Vernon Perkins of the First Baptist 0hutch gave the invocation followed by the Salute to the Flag. Recognition was given to those ~Very Important Citizens" attending the meeting at the special invitation of the Council, MINUTES Regarding minutes of regular meeting of ~ay 3rd~ Mr, Arohie requested that a typographical error on the first page~ next to last line be corrected. Mr. Banks requested that on Page 5, middle of the page~ the word ~assent" be changed to "consent." Mr. Eadsen moved that the minutes be approved with the corrections. Mr. Boos seconded. Motion carried 5-0. OLD BUSINESS P~rk Lands Lsase - Florida Inland Na~lgation District Colonel Schull of F.I.N.D. presented the Council with a lease for property located between U. S. ~1 and the Int~a- Coastal %~aterway south of Hampshire Gardens comprising appro- ximately five and one-half acres. Colonel Schu11 requested that the lease, which had been worked out through the City Manager and the Jayeees~ be executed. Pm~ing $.~ E. 9th Avenue (On the Table) ~Lr. S. $1 Mr. Archie called the Couneil~s attention to the need for traffic lights at S. E. 23rd Avenue and U. S. ~1 and N. Eo 10th Avenue and Uo S. ~1. He noted the recent install- ation of traffic lights by the State Road Department in Hypcluxo -1- M 1 N U T E $ City Council Boynton Beach~ Fla. Nay 17, 1965 and Delray ~each, stating that he felt the need in Boynten Beach Ms just as great. Mr. Archie moved that the City A%~anager be instructed to do everything in his power by way of contacting the State Road Department and other governmental bodies necessary to brir~ about the installation of traffic signals at N. Eo 10th Avenue and U. S. ~1 and S. E. 23rd Ave. and U. $. ~1. ~r. Arohie included S. E. 15th Ave. and U. S. ~l in the motion at the request of Hr. Madsen. ~r. Banks seconded the motion which carried 5-0. ,,~e~q~est of ~illiam Weinstock - Relt Decision of,,Plannin~ & Zonina Board At the request of l'tilliam ~einstock a recent decision of the Planning and Zoning Board in recommending denial of an application for a change in zoning to permit the construction of garden-type apartments in Royal Palm Village was opened for discussion. Public Hearing for this recommendation was set for June ?th. Mr. ~adsen moved that in view of the large number of interested people present in the audience, that they be heard on the matter and that a transcription of the record be made and submitted to Council as part of the public hearing on June ?th. Mr. ~anks seconded. Motion carried 5-0. Mr. Phill!p ~resenting ~r. Weinstock spoke to Council at urging ~proval of the change in zoning to permit th~ erection ~f galen-type apartments. Mayor ~ahoney read. letters favoring the change from ~iss Mary D. Phillips and Mr. and ~Lr~. Adolph Tedma~. A petitAon bearing 103 certifyin~ approval of the rezoning was Also speaking in favor of the rezonir 418 N. E. 20th Avenue and JosePh H. N. E, 20th Avenue. Mr. ~illiam G~ Hartline, 348 N.E. · told Council that he objected to the rezoning~ however~ he would pre,sent his objections at the public hearing. All tho$e present favoring the rezoning were asked to stand. Approximately one hundred people rose. All those present not in favor of the rezoning were asked to stand. Six people rose. NEISBUSINESS R~rrioane Fund Reimbursement Colonel Ellis Altman of Civil Defense presented the Council with a check in the amount of $13,798.00 ~hich covered the cost to the City for cleaning up debris resulting from the passage of Hurricane Oleo in the Fall of 1964. Boynton ttills Subdivision Mr. Moore reported to Council that the initial offer of $1~000,00 providedwas was usual~ for the seller to provide title insurance an~ documentary stamps, however, the contract had the City bearing the cost of title investigation and stamps. He state~ that the additional cost would amount to $50.00 and that the~Oounoil should determine if they ~,anted to purchase the lots for this amount, Boos moved that the City pur- chase Lots Block D, Boynton t{ills, for the Mrl Banks seconded. ~otion 5-0. PUBLIC AUDIENCE ~r. Donald ~cKone, 718 Shore Drive, spoke to the Council regarding a petition submitted earlier by the residents of Coquina Cove calling the Counciles attention to the conditions existing in Coquina Cove and asking for improvements and relief. ~ro Piszczek~ 706 Shore Drive~ also spoke concerning conditions. ~r. Madsen moved that the City Manager and the City Engineer be appointed on a committee to mee~ with the representatives of the residents of Coquina Cove and work toward beautifying the area. ~r? ~anks seconded. ~otion carried 5-0. Mrs. Emily Jackson questioned the Council regarding the circulation of letters by the Council asking the State Repre- sentatives to vote for passage of the five charter changes up before the legislature ~ithout a referendum of the people. ~rs. ~ary Flook~ 1008 So E. ~th Street~ and ~r. Harry LeFort, ?25 Ocean Inlet Drive, asked questions about the same letter. Ordinance 65-11 2nd Readin~ Ordinance 65-11 levying assessments for paving S. W. ~h Street between Ocean Avenue and $. ~ 1st Avenue was read for the second reading by caption only. ~r. Mr. Banks seconded. Motion carried 5-0. Ordinance 65-18 - 2nd Readin~ Ordinance 65-18 was read by Mr. Moore by caption only. The Ordinance annexed the Dyer Tract into the 0ity. Mr. Madsen moved that Ordinance 65-18 be passed on second and final reading. Mr. Archie seconded. Motion carried 5-0. Ordinance 65-21 - 1st,Readin~ ~r. Moore read Ordinance 65-21 which annexed the Aiken tract located in Benson Bros. Subdivision east of the ~aterway, -4- City Council Boynton Beach~ Fla. into the corporate limits of the City. ~r. Archie moved the adoption of Resolution 65-Vo ~. Banks seconded. ~o- tion carried 5-0. Solomon ~olle ~andamus Suit ~r. Moore informed the Council that Mr. Solomon Belle had brought a mandamus suit against the City in his effort to obtain a liquor license for a 200 seat bar and restaurant on N. E. 10th Avenue and that Judge Knott had set a hearing for 1.~y 25th at 1530 p.m. at which time the City was directed to show just cause why the license had been denied. ~r. ~oore asked how the Council would like the matter handled. Mr. Boos moved that the City Attorney be instructed to answer the writ as follows: in answering the alternative ~rit of mandamus the applicant had furnished evidence that he was unable to provide adequate parkin~ facilities as required by the zoning laws under Section 31-13, Sub-section 8. ~r. Archie and ~ahoney. ~ro Archie moved that the Council instruct Vice ~iayor ~adsen~ Mr. Banks and Mr~ Boos to represent the City before Judge Ifnott on the 25th of May. ~r. ~adsen seconded the motion. ~r. Archie stated that he had made the motion as he was of the opinion that for the ~ay~r and him to appear would only weaken the City's position in %Jew of the way they had voted on the issue, ~r. Boos moved that the Kerr property, Lots 56 and ?3, Lawns Subdivision, constituted a nuisance and that the property be declared a nuisance and that the City Attorney be instructed to prepare the necessary papers. Mr. Banks seconded. Motion carried 5-0° Ordinance 65-19 - ~alcolm Tract ~r. Moore informed the Council that the purchaser of the ~alcolm Tract which was being annexed into the City by Ordinance 65-19 had determined that he did not desire to come into the ~City and, therefore~ he recommended that the Ordinance be dis- continued. Mr. ~adsen moved that Ordinance 65-19 be discontinued. ~tr. Banks seconded. Motion carried 5-0. Approval of Assessment Rolls for Street Improvement~ ment 1. ~r. ~adsen moved that the Council approve the assess- rolls for street improvement on N. W. 13th Ave. between 8th St. and N. ~. 9th St.$ and N. %~. 7th Ct. from N. Archie moved that the Council approve the assess- ment rolls for street improvement on N. E. 13th A~e. from N. I~. ?th St. to N. W. ?th Ct.~ total front footag~ of 6~ feet; total cost of $1,142o00. Hr. Banks seconded. Motion carried 5-0. 4. ~lr. Nadsen moved that the Gouncil approve the assess- ment rolls for street iml~ovement for the alley in the block between N. E. 1st Ave. and N, E. 2nd Ave. running from N. E. 4th St. east~*ard to U.S.~I$ total front footage o~ ~68 feet; total cost of $670.85. Mr, Archie seconded. Utility Easement - Laurel Hill Park Area Nr. ArcbAe moved that the request from the Florida Power and Light Company for a utility easement on City-owned property in Laurel Hill Park be tabled. Mr. Nadsen seconded. Notion carried 5-0. Contract with Russell & Axon Re: Streets and Storm Drainage Mr. Nadsen moved that the Council authorize the approval of a contract presented to the City by SusselI & Axon whereby engineering services for street and storm drainage improve- ments would be prepared in accordance ~th requirements of Public Law 560, providing for the inclusion of data for advance planning loan applications for securing federal funds, total cost of the contract to be $1,000.00, to be payable in the next fiscal year. Nr. Banks seconded. Notion carried 5-0. It was pointed out that this expenditure was being made in order that the Council ~*ould have figures available for the people to vote on for streets and storm drainage improvements. -7- MINUTES City Council Boynt on Beach, ~ay 17, 1965 Fla. Specifications for Bids for Annual ~suranoe Need~ Mr. Madsen moved that ~he Council appoint Mr. Clarence Bemry and 2~. ~illiamAllan to prepare the specifications for ~he annua% insurance needs and that the City Clerk be authorized to advertise the specifications for the receipt of bids at the June ?th meeting. Mr. Archie seconded. Motion carried 5-0. Mr.. Boos requested that the time allotted between the advertis- xng and receipt of bids be lengthened in ensuing years, so that companies would have sufficient time to prepare bids.
