No questions were asked regarding them. A letter was read from ~. J.H.Robinson requesting the transfer of the beer and wine license for the Palmetto Market from the name of Ray Zompa ~o his, as the new owner. U~. Hood made a motion, seconded by l~r. Shook, that the request for thetransfer of the Palmetto Market beer and wine license from the name of Ray Zompa to that of ~,~.Robinson be granted. Eot ion passed unanimously. The building inspector's report for the month of February ~as read. A letter was read from the Atia~tic and Gulf C~.anats Association advocating making a defencs area of the coast from Jacksonville to Key West. A recommendation by ~layor Purin~on that a Resolution be drawn uo setting aside tbs area indicated as a defence ares was unsnim~usly approved. Mr. Johnson said the question of civil defence, after having bean quiet for some time, was again becoming active. A sample chair rgbeived from Jacksonville was examined. The price was $3.75 single and $3.60 in lots of fifty. ~. Shook mo%ed that fift~ chairs be purchased a~ the price of $3.60 f.o.b. Jackson-~_lle. Mr. Fredrich seconded the motion which was passed unanimously. There was a long discussion o~ valves v~th special refer- ence to s shut-off valve in the middle of Pin~ Street, which, -3- being above street level, is a traffic hazard. I~r. Van Wagner was instructed to check on this valve. He said it ~ould not be easy go change the level because of the rock beneath the valve. It was agreed that some of the CommissiOners would make an inspection of the valve tomorrow. The Mayor stated that any pipe being replaced on the other aide of the Canal on account of a small leak wo~ld be paid for by Ocean Ridge. He added that Mr. Brockway had inserted ~ clause in the water co~tract calling for a penalty of $25 a day for delays; that the delay experienced by ~.Cromer had been due to strikes of the Pipe CompanLmakir~ pipe hard to secura, and-suggested that under the circumstances the penalty be waived as no ex- pense %o the City has been involved. ~. Shook moved an~ Mr. Fredrich seconded that s day penalty be waived and the clause referring to it be withdrawn from the contract. Motion passed unanimously. ~r. Johnson, in connection with the tax complaints, said ~fr.Harless was only interested in the valuation. He suggested thaz some enquiry should be made as to whether taxes, where complained of, are too high in certain cases, mud added that everybody who had made a complaint is expecting the ~% discount. Batches of cards returned by ~.Harless were presented; one batch contained cards in which no changes had been madam- mended, one in which certain changes had been made in valuation, and another on which the covering note said that as the altera- tions on the cards had been made by the Council he did not feel at liberty to take any further action on them. The >Zayor suggested a special meeting at which tax matters only would be discussed, and Tuesday, ~arch ll, was fixed as the date for su3h meeting. Mr. Har iess was to be notified in order that he could be present. There was a long discussion on the subject of a sign at the Top Hat which was said by neighbours to be causing a road block, in the course of which a request was made for a street to be made in the vicinity. The Mayor said the streets there were not City streets; that there was no plat, and the County Commissioners would not accept any street less than fifty feet W_de. He said the matter would have to be turned over to the legal department to find out how far a man can go on his own property before the City Co~missioners could do anything about it. Mr. Griffith said he would like to have more details and time to look into the matter before giving an opinion. ~. Purinton said they would go down and look the situa- tion over. He cited the Mango Court case which proved that anyone advertising his own goods on his own property is within his legal rights. ~. Hood said that in the matter of the street requested the property owners could ge~ together and have the street widened; that it will have to be paved before it can be accepted by the City, and that the cos~ will fall on the properDy owners. One man suggested the propervy owners close the street up entirely in the interests of safety as there is a fifty foot wide street available nearby. The Mayor said the Commissioners will be gla~ to do anything they can to eliminate hazard, but they canno~ go on private property, and they have no right to close the street. The colored man, Eddy Giltison, said he had looked at the lot offered by Mrs.Klemons as a swap for his own lot and had decided to accept it. Mr. Griffith asked him to take such papers as he has to his office tomorrow, saying he would get in touch ~th [~s. Klemons to F~ke the final arrangements. ~r. Hood made a motion, seconded by ~r. Weaver, that the 50 foot lot be purchased from ~;rs.Klemons for Er.Gillison in exchange for the lot he owns on ~ells &venue. ~otion passed unanimously. The ~ayo.r reported on the inspection offered by ~rs.Elemons, saying it had been for a playground and reccmmended buying it. of the property found most suitable ~. Shook made a motion, seconded by l~.Hood, that~the City purchase the l& lots @ $1,200.00 offered by ~rs.Klamons as a site for a playground and park for colored children, and also take an optio~ on the 12 lots mentioned in her letter of February,7, 1952. ~otion passad unanimously. The matter of a plumbing code was brought up and the spokesman of a delegation of plumbers present asked whether they could have a revised code, saying that Delray has already adopted the new State Code, and suggesting it be adopted by Boynton. He said ~n examination board should be set up. It was suggested that an Examination Board of five members be set up. The Commissioners a~pointed ~Ar.Shook to serve on the Board, together with Mr. Greenwood, Jim Priest and Charlie ~itman; ~Y~r.Johnson was appointed as an outside man. It was agreed that plumbers already r- 4 ' p act~slng in the City should not have to take the examination, but that all newcomers must take it. In discussing an electrical ~o~ Mr.Hood Worth had a better and simpler one than Delray, Electricians here would like that code adopted He suggested getting in touch with~r.Bowen. said Lake and tha~ in Boynton. Nr. Griffith wes asked to draw up au Ordinance covering the Plumbing Code to be read for the first time at the nex~ regular meeting of the Council. He was also asked to get in touch with ~gr. Bowen tomorrow so that he could draw up an Ordinance covering an Electrical Code at the same time. before Mr. Griffith said the City Clerk should be instructed that in the meanwhile no license should be granted to plumbers or electricians, not already practising in the City, they have taken the necessary examination. it was svated that the questionnaire for the plumbing examination was already prepared, the New York one having been used, and that copies of the proposed code could be bought for ~1.25. Weaver brought up the price of the 2½ acres on which ~r.Claughton had said he had an option. ~. ?urinton said there was no option on the property and recommended that the Council decide on the price. ~r. Hood did ~up the property on to be used. no~ think the Commissioners should hold account of the business for which it was Mr. Shook said it was up to the Coumcil to make a price instead of asking the man to make an offer. After long discussion the price of $2,750 was agreed upon~ with the stipulation that the propersy musz be used in conjunction with s super market food store.~=J ~a%c~ ~r. Fredrich said that %~. Bedford Jones, Smuitary Officer, had intended to be present at this meeting to discuss sanitary matters, but was prevented. He reported that he had followed the garbage truck round the streets for a whole week, and had found some conditions very bad. In some eases ~arbage was put out in pas~e board boxes which fell to pieces when picked up. Some garbage is picked up by private people at intervals of four or five days, which makes it a job for the -6- Health Department, and not for the Commissioners or D ~ apartment. Some of the restaurants allow private to pick up their garbage for sale. the Police individuals Y~r. Purinton said that in these cases such individuals should be notified that garbage must be picked up every day, excepting Sundays. Er. Fredrich suggested on the matter and having the Street Department had ~oaned the City is well covered. looking up the City Ordinance regulations enforced. The a truck and a man, and most of it was agreed that the public should Be notified through an advertisement in the local paper that, after March 15, metal containers with metal covers would be obligatory; that any garbage containe~ which does not comply with this order ~ll_, after that date, be taken away w~th the garbage; that in case of non-compliance, offemders will be reported to the Health Department and be prosecuted ~nder the City 0rdinanse. ~'~. Griffith said that in some cities ~ red ticket was attached to unsuitable garbage containers notifying the o~mers that if the container is used again it will be carried away with the g~rbage, He was asked to have a supply cf such tickets printed.
