AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER II OF THE CODIFIED ORDINANCES OF SAID
CITY BY ADDtNGTHERETO SECTION 2-10.1 ENTITLED "SAME--
ASSESSMENT FOR L~W ENFORCEMENT EDUCATION"; PROVIDING
FOR A ONE DOLLAR ($1.00) ASSESSMENTAS ADDITIONAL COURT
COSTS AGAINST EVERY PERSON CONVICTED BY M~ICIPAL COURT

WHEREAS, Section 23.103, Florida Statutes, provides that
every court created by the Florida Constitution or by legislative
act shall assess One Dollar ($1.00) as a court cost against
every person convicted for violation of a state~ penal or criminal
statute or convicted for violation of a municipal or county
ordinance; and
WPLEREAS, Section 23.105, Florida Statutes, provides:
"Municipalities and counties may assess an additional One Dollar
($t,00) as aforesaid, for law enforcement education expenditures
for their respective law enforcement officers."; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has determined that said assessment will assist in
alleviating the financial burdens in providing for law enforce-
ment education and training of police officers for the City of
Boynton Beach, Florida:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Chapter II of the Codified Ordinances of
the City of Boynton Beach, Florida~ is hereby amended by adding
Section 2-10.1 which shall read as follows:
"Sec.~ 2~10.1. Same--Assessment for Law Enforcement
Education.
(a) The Municipal Court of the City of Boynton
Beach shall assess One Dollar (SI.g0) as additional court
costs against every person convic~ for violation of a
municipal ordinance as-~authorized~by~-Secticn-2~l~ of

court costs established in this section shall be segregated
from all other funds of the City and set apart by ~he
Finance Director in a separate fund to be known and desig-

Section 2. Authority to Codify: Specific: authority is
hereby granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 3. Separability: Each of the provisions of this
Ordinance are separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4. Repe~aling Provision: Ail ordinances
of ordinances in conflict herewith are hereby repealed.
