I. CALL TO ORDER
Carol Ellis, Special Magistrate, called the Hearings to order at 9:00 a.m., and
explained her role and the hearing procedures. Pursuant to Florida Statute, all orders
are appealable to the Circuit Court in Florida and not the City Commission. She
explained a fine will be imposed if the violation(s) are not corrected by the deadline.

Ralph Starkey, property manager, and Daniel Sarlay, Vice President, stated that on
their May 18, 2016, appearance they were in the final stages of permitting process on
this nine year old case regarding removal of citrus trees. Mr. Starkey gave historical
accounting of the planning and permitting process, including delays due to vacations
and weather, and eventual compliance.
Decision
Ms. Ellis ordered that case has been complied, there is no fine, no administrative fee.

Repair all non-functional duct-detector remote test
stations on the ceiling. The test stations should have the
pilot green light lit at all times. Repair three units in the
seating area and one in the kitchen. The seating area
panic hardware is required to be installed on both two
exit doors. Panic hardware is required in existing place of
assembly with an occupant load of 100 persons or more.
The emergency lighting system shall be arranged to
provide the required illumination automatically in the
event of any interruption of normal lighting due to any of
the following: (1) failure of a public utility or other outside
electrical power supply, (2) opening of a circuit breaker or
fuse, (3) manual act or acts including accidental opening
of a switch controlling normal lighting facilities, (4) an

extension cord shall be plugged into an approved
receptacle power tab or multi-plug adapter and shall,
except for approved multi-plug extension cords serve
only one portable appliance.
Assistant Fire Marshall (AFM), John Moore presented the case, which was a routine
inspection. The initial inspection date was April 23, 2015. Initial written notice was April
23, 2015. Ten days given to comply. Notice sent Certified Mail September 15, 2016.
Green card was signed October 3, 2016. Notice sent regular mail August 3, 2016.
Notice was posted on the property and at City Hall on October 10, 2016. Several recent
attempts have been made with property management and representatives via email and
phone conversation to attempt to rectify these long-standing issues. Property last
inspected September 8, 2016. It is a health and life safety hazard. City recommended
30 days for compliance, or $200 a day. Ms. Ellis asked if any issues were still
outstanding. AFM Moore said some had been resolved, and all outstanding issues
should be rectified by October 24, 2016.
James Garbarsky, representing Sushi Masa and Boynton FCA, agreed with the
narrative and all should be complied within the 30 day extension.
Decision
Ms. Ellis ordered a 30-day extension date of November 18, 2016, or $200 a day.
Case No. 16-1568 Cynthia Alexis

Officer Roehrich presented the case, which was a citizen complaint. The initial
inspection date was September 23, 2016. It is not a repeat violator. Initial written notice
was October 3, 2016. Two days given to comply. Notice sent Certified Mail October 4,
2016. Green card was signed October 10, 2016. Date last inspected was October 19,
2016. At this time, the majority of the violations have been corrected. Shots and tags in
compliance. The only outstanding violation is the placement of kennels on the property
(showed Ms. Ellis photo of kennels). City recommends a Cease & Desist order for all
four of the compliances, issued with compliance date of October 21, 2016, at $500 per
occurrence.
Mr. Dobson, husband of respondent, is a dog breeder. There are no allegations of
fighting, abuse or neglect, but always multiple dogs on property. Officer Roehrich has

investigated several previous incidents with Ms. Alexis, as well as several with her
husband, Mr. Dobson, at previous addresses.
Cynthia Alexis, owner, stated Officer Roehrich is correct, with the exception that Mr.
Dobson has taken down the kennel because they keep the dogs in the house. Ms.
Alexis questioned the need for a Cease & Desist. She had pictures on her phone of the
kennels being torn down, which she showed to Ms. Ellis. Officer Roehrich said it is
because of the repetitive nature of the violations. Every time a complaint is received, the
same issues are usually cited. A discussion as to the length of the Cease & Desist
Order ensued. Officer Roehrich's goal is to make sure the dogs are always in
compliance, on an annual basis, without the need for reminders. Barry Dobson,
owner, came forward to testify about his recollection of the history of the rabies shots.
Decision
Ms. Ellis ordered a Cease & Desist Order effective immediately, to remain in effect for
six months to prove ongoing compliance, with instructions to properly file proof of rabies
vaccinations in a timely manner.

Case No. 16-1150 Ghazal Apartments LLC
Property Address: 251 N Atlantic Dr.

Officer Weixler presented the case, which was a citizen complaint. The initial inspection
date was July 7, 2016. It is not a repeat violator. Initial written notice was July 7, 2016.
Ten days given to comply. Notice sent by Certified Mail on September 23, 2016. Green
card was signed October 4, 2016. During Certificate of Use inspection, found additional
violations, such as permits needed to repair driveway, water heater without permit.
Permits since pulled, water heater complies, but driveway still in plan check. Property
last inspection October 18, 2016, and violations still exist. City recommended 30 days
for compliance, or $150 a day. Ms. Ellis inquired as to number of tenants. Office Weixler
said there were no more than six.
Taleh Ghazal, owner, stated that he understands the charges, but the hurricane has
thrown them off schedule with repairs for the driveway. Mr. Ghazal asked for 30 days to
comply, or possibly have the case tabled. City has no objections to tabling the case.

Officer Weixler presented the case, which was a citizen complaint. The initial inspection
date was August 8, 2016. It is not a repeat violator. Ten days given to comply. Notice
sent by Certified Mail on September 23, 2016. Green card was signed October 4, 2016.
Fence has been repaired. Part of the lawn has been seeded per conversation with
owner. City recommended 30 days for compliance, or $100 a day. Officer Weixler
showed pictures of the property to Ms. Ellis.
Anicea Harrison, owner, stated she has just been diagnosed with cancer and is doing
the best she can. She is having surgery and asked if the case can be tabled. Most of
what was ordered has been complied. Officer Weixler said the rest of the property
needs to be seeded. City has no objections to tabling the case.

submitted a permit. Ms. Ellis explained the Code and her decision.

discovered when title was taken, over $14,000 was spent to improve the property. The

to Ms. Ellis. About $30,000-$40,000 was spent in improvements, but did not have
receipts with them. Mr. Pierre said that he knew of this property previously and that it
was a community eyesore. Ms. Castillo asked that the lien be reduced to administrative
costs. Ms. Ellis asked that the owner produce copies of the invoices for the case file.

and invoices, as well as correspondence with the City, for Ms. Ellis. House is currently
vacant, property value $80,000-85,000.
