Gene Moore led the salute to the flag. Mr. Madsen moved the approval as written of the minutes of regular meeting of AuEust 17, 1~64. Mr. Archie seconded. Motion carried 5-0. Mr. Arohie moved the approval as written of the minutes of special meeting of August 31, 196A. Mr. Nahoney seconded. Motion carried ~-0. One correction was made by Mr. ~ahoney to the minutes of special meeting of September 3, 1964~ Page 4, Paragraph 4, .... Mr. Summers m~dea motion to adopt Resolution GG, should be Resolution 64-GG. Mr. Nadsen moved that the minutes be approved with the correction. Mr. Nahoney seconded. Notion carried Mr. Archie moved the approval of minutes as written of special meeting of September 9, 1964. Mr. Nahoney seconded Motion carried §-0. ' .LEGAL ~dinance 64-1~ - 2nd Reading, AmendinE Section 3-21 of .the Code The ordinance dealing with transfer of non-conforming uses was read for the 2nd reading by caption only by Mr. Moore called the Council's attention to the insertion in the ordinance of the amount of 500 feet as the distance requirement and stared that this amount wss the determination of the coordi- nated effort of the Director of Planning and Inspections and the Building inspector. Mr. ~Y~honey moved the adoption of Ordinance 64-13 on second and final reading. Mr. Archie seconded. Notion carried §-0. -1- ~ I N U T E S City Council Bo~nton Beach, Fla. Emergency Ordinance 64-t6 Re: Plumbin6.,Code Emergency Ordinance 84-1~ was read bye. ~oore. Nr. Madsen moved that the ordinance be adopted. Nr. Nahoney seconded. Notion carried 5-0. .ADNIN ISTRAT IVE Approval of Bills Mr. Kain recommended Council payment of bill to Florida Power & Light ComDany for the re-routing of lines on Sewer Nain 2A in rear of Kwik Chek Shopping Center as follows: Labor 765.64 Vehicle 79.07 Stores, Accounting & Purchasing 126.71 $971.42 Mr. Summers moved that payment be made to Florida Power & Light in the amount of ~971.42 charged to the Sanitary Sewer Construction Fund. Mr. Nadsen seconded. Motion carried 5-0. Mr. Mahoney asked ~r. Kain if this was covered by a Change Order. Mr. Kain said that it was--achange order already approved by Council. Mr. Nahoney requested that the Finance Director re- ceive a copy of all change orders or s memo regarding them in order that she will be able to keep track of the amounts. Final Payment - Bumby & Stimpson Sanitary Sewer Contract The City Nanager informed Council that all Release of Liens and affidavits of payment had been received and recommended pay- ment. The amount due was $74,399.56. Mr. Madsen expressed the desire to hold up final payment until the City received some kind of insurance. Mr. Archie stated that the Council had signed the contract without making the requirement of insurance or bond after completion of the work. He recommended that the Council go ahead and make the final payment according to the contract and then endeavor to get a bond, Bumby & Stimpson paying half and the City -2- MINUTES City Council Boynton Beach, Fla. Archie moved that the OouDcil approve payment of $633.2.7 ko Kelly Tractor Co. for the repair of the Traxcavator, charged to account number 260E2. Mr, ~L~dsen seconded. Notion carried 8-0. PavinE Contractor - Rubin Construction Co. Mr. Madsen moved that Rubin Construction Co. be paid $1,907.78 for paving streets Under street assessments account. Mr. Archie seconded. Motion carried 5-0. Ed. Clanton - Truck Rental re,: Hurricane Cleanup Mr. Kain presented a bill in the amount of $1,910.00 from Ed. Clanton, covering rental on three trucks and drivers from period August 31st thru September 12, wi th the exception of September 6th. Mr. Katn explained that this work was in connec- tion with the cleanup after the recent hurricane and funds were available in the Hurricane Emergency Fund. He recommended pay- ment. Mr. Archie moved that the bill from Ed. Clanton in the amount of $1,910.00 be paid. Mr. Mahoney seconded. PUBLIC HEARING Review of Proposed 1964-65 Budget Mr. Kain presented to the Council the Preliminary Budget Report. Copies were available for those in the audience who wanted them. The City Manager gave a brief explanation for the benefit of Council and those present. Mayor Banks asked if anyone in the audience wanted to ask any questions concerning the budget. There was no cormment. ¢.rdinance 64-14 -, lst..Readin~ Adootin~ Budget Fisaal Year 1964-65 The Mayor asked that the City Attorney read the ordinance adopting the budget as presented by the City Manager for the fiscal year 1964-65. l~k% Moore read the ordinance in its entirety. Mr. Summers moved that the Ordinance be passed on first reading, to second reading. Mr. Mahoney seconded. Under discussion Mr. Summers asked N~. Moore if the figures included in the 0~di- nance had been checked with ~lr. Kain and the Finance Department. He was assured that they had been.
