Minutes 03-24-16 MINUTES OF THE RED LIGHT CAMERA HEARINGS HELD IN COMMISSION CHAMBERS CITY HALL, 100 E. BOYNTON BEACH BLVD, BOYNTON BEACH, FLORIDA, ON MARCH 24, 2016, AT 9:00 A.M. James Stokes, Special Magistrate Shana Bridgeman, Assistant City Attorney Gwen Mills, Traffic Clerk Anthony Petriello, Traffic Infraction Enforcement Officer Officer Anthony Verrigni, Traffic Infraction Enforcement Officer 1. Call to Order: Mr. Stokes called the Red Light Camera hearings to order at 9:01 a.m. Mr. Stokes explained he is the Special Magistrate to preside at the hearings. The Statute requires a neutral person hear the cases and he does not work for the City. He has no knowledge of the cases and he has not reviewed any evidence. As a Hearing Officer, he is not a judge. He cannot rule on the program or its constitutionality. If the Violator wants to challenge the program in court, they must make their record because the Violator has to first exhaust their administrative rights. Violators often comment they were not driving. Mr. Stokes explained the law was enacted as a civil offense. They have a picture of the vehicle and the allegation is the car ran the light resulting in the registered owner receiving the notice. If two names are on the registration, the Notice of Violation is sent to the first name. The notice indicates if not driving, the owner has to identify the driver so the City can resend the Notice of Violation. If no affidavit is sent and the owner is found guilty, they can take the matter up with the driver to recoup the fine. Mr. Stokes explained the original notice indicates there is a fine of $158. If requesting a hearing, an administrative fee of$50 is added. If testifying to the case and found guilty, a court cost of $35 is further imposed. Mr. Stokes offered those wishing to change their plea to come to the front of the Chamber and receive their Order. 2. Violation Hearings: Failure to comply with a steady red signal. Beth Joy Kozak Notice No. 1851500172505 Steven Kozak was present. Anthony Petriello, Traffic Infraction Enforcement Officer, explained on December 3, 2015, at 5:55 p.m., a vehicle registered to the Violator was travelling southbound on S. Congress Avenue and W. Woolbright Road in the number four lane. After a review of the electronic evidence and still photographs, Officer Petriello issued a Notice of Violation on December 14, 2015. Officer Petriello submitted the ATS evidence packet to Mr. Stokes. The CD contained all the videos and images for today's hearings. Mr. Stokes accepted the evidence. Messrs. Stokes and Kozak viewed the electronic evidence and photographs. Mr. Kozak explained prior to his going through the light, there was a tractor trailer in front of him. His view of the light was obstructed and the weather was deplorable. He was travelling safely behind with his children going to a school open house. When he saw the red light he could either slam on his brakes or continue. He went through the light and stood by his choice. He was so upset, he took a picture of the truck on his phone. Mr. Stokes understood, but noted he was not travelling that close to the truck. When the light turned red, the truck was almost through the intersection. He agreed the weather was a factor, but the video showed Mr. Kozak was behind the stop bar when the light turned red. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243, payable within 30 days. Kurt Altman Notice No. 1851600024157 Anthony Verrigini, Traffic Infraction Enforcement Officer, explained on January 13, 2016, at 2:18 p.m., a vehicle registered to the Violator was travelling eastbound on 2 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 24, 2016 Woolbright Road and S. Congress Avenue in the number one left-turn lane. After a review of the electronic evidence, Officer Verrigini issued a Notice of Violation on February 2, 2016. Officer Verrigni submitted still images and a video to Mr. Stokes. Messrs. Stokes and Altman viewed the video and still images. Mr. Altman gave Mr. Stokes a picture he received in the mail. The picture showed he turned left when the red lights were on east and west, north and south and the two green left-turn signals come on. He was turning left when two other cars were turning left at the same time, so the green arrows had to be on. The photograph was a still photograph, but the picture he received showed him turning left when two other drivers were turning left on the other side. He contended the green turn signal had to be on. Mr. Stokes noted Mr. Altman was facing a red arrow and the vehicles across from him were turning left, but commented opposing left turn arrows are not always in sync. Mr. Altman contended the green arrows had to be on. Mr. Stokes watched the video again and when the photos were enlarged, it showed the arrows were red. Mr. Altman submitted his driving record to Mr. Stokes. Mr. Stokes explained no points will be assessed on his driving record or impact his insurance rates. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine payable within 30 days. Marcus Lamar Wilson Notice No. 1851500180018 Officer Petriello advised on December 11, 2015, at 8:29 p.m., a vehicle registered to the Violator was travelling southbound on NW 8th Street and W. Boynton Beach Boulevard in the number one lane. After a review of, the electronic evidence, Officer Petriello issued a Notice of Violation on December 18, 2015. Officer Petriello submitted the ATS evidence packet to Mr. Stokes. Messrs. Stokes and Wilson watched the video and still photographs. Mr. Wilson commented this was not the video or picture he received. The video and picture he got was from a different date. Had he looked at this video, he would have paid the ticket. Mr. Stokes reviewed the pictures and commented the pictures were the same. Decision Based on the evidence, Mr. Stokes upheld the citation. Mr. Stokes recommended Mr. Wilson speak with Sergeant Hawkins to ensure records did not get crossed with ATS and explained he was looking at information that is date and time stamped. Mr. Wilson commented he did not want to pay the court fee if he got the wrong video. Mr. Stokes explained if the court found there was an error, Mr. Wilson could receive a refund. It was up to the court. Based on his current case, Mr. Stokes advised the video and stills showed there was a violation. Adrienne Jill Cohen Notice No. 1851500186015 Officer Verrigini advised on December 17, 2015, at 4:47 p.m., a vehicle registered to the Violator was travelling northbound on Congress Avenue and W. Boynton Beach Boulevard in the number three lane. After a review of the electronic evidence and still photographs, Officer Verrigini issued a Notice of Violation on December 30, 2015. He had an evidence packet with still images and a video to show to the court. Ms. Cohen and Mr. Stokes viewed the video and still photographs. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243, payable within 30 days. Ms. Cohen advised she would only pay half the fine. She could have been going to her Foundation and did not remember the incident. Mr. Stokes explained his hands were tied and the fines are set by Statute. Theresa Capozziello Notice No. 1851500139915 Officer Verrigini conveyed on October 23, 2015, at 3:13 p.m., a vehicle registered to the Violator was travelling southbound on NW 8th Street and W. Boynton Beach Boulevard in the number two lane. After a review of the electronic evidence, Officer Verrigini issued a Notice of Violation on October 29, 2015. Officer Verrigni submitted the evidence packet to Mr. Stokes. Mr. Stokes and Ms. Capozziello reviewed the electronic evidence and still images. The light was red 3.1 seconds and traffic was beginning to move towards her vehicle while she continued to make her left-hand turn. The turn lane arrows were both red. Ms. Capozziello explained that day she was behind a truck and her last view of the light was green. As she approached the light she was going to turn, but hit the brakes when she saw the light was red. She had to choose and went through the intersection. She commented if an actual officer had stopped her going through the light, she would have received a warning and not a ticket. Mr. Stokes agreed the vehicle in front did obstruct the light and recommended backing off of high profile vehicles. 4 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 24, 2016 Decision Based on the evidence, Mr. Stokes upheld the violation and gave 30 days to pay the fine. Sophie Allison Burtoff Notice No. 1851500185470 Officer Verrigini commented on December 17, 2015, at 6:28 a.m., a vehicle registered to the Violator was travelling eastbound on Gateway Boulevard and N. Congress Avenue in the number four lane. After a review of the electronic evidence, Officer Verrigini issued a Notice of Violation on December 29, 2015. He submitted the ATS evidence packet containing a video and still images to Mr. Stokes. Mr. Stokes and Ms. Burtoff viewed the electronic evidence. Ms. Burtoff explained she is one of multiple owners of the car and one of multiple drivers. She would like to appeal the case. Mr. Stokes explained without the identity of the actual driver, the owner is responsible. Decision Mr. Stokes upheld the citation and issued an order giving 30 days to pay, which is the same period to appeal to Circuit Court. Mary Mullin Villaume Notice No. 1851500143628 Officer Verrigini mentioned on October 28, 2015 at 2:05 p.m., a vehicle registered to the Violator was travelling westbound on Woolbright Road and S. Congress Avenue in the number one lane. After a review of the electronic evidence and still photographs, Officer Verrigini issued a Notice of Violation on November 4, 2015. Officer Verrigini submitted the evidence packet to Mr. Stokes. Ms. Villaume and Mr. Stokes viewed the video and still photographs. Ms. Villaume advised she never goes through a red light. She was just following the vehicles in front of her. Decision Based on the video, Mr. Stokes upheld the citation and issued an order giving 30 days to pay the fine. John Harrigan, Ms. Villaume's husband pointed out he had looked at the video about 40 times and could not identify her vehicle. There were six or seven vehicles that looked the same. He asked if there was anything that could be done with the court costs. Mr. Stokes responded there was nothing he could do. 5 � I Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 24, 2016 Michele Lowy Notice No. 1851500182923 Officer Petriello conveyed on December 15, 2015, at 11:26 a.m., a vehicle registered to the Violator was travelling eastbound on W. Woolbright Road and SW 8th Street in the number two lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on December 21, 2015. He submitted an evidence packet to Mr. Stokes. Mr. Stokes and Ms. Lowry examined the video and still photographs. Ms. Lowy explained the video shows her son had a blowout. He swerved once past the light and he pulled over to the side after he was past the light. She had the time he got the tire and the time AAA was called on Woolbright Road. Ms. Lowry submitted documents attesting to the blowout to Mr. Stokes. The blowout was just before the red light. Her son is 21 years old and only knew to pull over. Adam Lowry, the driver, explained he was 16 when he received his license and Mr. Stokes noted he was driving for five years. Mr. Stokes thought by continuing through a red light, the end result could have been much worse, but there were extenuating circumstances. Decision Mr. Stokes dismissed the citation. Gonzales Bernadeau Notice No. 1851500134239 Gonzales and Sydney Bernadeau were present and explained they did not view the video as it was not working online. Officer Petriello played the video, noting the violation occurred in the number two lane. Mr. Bernadeau opted to change his plea. Decision Mr. Stokes advised the fine was $208. The hearing fee could not be waived. Bertha Achille Notice No. 1851500160788 Al Jacquet, Esq., was present on behalf of Bertha Archille. Officer Petriello noted on November 18, 2015, at 4:29 p.m., a vehicle registered to the Violator was travelling eastbound on W. Boynton Beach Boulevard and N. Seacrest Boulevard in the number one lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on December 7, 2015. He submitted the evidence packet from ATS to Mr. Stokes who noted the packet contained the violation notice and everything else his client should have received. 6 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 24, 2016 Mr. Stokes, Attorney Jacquet and Ms. Achille viewed the video and still photographs. There was a four-second yellow light and one-second red light. Attorney Jacquet inquired what Officer Petriello reviewed. Officer Petriello responded he reviewed the vehicle, the video, the vehicle information, the person's name and the still images on the ATS system. Attorney Jacquet asked if ATS was in Palm Beach County and Officer Petriello explained ATS is the vendor they use for the red light cameras and they are based in Arizona. Attorney Jacquet asked if the information was sent to him by ATS or if Officer Petriello reviewed the information on the ATS system itself and learned Officer Petriello viewed the information on the ATS system. Once the image is captured on the video, Attorney Jacquet asked if it was uploaded directly to the ATS system. Officer Petriello responded it was. After it goes to ATS, then all violations come to the Police Department and they have access into the system where all the violations are kept. Attorney Jacquet asked when Officer Petriello accesses the information and video, what Officer Petriello's role was and learned it was his role to view the video, determine if a violation occurred. If so, he accesses the information, supplies missing information, he inputs all the models to the vehicles as they come in, and after he determines a violation occurred, he issues a Notice of Violation. The Notice of Violation is sent through the ATS system. Attorney Jacquet asked if Officer Petriello puts a stamp on the Notice of Violation and if he mails out the Notice of Violation. Officer Petriello responded he does not physically mail the Notice, nor does the City of Boynton Beach Police Department. ATS sends out the violation after Officer Petriello instructs them to do so. Attorney Jacquet commented when the client is issued a Notice of Violation and nothing happens within the allotted time, an actual traffic citation is then created at some point. Officer Petriello responded that was incorrect. A traffic citation is only created unless Officer Petriello tells the system to create one. Shana Bridgeman, Assistant City Attorney, objected to the questions regarding a Uniform Traffic Citation or anything related to that because the matter before Mr. Stokes is a Notice of Violation and the relevant process is what occurs with the Notice of Violation, not a Uniform Traffic Citation. Attorney Jacquet explained he was present for the Notice of Violation. The process of the citation follows the Notice of Violation and they were not there yet. Attorney Jacquet asked if Officer Petriello sees the Notice of Violation before it is sent out through ATS. Officer Petriello responded he does not see the actual paper. 7 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 24, 2016 Attorney Jacquet queried who gives notice to be present at the hearings. Officer Petriello explained the Violator can request a local hearing. When done, the ATS system puts together a calendar with the Violator's name and date, and he would know because he reviews the calendar. Attorney Jacquet wanted to question ATS on their process and learned no one was present from ATS. Mr. Stokes explained ATS testified on October 10, 2015. The process had been put on hold for a while, and in October, officials from ATS were present to testify. There was an attorney present who cross examined ATS, which was transcribed and was available through the City. Attorney Jaquet commented ATS counsel was present in October, but he was not, and there has been lots of testimony about access to the ATS system, how ATS sends.the Notice of Violation and the calendar. Mr. Stokes understood, but advised ATS does not come to every hearing. Attorney Jacquet inquired how they could proceed without ATS when the Officer had put on the record how ATS has hands on access or is heavily involved in the process and he has no opportunity to question them. He did not see how Mr. Stokes could make a ruling without a full hearing if this was an administrative hearing. Attorney Jacquet suggested with case law already decided, the judges had said the City must review and issue from the very beginning, which means the City must have complete control of the system. He asserted the City did not have control over the system whatsoever. Attorney Jaquet thought the testimony was clear the images are captured by a third party outside of the County, conflicting with Florida Statute. Once ATS captures the images, the Officer reviews the information. Once they have been reviewed, the private organization in Arizona, issues the Notice of Violation, sends it to his client and the officer testified he never physically saw the Notice of Violation. Officer Petriello did not mail it and it was all done by a third party. Attorney Jacquet asserted it is an unlawful delegation of police power and if they could not have a full hearing to question ATS on their process, the hearing was unconstitutional. He requested the opportunity to question ATS, and there was no way the administrative hearing could conclude or go forward. Mr. Stokes asked if Attorney Jaquet subpoenaed anyone from ATS or asked anyone from ATS to appear. Attorney Jacquet responded he did not, and the record was being created by the City and ATS had to put on a case. He did not have to subpoena them to appear. ATS is involved and Attorney Jacquet thought the City should have brought ATS to the hearing. Mr. Stokes advised ATS did testify on October 10, 2015, which he takes administrative and judicial notice of the process as it was explained at that point. Mr. Stokes' determination is the Notice of Violation is sent manually by ATS, only when authorized 8 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 24, 2016 by the Officer. As a Hearing Officer, Mr. Stokes explained he cannot rule on the constitutionality or legality of the program. Attorney Jacquet differed and commented the Administrative Officer in Orlando made the same decision Mr. Stokes did, and the Court overruled it and said the Administrative Officer was incorrect and the case should not have gone forward because according to Aaron and Hastings and the City of Orlando, he has the authority to make that the decision. Mr. Stokes explained they had the hearing in October and he was convinced the issues that came from the various appellate courts were addressed in the City of Boynton Beach, that the officers were the ones making the decision on who gets issued a Notice of Violation and that the vendors were not making that decision. Attorney Jacquet differed. Decision Mr. Stokes explained in this case, factually he is upholding the citation. Attorney Jacquet made his record, and it has to go to the court. Erica M. Manfred Notice No. 1851500117275 Officer Petriello commented on September 25, 2015, at 3:58 p.m., a vehicle registered to the Violator was travelling northbound on South Federal Highway and SE 23rd Avenue in the number two lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 1, 2015. He submitted the ATS evidence packet to Mr. Stokes. The Violator was not present. Mr. Stokes reviewed the video and still images. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243, payable within 30 days. Seacrest Boulevard in the number two lane. After a review of the electronic evidence, Officer Verrigini issued a Notice of Violation on November 13, 2015. The Violator was not present. Officer Verrigni submitted the ATS evidence packet to Mr. Stokes which he viewed. After a review of the electronic evidence, Officer Verrigini issued a Notice of Violation on October 13, 2015. Officer Verrigni submitted still images and an evidence pack to Mr. Stokes. Officer Petriello submitted the ATS evidence pack to Mr. Stokes. The red light time was 22.26 seconds. The Violator was not present. Mr. Stokes viewed the electronic evidence and still photographs. Decision Based on the evidence, Mr. Stokes upheld the violation and assessed a fine of $243, payable within 30 days. John A Cavallo Notice No. 1851500136804 Officer Petriello mentioned on October 19, 2015, at 5:10 p.m., a vehicle registered to the Violator was travelling northbound on N. Congress Avenue at W. Gateway Boulevard in the number two lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 26, 2015. He submitted the ATS evidence packet to Mr. Stokes. The Violator was not present. Mr. Stokes viewed the video and still images. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243, payable within 30 days. Cassandra M. Tucker Notice No. 1851500142422 Officer Petriello commented on October 27, 2015, at 12:35 p.m., a vehicle registered to the Violator was travelling westbound on W. Woolbright Road and S. Congress Avenue in the number one lane. After a review of the electronic evidence, Officer Petriello 11 Meeting Minutes Red Light Camera Hearings Boynton Beach, Florida March 24, 2016 issued a Notice of Violation on October 30, 2015. Officer Petriello submitted the ATS evidence packet to Mr. Stokes. The Violator was not present. Mr. Stokes viewed the video and still photographs. The red light time was three seconds. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243, payable within 30 days. Vincent Hylton Notice No. 1851500146555 Officer Verrigini advised on November 1, 2015, at 6:13 a.m., a vehicle registered to PV Holding Corporation (Avis) was travelling southbound on Congress Avenue and E. Gateway Boulevard in the number two lane. After a review of the electronic evidence, Officer Verrigini issued a Notice of Violation on November 5, 2015. The red light time was 28 seconds. An affidavit dated November 12, 2015, was sent by Avis naming Vincent Hylton as the driver. A second Notice of Violation was sent on November 12, 2015, to Mr. Hylton. Officer Verrigni submitted the evidence packet with a video and still images to Mr. Stokes. The Violator was not present. Mr. Stokes viewed the electronic evidence and still photographs. Decision Based on the evidence, Mr. Stokes upheld the citation and assessed a fine of $243, payable within 30 days. Jorge Luis Morales Notice No. 1851500149930 Officer Petriello commented on November 5, 2015, at 1:19 p.m., a vehicle registered to the Violator was traveling southbound on NW 8th Street and W. Boynton Beach Boulevard in the number one lane. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 13, 2015. Officer Petriello submitted the ATS evidence pack to Mr. Stokes. The Violator was not present. Mr. Stokes viewed the video and still images.
