follows:

REQUEST
The applicant is requesting Master Site Plan Modification approval of the Quantum Park&Village
South project for the build-out of the last remaining Parcel,depicted as Retail Building 1.As the site
was approved as a Mixed Use Pod within the PID (Planned Industrial Development) district, any
modifications are deemed Master Site Plan Modifications, either minor or major, depending on the
magnitude of change requested.This request is to increase the building footprint of Retail Building 1
from 4,000 square feet to 4,025 square feet,which typically would be treated as a Minor Master Site
Plan Modification, requiring only staff review and approval. However, since the applicant is also
requesting a PID Waiver to reduce the west setback from 15 feet to 5 feet along Retail Building 1,
City Commission approval is required.
BACKGROUND
The subject Mixed Use Pod consists of 14.27-acres located immediately west of High Ridge Road,
on the south side of Gateway Boulevard. Retail Building one is located at the NW corner of the site
on a 0.92-acre parcel. According to Sheet SP-1, the Master Site Plan consists of approximately
81,000 square feet of retail/office/restaurant/mixed use, and 137 dwelling units.
As previously noted, these requests are to increase the building footprint of Retail Building 1 from
4,000 square feet to 4,025 square feet,and application for a PID Waiver to reduce the required west
setback from 15 feet to 5 feet along Retail Building 1.

ANALYSIS
The applicant is proposing to construct on the last vacant parcel of the Quantum Park & Village
South development. The property owner has long considered the construction of a restaurant on
this parcel, with a large dining terrace overlooking the water body to the west and south. As the
dining terrace is proposed to be roofed, the roof and columns/supports are required to meet the
approved setback of 15 feet, however the roof overhang may extend into a setback by no more than
three (3) feet. As the columns/supports are proposed at five (5) feet from the west property line, a
waiver request of 10 feet has been submitted. As part of staffs review, it was noted that there are
two (2)drainage easements depicted on the plat on the Retail Building 1 parcel.There is also a plat
note stating that no buildings shall be placed closer than 15 feet from any easement. This note
would adversely impact the building's placement. However, in 2012/2013, the applicant dedicated
two (2) new drainage easements to the Quantum Park Overlay Dependent District (QPODD) in
exchange for the release of the existing easements, in order to accommodate the proposed
development of the parcel. Unfortunately, the release of the platted drainage easements were not
recorded by the QPODD at the same time. As a result, staff is recommending a condition of
approval that any approval of the site plan and waiver request be subject to the applicant's
submittal of a recorded release of the two(2) platted easements. In addition, there is a five(5)foot
wide irrigation easement belonging to the QPODD that was granted by the applicant in 2013,
located along the west and south sides of the parcel. According to the agreement, the applicant is
ultimately responsible for any improvements placed within said easement.
The applicant, in their Justification Statement, states that the project as designed would bring a high
quality restaurant to Gateway Boulevard and draw increased visitation and investment to the area.
Additionally, the applicant indicates that the outdoor dining experience along the water allows for
the enjoyment of the outdoors and if the waiver was not approved, the outdoor dining area would
shrink by 50%and the restaurant would become primarily an indoor experience.The applicant goes
on to note that granting of the waiver would "not reduce public safety, parking or other important
building requirements". Lastly,the applicant notes that the granting of the waiver request would not
adversely impact water run-off, as it would be captured and directed into the storm drainage system
and that the lake maintenance would not be impeded, as the maintenance is conducted on the area
between the water's edge and the existing retaining wall.
The proposed waiver of 10 feet, from a 15 foot setback to a 5 foot setback along the west side of
the building,would not adversely impact adjacent residents or businesses, as the building will abut
one of the Quantum Park lakes. Certainly, as the applicant notes, the outdoor dining ambiance is
greatly increased as a result of the larger covered terrace. Since no apparent adverse impacts are
foreseen with the reduced setback, staff is in support of the request.
RECOMMENDATION
Staff has reviewed this request for a Master Site Plan Modification and recommends APPROVAL,
including the approval of the associated PID waiver for the minimum setback requirements,subject to
satisfying all comments indicated in Exhibit"D"—Conditions of Approval. Any additional conditions
recommended by the Board or approved by the City Commission shall be documented accordingly in
the Conditions of Approval.
