ORDINANCE NO. 74-~3- AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 61 OF ARTICLE IV OF THE MUNICIPAL CHARTER OF SAID CITY TO PROVIDE FOR THE DISCONTINUANCE OF TI~E REQUIRF2~ENT FOR THE CHIEF OF POLICE TO ATTEND ALL REGULAR ~ET1NGS OF THE CITY COUNCIL OF SAID CITY; FURTHER P~©V!DING FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS~ the City Council of the City of Boynton Beach, Florida, deems it advisable and necessary for the efficient operation of the municipal government to discontinue the requirement for the Chief of Police of said City to attend all regular meetings of the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Section 61 of Article IV of the Municipal Charter of is hereby amended by meetings of the City the City of Boynton Beach, Florida, be and deleting the words "to attend all regular Council" from said section in order that said Section 61 of Article IV of the Municipal Charter shall read as follows: "Sec. 61. Same--Duties. It shall be the duty of the Chief o~ Police to aid in the enforcement of order under the directions of the Mayor~ and the City Council; ~o execute a!tlpap~Es. and process (processes) of the city or its authorities; to attend Municipal Court during its sittings; to execute its commands and to aid in the enforcement of order therein; and to perform such other duties as may lawfully be required of him. Subject to the commands of the Mayor and the Council, the Chief of Police shall have control of the police force." Section 2: Authority to Codify: Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing Code. Section 3: Separability: Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any portion thereof shall ben,declared ~invatid, the. remaining~portionlshall net.~ affected but shall remamn in full force and effect. Section 4: R epea~llng Provision: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Sect'iOn 5: An Effective Date: This Ordinance shall become effective in the manner and at the time provided by law. First reading this ~-~ day of September, 1974.
