The meeting was called to order at V:30
The Rev. Keith'Love, of the Presbyterian Church, Boynoon Beach
gave the invocation.
~inutes of the last regular meeting, held December 2t, 1959,
were read and unanimously approved with no corrections.
D~ing the public half hour ~r. George C. ~iles from the
audience asked to be recognized. He presented the Council with a
letter addressed to tb~ Council~ which was read for the record.
The letter requested that the City pay or caused ~o be oaid into
the ~ater Revenue F~ud a sum equal to the amount paid out of the
Water Revenue F~uud with interest sad tb~.t all tb~ Covenants of the
Bonding Agreements be enforced. The letter also requested t~t
all liens and enc~mberances except those established by th~ Bon~ing
Resolution be made null and void. The writer stated that he was
holder of ~ater Revenue Bonds dated l~/1/50 ~os. ~ and
iEr~ Durkin moved that the letter and the legal opinion ~daich was
attached be turned over to the new City Council. ~r. 0yet se~ nded
the motion ~ich passed ~v. animously. ~ Eiles requested tha~ a
copy of the letter be rmade a part o£ the minutes~ (Copy attached~)
Recommendations of the Zoning Board which were tabled at the
last regular meeting, were removed from the table by a unanimous
vote of the Council~ l~r. 0yet moved that Lots 17, 18, 20 of Block E
Hathaway Park be rezoned to light industrial. D~r. Durkin se~nded
the motion which passed unanLmously.
D~. Baugbanan moved that the Council deny the application for
relieving the setback requirements for Lot l, Block 8, Central
Park Annex. ~. Nadsen seconded the motion w?~ch passed unanimously.

waiver of..penalty on ~ licenses, Tow~ o~ Oces_u Ridge~ petition and
applications for Finance Director.

Dr. Charles Akes and John L~ Archie recently elected Councilmen
and Cotuucilman Martin Du~kin stepped down f~om the Council table.

pla~ues [~o Oyer seconded th~ motion wh_ch massed ~uuanimously,
Er. Oyer took the Chair, and asked for nominations for the
office of ~ayor. ~o Madsen nominated John Archis for Mayor.
?~r, Bau~n~an seconded the nomination. Mr. Archie declined the
Mayorship stating that he felt that he would not at the present
time be capable of being ~ayor~ Dr~ Akes nominated ~!r. 0yet for
~ayor and ~r. Archie seconded the motion. Mro Archie moved that
nominations be closed. Dr. Akes seconded the motion which passed
unanimously. Upon a call for a vote on the appointment of
Mr. 0yet for Mayor, the appointment carried three to two, ~. Madsen
and ~. Baughman voting no.
For the office of Vice-Mayor, Dr~ Akes nominated Mro Archie.
~r. 0yer requested ~. Madsen to take the chair in order to second
the nomination. ~. Bau~hman nominated Dr. Akes as Vice-Mayor.
~r. ~adssn seconded the nomination of Dr. Akes. Mr. Archie was
elected to the Vioe-~ayorship by a four to one vo~e, ~, Baug~Iaan

of the City was given each Council member by Mayor Oyer.

Dr~ Akes seconded the motion. Iv~o Baughman,.~.m)ovsd that Rona~d Fruda
be appointed to the position. ~. ~adsen seconded the motion.
Lengthy discussion as to the propriety of the appointment of a
new City Attorney in view of the suits pending was held.
Nr. Baughraan asked Nayor Oyer whether or not the appointments
made at this meeting would be permanent. ~ayor Oy~r stated that
he would ~eco~end all appointments other than the city Attorney
and the City judge be.on a temporary basis. ~r. Baugb~nan requested
that in voting for the Gmty ~t~orney tha~ ~r.~Fruda's name be
called first. The appointment of M~. Fruda as City Attorney was
denied by a three tO two vote, ~. Archie, Dr. Akes, and ~ayor 0yet
voting no. The appointment of ~. Noore was approved by a three-two
vote, ~.Nadsen and ~. Eaugb~nan v6ting no.

Mayor 0yet recommended to the Council that all other appoint-
ments be o£ a temporary nature to await the hiring of a City ~anager
~dao, upon familiarization, would m~me recommendations to the
Council regarding permanent appointments. ~r. ~adsen moved that
all appointments be for one year, ~. Baughman seconded the
motion. Upon a call for a vote, the motion was denied t~ee to
two, ~r, £mrchie, Dfc Akes, a~. ~ayor 0yer voting no~
Thereupon, ~r~ Archie moved ~nat all the remaining dsp~tment
heads be appointed on a temporary basis and that if a new City
~anager is hired that he be free to make recommsndations to the

record show that he voted no as he did not feel that any Council

and Hunnicu~t, Assoc. for the same year, ~r. Bangnman moved that

maintained as Purchasing Agent a~d Tax Assessor, and Assistant

The City Clerk brought to the attention of Council a request
from Paul Eercer for use of the Cotuucil Chambers on January 12th
at 8 P.I~. by the United Fund. ~r. Archie moved that the request
be granted. ~r~ ~iadsen seconded the motion which passed unanimously.
A letter was read from the Chamber of Cormmerce pledgir~ their
support to the new City Co,3mcil.
~. Archie m~~ ed that a resolution be drawn up authorizing
the signatures of the new ~!ayor and Vice-Mayor on checks drawn on
City accounts° Dr. Akes seconded the motion which passed unanLmously.
~. :~cb~le move8 that the City Clerk be instructed to advertise
through p~oper channels for a City Recreational Director, a City
Engineer, and~a City Manager. Dr. Akes seconded tb~ motion ~nich
passed unanimously.
