Minutes 03-10-16 , I MINUTES OF THE RED LIGHT CAMERA HEARINGS HELD IN COMMISSION CHAMBERS CITY HALL, 100 E. BOYNTON BEACH BLVD, BOYNTON BEACH, FLORIDA, ON MARCH 10, 2016, AT 9:00 A.M. James Stokes, Special Magistrate Shana Bridgeman, Assistant City Attorney Gwen Mills, Traffic Clerk Anthony Petriello, Traffic Infraction Enforcement Officer Officer Anthony Verrigni, Traffic Infraction Enforcement Officer 1. Call to Order: Mr. Stokes called the Red Light Camera hearings to order at 9:05 a.m. Mr. Stokes explained he is the Special Magistrate, appointed per Statute to hear Red Light Camera violations. He is not a judge and his authority is restricted per Statute to uphold or dismiss the citation. Individuals challenge the legality of the program. In order to challenge the citation, the violation has to be heard in Circuit Court, but all administrative remedies must be exhausted first. Mr. Stokes will put the arguments on the record in preparation of challenging the program in court. Mr. Stokes advised the Officers that issued the citations were present in Chambers working the computer monitors. All parties will see the same images at the same time. Mr. Stokes would review the evidence for the first time at the hearing. The program is a civil violation against the vehicle, and the first name on the registration is sent the notice. If the owner was not driving, the owner could submit an affidavit identifying the driver and the violation would be reissued to that driver. He explained there is a fee for the citation and a hearing fee. He could waive the hearing fee if the owners change their plea before the case is heard. Mr. Stokes requested anyone wishing to change their plea to come to the front of the Chamber and pointed out the citation, if upheld, does not affect insurance rates. It was more like a parking violation than a moving violation. Mr. Stokes explained the City bears the burden of proof and the Officers would present their case first. 2. Amendments to the Agenda 3. Swear in of witnesses The Minutes Specialist administered an oath to all those testifying. 5. Violation Hearings: Failure to comply with a steady red signal. Stanford Schaffer Notice No. 1851500153031 Anthony Petriello, Traffic Infraction Enforcement Officer, reported on November 9, 2015, at 2:28 p.m., a vehicle registered to the violator was travelling westbound on W. Woolbright Road at S. Congress Avenue in the number one lane. After a review of the electronic evidence, a Notice of Violation was issued on November 16, 2015. Officer Petriello submitted an evidence pack for this case and a video and packet for all the cases being heard at the hearings to Mr. Stokes. Mr. Stokes accepted the evidence. Messrs. Stokes and Schaffer viewed the video and still photographs. Mr. Schaffer advised he is 84 years old and he had been driving since he was 16. He contended there must be other evidence in the photograph they do not see. Running a red light was not his style and he drives too slow. Mr. Stokes advised the video showed a violation occurred. Mr. Schaffer asked how it was determined his car ran the light and Mr. Stokes responded the camera takes an image of the license plate. Mr. Stokes had a still picture and video as evidence and he noted Mr. Schaffer was a full second behind the stop bar. Mr. Stokes advised he should pay the citation. No points would be assessed and his insurance would not increase. Mr. Schaffer could obtain a copy of the recording and take it to court as the first step in the appeal process. Decision Mr. Stokes upheld the violation, assessed a fine of$243 and advised he had 30 days to pay or appeal the decision. Karen Cooper Notice No. 1851600014893 Officer Petriello explained on January 3, 2016, at 11:33 a.m., a vehicle registered to the violator was travelling eastbound on W. Woolbright Road and SW 8th Street in the number three lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on January 15, 2016. He had an evidence packet he submitted to Mr. Stokes. Ms. Cooper and Mr. Stokes viewed the video and still photographs. Ms. Cooper explained at the time, she had just arrived in Florida to help care for an elderly relative and was unfamiliar with the area. She used her navigation system, there was an incline and the light was yellow. She sought to go through rather than slam on the brakes. She has since revisited the intersection to understand the traffic flow and asked for a dismissal as the fine would be a great financial burden to her. Mr. Stokes appreciated her becoming familiar with the intersection. The yellow light was 4.5 seconds which was longer than the State required and he noted her speed was 55 mph. The posted speed limit was 40 mph and he mentioned she was behind the stop bar when the light was red Decision Based on the evidence, Mr. Stokes upheld the citation and gave 30 days to pay. Douglas Wayne Mattocks Notice No. 1851500168385 Linda Mattocks, the driver of the vehicle was present. Officer Petriello mentioned on November 28, 2015, at 12:15 p.m., a vehicle registered to the violator was travelling southbound on S. Congress Avenue at W. Woolbright Road in the number two lane. After a review of the electronic evidence, a Notice of Violation was issued on December 14, 2015. The evidence pack was given to Mr. Stokes. Mr. Stokes and Ms. Mattocks viewed the video and still photographs. Ms. Mattocks commented there was an officer waving her and others behind her through the intersection as there was an accident. She did not want to turn onto Woolbright Road. Mr. Stokes reviewed the video again and explained there was an exception to the Statute. Although it looked like the Officer's hand stayed by his side, there was a lot of confusion. Decision Mr. Stokes dismissed the citation due to the circumstances. Richard Alan Gilligan Notice No. 1851500184200 Anthony Verrigini, Traffic Infraction Enforcement Officer, advised on December 16, 2015, at 12:01 p.m., a vehicle registered to the violator was travelling southbound on NW 8th Street and W. Boynton Beach Boulevard in the number two lane. After a review of the electronic evidence, Officer Verrigni issued a Notice of Violation on December 23, 2015. He submitted an evidence pack to Mr. Stokes. Messrs. Stokes and Gilligan viewed the video and still photographs. Mr. Gilligan advised the intersection was upgraded late last year, and there are four lights for three lanes. In his lane, the second light from the right was green, but the light to the right was red. Mr. Gilligan asserted the lane had always been a turn lane and always been governed from the second light from the right. He questioned which light he was supposed to obey. No one from other side was moving. Mr. Stokes advised an arrow always trumps a green light. Decision Mr. Stokes upheld the citation and gave 30 days to pay. Mr. Gilligan thought it was extremely unfair. Pamela Alayne Brewster-Owens Notice No. 1851500159194 Officer Petriello indicated on November 16, 2015, at 7:49 p.m., a vehicle registered to the violator was travelling southbound on NW 8th Street and Boynton Beach Boulevard in the number two lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on December 4, 2015. He submitted an evidence pack to Mr. Stokes and Mr. Stokes and Ms. Brewster-Owens reviewed the electronic evidence and still photographs. Ms. Brewster-Owens commented she received the ticket on November 16 and she had gotten the car November 8th. The car has an automatic shut-down system she was unfamiliar with. She got the car to go, but could not stop because of the car behind her. She indicated she was not going to make a sudden stop or cause harm to anyone else. Mr. Stokes understood new cars had various computer systems. She was travelling under the speed limit and had a four second yellow light. He reminded her yellow lights are a warning to stop and pointed out she was behind the stop bar when the light was red. Decision Mr. Stokes upheld the violation and gave 30 days to pay. Ms. Brewster-Owens reiterated the car shut down on her a few times and she did not want to cause harm. Mr. Stokes explained there is an expectation that drivers know how to safely operate their vehicles and it was not a defense for the citation. Jeffrey H. Kurzius Notice No. 1851500154781 Officer Petriello commented on November 11, 2015, at 9:48 a.m., a vehicle registered to the violator was travelling eastbound on Boynton Beach Boulevard and N. Congress Avenue in the number three lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on November 23, 2015. He submitted an evidence pack to Mr. Stokes and Messrs. Stokes and Kurzius viewed the video and still photographs. 4 1 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 10, 2016 Mr. Kurzius advised he had just moved from New Jersey and intersections are different between Florida and New Jersey. The light was just changing from yellow to red and he had to decide whether to slam on the brakes or continue. He thought it was safer to proceed. Mr. Stokes noted the light was yellow for five seconds which gave ample time to stop. Mr. Kurzius reviewed the video again. Decision Mr. Stokes upheld he citation and assessed a fine payable in 30 days. Josue Jean Fort Notice No. 1851500132894 Officer Verrigni commented on October 15, 2015, at 2:27 a.m., a vehicle registered to the violator was travelling westbound on Woolbright Road and Congress Avenue in the number two left-turn lane. After a review of the electronic evidence, Officer Verrigni issued a Notice of Violation on October 22, 2015, and noted the red light time was 63.5 seconds. He submitted an evidence pack to Mr. Stokes. Messrs. Stokes and Fort viewed the video and still photographs. Mr. Fort explained there are multiple drivers and he did not know who was driving. Mr. Stokes explained unless he could identify the driver, the violation falls on the owner. Decision Mr. Stokes upheld the citation and gave 30 days. Josue Jean Fort Notice No. 1851500131730 Officer Verrigni reported on October 14, 2015, at 1:47 a.m., a vehicle registered to the violator was travelling westbound on Woolbright Road and Congress Avenue in the number two lane. After a review of the electronic evidence, Officer Verrigni issued a Notice of Violation on October 21, 2015. The red light time was 119.7 seconds. He submitted the evidence pack to Mr. Stokes and Messrs. Stokes and Fort viewed the video and still images. Mr. Fort explained the circumstances were the same as the prior case. Decision Based on the evidence, Mr. Stokes upheld the violation. Josue Jean Fort Notice No. 1851500132340 Officer Petriello explained on October 11, 2015, at 3:09 a.m., a vehicle registered to the violator was travelling westbound on West Woolbright Road and S. Congress Avenue in 5 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 10, 2016 the number two lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 22, 2015. He submitted an evidence pack to Mr. Stokes noting the red light time was 225.4 seconds. It appeared the driver may have been following someone. Decision Mr. Stokes upheld the citation and gave 30 days to pay. He explained if the citations are not paid within 30 days, a hold would be put on the vehicle registration. He recommended paying the fines as soon as possible. Karen T. Prince Notice No. 1851500174177 Officer Verrigni advised on December 5, 2015, at 7:05 p.m., a vehicle registered to the violator was travelling southbound on S. Federal Highway and SE 23rd Avenue in the number three straight lane. After a review of the electronic evidence, Officer Verrigni issued a Notice of Violation on December 15, 2015. He submitted an evidence pack to Mr. Stokes. Mr. Stokes and Ms. Prince viewed the video and still photographs. Ms. Prince commented she was lost and it was raining. Decision Based on the evidence, Mr. Stokes upheld the violation. Luisa Veronic Landucci Notice No. 1851500124925 Officer Petriello commented on October 5, 2015, at 10:27 a.m., a vehicle registered to the violator was travelling southbound on N. Congress Avenue at W. Gateway Boulevard in the number two lane. After a review of the electronic evidence, Officer Petriello issued a notice of violation on October 13, 2015. He submitted an evidence pack to Mr. Stokes. Mr. Stokes and Ms. Landucci viewed the video and still photographs. Ms. Landucci had no comment. Decision Mr. Stokes upheld the violation and gave 30 days to pay. Melchor Anon Feliciano Notice No. 1851500166017 Jan Feliciano was present. Officer Petriello explained on November 25, 2015, at 4:06 p.m., a vehicle registered to Melchor Feliciano was travelling southbound on NW 8th and W. Boynton Beach Boulevard in the number one lane. He submitted an evidence pack to Mr. Stokes. Mr. Stokes and Ms. Feliciano viewed the video and still images. Ms. Feliciano was present and advised she would appeal the matter in 30 days. Decision Mr. Stokes upheld the citation and gave 30 days to pay or appeal. Shantel Terrell Smith Notice No. 1851500123927 Officer Petriello advised on October 3, 2015, at 5:30 p.m., a vehicle registered to the violator was travelling eastbound on E. Boynton Beach Boulevard and N. Seacrest Boulevard in the number three lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 8, 2015. He submitted an evidence pack to Mr. Stokes. Ms. Smith objected to the submission of the evidence the Officer was attempting to enter into evidence before it is considered by the judge. It has not been properly authenticated. Ms. Smith objected to all the evidence that was being submitted for review by the court. Mr. Stokes noted the objections on the record. The packet has all been maintained in the course of public records. Mr. Stokes and Ms. Smith viewed the video and still photographs. Ms. Smith, without waiving her objection, requested Officer Petriello's identification number which she received. She thanked Mr. Stokes for making a record. Decision Mr. Stokes upheld the citation and gave 30 days to pay or file a notice of appeal. Summer Priscil Barnes Notice No. 1851500148379 Ms. Barnes objected to anything moved into evidence and any officer's testimony as to what he sees in a video that he did not record and would not be able to properly authenticate, including the video and still photographs; any evidence that was not shown to her. She objected to the lack of foundation, the Officer testifying as to lack of personal knowledge, and she was challenging the constitutionality of the Red Light program and requested a trial. Mr. Stokes advised he could not rule on the constitutionality of the program, which could only be done in court, but she made her record for appeal to the Circuit Court. She can then take the record and proceed to court. The objections are on record and overruled for the record. Officer Petriello explained on November 9, 2015, he logged into the ATS system to review events as potential violations and came across a vehicle registered to the violator who was travelling eastbound on Boynton Beach Boulevard at N. Seacrest Boulevard. Ms. Barnes objected to the Officer indicating the car was registered to her as she has not seen proof of registration, a certified business record, or been given knowledge of the Officer testifying. She has not been shown what they are moving into evidence and it is all hearsay. Mr. Stokes explained the evidence packet he gets is sent out in the mail. It contains the original notice, anything she sent in requesting a hearing or affidavit, and photographs which are provided in hard copy and on video. He noted the objections and overruled them for this hearing. Mr. Stokes explained they were operating under the Statute that provides for the hearing and the process being followed. Officer Petriello explained the vehicle was travelling eastbound at Boynton Beach Boulevard and N. Seacrest Boulevard in the number three lane on November 3, 2015 at 5:16 p.m. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on November 9, 2015. He submitted the evidence pack to Mr. Stokes. Mr. Stokes and Ms. Barnes reviewed the video and still photographs. Ms. Barnes stood on her prior objections. Decision Based on the video and the information, Mr. Stokes upheld the citation, assessed a fine of $243 under the Statute and gave 30 days to pay or file an appeal. Tula Anneli Kaitera Notice No. 1851500137422 Officer Petriello reviewed on October 20, 2015, at 3:49 p.m., a vehicle registered to the violator was travelling southbound on NW 8th Street and W. Boynton Beach Boulevard in the number two lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 26, 2015. He submitted the evidence pack to Mr. Stokes. Mr. Stokes and Ms. Kaitera viewed the video and still photographs. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243 payable within 30 days. 8 iJ ,I Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 10, 2016 Ms. Kaitera requested 60 days to pay. Mr. Stokes explained the Statute only permits 30 days. Arnette P. Lawrence Notice No. 1851500171462 Officer Petriello explained on December 2, 2015, at 11:45 a.m., a vehicle registered to the violator was travelling westbound on W. Woolbright Road and S. Congress Avenue. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on December 14, 2015. He submitted the ATS evidence pack to Mr. Stokes. Mr. Stokes and Ms. Lawrence viewed the video and still photographs. Ms. Lawrence appeared because when she was driving, she could not see the light because of the height of the emergency vehicle. She presumed they were following the law as well, but when the vehicle turned, the light was red. Mr. Stokes explained it did not relieve the driver of the responsibility to pay attention to lights and signals. This intersection has three arrows. Ms. Lawrence explained she was in the far left and she could not see what was available. Traffic was flowing and she assumed the light was green. She did not live in the area. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243 payable within 30 days. Ms. Lawrence noted there were three other vehicles that ran the light. Mr. Stokes explained every vehicle that goes through the light is sent a violation. She requested seeing those pictures or notices. Amiel Nuchovich Notice No. 1851500133777 Officer Petriello reported on October 16, 2015, at 8:57 a.m., a vehicle registered to the violator was travelling southbound on S. Federal Highway and SE 23rd Avenue in the number three lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 27, 2015. He submitted the ATS evidence packet to Mr. Stokes. Messrs. Stokes and Nuchovich watched the video and still photographs. Mr. Nuchovich did not recall driving at that time, but acknowledged it was his vehicle. Decision Mr. Stokes upheld the citation and gave 30 days to pay the fine or appeal the violation. He explained the registered owner was responsible for the vehicle running the red light. 9 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 10, 2016 Mr. Nuchovich explained he was not proven to be driving the vehicle at that time. Mr. Stokes clarified he did not send in an affidavit identifying another driver and the Statute makes the registered owner responsible for the violation unless an affidavit was sent. If sent, the notice would be reissued to the actual driver. Mr. Nuchovich objected to the requirement of self-incrimination or incriminating others. Mr. Stokes noted the objection is on the record and overruled. He could take the matter to Circuit Court. Mr. Nuchovich noted the sixth amendment regarding a fair and speedy trial and noted it was over five months since the supposed infraction occurred. He was unsure if this was a civil hearing and he did not know how long he would have to wait for it to get to the appeals court. Mr. Stokes explained an appeal would have to be filed within 30 days and the further up the appeals system, the slower it gets. Jacks Price Kervens Annevil Notice No. 1851500125849 Officer Petriello conveyed on October 6, 2015, at 5:26 p.m., a vehicle registered to the violator was travelling northbound on N. Congress Avenue at W. Gateway Boulevard. After a review of the electronic evidence, Officer Pierre issued a Notice of Violation on October 13, 2015. He submitted an evidence packet to Mr. Stokes. Messrs. Stokes and Annevil viewed the video and still photographs. Mr. Annevil did not think he crossed the line. Decision Mr. Stokes upheld the citation and gave 30 days to pay. Irene Louise Grant Notice No. 1851500131250 Officer Petriello explained on October 13, 2015, at 4:10 p.m., a vehicle registered to the violator was travelling eastbound on W. Woolbright Road and SW 8th Street in the number one lane. After a review of the electronic evidence and photographs, Officer Petriello issued a Notice of Violation on October 19, 2015. He submitted the evidence packet to Mr. Stokes. Ms. Grant was not driving and thought she submitted an affidavit indicating her daughter driving. She drives a school bus and was at work at the time. Officer Petriello pointed out she did submit something that someone else was driving, but there was no address, date of birth, or driver's license number submitted and she submitted a local hearing request. Officer Petriello clarified she did not comply with the statutory requirements of the affidavit. Mr. Stokes reviewed Ms. Grant submitted a handwritten note that was signed and notarized. Ms. Grant explained she relocated out of State and asked her daughter to take care of the ticket. She lives in Shiloh, Illinois and she flew down to address the matter. Trevor Renard Bouie - Notice No. 1851500135996 Officer Petriello commented on October 18, 2015, at 7:41 p.m., a vehicle registered to the violator was travelling westbound on W. Woolbright Road and Congress Avenue. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 23, 2015. He submitted the ATS paperwork and video to Mr. Stokes. The red light time was 79.6 seconds. Messrs. Stokes and Bouie viewed the video and still photographs. Mr. Bouie explained there was a yield sign next to the red light saying yield to pedestrians, and motorists can make a U-turn on red lights. Sergeant Davis, Boynton Beach Traffic Unit, gave the history of the safety lanes and explained U-turns on red lights are not allowed. Decision Mr. Stokes upheld the citation and waived the hearing fee. Keith D. Blechner Notice No. 1851500134361 Officer Petriello explained on October 16, 2015, at 8:11 p.m., a vehicle registered to the violator was travelling northbound at S. Federal Highway and SE 23 Avenue. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 23, 2015. He submitted the ATS evidence pack to Mr. Stokes. Mr. Stokes viewed the video and still photographs. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243 payable in 30 days. Mason Gabriel Cote Notice No. 1851500166611 Officer Verrigni said on November 26, 2015, at 3:03 p.m., a vehicle registered to the violator was travelling eastbound on Woolbright Road and S. Congress Avenue in the number four lane. After a review of the electronic evidence, Officer Verrigni issued a Notice of Violation on December 11, 2015. John Louis Franco Notice No. 1851500173658 Officer Petriello reviewed on December 5, 2015, at 9:42 a.m., a vehicle registered to the violator was travelling northbound on N. Congress Avenue and W. Woolbright Road in the number three lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on December 14, 2015. He submitted the evidence pack to Mr. Stokes. Mr. Stokes viewed the video and still photographs. The violator was not present. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243 payable within 30 days. He noted the red light time was 63.8 seconds and he submitted the ATS pack to Mr. Stokes who viewed the video and still images. The violator was not present. Decision Mr. Stokes upheld the citation and assessed a fine of$243 payable in 30 days 12 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 10, 2016 Garry Dana Grieser Notice No. 1851500122838 Officer Verrigni advised on October 2, 2015, at 4:03 p.m., a vehicle registered to the violator was travelling westbound on Woolbright Road and Congress Avenue. After a review of the electronic evidence, Officer Verrigni issued a Notice of Violation on October 9, 2015. Officer Verrigni submitted the ATS evidence pack to Mr. Stokes who viewed the video and still photographs. The violator was not present. Decision Based on the evidence, Mr. Stokes upheld the citation and assed a fine of$243 payable within 30 days.
