The meeting w~ called to order by the Mayor at V:30 P.N.
A tribute and praye~ was offered for Judge Edward Glenn, a member
of the Advisory~.Board who had passed away. The Rev. Wm. Johnson,
pastor of the T. znity Lutheran Church of Boynton Beach gave the
invocation.
Minutes of regular meeting held October 19th, 1959 were read
and unanimously approved with no corrections. Minutes of special
meeting held October 30th, 1959, were read and unanimously approved
with no corrections.
One bid for a Trax Oavator was opened and read by the City
Clerk, in the amount of $8500 for one 955 Trax Cavator with
Caterpillar Engine from Carson an~ Clark, !nc., Rocky ~{ount, N. O.
After being assured by the City Attorney that the bid was legal
and proper under the Charter, ~,~r. 0yet moved that the Council
authorize the purchase of the Trax Cavator from the above mentioned
company in the amount of $8500. ~ir. Madsen seconded the motion
h~ch passed unanimously.
A letter, was. read. from the Palm Beach County Council P.T.A.
expressmng apprecmatmon for the use of the City Hall for their
district meeting.
Two letters were read from the Board of Public Znstruction
regarSing· . the~proposed annexation of Seacrest High School property
by ~he.Cmty o~ Delray Beach. The first to the Mayor expressing
appreciation for his attendance and presentation of the views of
Boynton Beach at a meeting on October ~lst and the secon5 addressed
to the Nayor of Delray Beach requesting that they postpone annex-
ation until such time as Boynton Besah has a high school of its
own, n~ch they predicted would be within the next few years.
The Mayor informed those present that the City of Delray Beach
had withdrawn any intent to annex at this t~me.
~_ letter was read from the U. S. Air Force R~crumting~ ' Office
requesting space in the lobby o~ the City Hall ~ ~

purposes. Mr. Madsen moved that the request be granted.
Mr. Baughman seconded the motion which passed unsnimously.

A latter was read from Charles V, Gornitz requesting a lot
set back variance on Lot t, Block 8, Central Park Annex. Er. Cyer
moved that the ov~er be advised that he should make a request of
th~ Zoning Board and accompany that request with a plan for the,
dimensions of the house and the lot lines. Nr. Durkin seconded
the motion which passed unanimously.
A p~t~tlon was read from the BoyntOn Beach Einisterial Assc.
~stating their position on the proposed recreation center.
A letter was read from Allen E. Powell proposing the erection
of signs at the north and south city limits~advertising the City,
and calling the Council's atbention to the need of lighting on
South Federal Eighway from S. E. Zrd Ave. to the southern boundary.
Pursuant to t~s, ~ro Bau~nman moved that the City Clerk be
authorized to contact several sign companies for suggestions and
proposals for signs at the north an~ south city limits. Nr. 0yet
seconded the motion ~nich passed unanimously.
A letter was read from Robert F. Griffith, Attorney repre-
senting William Fiorentino o~er of Lot 22, Crest View, Boynton
B~ach, requesting that the City remove encroaching pavemen~ from
his property. A copy of a survey was enclosed showing the
croac~ment of part of the pavement of S. ~. 23rd Avenue, Boynton
Beach, on his property. Mr. 0yet moved that the matter be referred
to the City Attorney for hLm to hsv~ the encroachment appraise8
and make gr. Fiorentino an offer for the property. ~r. Nadsen
seconded the motion which passed unanimously.
~r. Fruda informed the Council that he was in possession of
the deeds necessar~ for the completion of S. E. ~Srd Avenue from
S~acrest Blvd. to Golf View Road. gr. Oyer moved that the City
Attorney be authorized to record the deeds. ~r. Nadsen seconded
the motion which passe~ unanimously.
A letter was read fr~m Tereesa Padgett, City Clerk,~stating
that she had examined ~nd checked the nominating petitions and
fb-~n8 them to be i~ order of the following candidates for City
Council: Charles D. Akes, John L. Archie, David Davis, James J.
Eahoney, and John H. Rok~s. gr. Eadsen moved that these names be
approved to be placed on the ballot for the coming election for
City Council and that they be placed in alphabetical order.
Er. Baughman seconded the~motion which passed unanimously.
Er. Baughman moved that the following persons be appointed
as election o~ffielals for the coming election: Ers. Joseph Brull,
Clerk, Nr. ~ne Mahlmeistar, Deputy, an~ Nrs. William Dal~
Mrs. Nildre8 Hallier, Nfs. Clifford Rich, Ers. S~ Adams, Sr.,
~rs~ Arthur Hartwig, Ers. Harry LeFort, ~rs. ~illiam V,~ittaker,
and ~r. Tom Dwyer, inspectors. ~r. Eadsen seconded the motion
which passed unanimously.
A recommendation from the Zoning Board was read as follows:
That all of Lots 196, 197, 198, and 199 Cherry Hills, a subd!v_szon'~'
of Boynton Beach, Florida, as recorded in Pl~t Book 4, Page 48,
Public Records of Palm Beach County, Florida; address, N. ~. 10th
Avenue be rezoned for Church purposes. Mr. Baughman moved that
the recommendation be spproved and the City Attorney authorized
to draw up an ordinance covering the rezoning. Mr. Madsen
seconded the motion which passed unanLmously.
A joint meeting of the Pl~nn_ng and Zoning Boards was announced
by Jos. O. Humphrey, Chairman of the Zoning Board, for Wednesday,
November 4th, at V:30
A letter was read fr~a Dominic A. Visconsi, requesting
authorization to pave N. E. 26th Ave. from N. E. 4th St. to the
F.E.Co right-of-way and further requesting that the City enter into
negotiations with the F.E.C. to connect N. E, 26th ~v~. with the
No Federal Highway across the railroad right-of-way, the cost to
be borne by him. Mr. Baughman moved that the Council accept the
proposition aud permit Mr. Visconsi to pave the road at his ex-
pense, the details to be worked out later and that the City Attorney
beauthor!zed' to enter into negotiations with the F.E.C. regarding
the railroad crossing. Mr. Nadsen seconded the motion which passed
unanimously.
A petition for abandonment of an alley which permits passage
from N. E. 4th St. into the proposed shopping center submitted
by Jos. W, H~amphr,y, Attorney for Boynton Pla~a, Inc., was read.
Mr. ~adsen moved that the City abandon the alley any cost incurred
to be paid by Mr. Visconsi. Mr. Baughman seconded the motion which
passed unanimously.
A recommendation from the Planning Bo~d was read. Two changes
in the plat lay out for Golf View Harbor, previously passed by the
Council, as suggested by the F ....w A. office were submitted for
Council approval. D~fter discussion Mr. Baugb~nan moved that the
C. ouncil accept the recommendation of the Planning Board and give
ent~tz~e approval to the revised plat. ~r. Durkin raised two
objections to the plat~ he felt that area for recreational facili-
ties should be provided for in the center of the plat, and that
right-of-way should, be provided for in the 31 continuous lots
bordering on the lateral at the south end of the property. ~r. 0yet
moved t~t any action be tabled until such time as the location
of this plat in regards to the City property is properly shown
and that we know any possible land owuaers between the City prooerty
and this. Mr. Durkin seconded the motion to table. The ~ -

was denied three to two, Mr. Madsen, Er. Baughman and Mayor ~noney~'
voting no. ·
~eturnmng to the Original motion ~hat the plat for road and
lot lay-out be approved, the motion carried three to two, Nr. Oyer
and Nr~ Durkin voting no. Mr. Durkin requested the record show
that he voted no as he falt that the plat was not laid out in the
best interest of the City or of the ~uture property o~aers of the
development. Nr. Ba~Ebman reeuested the record show that he voted
for t~e motion as he felt tha~ the Council should follow the
reeommemdation of the Planning Board.
A request for refunds on plumbing permits issued on houses
never built located in Rolling Green Ridge in the amount of ~130.00
from V. A. Conroy~. President of General ~lumbing~ !nc., was read~
Mr. Ba~ghman moved that the request be denied. Mr. Eadaen seconded
the motion which passed unanimously.
A list ~f accounts receivable which the auditors had recom~ended
~e~g&d off was presentad to the Council by the City ~lerk.
Mr. Eadsen moved that they be turned over to a collection agency.
~r. Baug~hman seconded the motion which passed unanimously.
A list of ~ater Dept. accounts receivable which the auditors
had recommended be charged off was presented to the Council by the
City Clerk. Nr. Baugk~an moved that the accounts be charged off
and that a recor8 be kept of the accounts in the ~ater Department
so that in the event a request for water was received from an
account on the list, an attempt could be made to collect the bad
debt. N~. ~adsen seconded the motion ~nich passed ~uanimously.
A list of unpaid personal property taxes which the auditors
had recommended be charged off was oresented to the Council by the
City Clerk. ~r. ~adsen moved that they be turned over to a
collection agency. Mr. Baug~an seconded the motion which p~ssed
unanimously.
A letter was read from O. R. Cierpik, Ci~.Treasurer, request-
ing permission to charge off bad checks tot~i-{n~-$10$.00. ~r. Oyer
moved that the request be granted. Mr. Baughman seconded the
motion which passed unanimously.
A resolution on fees to be charged for the collection of garbage
at commercial establishments was read for Council approval.
Nr. Baughman moved that it be approved. Mr. 0yet seconded the
motion which passed unanimously.
Pour resolutions designating a depository for e portion of
City Funds was read by the City Clerk. ~r. Durkin moved the
adoption of the resolutions. Nr. Baughman seconded the motion
which passed ~uanimously.
The building report for the month of October was read. Total
building permits issued was ~,~89o
A request for a temporary septic tank installation from
Carroll Builders, Inc., to be located on Lot 5, Block ~0, Rolling
Green Ridge 1st Addition was read. Nr. Eadsen moved the request
be granted. ~r. 0yet seconded the motion which passed unanimously.
A request for a temporary septic ta~ installation from
Riley Builders Corp., for Lot 51, Block 21, Rotlmng' Green Ridge
1st Addition was read. Mr. Oyer moved that the request be granted.
Mr. Durkin seconde8 the motion which passed unanimously.
The Chief of Police ~ea~ested permission to advertise for
bids on a motorcycle to be used in his department. Mr. Nadsen
moved that the City Clerk be authorized to advertise for bids fox
the motorcycle upon specifications being submitted by the Chief
of Police. Nr. Baughman seconded the motion which passed unani-
mously. .
The Supt. of Public ~orks asked for permission to advertise
for b~ds for fencing around the well field at So E. 15th Ave.
Mr. Oyer moved that the City Clerk be authorized to advertise for
a chain link fence to go ar~and the well field. Er. ~adsen
seconded the motion which passed unanimously.
There being no further business the meeting was adjourned at
