBLIC ~RING Zoning Change Request - Lot 135, Block A, Boynton Hills - Request R-l:to R-2 - Address: llO N.W. 3rd Avenue - Owner: Eugene and Jean ~llt . There was no one in the audience to speak in favor of or opposed to this zoning change request. Mr. Madsen made a motion that the petition be denied and the matter be referred back to the Pls.uning and Zoning for rehearing. Mr. Archie seconded and it was ur~nimously carried 5-0~ Mr. Wilt then came forward and stated that the people who origLually objected to R~2 zoning do not object to R-2A zonLug. ~fr. Moore explained that this request should be readvertised and brought before the Planning and Zoning Board for rehearing, with the suggestion that the fee be waived for readvertisLug. Mayor Mahoney noted that the Roger SW~ll~n request for rezoning was withdravm by applicant. LEGAL Ordiuance No. 65-&9 - 2nd reading - rezoning portions of Lots 20 through 26~ Sam Brown~ Jr. S~D ..... Mr. Moore read Ordinance 65-~9 by caption only. Mr. Banks moved that Ordinance 65-49 be passed on second and final reading. M~. Arehie seconded and~it was unan~ously carried 5-0. PUBLIC AUDIENCE Mr. Donald Shephard spoke about plans for development of property on the northern boundary of Boynton Beach in Hypoluxo. Re intends to develop condom~uium apartments and marina. He stated that it is an elaborate project and quite extensive and would like the consid- eration of the city for the extension of city utilities and other services to that property~ He stated that he would like to have the property to be annexed by the City of Boynton provided it is City Council, Boynton Beach, Florida December 20, 1965 agreeable to Hypottuxo. Mr. Moore stated it is possible for the city to furnish utilities and other services and that a contract would have to be drawn to remain in force m~til ar~nex~tion. Mr. Archie. made a motion that the city attorney be instructed to draft a contract outlining what was discussed this evening ~lth a copy to Mr. Shep~hard, Mr~ Madsen seconded and it was unanimously carried 5-0. Mr. Pa~l Johnson spoke about the bad conditon of city streets and wished to interrogate councilmen about this. Mayor Mahoney stated that he did not think it proper to ask city questions individually of' the council at the co~ncii .meeting. Mr. Johnson asked why the money vms not budgeted to have the streets repaired. It was stated that there was not enough money there to keep road in good repair and that they had hoped to get moeny from the CoI,P. Me. Banks went on to explaiu that the brochure referred to by Ns. Johnson was to try to remind the people that there was a definite need for this ~n our city and for complete storm drainage. He stated that there could be no good roads until thei-.e is proper storm drainage. Also, it was explained that the city does not have the mone~u available for proper storm drainage. Mr. Boos asked Mr. Jot~u~ how he thought the people wotuld feel about paying on an assessment baais for Curbing and side~alks. ~. Johnson stated h~ would: prefer n~t to,: but would ge along ~lth anything. ~. John~son aske~ about the cleaning up of lots and trash and asked f the city sP~nd~ about ~30~(~0 for t~is work. F~. Kain stated that it was more nea~ly $12,0~0~ a year for this work~ Mr. Miles stated th?~t t.he city is to blame for some of this because there is no regularity in pro~rty developEent. Property owners are allowed to run yards o~t ~0 e~ge of pavement. Mr. Ward asked about the appointment of a Rublic Works Director and wanted to know h°w ~he position will be giMen out. Mrs. Jackson asked how much was budgeted for road repair this year. Mr. Kain stated approximately $t5,OOO for about 50 miles of roads. NINUTES City Council, Boynton Beach, Florida December 20, 1965 Mrs. Latcham asked how come you cannot ask individual councilmen questions at' the meetings and asked if the storm sewers could be city ~ide. Mr. Banks stated that the city cannot properly repair streets until we have storm drainage a~ud that there is not enough money to budget for storm drainage, curbing and sidew~l~s. The estimated cost would be aro~ud one ~11 ton dollars. Mrs. Latcham also asked if it would be possible not to clear lots for two years and use that m~ney for road re,ir. ~ADMINISTRATIVE ¥~. Boos made a motion that the request of the Palm Beach County Unit, American Cancer Society, to solicit' during April, 1966, be granted and the fee waived. Mr. Banks seconded and it was unani- mously carried 5-0. Mr. Archie made a motion that the council acknowledge receipt of the following cremation certificates. APPROVAL OF BILLS Emergency repair items: Freshwater Smith Machine Company, Fort Pierce - Crane Repair: TOtal Mr. Kain stated that the Freshwater firm asked for the crane to be eF=m~ued and he thought the job work order was to be an estimate; however, the work is completed and ready to be delivered, ~r. Charles ~Y. Showers signed the Job order. Mr. Kain stated that the total b~ is not out of line because the crane was broken in five major parts; however Mr. Mahoney wanted to know who authorized this work to be done and why it did not come before Council. ~Lr. Banks suggested that ~o Kain be given more time to check into this and contact F~. Freshwater perso~a~ly. B & H Sales, Inc.. Lake Park $1,061.60 Funds for this item are recommended from the surplus in the water and sewer fund. Er. Madsen made a motion to pay this bill and Boos seconded. It v~as unan~oUSly Carried 5-0. -6- MINUTES City Council, Boynton Beach, Florida December 20, 1965 NeDtu~ Met.er Company Mayor Mahoney stated that these bills have been in the Public ~orks Department siuce Jtuly and the requisitions ;~re signed in November. B~ls arrived in the Finance Depar~nent in November after the beginniug of the current budget year. Mr. ~L~honey said he inquired of the Purchasiug Agent ~ho signed the requisitions and O,K. 'd the bills and he said no one. This never came before the council for approval and on November Llth Mrs. ~'allace wrote a memo toMro Kaiu Mr.. ~u was asked to make ~ ~ respon- sible for mak~ ~u~chases ~ knowing. noted that if the~ is no Tequisiti~n~ they sho~uld he sent back if they have not been used. Mr. Madsen seconded and it was unanimously carried 5-0. Mr. Madsen then asked the police chief when he anticipates to put the motorcycle in operation. He said just as soon as they get new Mr. George Miles then spoke about a $4,000 discrepancy which was paid to the General Fund from the Utility Fund earlier in the year. Mr. Kain explained that this is not a discrepancy and that it was a mather of paying what we had and the b~l~uce at the end of the year. There was money there but other expenditures to be made.
