Edgar Stauffer of the First Methodist Church gave the invocation and Mrs. Padgett led the Flag Salute. MINUTES Mr. Banks moved that an error in the minutes of November 15, 1965 be corrected as fol!m~s: on p~ge 2,'4th paragraph, it shquld ~ead "~.. National GoL* Tournament" instead of "...Nation Golf Toornament". ~r. Boos moved tB~t an e~-ror on page 9, last sentence~ be corrected as follows: '~It was felt that..." instead of "Felt t~at o. ~" Mayor Mahoney moved that an error on page 9~ last sentence~ be corrected ~s follows: "...Broward Grain.,~ should be changed to ~'. ,Place au Soliel". ' Mr. ~dsenmade a motion that the minutes be accepted as corrected. Motion was seconded by Mr. Boos and unanimously carried 5-0. OLD BUSINESS Request of IvyMerkel to rezone property known as S 136.7' of W 60~ of~ Lot 6, Bloc~l&, Sa~er's Addn. lO1 East Ocean Avenue. Mr. Banks made a motion that this request be moved from the table. Mr. Archie seconded the motion and it was unanimously carried. There was a discussion of the findings of Mr. Kain and Mr. Moore and it was stated that the sale price of ~he property is $15,0OO under cash sale conditions. It was suggested that negotiations continue and a more definite report given. Mr. M~dsen made a motion that the re- quest be tabled. Motion was seconded by ~Lr. Boos and was unanimously carried 5-0. Request of Vernise Butler to have Lot 36, Lainhart,s of ~ S/D, ll5 ~ E. lSth Avenue, rezoned from R-1 to CITY COUNCIL, BO~ON ~J~CH, ~OR]])A December 6, 1965 Mr. Madsen moved that the request be moved from the' table. Mr. Archie seconded the motion and it ~s unanimously carried 5-0. There has been no report from the Planning end Zoning Board on this m~tter. Mr. Boos n~de a motion that the request be retabled until the report is received. The notion was seconded by ~r. Archie and ~nanfmously carried 5-0. ..BIDS -Ai~ .Conditioning and H~a~zug Units - Wilson Recreation Center There were no new bid~s presented at the meeting. Mr. Madsen moved that the bids be received. Motion was seconded by Mr. Boos and unanimously carried 5-0. Advance Air Conditioning and Heating - Base Bid Alternate #! Alternate #2 $3~72.00 1~o00 less !6~.0Omore $t73~60 company check enclosed. They would begin work Ln two weeks or sooner from date of award and could complete work in t';;O weeks. Modern Roofing and Air Conditioning - Base Bid Alternate #! Alternate #2 225.00 less 370.OOmore Cashier's check for $167.25 enclosed. They would begin work within one week and complete work withiu three weeks from date of order. Mr. Madsen wanted some discussion on ~hat the bids include. Mr. Grootenboer explained that Alternate #1 el~m~uates heatLug unit in zone one of the building and Alternate #2 includes a gas fire unit in zone two. Mr. Boos moved that the bids be referred to the proper committee, that is, Mr. Kain, Mr. Grootenboer and bhe Purchas~j~ Agent, and report back to Council. Motion was seconded by Mr. Banks and unanimously carried. Mr. Madsen suggested that the reconmuen- dation b~e made by V~ednesday, December 8th. PUBLIC HEARINGS Request from Richard Eowe on hehalf of Four Seasons Development Corpor- ation to change zo~g in the parcel described as lying South of N. E. 20th Avenue~ North of N. E. 16th Avenue, P~st of U. S. #1 and East of N. E. 3rd Court. It was requested that this parcel be rezoned from its present R-1 to C-1. At the Planning and Zoning Board meeting of November ll, it was agreed by the Board ~nd the Applicant that the request would be modified as follows: that a portion of this land described as Parcel i (remainder of the property outside of the center two acres) be rezoned from R-1 to R-3A and t~t a portion designated as Parcel 2 (area not cIoser to surrounding property than -2- MLVOTES CITY cOUNCIL, BOI~TON BEACH, FLORIDA December 6, 1965 300' from the property line and not to exceed two acres) be rezoned from R-1 to C-1. A discussion followed and Mr. Dick Lowe, President of Four Seasons Development Corporation, spoke in favor of bhis re- zoniog for the pu~oose of buildi~ a condo~inium complex. Mr. Turtle, a property o~uuer in this area~ spoke in favor of the rezoning stating that a petition with 107 names of pro_Derby owners in the surro~udirg area had been presented to the Planning s_nd Zoning Board suggesting the change from R-1 ~o R-3A and the center rezoned from R-1 to C-1. No one in the audience spoke in opposition. Mr. Moore read Ordinance 65-~9 rezoning subject property. Mr. Bar,ks made a motion that Ordinance 65-~9 be passed from first to second reading. Motion was seconded' by ~Lr. Boos and unanimously carried 5-0. Ordirtance~ 65-&8 - 2n~d~ Readin2 - Amending Section 17.32.2 of the Code re: assault and resisting arrest. This Ordinance was read for the first time November 15 and ~s pre- sented for the second reading by ~r. Moore. Mr. Archie made. a motion that Ordinance 65-~8 be passed on second reading. Mr. Boos seconded the motion and it was unanimously carried 5-0. Resslution 65-RR - Transfer of Bond ~sa to Construction Trust Fun~ Mr. Kain explained that a portion of the proceeds of the 196~ Water and Sewer Refunding Bonds was over invested in the ascotunt ~ich was set up to retire the 1960 water bends. This over investment is in the amount of $72,773~. The Atlantic National Bank of West Palm Beach and Bache and Company have been notified of this over invest- ment. The Atlantic National Bank has agreed to transfer the listed amount ~o the Construction Trust Fund upon authorization from the City to do so. It was noted by Mayor Mahoney that Mrs. Olive Wallace of the Finance Department deserves a lot of credit for the work she has done on this and discovering the error ~pproXimately eleven months ago. Mr. Madsen made a motion that Resolution 65~RR be accepted. Motion was seconded by Mr. Banks and it was tunanimously carried 5-0. MINUTES C1 y Council, Boynton Beach~ Florida December 6, 1965 Resolution 65-SS - License Agreement with F. E. C. ~:~lway This license agreement with the Railway w~ll permit the extension of lateral lO-A-2 across the ra~]road right-of-way at S. E. 21st Avenue. This work is needed in the current contract for sewer construction. Mr. Banks made a motion to adopt Resolution 65-SS. Motion was seconded by Mr. Archie and unanimously carried 5-0. PUBLIC AUDIENCE Col, Albert J. Wehrell spoke in opposition to the C .I.P. Mr. F. T. Rogers, 333 S. B~. 9th Ave., spoke and requested that some vacant lots be mowed in the vicinity of his pzoperty, Mr. Frye spoke about getting a guard on N. E, 2nd Ave. at N. E. 1st St. Mr. Frye said that the guard was promised but had not shown UP. Mr. Eain and the police chief stated that two guards have been assigned. One for the above crossir~ and one to be assigned to N. E. 22nd Ave. and Seacrest. ADmiNISTRATIVE Change Order #~ - Bt~mby & St~pson Contract This is the installation of a se~r lateral at N. E. 10th Avenue and the F. E. C. right-of-way designated as 2A-IO-A. This work was originally contained in the '~hitmire-Mock contract; however, due to the urgent need for this work, it is recommended that this be made an addition to the Busby & Stimpson contract since this firm is ready to install the line as soon as possible. It was stated that ~aitm~re-Mock shottld release their part of the contract by letter. Mr. Madsen made a motion to accept Change Order #~ subject to the letter from Whitmire-Mock releasing this contract to Bumby & Stimpson and making change in the bonding situation. Mr. Banks seconded the motion and it was uuanimously carried 5-0. Change Order #5 - Bumby & Stimpson Contract This is the installation of sewer lateral lOA-1-A, S. E. 23rd Avenue from U. S. #1 to the F.E.C. Railway. Mr. Banks moved that Change Order #5 be approved so that we can proceed with this installation. M~. Archie.seconded the motion and it was'unan~mouslycarried 5-0. Bill from Bumby & Stimpson for sewer construction from period of October 20 to November 23, 1965 iu the amount of $67,228.12. This has been ~erified by Russell & Axon, the City Engineer and by the Finance Department. M~o. Boos moved that this bill be paid. Mr. Archie seconded the motion and it was unanimously carried 5-0. Bill f~om F.E.C. in the amount of $1,376.79. Payment is recommended from th~ encumbered funds in 590~-~ Bill from F.E.C. in the amount of $2,62~ and payment is recommended from Account 20-lO1. Mr. Archie made a motion that these bills from F.E.C. be paid. Mr. Boos seconded ~and it was una~q~ously carried 5-0. Bill from Southern States Chemical Company in the amount of $579.38 for chemicals for Water and Sewer Depts. Fund.s are availa, ble.in 6220-B-gA a~d 6120-B-9. In response to an inquiry to Mr. Maxwell, Mr. Moore had received a two-page letter of explanation today. He ~ill give a further report after haviug tim~ to digest thoroughly. Mrs. Padgett presented a request for a transfer of beverage license from the Cartage House d/b/a Tropical Acres to Carriage House d/b/a E1 Dorado Supper Club at the same a?.dress. There ~ a~ ch~e.iu the make-up of the corporation but it has been checkea ou~ ana approved. ~. Archie moved that the request be granted and Mr. Banks seconded. It was unanimously carried 5-0.
