She recommended not using the firm again and publicizing the name of the firm since they did nothing for a month. She supported changes on Boynton each Boulevard and asked about public input as she would be happy to attend a meeting. Rae Whitely, 223 NE 12th Avenue, noted there were several developments ongoing in the City and establishments such as Lowes. There were also mom and pop establishments and hardware stores. He inquired if there could be an agreement with developers to obtain supplies from local vendors. No one else coming forward, Public Comments was closed. 5. ADMINISTRATIVE A. Appoint eligible members of the community to serve in vacant positions on City advisory boards. Vote 13 Meeting Minutes City Commission Boynton Beach, Florida February 7, 2017 Black history included in the calendar. He thought there was very little, and the calendar was white washed and he and others were offended. He announced February 7th was Robert E. Wells Day and they are holding the celebration on the 11 t". He thanked Vice Mayor cCray for his contribution making the event better than it was last year. There are some contributors and the police should let people have fun with the bounce houses, D.J. and others to make it festive. He thanked all on the dais, Warren Adams, Historic Preservation Planner and the Historic Resource Preservation Board, and the Historical Society. Commissioner Romelus recalled Eleanor Krusell, Communications Manager, and some of the Historical Society members had been asking the community for photographs for months. Reverend Wright was unaware and had been to one of the Historical Society Christmas parties held every year, but was disappointed, since he initiated the research project they have not invited him back. He contended the City cannot out build the issue because for each dollar it brings in, it cost $1.25 for new development and the more they develop, the more the costs will rise. He wanted the mission statement to say the City will do the best it could, but it probably would not work as it did not work in Ft. Lauderdale. His friend just got his tax assessment which was higher than last year which he could not afford. He commented the City was in the same situation and it was the City Commission's fault because they were not addressing the matter. New development will require new fire trucks and police cars. He commented the average police car has $2,000 in equipment and thought the City should make the developers pay for it as opposed to residents. He commented residents had an $80 fire assessment a year for four years which was not supposed to be permanent and it was renewed four years later and was increased to $100. He requested clarification regarding residents that are serving on multiple boards, how this affect an appointee. Judith A. Pyle, City Clerk said she did look into this situation. This was reviewed in 2010. At that time, a motion was made to allow for a resident to serve on two boards. Ms. Pyle advised the appointee can serve on two boards; one as a regular board member and one as an alternate. Commissioner Romelus wanted to know how this would affect Ms. Susan Oyer. She was already serving on two boards as regular members already. Ms. Pyle said that she would need to become an alternate on one of the boards; if there was availability. The anticipated Community Development Block Grant allocation is $514,937, and the re appropriation of$300,000 non-expended funds from previous year. Mayor Grant read the item and asked how to apply. Octavia Sherrod, Community Improvement Manager, explained the City has a Five- Year Consolidated/One-Year Action Plan the City approves. Each year, staff advertises the anticipated CDBG allocation in a paper of general circulation and holds a public meeting to explain the program and how it works. Community Improvement has a database of organizations and churches that have made inquiries about the program, and those organizations are sent letters and invited to attend. Staff spends hundreds of dollars on newspaper advertisements informing the public about the meetings and workshops. This year, the public meeting occurred in the spring in Commission Chambers and personal meetings with interested parties are scheduled. Minutes are taken. Mayor Grant inquired if the $814,937 was allocated and learned staff recommends how the funds should be used. He asked if new organizations were applying and learned they were not. The applications are due August 15th. Mayor Grant thought the same people are funded and new agencies do not apply. Ms. Sherrod explained due to what is occurring in Washington D.C., entitlement communities did not receive any indication about their allocation and the process was thrown off track. Staff usually finds out in June what the allocation would be and since the announcement was delayed until June, HUD allowed for an abbreviated process. Representative Emily Slosberg, 7499 W. Atlantic Avenue, Delray Beach, wanted to introduce her staff. She stated she represents District 91. Representative Slosberg was here to thank the Commission for allowing her to speak on behalf of texting and driving. Representative Slosberg indicated that Florida was only one of four states that do not have a law regarding texting while driving. She explained that she introduced a bill that would make texting while driving a primary offense. Currently drivers can text and drive and nothing can be done. Representative Slosberg requested the City to pass a resolution regarding texting while driving. Representative Slosberg noted that there have been record amounts of calls in favor of the new law. Representative Slosberg shared that she lost her in sister in a car crash. Representative Slosberg said she was not sure if Tallahassee was not focused on safety, but she was not given a hearing on the bill. There seems to be a culture that says that it was ok to text and drive. Representative Slosberg wanted to say thank you to the Commission for backing of this bill. Congress Avenue, an adjunct professor at Florida Career College was present on behalf of the U.S. citizens of Puerto Rico, the students, and her supervisor, Tai ka Morris, and campus president Scott Shaeffer. Ms. Contraras teaches Level 5 Leadership based on a research model that proves the best leaders demonstrate humility. Her students will learn the art of service, being a servant and the meaning of duty. She noted 55% of Puerto Ricans do not have clean water and 14% have cellular service. Only 5% have power and 721 of the 1,100 gas stations are open. Because of the situation, citizens cannot receive the medical attention needed. any have declining health or will have declining health due to a lack of food and clean water. She announced a fundraising event with food and entertainment on October 28th at Florida Career College on Congress Avenue. She requested the City's support through funding, marketing the event or any other way to support U.S. citizens of Puerto Rico. Olivia Lang, 1743 N. Congress Avenue, spoke on behalf of Puerto Rico and her classmates, commenting it was important for business students to receive hands on experience in fundraising, which would allow them to give back to Boynton each. Jim Cherof, City Attorney, explained the item was a request from E2L, for the City to consent to an assignment of their contract for Phase I to Dougherty Funding LLC who is a lender. E21- was looking for funds to pay the development team working on the Town Square project and E2L, as the Lender, wanted to ensure if there was a default under the loan document, that they would have the option to inherit, (not the obligation), the rights of E21- and the contract it has for Phase I with the City. If the option is used, the City would deal with Dougherty Funding LLC or their assignees to continue to perform the work specified in the contract, that E2L would otherwise do. It is possible that Dougherty funding will not exercise its right to take over the contract and would allow E21- to continue to perform under the agreement, notwithstanding the default under the loan agreement. Commissioner Casello requested clarification. Attorney Cherof explained the City is consenting to a third party lending the money to E21- for Phase I in exchange for allowing the third party to inherit the contract if E2L defaults. If a default occurred, the City has recourse under the agreement. Currently, the City has no monetary obligation, until the completion of Phase 1, and the election of rights to continue. She saw a drug deal going down behind the Family Dollar store. She was a retired investigator from the State of New Jersey. She expected someone to arrest the guy. Mayor Grant seeing no one else coming forward, closed Public Audience. Mayor Grant answered the questions regarding vacancies. The City does not have a social media request. The applications are available online. The City of Boynton each has vacancies. No one else decided to volunteer. Commissioner Romelus wanted to add, we as the Commission bear the responsibility to be more vigilant. The Commission has a duty to the public to protect them. She said when we have individuals who were blatantly violating those rights we need to do something. This was something that was very disturbing.
