When Congress passed the ADA (Americans With Disabilities
Act) , their intent was to remove the barriers that deny some
43 , 000, 000 individuals with disabilities and equal opportunity to
share in and contribute to the American Way of Life. The ADA was
designed to help provide access to ,fobs, public accommodations,
Government services , programs , public transportation and
communication.
The City of Boynton Beach, through its Capital Improvements
Program, has for the last five years , built and remodeled city
facilities not only in accordance with minimum State Regulations ,
but also with the intent to provide reasonable accommodations to
its services , programs and activities for the public and its
employees .
Title II of the Law addresses these areas in detail and sets
out dates by which items of compliance must be completed.
The City' s ADA Committee has split these tasks up and
completed those checked off or are in the process of completing
those asterisk items . The remaining items are dependant on the
completion of the transition and self evaluation plans .
By January 26 , 1992 -
J Appoint ADA Coordinator (Required if 50 or more employees )
Adopt Grievance Procedures (Required if 50 or more
employees )
* Review, modify, and/or create job descriptions that conform
to the ADA
• Review, modify, and/or create application and testing
procedures ( including medical and drug testing requirements )
that conform to the ADA
• Review and modify sick leave policies , health insurance, and
smoking policies for compliance with ADA

Develop handbooks, manuals, posters , and similar
announcements to inform, the public of the rights and
protections afforded by the ADA
Place required signage in and around facilities indicating
nearest accessible facility or service
Obtain and install TDDS for 911 and emergency communications
Obtain TDDS for other offices that have regular telephone
contact with the public.
Begin self-evaluation and Transition plans :
1 . Assign task to responsible employee( s ) ;
2 . Notify public and invite participation by disabled
persons;
3 . Appoint advisory committee;
4 . Examine every program, service, and facility
( including leased facilities and services provided
by contractors) .
By July 26, 1992

By January 26 , 1995
All changes identified in Transition Plan must be fully
implemented.
Section 35 . 150 states
a. A public entity shall operate each service , program, or
activity so that the service, program, or activity, when
viewed in its entirety, is readily accessible to and
usable by individuals with disabilities .
It does not necessarily;
( 1) require a public entity to make each of its existing
facilities accessible to and usable by individuals with
disabilities;
2
(2) Require a public entity to take any action that
would threaten or destroy the historic significance of an
historic property; or
(3 ) Require a public entity to take any action that it can
demonstrate would result in a fundamental alteration in the
nature of a service, program, or activity or in undue
financial and administrative burdens . In those
circumstances where personnel of the public entity believe
that the proposed action would fundamentally alter the
service, program, or activity or would result in undue
financial and administrative burdens, a public entity has
the burden of proving that compliance with 35 . 150 (a) of
this part would result in such alteration or burdens . The
decision that compliance would result in such alteration or
burdens must be made by the head of a public entity or his
or her designee after considering all resources available
for use in the funding and operation of the service,
program, or activity, and must be accompanied by a written
statement of the reasons for reaching that conclusion. If
an action would result in such an alteration or such
burdens, a public entity shall take any other action that
would not result in such an alteration or such burdens but
would nevertheless ensure that individuals with disabilities
receive the benefits or services provided by the public
entity.
(b) Methods . ( 1 ) General . A public entity may comply with
the requirements of this section through such means as
redesign of equipment, reassignment of services to
accessible buildings , assignment of aides to beneficiaries ,
home visits, delivery of services at alternate accessible
sites , alteration of existing facilities and construction of
new facilities, use of accessible rolling stock or other
conveyances , or any other methods that result in making its
services , programs , or activities readily accessible to and
usable by individuals with disabilities . A public entity is

not required to make structural changes in existing
facilities where other methods are effective in achieving
compliance with this section. A public entity, in making
alterations to existing buildings , shall meet the
accessibility requirements of 35 . 151 . In choosing among
available methods for meeting the requirements of this
section, a public entity shall give priority to those
methods that offer services , programs , and activities to
qualified individuals with disabilities in the most
integrated setting appropriate .
The required Transition Plan must be completed by July 26 ,
1992 and indicate all structural changes that would be needed to
fully comply with the ADA accessibility guidelines .
The Project Management Department has completed inspections
of all city facilities noting these requirements, the work needed
to correct them and a rough estimated cost.
The following (31 ) buildings were included in the Transition
Plan and inspected using the attached reference checklist.

In addition a self evaluation study will provide
information on five other areas of changes :
1 . General building changes , ie; signage, communication,
service access , public notices , circulation.
2 . Site - Changes to parking lot layouts , striping,
curbing, walkways and ramps . Specific requirements for
providing curb cuts on all city streets with priority
to those serving public facilities .
3 . Parks Facilities - Modification of paths and walkways ,
playground equipment, picnic tables , grills etc,
bleachers , docks and boardwalks and others .
4 . Employee Areas - Inspections to confirm accessibility
around desks and furniture, service area usage,
lounges , files and equipment. As required, needed
changes to work space equipment (desks , chairs etc,
will be considered) .
5 . Programs - Modification and changes to programs and
services to make sure they are accessible or that an
alternate means is available.
As noted before, the items listed and price estimates are
for major or structural changes and accessory items needed to
make the building and public areas of buildings fully accessible .
Where it was considered physically or financially unreasonable to
make the change, the notation TF is noted.
The total estimated cost for these transitional changes is
$28 , 810 . 00 .
To complete the plan, a schedule must be developed,
specifying the steps and dates each item of compliance will be
met.
