KAIN, CITY MANAGER G~E MOORE, CITY ATTOBNEY TEREESA P~~GETT, CITY CLERK Mayor Banks called the meeting to order at 7:30 Rev. Earl Downey of the First Presbyterian Church gave the invocation. The Salute to the Flag was led by First Class Scouts A1 Buscher and Bob Thomas of Troop 305. Mayor Banks expressed appreciation to Vice-~ayer Mahoney for taking over various tasks during his absence; for officiating at the last regular meeting. MINUTES ~&r. Archie moved that the minutes of the Regular meeting of June 1st be approved as written. Mr. Mahoney seconded. AYES: Archie. ~ahoneT, Nadsen and Summers; ABSTAINING: Banks. (On vacationJune lst) M~. Archie moved that the m&nutes of Special Meeting of June 12th be accepted as written. Mr. Mahoney seconded. ~YES: Archie, Nahone~ Nadsen and Summers, 2~r. Banks abstained. On vacation June 12th) Fiscal Agent Agreement with T. R. Alcock.& Co~ - .Amendment The City Attorney ~ead proposed changes to the fiscal agent agreement with T. R. Alcock & Co. dated February 14, 196~. These were discussed by the Council. M~. SUmmers moved that the proposed amendment to the contract be approved and that the Mayor or Vice-~yor and the City Clerk be authorized to execute the document and that the original thereof be appended and made a part of the original agreement now on file in the office of the City C~erk. Nr. Madsen seconded. As discussion Mr. Mahoney read a statement which he had prepared and set forth the following: That the present bonded indebtedness is apProx~m~tel~$~.O00.O00~O0. The new bond~ inde redness will be$8,000,O00. O0. Benefits gained by the citizens of Boynton BeaCh and the City acc6~di~g to Mr. Mahoney's -I- statement are as follows: 1) Sewer five additional sections thereby adding 744 new customers to the system~ 2) Reduce the interest rate f~om the p~esmmt A,12% with an overall to a proposed new ~ate of ~.8~%, ~i foot foot assessment. A pro- rate of , month is Under consideration. the pledge ¢ ~y taxes of approximately $100,000 for paymentof bonds, now Used in the General Fu~d. 5) Allow the us® of the excess fUnds of the wate~- and sewer income, par Present. bunds sold at M~:~ Eain road a telegram from T. R. Alcoek & Co. dated June t5, 196& which text was: "As outlined in the bond schedule discussed w~ th you Friday I have the ~,8~&% interest costs bid firm for your consideration and acceptance at your City Co~uci! meeting tonight subject to six million dollar bonds b~ing delivered in sixty days or at such later date as may be approved by the bidder. The unqualified legal opinion of Freeman, Richard- son & Watson and non-litigation certificate is to accompany delivery of the bonds. T.R.Alcock" Hr. S~mmers called for the question. AYES: Mahoney, Nadsen and SUmmers; NAYES: A~chie and Banks. Mr. Archie asked that the record show that he voted No on this same issue on February 13th and that he was ~oting No on this as it was just au amendment to the original contract. He stated that this was the largest single financial issue that any Council had ever.~been faced wi.th in the history of the City of Boynton Beach. H~ was not satmsfied in the ms. er in which it was undertaken. Mm. Archie further stated that the Ccuncil by a three to two vote entered into a contract with a man from Boston, Massachusetts, a fiscal agent, and by their statements at this last meeting in February no one had checked this man's background and no other firm had been interviewed by this Council before the Mayor signed the contract with him based on that three-two vote. "Because of this and the size of the issue, he felt that ~his was wrong. He certainly did not oppose dropping the front ~oot assessment or any of the other nioities. Mr. Mahoney stated that any Councilman could look into the hackgro~'ldI of any firm doing business wi th the City and that he had looked, into it and read three telegrams giving favorable ~efe~ences ~o Te R. Alc0ck & Co. The telegrams were from Chap- man & Cutler, bonding attorneYS of Chicago, Ill., Merchants National Bank & Trust C0., New York City, ~nd Guardian Life oYmsurance Oompany of New York. Mr. MaSonry also sta~ed that the ouncil had consulted: Ports & Shepard and that the majority of Council di~ not ~feel that their p~oposal was satisfactory, -2- Request from Ronlee,. Inc.. ~f.or an Extension of Time on Con~ract Mr. Kain informed the Council of the request by Ronlee, Inc., for an extension of 60 days on their contract with the City, giving as thei~ reasons, the fa.ct that their contract had been increased by 9% mud there was dmfficulty in the acquisition of certain easements. ~ro Kain recommended that the Council grant them twenty days. It was pointed out tha~ there had been an increase in the contract amounting to 36.84 days. There was dis- cussion as to whether to give 30 days extension or the recommended Mr. Summers first moved that they be allowed 30 days. r seconded. After discussion, Mr. S~m~ers~ ~m-nded his mot days and Mr. Mahoney accepted tha amendment. AYES: Mahoney, Archie, Madsen and Banks. BIDS Specifications hs.d been drawn and advertised for the Writing of seven types of ~nsurance coverage for a period of one yea~ beginning July l, 1964~ At ~:~8 P~. the Mayor had called for amy bids. Mr. Madsen moved that the bids be opened~ accepted and i~ltialed. Mr. Mahoney seconded. All Councilmen voted AYE. Bids were opened from the following: 1) Frank J. Swank Agency, Boynton Beach, Pla. Mr. Madsen moved that the bids be accepted and turned over to a committee for tabulation, the committee to consist of Mr. Kain, ~r. Moore and the Mayor or Vice-Mayor. Mr. Summers seconded. All Councilmen voted AYE. PUBLIC HEARING Re-Zoning Application on Lots 25, 26, 2~, Block 4, Bo.vnton Heights F~pm.R-2 to R-3 The Public Hearing was called on the above application. There were no objections made to the re-zoning, Mr, William Yates, applicant and owner, appeared before the Council and told them that every lot in Block 4 on ~acrest Blvd. was zoned C-1. Mr. Moor~wead Ordinance 64-tQ. Mr. ~ahoney moved that nance 64 1~be approved on first reading and passed to second reading. Mr. Madsen seconded. All Councilmen voted AYE. Hearin~ of Feldc~mp Electric C0. The City Attorney explained procedure that the hearing should follow. Mr. Kain read letters sent to the complainants and the defendants. Each person testifying was sworn in by Mrs. Padgett. The following persons appeared as c?m~lainants: Donald L. Spath, ~144 Chapel Hill Blvd., and L. A. Einhorn, ~220 Chapel Hill ~lvd. Both parties complained of delivery of e~pplies by large tramler- tractor vans to the residence on ~214 Csm~al Drive and of the pa~king of two trucks on the property, Police Chief Erwin and Mr. gain told the CoUncil what they knew of the situation. Mr. Feldcamp appeared in his own behalf. After hearing all the evidence, ~r. Archie said that it appea~ed that there was some e~idence that Nr. Feldoamp had in the past used his residence as a business location, but in the last three months had stopped and had rented a warehouse. He, therefore, suggested that the matter be resolved by placing Mr. Feldcamp on a six-months probation and that if, at the end of that time, demonstrative evidence is produced to prove that Mr. Feldcamp is doing ~usiness from his residence, his license at that time be revoked. Nr. ~adsen moved that Mr. Archie~s suggestion be followed. Nr. ArcD~e seconded. All Councilmen voted A~E. Hearing on Tru-~hite Roof.ing Company Letters sent by the City Manager to TPu-~ite Roofing Co., and the complainant, Thomas Wagenhouzen of 12~ N. E. l~th Ave. were admitted to the record. The complainant was first given a hearing; he told of three trucks parked at the residence and of personally observing the loading and unloading of bs~s of materials presumably Used in the roofing business. The complain- ant, Mr. ~agenhouzen, after being informed that the Tru-V~ite Roofing Company had obtained a license for doing business in a commercial zone, withdrew his complaint. The hearing therefore terminated. Approval of Bills The following bills were submitted for payment by the City Manager: Russell & Axon - Engineering services for redesig~ of the treatment plant effluent line. $2,670.47 Russell & Axon - Consulting engineering services on construction of the Intracoastal Waterway ~ater Main Crossing and Water Supply Wells, to May 20,1964. $ 246.00 Russell &Axon - Consulting Engineering services in connection with construction of the sewage plant and system to May 20~ 1964. $5,480.4V Mechanical & Equip,, inc. - Estimate #6 - Construc- tion of water supply wells ~ud fix- tures on S.W. l§th Ave. well field, from April 21, 1964 to Nay 20, 1964. $3,419.99 Mr. Summers moved the payment of the above bills. Mr. ~ahoney seconded. All Councilmen voted AYE. Insurance bills on boiler and machinery written by the Lawrence W. Myers Insurance Agency were submitted for Council approval. The policies were written on a three-year basis and the bills being considered represented the second installment. They were as follows: General Fund - 12 items - $591.91 Utility Fund - Water 23 items - $693.38 Sewer 8 items - ~405.87 Mr. Mahoney moved the payment of the above insurance bills, Mr. Archie seconded. All Councilmen voted Aye. ?a.Tments in May by Funds Mr. Mahoney moved that payments in May by account funds in the total amount of ~140,983.V5 be approved and a copy be attached to the minutes of this meeting. Mr. Summers seconded. All Councilmen voted AYE. Departmental Reoorts Mr. Madsen moved the departmental reports be accepted. Mahoney seconded. AYES: Madsen, Mahoney, Archie and Summers.
