enforced. I refer you to Section 4.08 of the resolution for "R~medies".
Also to the second paragraph of Section 4°0?.
You hav~ the opinion of the City Attorney that it is the sworn
obligation of each member of this~cOuncil, to the best of their abilTty,
to see that all of the covenants of the Water Bonding Resolution are
complied with, and that all covenants are legal and 2i~ing upon the
City of Boynton Beach.
I don't know of any action that has been taken to co~ply
with the Bonding Resolution.
Now, I ask that Dr, Akes, as W'ater Commissioner, in 9barge of
~- ~ at our next regular codncil
the city's water department, zurnis~_ us,
meebing, a list of all t~h~ violations, ~ud there are many~ of ~he above
mentioned bonding resolution, and his recommendations as to the action
that Council should take, so that the City will be in compliance with
uno r~soluulon.
We are now virtually ~sitting ducks" as any of us can be
c~arged with nonfeasance, misfeasance or malfeasance of office~ I will
give you the legal definition of these charges:
Nonfeasance the not doing of what ought to be done.
Misfeasance the doing of a lawful act in am unlawful
manner; legal trespass.
Malfeasance an illegal act or deed.

Therefore, i am now making a motion to adopt a resolution,
so tk~t my vote, as well as ~hat of the other members of ¢ouncil~
will be officially on the records. The resolution I propose is as
follows:
"It is fouled and determined that the City o~ Boynton Beach
is violatinM certain covenants of the ~Yater Bondin~ Resolution adopted
January #, 1951o
Therefore, it is resolved that the city council shall
promptly take such action as is required to remove any and all
violations of said Water Bonding Resolution~ and it is further
resolved that the City will comply with and enforce all the covenants
of said Water Bonding Resolutiom~,
