CmS N~ BOOS, COUNCIL~IAN F · T · KAIN, CITY I~IANAGER GENE MOORE, CITY ATTOi{NEY TEREESA PADGETT, CITY CLERK Mayor ~ahoney called the meeting to order at 9:15 a.m. to consider the question of the beverage license for the Alamo Restaurant° Said meeting was called upon approval of the entire Council. The City Attorney reviewed the facts of the pending application and recommended tentative approval only. Re further suggested that a letter be sent to Donald P. Kohl, attorney for the applicant, se~ting forth the requirements to be met before final approv~ would be granted and the license issued· A lengthy discussion followed. Mr. Banks read Section 3-20 of the Code of Ordinances and stated that he still felt, based on this section, that even though the applicant should meet all the necessary requirements as to building, zoni~g~ etc., he would still not be entitled to a license. %fhile the above mentioned letter was being prepared, Mr. Moore informed the Council that the new contract received covering the purchase of Lots 172, 173 and 174, Block D, Boynton Hills, amounted to $1,054.10 instead of $1,050.00 as approved by Council May l?th. Mr. Boos moved that the additional amount of $4.10 covering documentary stamps be approved. Motion seconded by Mr. Banks and unanimously carried. Mr. Madsen brought to the attention of the Council that Joe Faso]o was using his garage to store paint at 1503 N. Eo 4th Court. Mr. Madsen made a motion to instruct the City ~anager to investigate this complain~ and if deemed necessary, to hold a public hea~ing on the occupational license of Sro Fas~lo regarding conducting a business in a residential area. ~otion second~d by Mr. Archie and unanimously carried. ~ayor ~ahoney r~ported to the that the School Boar~ had accepted twenty acre tract in the southwest industrial school site. Council that he understood the City's offer of the section of the City for an -1- City Council Boynton Beach, ~ay 22, 1965 Fla0 · l~e City Attorney read the attached letter addressed to attorney Kohl. ~r. Arc/lie moved the adoption of the letter as read and also moved that the members of Council sign same denotin~ their approval. ~otion seconded by Mr. Boos and carried 4-1. ~ro ~anks voted No~ and~ therefore~ did not si~ the letter. The attorney was to follow through on this sub- ~ect ~nd advise the outcome prior to the Court hearing sche- duled for 1~30 p.m., Tue~day~ }~ay ~Sth. ~Iro Arch~e inquired as to the status of the sewer rate study and was irrformed that the e~gineers were st~ll working on to get all the facts sewer extensions and arman~e a meetin~ to discuss same.
