During the public half hour a plat was~esented to the Co~mcil by PM. ~tl!i~m i~J~ler for property o~n~ed by him on South Seaerest Blvd. ~'~. Cummings inquired a~oUt the ~*ater supply in Rolling Green Ridge. Mayor Mahoney informed him that a report from the e~gineers was soon fore,- coming on water. I~. Thcu~s .Dwyer asked about lighting in ~%oyal Pa]an Village. ~. 0yer gave a report on the -~ork ef the l~hting committee and told M~. D~yer ~hat Royal ~ Village lighting ~as in the initial report of the Co~- ~ tree. ~Eu~_ene ~odbee asked the C~ttucil about acquiring a taxi permit, and was Lurched that the City had a franchise ~fith s~ individual and unless it proved %/uat the service was not adequate~ another permit could not be issued. The Nayer asked for the Council's feelings on investigating a~c~.~ing some County land in the south end of the City to be used for recreat~-onal purposes. The Council gave the ~yor permission to write to the Co-o~ty and in~re if there is andy l~nd available. The ~V~yor notified al! dep~?~ment heads ~o start preparing their budgets for fiscal y~ar 1960~ c~tis ~nLng th~m ~o be extremely careful in that ~ items w~ald be carefully scrut~zed by the Council. A Citation from the American Legion for ~J~orious Service by the City of Boynton Beach w~s brought to the ~ttentlon of those present. ~z~. Field. 1.~. Oyer reeved that the Mayor be authorized to contact ~. Fields to ascer- tain if he is going along with the request of the County Com~ ssioners ~nd, if not, endeavor to arrange a meeting ~ith ~. Ben S~udy~ County Ms. Field, Mr. Niddleton, County Engineer~ and the Council. 1~. ~au~n seconded the motion ~Ynich c~rried uu~nimously. A letter was read from the Civic League of Bo~nton Beach, requesting the City to demolish outhouses in the colored section. After discussion, PS. Baughman moved that this m~tter be turned over to the Plumbing Inspector ~ a report made by him as to the ac~al conditions and violations of existing ordinances. P~. F~dsen seco~ied the motion which passed unanimously. Another letter from the Oivic League was read re~esting that the registration books be made aw~ilable in their area on ~y 8 and 9 from 5 p.m. to 9 p.m. and I p.m. to 7 p.m. respectively. ~. Nadsen m~ved end Mr. Oyer seconded the motion approving this which passed unanimously, copy of a letter was read from the Florid~ State Board of Hee~l~ to ~_llism C. Hal!, Seoretaz~, Lske Bo~noon ~st~tes, Inc.~ regarding ~e~-~ge dmspos~ ~usw~t~tions ~ ~hat sub-divms~ons. A letter ~as read regar ~ding rubbish and g~rb~ge trucks being parked at 3020 E. Pslm Dr., City. ~r. Oyer ~Tormed the Council that the owner of the p~operty had been contracted ~ud had told him that he would cooperate in any way possible. request From Boy, ton Beach V.F.W. Post #5438 for use of the Council Chambers on ~y iSth, was grated by m un~ ~nmmous vote of the ~ouncil. A letter was read from the Bo~nton Beach Elementary P.T.A. thanking the City for ~ on the school playground. -2- A letter was read from L~ke Lytal, Commissic~er of Pa]~ Beach County informinE the Council that bids for the Boynton-Se~crest Blvd. bridge wo~ld be received on May ll by the County Commissieners. At the written request of the ~merican Legion .~!ia~y, Nr. Oyer moved that a resolution be passed establiehin~ a permanent ~ Poppy Day on Friday and Saturday prior to Nemori~l Day each year. Mr. Durkin seconded the motion which was ~u~mimously passed. Mr. Fruda was asked to read Ordinance #32-I for the first readiz~. Mr. Frud~ advised the 0ouncil that a new system of numbering ordin~u~es had been ~stab!ished subject to the approval of the 0ouncil, which wo~ld utilize the year ~ud the ~ of ~he ordiuance passed in ~ respec.t~ive year. Us~ this as a basis this ~nce would be ~59-1. The C~o~cil acquiesced te this n~m~be~ system and l~r. ~ read the ordSr~, on zoning Lets ~ to 12 inclmsive, R. S. Nerritt Sub. Div. Mr. Madsen moved it be approved on first reading. Mr. Ban~ seconded the motion which passed unsmtmonsly. NE. Fr~da gave the Council a report on the d~molishing of ~mmildinge in the colored section which the previous Council had condemned. In his report he said that any action, legally advisable, would 'be expensive to the City. ~*ter discussion, t~. Madsen moved that the ~ners of the property be contacted and asked to demolish the buildings or give the City permission to do so. ~&-. Baughman seconded the motion which passed unanimously. A resolution regarding delinquent taxes in the amount of $6,084.61 read. Mr. Durk~ moved that the resolution be approved and that the Nayor and City Clerk be authorized to sign the resolution and that it he published in the newspaper. ~r. ~Isen seconded the motion which passed u~o~sly. ~he Mayor ~oz~ed the Ccuncil that the Chain of title of property owned by the City since 1939 had been completed and was now in the hands of the auditors. The cost of this Chain of Title was $985,00. A written opinion from t~he City Attorney om a contract between N. t~. Field and the City of Boynton Beach dated December 19, 1958 on ~ter Re£und- lng Agreement w~e read. The opinion stated in effect that the contract is unenforceable. M~. M~dsen moved that Mr. Field be notified that the City has no rei~zuding policy on subdivisions and that any ~ction t~ken by him in adding ~at~r lines in Rolling Green Ridge 1st ~i~ion will be his full responsibility and expe~ nSe. ~. 0yet mo~ed that the motion be amended to the effect that the Council accept this report of the City Attorney and t~bat ~ meeting be set mp ~th Mr. Field to discuss~ the ma~ter. ~. The recommendations were read and included the following: That all new construction work be ~n~t~]~ed with 100% E.I~TZ or ridged conduit, that ex~inations for Naster Electrioi~us be given every three months, that all receptacles ins~ on new construc- tion work be of the-gro~mded type. ~r. B~ughman moved that the recOmmen~tation be approved. Mr. Madsen seconded the motion which passed' un~ously. A letter.was read ~igned by Geo. H. Roberts, B-~i]ie M. Young, Ida ~e Smith, ~-~e ~Wriel~ and Ed~zrd Jnng, asking the Council to a~end the sign ordinance and delete t~t portion dealing ~th res~ estate signs. Baughms~ moved that the~ sign ordinance now in affect be amended and that portion relating to real estate signs be deleted. ~ir. ~dsen seconded the motion. ~. The Council scheduled a meeting with the Advisory Board to go over the report on Railroad C~ossings and Remedies Therefor for S~turday, A request for a tax refund to Shera Smith of 1536 N. Seaorest B~±vd. of $40.85, was approved by a motion by Er. ~dsen, seconded by ¥~. Baug~n~u and ~ly passed, It~was pointed out that the square footage she had b~e~ged for was in error. The b~lding report for the month of April was read shoving total b~din~ permits issued of $564,494.00. The Tax Collector's Eeport was read and noted. P~co~m~ud~tions from the Bo_tiding Board were read. Er. Oyer suggested that this report be accepted and ~en under advisement and ~ meeting ~ith the Board be set to go over the report. A meeting was scheduled for Nond~y ever~, at 7:30 p.m. A complimentary letter ~as read address to the Pelice Department z~rom the American Legion. The Police Dep~rtment and Fire Department monthly reports were read. ~r. Oyer moved that the City Clerk be instructed to send a formal letter to the owner of the property known as the Eirsoh Track and also owners of lots on ~. E. 8th Ave., that those properties that are ~it~Lu 100 feet of any residence h~ving a growth of six feet and over, if not cleared within thirty days, will be cleared by the City and the owners billed~ sending along a copy of the ordinance dealing with this. ~. ~dsen seconded the motion ~nich passed unanimously. Mr. Grootenboer gave a deiailed report on the Public ~orks Department in which he suggested that Mm. Stone be sent to Water Short Course in Gainsv~te, Florida, in J~ne and that he be given $75.00 for e~penses. ~. ~ughman moved that Mr. Stone be sent. F~.
